The Nomination Court will sit today, 07 November, to receive papers from aspiring candidates for the 09 December by-elections.
The Government has set aside a US$5.3 million budget for the Zimbabwe Electoral Commission (ZEC) to conduct the by-elections.
Nine National Assembly seats are up for grabs after they were declared vacant following recalls of CCC MPs last month.
ZEC deputy chairperson, Rodney Kiwa told <a href="https://www.herald.co.zw/nomination-court-sits-today/">The Herald</a> on Monday that they are ready for the by-elections. Said Kiwa:

Everything is set for the Nomination Court sitting scheduled for tomorrow (today), if we fail to deliver we as an organisation will have failed.
All other required materials like ballot papers, stationery, tents, lights and ink are available.
The commission has heavily invested to meet the requirements of the upcoming by-elections.

Each National Assembly candidate is expected to pay a US$1 000 nomination fee.
The by-elections will take place in Beitbridge West, Binga North, Bulawayo South, Cowdray Park, Lobengula-Magwegwe, Lupane East, Mabvuku-Tafara, Mpopoma-Mzilikazi, and Nketa constituencies.

Nomination Courts For 09 December By-elections Sitting Today

High Court judge Justice Gladys Mhuri has reserved judgement in the matter where presidential aspirant Linda Masarira is challenging the rejection of her nomination papers.
Masarira had made an appeal challenging the decision of the Nomination Court to reject her nomination as a presidential candidate after she failed to raise the required US$20 000 fee.
The leader of the Labour, Economists and African Democrats (LEAD) said she wanted to pay using real-time gross settlement (RTGS), but the presiding officer insisted on cash or payment through the ZimSwitch Instant Payment Interchange Technology (ZIPIT) system.
Speaking in an interview with CITE’s <a href="https://cite.org.zw/high-court-reserves-judgement-in-masarira-presidential-candidacy-case/">Senzeni Ncube</a>, Masarira’s lawyer, Andrew Makoni of Mbidzo, Muchadehama and Makoni legal practitioners said the judgement was reserved. He said:

So, judgement in the matter has been reserved by Justice Mhuri. We filed heads on Friday and Zimbabwe Electoral Commission (ZEC) given until tomorrow to file heads.
So, respondents number 1-4 then asked for time to also file their head of argument.
They will have the opportunity to file their heads of argument by tomorrow (Wednesday) 3 PM.  
Linda was also given until Wednesday to file supplementary heads of argument.
After the filing of supplementary heads of argument, the judge will determine whether there be a need for an oral argument on the matter, if she feels that there is a need for an oral argument, she will then call the parties to argue on the restrictive points that she may want us to address on and otherwise she will be ready to give a judgement on the matter.

In her court papers, Masarira cited the Presiding Officer of the Nomination Court as the first respondent, the second respondent being the (ZEC) Chief Elections Officer, the third respondent being the Chairperson of the Zimbabwe Electoral Commission, the fourth respondent being ZEC, the fifth respondent being Emmerson Dambudzo Mnangagwa, the sixth respondent being Nelson Chamisa, seventh respondent is Douglas Togaraseyi Mwonzora, eighth respondent is Lovemore Madhuku while the ninth respondent is Saviour Kasukuwere.
If the court rules in Masarira’s favour, she will become the second female presidential candidate after UZA president Elizabeth Valerio won her appeal last week.

High Court Reserves Judgement In Linda Masarira's Candidacy Appeal

Lawyers representing CCC candidate MPs in a case where twelve Bulawayo registered voters seek their disqualification from participating in the August elections want the case thrown out.
The lawyers argued that the applicants have no evidence to support their claims and are relying on hearsay.
<a href="https://cite.org.zw/lawyers-want-frivolous-case-against-ccc-candidates-thrown-out/">CITE</a> reported that Bulawayo High Court judge Justice Bongani Ndlovu is presiding over the hearing which commenced on Wednesday and is set to continue this Thursday.
12 registered voters filed urgent chamber applications at the High Court, claiming the Zimbabwe Electoral Commission (ZEC) accepted candidate nomination papers from opposition candidates after the 4 PM deadline.
The candidates are from parties including CCC, ZAPU, Free Zim Congress and the Zimbabwe African National Congress (ZANC).
The applicants want the courts to prevent the candidates from running in the elections and cite ZEC and different opposition party candidates as respondents.
The CCC candidates were being represented by Advocate Thabani Mpofu and Professor Welshman Ncube while ZEC is being represented by lawyer Tawanda Kanengoni. Advocate Thembinkosi Magwaliba represented the 12 applicants.

