Deputy Minister of Industry and Commerce, Raj Modi, has lost the Bulawayo South Constituency Parliamentary seat to opposition candidate Nicola Jane Watson from the Citizens Coalition for Change (CCC).
Modi, a well-known businessman, philanthropist, and member of ZANU PF, received 3,752 votes, while Watson secured 10,470 votes.
Born on February 4, 1959, in India, Modi relocated to Zimbabwe at the age of 22 after marrying his wife, who is from Zimbabwe. Initially, his intention was to gain an understanding of his wife’s country, but he ended up staying when his father-in-law passed away.
Modi is one among several prominent politicians who have lost their Parliamentary seats. One of them is Independent Member of Parliament for Norton, Temba Mliswa, who lost to CCC’s Richard Tsvangirai.
Additionally, preliminary results from polling stations in the Cowdray Park Constituency of Bulawayo indicate that Finance Minister Professor Mthuli Ncube received fewer votes compared to CCC candidate Pashor Raphael Sibanda.

Zimbabwe Elections 2023 Results: Deputy Minister Raj Modi Loses Parliamentary Seat To CCC's Watson

A registered voter has filed an application with the Bulawayo High Court to prevent incumbent legislator and ZANU PF candidate Raj Modi from running for Member of Parliament in Bulawayo South. The applicant argues that Modi filed his nomination papers after the 4 PM deadline, contravening the Electoral Act.
<h3>Some context:</h3>
The case comes amid the ongoing controversy surrounding the <a href="https://www.pindula.co.zw/2023/07/28/2023-elections-zec-says-disqualified-ccc-candidates-submitted-nomination-papers-on-time/">disqualification of 12 parliamentary candidates</a> from the opposition Citizens Coalition for Change (CCC) in Bulawayo. High Court Judge Bongani Ndlovu disqualified the candidates, ruling that they had contravened the Electoral Act by submitting their nomination papers through a police officer on June 21, when the Nomination Court sat.
High Court Judge Nokuthula Moyo delivered the ruling on behalf of Justice Ndlovu, disqualifying the CCC candidates and three other candidates from different political parties. Said Justice Ndlovu said:

We now know that a Police Officer collected the nomination papers from the candidates. The Applicants’ case is that the Respondent (CCC candidates) violated the law. I have also been moved by both sides of the bar, to give Section 46 (7) and (8) of the Act the golden rule of interpretation. The Nomination Court closed at 4 pm. Once it closed it was no longer sitting in open court and by the time the respondents sat before him they were not doing so in open Court. The separation of the papers from the Respondents through the medium of the Police Officer was unlawful. The statute says the candidate or his/her agent must be in court and ready to submit at 4 pm. It does not say that the candidate’s papers alone must be in the courtroom.

The 1st Respondent, therefore, violated the provisions of the electoral Act in that regard as he also did close to midnight when he adjourned to 22 June 2022.

<h3><a href="https://www.pindula.co.zw/2023/07/28/2023-elections-zec-says-disqualified-ccc-candidates-submitted-nomination-papers-on-time/">Not About Late Submission:</a></h3>
ZEC officers who were assessors of the Nomination Court which sat on the 21st of June 2023 at Tredgold Magistrates Court, testified in court that every candidate on the government gazette, including CCC and ZANU PF candidates, submitted their nomination papers on time. ZEC official, Pretty Gadzikwa, stated that the nomination officer, Mr I. Ncube, announced the court was closing at 4 pm on 21 June and instructed the police to collect all nomination papers from aspiring candidates outside the courtroom. In her affidavit, Gadzikwa added that processing of the nomination papers continued until midnight, with the times shown on the submission form indicating when individual forms were completely processed. She said:

1. On the 21st of June 2023 at 15:55 hrs the Nomination Officer, Mr. I. Ncube announced that the court was about to close at 16:00ho. He went on to instruct the police officer manning the door to collect all Nomination papers from the aspiring candidates who were outside the Courtroom. The Courtroom was very small and could only allow batches of fifteen (15) people at a given time.
2. After collecting all the Nomination forms outside, the police officer brought them before the Nomination officer’s desk. The nomination officer at 1600hrs announced that the court was now closed for new nomination papers to be submitted.
3. Processing all nomination papers on the nomination officer’s desk was done up to midnight when results were announced. The times shown on the form written Submission Form were times when Individual forms were completely Processed.

The <a href="https://www.pindula.co.zw/2023/07/28/ccc-appeals-disqualification-of-12-mp-candidates-from-2023-elections/">CCC has since appealed against the High Court decision</a> which means the ruling is suspended until a determination is made by the Supreme Court.

