Former Finance and Economic Development Deputy Minister, Terrence Mukupe, has been denied bail pending appeal by the High Court following his recent conviction for fuel smuggling in February 2017, reported <a href="https://www.hmetro.co.zw/mukupe-bail-bid-flops/">H-Metro</a>.
Mukupe was among a group of four people jailed for three years in November 2023 after importing over 138 000 litres of diesel into Zimbabwe without paying duty.
The former Harare East MP and his three accomplices had misrepresented the destination of their tankers as the Democratic Republic of Congo to evade payment of duty amounting to approximately US$55 600.
In his application, Mukupe argued that the High Court had misdirected itself on the facts and evidence.
He claimed the court grossly misdirected itself by basing on circumstantial evidence where the inference of guilt was not the only reasonable inference to be drawn from the facts and evidence.
However, Justice Benjamin Chikowero dismissed the appeal saying the application was without substance.
Justice Chikowero stated that even though Mukupe did not import the diesel, he unlawfully and intentionally connived to import and dodged payment of duty. He said:
<blockquote>
I consider that all the grounds of appeal are without substance. I do not think that there is any real prospect of the court finding differently.
The court explained why Mukupe is caught in the ambit of being an importer and why it was satisfied that he imported the diesel in question.
Further, it must always be borne in mind that even if the court had not found that he did not import the diesel, it still made a finding that he unlawfully and intentionally, therefore, assisted in or was an accessory to or connived in the importation of the diesel without payment of duty thereon.
It is for these reasons that I take the view that the first ground of appeal is frivolous.
The second ground of appeal not only attacks findings of fact, some of which were based on an assessment of the credibility of all those who testified at the trial, but is erroneous.
The conviction was not based solely on circumstantial evidence. It rested on a combination of direct evidence and circumstantial evidence.
Consequently, there is not and can be no substance in the second, being an incorrect ground of appeal.

The judge noted that even if he could be confident Mukupe wouldn’t abscond, “everything else is against him”.
<blockquote>
He failed to tip the scales in his favour. The application for bail pending appeal against conviction and sentence be and is dismissed.

Mukupe and drivers, Sam Kapisoriso, Joseph Taderera and Leonard Mudzuto were convicted and jailed in November last year.

Mukupe's Bail Application Pending Appeal Dismissed

Former Deputy Minister of Finance, <a href="https://pindula.co.zw/Terence_Mukupe">Terrence Mukupe</a>, has been sentenced to an effective three years in prison for fraudulently importing over 130,000 litres of diesel without paying duty. The Zimbabwe Revenue Authority (ZIMRA) discovered the scheme in 2017 when they intercepted trucks owned by Mukupe and found that they were transporting water instead of diesel. Mukupe was initially sentenced to three and a half years, but six months were suspended on the condition of good behaviour. In addition to the prison sentence, Mukupe has been ordered to pay US$12,000 in restitution.
Mukupe’s conviction and sentencing come after a prolonged legal process. He and his three accomplices were found guilty of smuggling fuel across Forbes Border Post in January 2017. They had misrepresented the destination of their tankers as the Democratic Republic of Congo to evade payment of duty amounting to approximately US$55,600. The quartet was intercepted by ZIMRA officials at Chirundu Border Post.
During the court proceedings, ZIMRA presented a Victim Impact Statement to highlight the financial harm suffered by the state. The sentencing of Mukupe.
This is not the first legal trouble Mukupe has faced. In April 2018, he was arrested and fined for assaulting the then 58-year-old Finance Director of his ministry, Ignatius Mvere, for allegedly giving him a “paltry $910 travel allowance”.

Former Finance Deputy Minister Mukupe Sentenced To 3 Years In Jail

<a href="https://pindula.co.zw/Terence_Mukupe">Terrence Mukupe</a>, a former Deputy Minister of Finance and Economic Development and three accomplices have been convicted by the High Court of importing 138 979 litres of diesel without paying duty.
In a statement issued this Wednesday, the National Prosecuting Authority of Zimbabwe (NPA) said the accused persons are in custody pending sentence on the 9th of November 2023. Said the NPA:

Former Deputy Minister of Finance and Economic Development Terrence Mukupe together with 3 others have been convicted of importing 138 979 litres of diesel without paying duty.
The State proved that on the 27th of January 2017 at Forbes Border Post in Mutare, Terrence Mukupe, Same Kapisoriso, Joseph Taderera and Leonard Mudzuto connived to unlawfully import diesel without paying duty.
The accused persons misrepresented that the diesel was going to be offloaded in the Democratic Republic of Congo (DRC). Pursuant to their plan, they replaced the diesel with water in Zimbabwe.
The matter came to light on the 30th of January 2017 when officials from the Zimbabwe Revenue Authority (ZIMRA) intercepted them at Chirundu One Stop Boarder Post to verify the nature of the goods they were carrying.
In so doing the accused persons prejudiced the State of revenue amounting to USD$55 591-60.
The accused persons are in custody pending sentence on the 9th of November 2023 at the Harare High Court.