Lawyers Want Case Against Bulawayo CCC Candidate MPs Thrown Out

The Electoral Court Division of the High Court in Harare will on Friday, 14 July hear an appeal by opposition United Zimbabwe Alliance (UZA) leader, Elisabeth Valerio, challenging the rejection of her nomination papers.
In a statement, UZA National Spokesperson Elvis Dzvene said the Nomination Court rejected Valerio’s nomination to run for the presidency despite submitting proof that she had paid the nomination fee in full. Said Dzvene:

The United Zimbabwe Alliance (UZA) wishes to inform the public, the media, and all interested stakeholders that our party President, Elisabeth Valerio, will be attending an appeal hearing in the Electoral Court Division of the High Court in Harare on Friday, July 14th at 10 AM.
The appeal is against the June 21st decision of the Nomination Court, which rejected President Valerio’s nomination for election to the office of the President. President Valerio provided bank-stamped proof of her request to initiate a ZWL transfer of funds to the Zimbabwe Electoral Commission (ZEC) bank account for the required nomination fees equivalent to US$20,000. Full payment was made to ZEC but her nomination papers were still refused.
UZA is challenging this decision as a violation of the constitutional rights of President Elisabeth Valerio and the party members who nominated her.
We are seeking an order directing ZEC to accept her nomination papers and allow her to contest in the August 23rd presidential election.

She said that appeal by Valerio is an important step for the advancement of democracy, transparency, and women’s rights in Zimbabwe. Dzvene said:

We are confident that the High Court will uphold the principles of justice and fairness that are essential for our political system and the participation of women in political leadership.

Valerio and the leader of Labour, Economists and African Democrats (LEAD) Linda Masarira were the only women who expressed their intention to contest in the presidential elections and both failed in their bid to submit nomination papers.

Electoral Court To Hear Elisabeth Valerio Appeal On 14 July

The Bulawayo High Court has reserved judgment on a case brought by 10 members of the Citizens Coalition for Change (CCC), who are challenging the rejection of their nomination papers by ZEC. 
The CCC members allege that the Zimbabwe Electoral Commission (ZEC) prevented them from submitting their party list nomination papers, depriving them of the opportunity to contest in the upcoming harmonised elections. They have asked the court to order ZEC to permit them to submit their candidate names and reverse the election of the ZANU-PF provincial council candidates who stood unopposed. 
ZEC’s Bulawayo Provincial Elections Officer (PEO), Innocent Ncube, <a href="https://www.pindula.co.zw/2023/07/05/rejection-of-nomination-papers-zec-opposes-court-case-by-10-ccc-members/">refuted the allegations</a> made by the CCC members. He claimed that the opposition party had three party lists for Senatorial, National Assembly, and Youth quotas, but none for the Provincial Council. According to Ncube, CCC attempted to submit its Provincial Council party list while submitting amendments to its initial nomination papers, which was prohibited. 
The matter was heard before Justice Bongani Ndlovu on July 3, and judgment has been reserved. The CCC members have argued that the matter is urgent as the election is approaching, and the judgment needs to come before the election. ZEC has opposed the application, arguing that the High Court lacks jurisdiction in the matter, and the application should be struck off the roll as it lacks a legal basis.

