Prominent human rights defender Jestina Mukoko has taken the Minister of Finance, Economic Development and lnvestment Promotion, Mthuli Ncube, to court for allocating national funds to the National Peace and Reconciliation Commission (NPRC) whose term of office expired in August 2023.
According to the Zimbabwe Human Rights NGO Forum, Mukoko alleges that in terms of section 251 of the Constitution, the NPRC was supposed to exist for only 10 years from 22 August 2013, the date it was operationalized. This means the NPRC ceased to exist on 23 August 2023.
However, despite this position, Finance Minister Mthuli Ncube allocated funds to the NPRC in his 2024 annual budget. Mukoko stated:
<blockquote>
There is no law that allows any public expenditure in favour of the NPRC and this event is contrary thus to section 17 of the Public Finance and Management Act. I submit that it is neither prudent nor economical for the Respondents to allow expenditure for an entity that is not recognized by law or authorized to receive such expenditure. Section 308 of the Constitution provides that “it is the duty of every person who has custody or control of public funds to safeguard the funds and ensure that they are spent only on legally authorised purposes and in legally authorized amounts.”

Mukoko has also cited the Parliament of Zimbabwe and the Attorney-General as respondents. They are yet to respond to Mukoko, who is represented by Noble Chinhanu of the Zimbabwe Human Rights NGO Forum.
The Ministry of Justice, Legal and Parliamentary Affairs announced that it was working on transferring the functions of the NPRC to the Zimbabwe Human Rights Commission (ZHRC).

Jestina Mukoko Takes Mthuli To Court Over NPRC Funds Allocation

National Peace and Reconciliation Commission (NPRC) spokesperson, Obert Gutu, has criticised CCC spokesperson, Fadzayi Mahere over the remarks she made at the United Nations Geneva Summit for Human Rights and Democracy 2023 in Switzerland on Tuesday.
Among other things, Mahere said Zimbabwe is under a dictatorship that is worse than during the late former president Robert Mugabe’s reign.
Speaking to <a href="https://zbcnews.co.zw/2023/05/19/mahere-under-fire-for-vilifying-the-country/">ZBC News</a>, Gutu said Mahere should have raised her concerns with the NPRC instead of using the United Nations Geneva Summit for Human Rights and Democracy to air her grievances. Gutu said:
<blockquote>
We normally want to encourage people to be mindful of what we say, where we say it, and how we say it.
It’s very unfortunate when utterances that might have the effect of disturbing peace are made here in Zimbabwe or outside the country there might have the effect of disturbing the peace because I understand from my observation that a number of people are very upset about what she said in Geneva.
I happen to have watched the video as well and I’m saying from a peace-building perspective, those issues she raised could have been raised locally as they say the best approach is to use domestic remedies before you go out of your own house to talk about domestic issues.
As a peacebuilding institution mandated by the supreme of the land to build peace in Zimbabwe, we wouldn’t have to encourage any Zimbabwean who feels they want to have issues to discuss to be free to contact us or give us suggestions may be orally or in writing with regards to what they would want to be done about the issues or complaints that they have.
We believe that as NPRC at the end of the day peace-building affects everyone and if you say something that might have an effect of sticking emotions, which is what appears to be the case here, that would actually invite an inferno of emotions that might even lead to civil unrest in the country and it will be very unfortunate considering that we are already in elections where political emotions are running very high and one would want to believe that the whatever we do, whatever we say as Zimbabweans, political actors and non-political actors, we should always be mindful of the impact-end of effect it might have on the peacefulness of our beloved country.

Speaking in Switzerland, Mahere claimed that half of Zimbabwe’s population lives in extreme poverty while billions are being looted by the ruling elite.
She also said the conviction of Transform Zimbabwe (TZ) president Jacob Ngarivhume for incitement to public violence is a warning by the ruling elite that participating in opposition politics is punishable.
Mahere narrated her ordeal at the hands of State institutions and castigated the treatment of political opponents, prisoners, and judicial capture.
She recalled her treatment at Chikurubi Maximum Prison after her arrest on charges of undermining the authority of the police after she posted a video that had already been posted multiple times alleging that a police officer had struck dead a baby with a baton in Harare. Mahere said:

Two years ago, I woke up in an overcrowded jail cell in Zimbabwe’s Maximum Security Prison.
No water. No toilet. No underwear. No dignity. No rights.
Inmates ate watery porridge with their bare hands because spoons are not allowed.
Before lights were off, we had to line up in queues for roll call – groups A, B, C and D. D was for Dangerous.
Even though the other women there had committed crimes such as murder, armed robbery and infanticide, I alone was put in the dangerous group.
I had committed the dangerous crime of tweeting against police brutality.

Obert Gutu Criticises Mahere Over Her Remarks In Geneva

Newly-appointed Commissioner of the National Peace and Reconciliation Commission (NPRC), Obert Gutu has said he never joined the ruling Zanu PF party.
Gutu who is a former spokesperson of the opposition MDC said he only expressed the intention to join ZANU PF but did not complete the process.
His denial comes as the Zimbabwe Human Rights Association (ZimRights), a National Transitional Justice Working Group Zimbabwe (NTJWG) member, filed an application demanding that Gutu be removed from NPRC as section 286 of the Constitution forbids political party actors from serving as NPRC commissioners. The NTJWG statement read:
<blockquote>Dzikamai Bere, the executive director of ZimRights, who deposed the founding affidavit, had submitted that on March 17, 2021, Gutu joined Zanu PF amid pomp and fanfare at State House where he was welcomed to the political party by President Mnangagwa.
But in a shock response, while admitting the reports and the article (Sunday Mail, 21 March: Why I joined Zanu PF) explaining his decision to join Zanu PF, Gutu submitted that he was yet to submit a formal application and had not paid the required joining fee.  He said he had abandoned the idea of joining Zanu PF when he was appointed to NPRC.</blockquote>

Ironically, Gutu was in March paraded at State House by President Emmerson Mnangagwa, who announced that the former MDC-T vice-president had defected to the ruling party.
Some have been calling for Gutu’s dismissal from NPRC over his recent remarks on Gukuruhundi atrocities that killed over 20 000 civilians in the Matabeleland and Midlands provinces.
Gutu said Gukurahundi constituted a small fraction of the issues the NPRC was dealing with.

I Never Joined ZANU PF - Obert Gutu

The National Peace and Reconciliation Commission (NPRC) on Friday said it had assisted two Bulawayo women who were victims of police brutality to make a formal report.
NPRC investigators led by Commissioner Leslie Ncube, who is in charge of the three Matabeleland provinces, said they were shocked by the level of abuse the women were subjected to. He said:
<blockquote>They were brutally attacked by male police officers who beat them on the thighs and buttocks while insulting them. We are told that the officers were insulting them using derogatory language which also fuels ethnical hatred.
The victims told us that the officers were telling them that there is nothing special with their hips as they also have wives with even bigger hips. So clearly the police officers became too personal instead of executing their police duties.
The police are supposed to be the custodians of law and are supposed to protect the lives of the vulnerable in our society. We condemn the behaviour of the said police officers.
The victims were allegedly insulted. Such actions are not expected from the police officers especially in an independent Zimbabwe.</blockquote>
National police spokesperson Assistant Commissioner Paul Nyathi rebuked the officers who were involved in the abuse, saying they should not get carried away when they perform their duties.
The two women, who are sisters, were snatched from a queue at a supermarket and handcuffed,  “because they were rude” before they were severely assaulted and left with bruises.