In April 2018, Mukupe was arrested and fined for assaulting his ministry’s finance director, 58-year-old Ignatius Mvere, for allegedly giving him a “paltry $910 travel allowance”.

Terrence Mukupe Convicted Of Smuggling Fuel

Former Finance and Economic Development Deputy Minister, Terrence Mukupe, who is also considered a close ally of President Emmerson Mnangagwa has urged Mthuli Ncube to raise the salaries of soldiers using the surplus he claimed to have made.
Mukupe claimed that he saw a high ranking military official crying because of his “paltry” net salary of only RTGS $380. Writing on Twitter, Mukupe said:

Deputy Minister of Finance and Economic Development, Terrence Mukupe has said that he is worried about the security of government’s sensitive information and data. Mukupe bemoaned the fact that government officials use private e-mails for government business. Speaking at a CEO Africa Roundtable discussion held in Bulawayo recently,
<blockquote>…I came from a situation where I worked in New York for the best banks and I know the kind of IT systems that they have got. You could literally lose your job if you were to use your private email…There is no way you can have access to your private email given the sensitivity of the information.
I can tell you (that) as the Ministry of Finance, we don’t have emails. People use their private emails and it’s a practice that’s there within the whole of government where they are using private emails and I cringe every time that you can imagine how much in terms of sensitive documentation that’s all over the place.</blockquote>

Deputy Minister of Finance and Economic Planning Terrence Mukupe has said that the government is fueling corruption by not giving miners the full value for gold deliveries. Speaking at the CEO Africa Roundtable discussion last week Mukupe said,
<blockquote>The price of gold is hovering around $44 000 to $45 000 a kg. It’s clear we have got a lot of makorokozas and I can bet you my last dollar that none of these makorokozas have got bank accounts. I read some reports that there are about eight tonnes of gold that is trading in the informal market. That’s close to $300 million.
Why do we have that situation? The reason we have that situation is that the way things are structured in our country, if you were to bring your gold to us as a government we are not giving you full value. We are not giving you 100% dollars; we are forcing you to take a certain percentage in a transfer.</blockquote>

Govt Fueling Corruption In Gold Sector By Underpaying Artisanal Gold Miners: Minister Mukupe

Deputy Minister of Finance and Economic Planning Terrence Mukupe has said that it is imperative for Zimbabwe to reintroduce its own local currency in order to solve the prevailing cash crisis. According to Mukupe, the currency will be backed by commodities.
<blockquote>Technically if we were to introduce our currency right now you would probably let it float between a $1,50 and $2 to US dollar, that’s where it should settle at. That would be the solution to our current problems. We have to adopt a national currency without a doubt and there has to be a cap on the maximum release of how much of the new currency you are going to put out. The numbers that are there right now are indicating probably that the maximum release is not more than a billion dollars.
For me releasing US dollars is a temporary measure but if you release that as your national currency that would work. Then it becomes an issue of what are you are backing the currency with. What is it that we have right now that we can use to back our currency? What’s probably feasible and what’s probably sustainable is you could back it using you forex facilities, your diamond stocks because our forex facilities have been gold backed for the last part and there isn’t much capacity there but our diamond stocks are run and covered for the most part.</blockquote>

We Must Have Our Own Currency To Solve Cash Crisis: Minister Mukupe

Deputy Minister of Finance and Economic Planning Terrence Mukupe has said that President Emmerson Mnangagwa’s administration was not going to reduce the government’s wage bill by cutting jobs or salaries. Instead, the government was going to focus on improving its revenue base. Speaking at Nyadire Teachers’ College on Tuesday, Mukupe said
<blockquote>I think you have heard other parties saying the wage bill is too high. But the truth of the matter is that the salary given to our civil servants is very low. Our civil servants are underpaid. The money our teachers get is not what they should get… we need to grow our revenue base. We can’t reduce our service as this will mean cutting our teachers, then the security sector and so on and so forth. We need to improve our revenue streams so that we are able to fund our service.</blockquote>

No Job Cuts Or Salary Reductions For Civil Servants In Order To Reduce Wage Bill: Mukupe

Labour body the Zimbabwe Congress of Trade Unions (ZCTU) has said that President Emmerson Mnangagwa should sack Finance Deputy Minister Terrence Mukupe as he is unfit for public service. Mukupe has been in the media for the wrong reasons after claiming that the military would not allow Nelson Chamisa to rule if he loses the election. Mukupe was also accused of promoting stigma against HIV/Aids after <a href="https://news.pindula.co.zw/2018/05/24/mukupe-insults-biti-on-live-radio/" rel="noopener" target="_blank">insulting former minister of finance Tendai Biti about taking anti-retro virals (ARVs)</a> on national radio. In a statement ZCTU said,

Deputy Minister of Finance and Economic Development Terrence Mukupe has revealed that the government will soon replace the Companies Act with the Companies and Other Entities Bill. Mukupe said that the move will make it easier for investors to establish their businesses in the country.
Speaking at a discussion on Opening Up Zimbabwe to Corruption Free and Transparent Business, Mukupe said,