Rejection Of CCC Nomination Papers: High Court Reserves Judgment

The Zimbabwe Electoral Commission (ZEC) has filed opposing papers in a court case brought by 10 members of the Citizens for Coalition Change (CCC). The CCC members are challenging the rejection of their nomination papers for the candidature of Bulawayo Provincial Council. The members argue that they were unlawfully denied the opportunity to file nomination papers when the Nomination Court sat on June 21. ZEC rejected the CCC nomination papers arguing that they were filed after 4 pm.
The CCC members then filed an urgent application at the Bulawayo High Court seeking a review of ZEC’s decision not to accept their nomination papers. Their lawyers argued:

Further, the refusal by the first respondent (Mr Ncube) to allow the applicants to submit new nomination papers was grossly unreasonable and insupportable of the facts of this case.
</blockquote>
However, ZEC has argued that there is no valid application before the court warranting the relief sought by the CCC members. Mr Ncube has argued that his decision is final in terms of the Electoral Act, and the High Court lacks jurisdiction in the matter. Through his lawyers, Ncube said:

The right to appeal is afforded to the sponsoring political party and not to the listed candidates on the party-list. In this instance, the right reposed in the CCC party. If such right is not exercised with the four-day period prescribed, the right to appeal shall lapse and the decision of the nomination officer shall be final.
In the present matter, the applicants, following my decision not to accept their nomination papers, noted an appeal to the Electoral Court sitting in Bulawayo under case number EC02/2023. They did so in their individual capacities and not through their political party, thus making their appeal fatally defective.
</blockquote>
Mr Ncube also stated that the Nomination Court cannot receive and consider applicants’ papers as it is only the President who can proclaim. He further added that the court has no legal basis to make an order that effectively makes a new proclamation or supplements the one already made by the President.
ZEC lawyers also argued that the applicants were afforded all the facilities and rights prescribed in terms of section 45E of the Electoral Act and were not denied the right to file nomination papers. They say the application should be struck off the roll, they argued.
Ncube stated that towards the close of the Nomination Court, he announced in court that they were about to close and invited all those who were present to submit their nomination papers. He further instructed the police officers to collect all nomination papers outside the court, except those already inside. When Ncube examined the party lists for the CCC, he found that the party had submitted three party lists for Senatorial, National Assembly and Youth quota, but did not have one for the provincial council. He sent their representative back to make corrections on anomalies. The corrected party-list nomination papers were returned with the provincial council party list added, which was not part of the original submission.
Ncube denied losing the nomination papers of the CCC members and stated that the factual narration given by the applicants is not correct. He added that he acted fully within the law, and there is no basis for the application. He further argued that the application has fatal defects that mitigate against the court granting any relief to the applicants.
The Bulawayo High Court judge, Justice Bongani Ndlovu, has reserved judgment after hearing the matter on Monday.

The opposition United Zimbabwe Alliance (UZA) party has approached the High Court for redress after a list of its candidates whose papers were approved in the nomination court did not appear in the Government Gazette published on 30 June 2023.
UZA president <a href="https://pindula.co.zw/Elisabeth_Valerio">Elisabeth Valerio</a> said the candidates’ papers were approved in nomination court and paid their fees but were rejected by ZEC.

Valerio Says UZA Candidates' Names Missing From ZEC Final List

ZANU PF intends to pursue litigation for the disqualification of the nomination of the CCC candidates who were registered to participate in the election after the stipulated time. Zimbabwe’s Finance Secretary, Patrick Chinamasa, stated that the candidates’ nomination papers were submitted after the 4pm statutory deadline, and the law is “peremptory” about compliance. He said the Zimbabwe Electoral Commission had no legal right to accept nominations from candidates who were not within the court by 4 pm on June 21, 2023. ZANU PF has directed that litigation be urgently instituted for the disqualification of the nomination of the CCC candidates who submitted their papers out of time, in contravention of section 46 (7) and (8) of the Electoral Act. Chinamasa said:

1. With respect to the Harmonised Elections slated for 23 August 2023.21 June Wednesday 2023 was gazetted as the nomination day to receive nominations for National Assembly Election Candidates and Party List Election Candidates. 
2. With respect to the time frame within which nomination papers are to be submitted Section 46 (7) and (8) of the Electoral Act Chapter 2:13) provides as follows:
No nomination paper shall be received by the nomination officer in terms of Subsection (6) after four o’clock in the afternoon of nomination day or. where there is more than one nomination day for the election concerned, the last such nomination day.
Provided that, if at that time a candidate or his or her chief election agent is present in the court and ready to submit a nomination paper in respect of the candidate the nomination officer shall give him or her an opportunity to do so. 8. The nomination officer shall examine every nomination paper lodged with him or her which has not been previously examined by him or her in order to ascertain whether it is in order and shall give any candidate or his or her chief election agent an opportunity to rectify any defect not previously rectified and may adjourn the sitting of the court for that purpose from time to time: Provided that the sitting shall not be adjourned to any other day that is not a nomination day-. 
3. The provisions of the law arc peremptory. To comply with the 4pm statutory deadline for the submission of nomination papers the candidate should be within the Nomination Courtroom with a validly signed nomination paper and the requisite nomination fee. The law is also peremptory that any adjournments for purposes of rectification of defects shall not be to any other day that is not a Nomination Day. In the instant case 21 June 2023 was the gazetted Nomination Day.

5. In short the CCC candidates referred to above were not in court with signed nomination papers and nomination fee by the time the Nomination Court closed at 4pm on 21 June 2023. As the above will show the Nomination Court sat on 22 June 2023 again in contravention of section 46 (7) and (8) of the Electoral Act. 
6. The Zimbabwe Electoral Commission had no legal right to accept the nominations referred to from candidates who were not within the court by 4pin on 21 June 2023. Further, the Zimbabwe Electoral Commission had no legal right to sit as a Nomination Court on 22 June 2023 to receive and accept nomination papers from CCC candidates referred to above. 
7. We are aware that failure by CCC candidates to submit their nomination papers on time were due to the structureless, constitutionless and banking accountless organisation that CCC is. It was illegal for ZEC to receive and accept nomination papers awaiting the signature of some CCC Official who was in Harare at the time the Nomination Court closed at 4pm on 21 June 2023. Equally, it was illegal for ZEC to accept payment of nomination fees after 4pm on 21 June, 2023 and to wait for the payment from a CCC Official who was said to be still in Harare as at 4pm on 21 June 2023. 
8. The law is “a ass” and must be obeyed and complied with. 
9. Accordingly ZANU PF has directed that litigation be instituted urgently for the nullification of the nomination of the CCC candidates mentioned above and whose papers were submitted out of time in contravention of Section 46 (7) and (8) of the Electoral Act( Chapter 2:13).

Law expert, Thabani Mpofu, suggests that ZANU PF’s decision to ask a court of law to disqualify CCC candidates is significant. 
Zimbabwe will hold harmonised elections on August 23, 2023. 
The nomination court sat last Wednesday, and the Zimbabwe Electoral Commission (ZEC) stated that only candidates who had submitted their papers but had difficulty making payments could register, even beyond the stipulated time. The commission rejected late submission stating that any nomination paper submitted after the proclamation date was in breach of the constitution.

Zimbabwe 2023 Elections: ZANU PF Seeks Disqualification Of CCC Candidates

The Nelson Chamisa-led Citizens Coalition for Change (CCC) has said forty-one (41) individuals fraudulently filed nomination papers as members of the party.
20 of the “fraudsters” filed nomination papers for National Assembly seats while the other 21 individuals filed for local authority seats.
In a statement on Monday, CCC national spokesperson Fadzayi Mahere said the party has filed criminal charges and also appealed to the Electoral Court. <a href="https://www.pindula.co.zw/">Pindula</a> is publishing Mahere’s statement below:

FRAUDULENT DOUBLE CANDIDATES
Pursuant to our press briefing on 22 June 2023, we filed objections against double candidates in terms of the procedure provided for under the Electoral Act. We have received no response from ZEC.
Consequently, we have noted an electoral appeal to the Electoral Court under EC3/2023 against the decision of the Nomination Court to accept the nomination forms of fraudulent double candidates whose forms carried forged signatures.
In addition, we have filed criminal complaints against all of the fraudulent candidates under RRB No. 5585161, ZRP Kopje.

