The Southern African Development Community (SADC) election observer mission (SEOM) has urged aggrieved parties to approach courts to resolve disputes from the August 2023 elections.
In its final report on Zimbabwe’s August elections released on Thursday 12 October 2023, the bloc said:

The SEOM calls for all concerned parties to ensure that any grievances with respect to the election results are channelled through the appropriate legal processes to ensure exhaustation of domestic legal remedies.
In terms of Section 11.8.2 of the Sadc guidelines, when SEOM publishes and officially submits the election reports, member States which held the elections may consider the recommendations advanced by the SEOM for improving the conduct of elections and submit to the chair of the organ, a response to the SEOM report.

Zanu PF accused Nevers Mumba, the head of the Sadc Electoral Observation Mission (SEOM), of being biased and sympathetic towards the opposition Citizens Coalition for Change (CCC). This accusation came after an initial report by SEOM criticised the elections for lacking credibility and fairness. However, the final report from Sadc observers praised political parties for maintaining peace despite the disputed nature of the election. Read the report:

The SEOM noted that …  some aspects of the Harmonised Elections fell short of the requirements of the Constitution of Zimbabwe, the Electoral Act, and the SADC Principles and Guidelines Governing Democratic Elections (2021).
The SEOM commends political leaders for spreading the messages of peace and non-violence throughout the electoral cycle.

The recommendation is a blow to the CCC, which has been advocating for fresh elections overseen by an impartial organisation such as SADC, the African Union, or the United Nations, instead of the perceived biased Zimbabwe Electoral Commission (ZEC). The party points to irregularities observed by local and international observers as the reason for calling for fresh elections. The CCC contends that ZANU PF, in collaboration with ZEC, manipulated the results, particularly in the presidential election, to favour President Emmerson Mnangagwa.

SADC Urges Zimbabwean Parties To Approach Courts Over Election Results Grievances

The opposition Citizens Coalition for Change (CCC) has proposed the establishment of a Transitional Authority in response to the final report by the SADC Electoral Observation Mission (SEOM) on the recent elections in Zimbabwe. The report has highlighted significant irregularities and states that the elections did not meet the requirements in the country’s constitution, electoral laws, and SADC principles.
It raises concerns about a shadowy group called Forever Associates Zimbabwe (FAZ) engaging in acts of terror, the controversial Maintenance of Peace and Order Act (MOPA) disrupting campaign activities, manipulation of the delimitation process, secrecy surrounding the voters’ roll, and deliberate disenfranchisement of potential voters in opposition strongholds.
Concerns were raised about the restriction of freedom of expression due to the Patriot Act, which criminalises communication involving foreign entities. The SEOM highlighted that this law violates the constitution and SADC principles. The report also mentioned discomfort regarding the Private Voluntary Organisation Bill, which restricts civil society organizations.
Stakeholders expressed concerns about the independence of the judiciary due to alleged financial incentives from the government. The SEOM also noted allegations of voter intimidation, compromised postal voting, and biased coverage by state-owned media. Read part of the report:

<h3>7.14 Alleged lack of transparency in the procurement and printing of the ballot papers</h3>
Section 239(g) of the Constitution gives ZEC the mandate to design the ballot paper. The Mission noted that Section 239 (a)(iv) of the Constitution also requires that elections be conducted transparently in accordance with the law. In the spirit of transparency, stakeholders were of the view that they should have been provided with information on the procurement of the printing of ballot papers earlier than the time the ZEC released this information. The stakeholders added that they were not provided with information regarding the company that was contracted to print the ballot papers early into the process. They also were concerned about their lack of awareness of the ballot paper design that would be used during the elections.
<h3>7.15 Polling stations</h3>
7.15.1 The Stakeholders raised concerns about the delay in informing the public about the number and places of polling stations, fearing possible confusion and low voter turnout during polling day. Section 51 (3) of the Electoral Act requires that:
Commission shall cause a notice of— (a) the places at which polling stations are to be established; and (b) the hours during which the polling stations will be open; to be published at least three weeks before polling day and again on polling day, in a newspaper circulating in the constituency concerned and in such other manner as it thinks fit.
7.15.2 The SEOM noted that the ZEC complied with the above legal requirements.