Voter Approaches Courts To Prevent Raj Modi From Running For MP

Bulawayo businessman Dharmesh Bhikha has approached the Bulawayo High Court seeking to stop Philip Ndlovu the Judicial Manager of Tilus Supermarkets, from disposing of the business’s assets to a company owned by Deputy Minister of Industry and Commerce, Rajeshkumar Indukant Modi.
Bhikha runs H Bhikha Enterprises trading as Tilus Supermarkets which is being run by Judicial Manager Philip Ndlovu.
The Judicial Manager is accused of having disposed of the property to Sai Mart, owned by Deputy Minister Rajeshkumar Indukant Modi, a close competitor to H Bhikha Enterprise Private Limited.
Modi yesterday denied that Sai Mart, officially opened in October 2020, ever received equipment from Ndlovu.
In his application papers filed through his lawyers Tanaka law Chambers on 14 April 2021, Bhikha cites Ndlovu as the 1st respondent. Stated Bhikha in the urgent chamber application:

Applicant is a shareholder and a creditor in the company, Bhikha Enterprises Private Limited and his interest stems from that position.
Applicant was suspended from supervising the day-to-day activities of the company H Bhikha Enterprises Limited through Judicial Management process albeit retains of interest which clothes him with the locus standi.
The Judicial Manager, the respondent herein has in the process of managing the affairs of Bhikha Enterprises Private Limited on behalf of the creditors and shareholders disposed of the assets so far which include industrial shelves, till points and bakery equipment.
</blockquote>
Deputy Minister Rajeshkumar Indukant Modi, just known as Raj Modi, is also ZANU PF’s Member of Parliament for Bulawayo South.

Deputy Minister Dragged Into Equipment Looting Scandal

Industry and Commerce Deputy Minister Raj Modi has dismissed as fake and shocking reports which suggested that he was operating a plant that brews an illicit brand called “The Commander In Chief.”
Modi claimed that all his alcoholic beverages are approved by the Standards Association of Zimbabwe (SAZ) adding the reports are inspired by a motive to undo his “good name.” He said:
<blockquote>I was shocked to wake up to news that I manufacture and sell an illicit beer called Commander In Chief.
I have no idea what inspired that story because it is not only false but malicious. This is a figment of someone’s imagination. I don’t make alcohol which is not approved by the Standard Association of Zimbabwe.
I challenge whoever came up with those allegations to prove that I manufacture such a product. Where do I manufacture it? Does it even exist? I doubt because I have not come across it.</blockquote>
Modi said he legally manufactures three alcoholic products namely Modivine Brandy, Everest Can Spirit and Divine Vodka.  challenging those who have complaints about their quality to come forward.

Deputy Minister of Industry and Commerce, Raj Modi said the draft Zimbabwe National Industrial Development Policy (ZNIDP 2019- 2023) is set to be tabled before Cabinet for discussion and possible approval.
Speaking in Gwanda recently, Modi said:
<blockquote>A draft policy for the years 2019 to 2023 is in place and is awaiting approval by Cabinet. Strategic interventions under the draft industrial development policy include value addition and beneficiation, import substitution, resuscitation of distressed industries, promotion of rural industry development, development and implementation of industrial value chains, implementation of local content strategies and export developments.</blockquote>

Zimbabwe's New Industrial Policy Awaits Cabinet Approval

Industry and Commerce Deputy Minister Rajesh Modi, who pledged to donate his Government salary, last week gave his first salary to a Bulawayo woman who suffered a stroke and needed specialist medical attention.
Brenda Zulu of Mzilikazi suburb was admitted at Mpilo Central Hospital before being discharged. Modi had her admitted to the Roman Catholic church-run Mater Dei Hospital, which had the required specialist facilities to treat her ailment. He paid the medical bills using his Government salary. In an interview with The Chronicle Modi said:
<blockquote>Sometimes it’s not about waiting for bigger projects that will benefit a lot of people. It is the little things that touch a few lives that matter. Next time it may be a household that needs food, a pupil in need of school fees or any other person in need of help. It may seem worthless to the next person but I know that part of their burdens would have been lifted.</blockquote>

Industry Deputy Minister Donates First Salary

Industry Deputy Minister and Bulawayo South legislator Raj Modi’s shop charges alcoholic drinks in United States dollars.
The Zanu-PF legislator confirmed this on his Twitter account saying that they charge in foreign currency which are in shortage because their suppliers want United States dollars. He said his shop accepts bond notes and swipe for other alcoholic drinks other than Amstel Lite and Heineken. Said Modi:
<blockquote>I would like to inform my valued clients that only alcoholic drinks bought in USD are being sold in USD to allow us to restock. Our suppliers want USD, nothing else. For all other goods, Liquor Hub accepts any form of payment. Bond notes and plastic money are legal tender.</blockquote>