CCC Sues 41 "Fraudulent" Candidates

The Zimbabwe Lawyers for Human Rights (ZLHR) has filed two notices of appeal at the Electoral Court appealing against the decision of the Nomination Court, which rejected <a href="https://www.pindula.co.zw/Linda_Masarira/">Linda Masarira</a> and Elisabeth Valerio’s nomination as candidates for election to the office of President in general elections scheduled for 23 August.
Masarira and Valerio failed to pay the required US$20,000 fee by the end of Wednesday to register their candidacy for the election. Even after the <a class="MarkdownLink_linkifiedLink__KxC9G">Zimbabwe Electoral Commission</a> (ZEC) gave <a class="MarkdownLink_linkifiedLink__KxC9G">disqualified candidates</a> two hours to make the payment on Thursday, they still couldn’t make the payment. 
Linda Masarira leads the opposition <a href="https://www.pindula.co.zw/Labour,_Economists_and_African_Democrats/">Labour, Economists and African Democrats (LEAD)</a> while Elisabeth Valerio is president of the United Zimbabwe Alliance (UZA).
<a href="https://pindula.co.zw/Elisabeth_Valerio">Elisabeth Valerio</a> recently condemned the <a class="MarkdownLink_linkifiedLink__KxC9G">Zimbabwean Parliament</a>‘s decision to uphold high <a class="MarkdownLink_linkifiedLink__KxC9G">nomination fees</a> for candidates set by the <a class="MarkdownLink_linkifiedLink__KxC9G">Zimbabwe Electoral Commission</a> (ZEC). Valerio expressed concern that the fees would prevent some aspiring candidates from participating in the upcoming elections as they cannot afford them. She argued that <a class="MarkdownLink_linkifiedLink__KxC9G">high nomination fees</a> limit <a class="MarkdownLink_linkifiedLink__KxC9G">political participation</a> to only those with financial resources and undermine the political rights of citizens.
According to Statutory Instrument (SI) 144 of 2022, parliamentary candidates must pay US$1,000, while presidential candidates must pay US$20,000 to run for their respective offices.

Masarira, Valerio Appeal Presidential Candidacy Disqualification

The Zimbabwe Electoral Commission (ZEC) has announced a new deadline for aspiring candidates who failed to pay nomination fees due to banking system issues. In a statement seen by Pindula News, ZEC has called on candidates to approach the Nomination Court before 5 pm on the same day. ZEC said the decision followed reports that some candidates were disqualified from lodging their nomination papers due to payment difficulties caused by banking system challenges. Reads the statement issued on Thursday, June 22nd:

The Zimbabwe Electoral Commission has noted with concern reports to the effect that prospective candidates were disqualified from lodging their nomination papers on account of difficulties experienced in effecting payment of nomination fees largely due to the current challenges within the banking system.
In view of this, the Commission is calling upon all candidates and parties whose nomination papers had been submitted but had challenges with the Commission’s point of sale machines and those who had submitted proof of payments but funds not reflecting in ZEC’s account to approach the respective nominations courts wherein their papers were lodged and make the necessary payments or get confirmation of said payment no later than 1700hrs on 22 June 2023.
The overriding mission of ZEC is to be as accommodative and inclusive as possible to enable Zimbabwean voters to exercise their cherished democratic rights.

ZEC Extends Deadline For Disqualified Candidates To Make Payment

The Nomination Court for Presidential Candidates sat at the High Court on Thursday and 23 candidates were duly nominated to contest for the presidency in the July 30 elections.  Although this is the highest number of candidates to ever participate in a Zimbabwe presidential election, it is still way below the number of political parties which are reported to be over 100.  Here is the list of candidates who successfully filed their papers.

Daniel Chingoma, <a href="https://www.techzim.co.zw/2010/10/homemade-chopper/" rel="noopener" target="_blank">who became famous after attempting to make a helicopter</a> was told to go back twice because his things were not in order. In the first instance, he was asked to resubmit new passport size photos because in his old ones he was wearing a cap.  However, when he returned the officials informed him that some of the people who had nominated him are not on the Voters’ Roll. So he was asked to get different people to nominate him. According to the regulations, a candidate needs to be nominated by not fewer than 10 voters who are on the voters roll from each of the 10 Provinces, meaning one needs 100 votes.