In response to the report, the CCC party, led by Nelson Chamisa, stated that the people of Zimbabwe are calling for new elections due to the compromised electoral environment that prevailed during the August harmonised elections. They propose the establishment of a Transitional Authority, supported by SADC, to oversee fresh elections in a fair and trustworthy manner. They express a lack of trust in the current Zimbabwe Electoral Commission to administer these elections.

CCC Proposes Transitional Authority In Response To SADC's Final Report On Zimbabwean Elections

<a href="https://www.pindula.co.zw/Nelson_Chamisa/">Nelson Chamisa</a>, leader of the <a href="https://www.pindula.co.zw/Citizens%27_Coalition_for_Change/">Citizens Coalition for Change (CCC)</a>, has advised party members who were not given positions they wanted to form their own party, NewsDay reported.
Chamisa made the remarks while addressing CCC Mashonaland East provincial members at Mbuya Nehanda Hall in <a href="https://www.pindula.co.zw/Marondera/">Marondera</a> on Wednesday. The former ICT minister who is currently on a nationwide tour meeting provincial executives, receiving reports on the just-ended harmonised elections, is quoted as saying:

Those who want positions, let me say, form your own party. No one is ever going to form a party stronger than this (CCC).
Leading a nation is not about studying books, it is about studying the hearts of the citizens. We are not here for opportunists.
We are an organised citizens’ movement. We are guided by the citizens. If you had a post in the MDC, it has nothing to do with the current set-up.

Chamisa has been accused of sidelining party senior members in favour of young activists.
Nelson Chamisa expressed his lack of concern regarding the holding of an elective congress for the party. He stated that they were not in a rush and dismissed claims that the CCC lacked structures, pointing to the election of mayors, councillors, and MPs. Chamisa emphasized the presence of leaders in places like Goromonzi and South Africa as evidence of the party’s structure.
Chamisa, who according to the <a href="https://www.pindula.co.zw/Zimbabwe_Electoral_Commission/">Zimbabwe Electoral Commission (ZEC)</a> garnered 44% of the presidential votes against Mnangagwa’s 52.6%, maintained that the CCC defeated ZANU PF in the 23 August 2023 harmonised elections. He said:

It was not easy to defeat Zanu PF, they had State institutions support like Zec and army. There was FAZ (Forever Associates Zimbabwe) and they had traditional leaders as the party commissars. The good thing is that, with all that, we won the election.

The <a href="https://www.pindula.co.zw/2023/08/25/seom-au-comesa-and-ecf-sadc-observer-missions-joint-statement-on-zimbabwe-2023-elections/">SADC Election Observer Mission</a> report stated that Zimbabwe’s elections did not meet the required standards and were not considered free, credible, and fair. Despite this, Chamisa assured delegates that even if SADC does not intervene, he believes that God will intervene in the situation.

"Those Who Want Positions, Form Your Own Party" - CCC Leader Nelson Chamisa

Zimbabwe’s presidential spokesperson, George Charamba, has criticised Dr. Nevers Mumba, the head of the Southern African Development Community (SADC) Election Observer Mission, for allegedly breaching SADC protocols in compiling the region’s report on Zimbabwe’s recent elections.
Several observer missions, including SADC, raised concerns about voter intimidation and irregularities during the August 23 polls, stating that they did not comply with the country’s constitution and regional and international principles.
Charamba argued that elections are a complex process that goes beyond a single day and suggested that key decisions regarding the SADC Observer Mission’s report should not be solely in the hands of one individual overseeing a subsidiary body. He said:

We are seeing an enthusiastic chairman of a process which is in fact a SADC one. He does not report to the Zambian people. Which is why we all were flabbergasted to find him spending as much as more than 2 hours on a national television. Who is he reporting to? This is a SADC mission for goodness’ sake, appointed by the chairman of a SADC organ. Not SADC Summit, SADC Organ, right? What it means is, that the preliminary report still has to: 1. Become a final report and when it becomes a final report, it still has to be tabled before a council of ministers which is really a body which brings together foreign ministers of SADC. There is a council of ministers and is probably meeting around February, March. When that has happened and the foreign ministers must look at that report, they will then push it upwards to the SADC Troika. It still has to come to Summit and this will be about August next year (2024). It is only at Summit that that report is tabled, discussed, amended, endorsed or rejected.

Meanwhile, Nelson Chamisa, leader of the main opposition party, Citizens Coalition for Change (CCC), reiterated his party’s rejection of the election results. Chamisa expressed doubt about pursuing legal action within Zimbabwe’s courts and instead viewed the SADC as a court of public opinion that had already deemed the election a sham.
The situation in Zimbabwe remains contentious, with political stakeholders expressing differing opinions on the election’s legitimacy and the best approach to address their concerns.
SADC now has its final report, stating that the election in Zimbabwe lacked legitimacy. Dr. Mumba, the Chairperson of the SADC EOM, explained that the only difference between the preliminary and final reports is the inclusion of electoral developments. He said the report was written and approved by over 20 individuals, making it a conclusive SADC report.

Charamba Criticized Mumba For "Breaching" SADC Protocols In The Election Report Compilation

The SADC Electoral Observation Mission (SEOM) to Zimbabwe will deploy its members countrywide on Friday ahead of general elections to be held on 23 August.
In a statement released on 11 August, SEOM said the SADC Secretariat team has been in the country since 10 August. It said:

the SADC Secretariat team arrived in Harare on 10 August 2023 to prepare logistics for the launch of the SADC Electoral Observation Mission (SEOM) at the Rainbow Towers Hotel in Harare, and its concomitant full deployment on 18 August 2023.
The SEOM will be deployed to all ten (10) Provinces of Zimbabwe to observe the pre- and post-election 
phases and the polling day.
Before the Launch, the Head of Mission (HoM), the Republic of Zambia (the Incoming Chairperson of the SADC Organ on Politics, Defence and Security Affairs) for SEOM Zimbabwe shall undertake a Courtesy Call to the Ministry of Foreign Affairs and International Trade of the Republic of Zimbabwe.
The HoM will also conduct meetings with the leadership of the Zimbabwe Electoral Commission (ZEC) as well as the SADC Ambassadors and High Commissioners Accredited to the Republic of Zimbabwe.

It has invited the Ministry of Foreign Affairs and International Trade of Zimbabwe, the Zimbabwe Electoral Commission (ZEC), Zimbabwe Republic Police, Attorney General, political parties, voters and citizens, traditional leaders, faith-based groups, civil society, members of the media, Diplomatic Missions/Corps, United Nations Resident Coordinator in Zimbabwe, European Union Delegation in Zimbabwe, other International Cooperating Partners, and the Heads of Delegations of International Electoral Observation Missions, to attend the Launch of SEOM Zimbabwe at the Rainbow Towers Hotel in Harare.
SEOM’s mandate is guided by the revised SADC Principles and Guidelines Governing Democratic Elections of 2021. Reads the statement:

The Mission will assess the conduct of the elections against a set of central principles stipulated in the revised SADC Principles and Guidelines Governing Democratic Elections of (2021) which include, amongst full participation of the citizens in the democratic and development processes, measures to prevent political violence, intimidation and intolerance, equal opportunity for all political parties to access the State Media as well as access to information by all citizens, and acceptance of and respect for the election results by all political parties.
</blockquote>
SEOM will join various other observer groups, such as the Carter Centre and the African Union-COMESA teams, already stationed in the country’s 10 provinces.
