The United States Embassy in Zimbabwe has expressed concern over reports of continued politically motivated violence and intimidation in the aftermath of the disputed 23 August 2023 Harmonised Elections.
Posting on X, the Embassy also urged President Emmerson Mnangagwa’s administration to stop “lawfare”.
Lawfare is the misuse of the law as a weapon to cause problems for political opponents. Said the U.S. Embassy:

We are concerned by reports of continued politically-motivated violence and intimidation post-election.
Every person, no matter their political affiliation, has the right to live free of fear and to be treated fairly under the law. #StopLawfare
</blockquote>
Responding to the US Embassy in Zimbabwe, Presidential spokesperson George Charamba, using one of his X handles, dhonzamusoro007, said:

We are acutely concerned about the pre-election harassment of Donald Trump, the Republican candidate for America’s forthcoming elections, and weaponisation of US law by the Biden Administration against the same and other Republicans. We demand an even playing field, before, during and after US elections set for next year, elections free from law-fare!!!!! Attention, African Union, Russia, China, North Korea, Cuba, Venezuela and Iran, among other progressive countries!!!!!

Several members of the opposition Citizens’ Coalition for Change (CCC) party have been arrested on what critics consider “trumped up charges”, while a few have been abducted and tortured.
Recently, CCC deputy spokesman Gift Siziba, Harare deputy mayor Kudzai Kadzombe, and Sunningdale MP, Maureen Kademaunga were arrested on various charges, which were dropped barely 48 hours later.
CCC activists Womberaishe Nhende and Sonele Mukhuhlani were allegedly abducted, tortured and drugged on Saturday, 02 September by people they suspected were state agents.
Their lawyers, Tapiwa Muchineripi and Douglas Coltart of Zimbabwe Lawyers for Human Rights were arrested and charged with obstructing or defeating the course of justice.

Stop Lawfare, United States Embassy Tells Mnangagwa

A United Nations (UN) expert on Wednesday expressed concern about the ongoing legal proceedings against human rights defender Obert Masaraure in Zimbabwe.
Masaraure is the president of the Amalgamated Rural Teacher’s Union of Zimbabwe (ARTUZ) and Crisis in Zimbabwe Coalition (CiZC) spokesperson.
UN Special Rapporteur on the situation of human rights defenders Mary Lawlor called for the charges against Masaraure to be dropped.
She also urged Zimbabwean authorities to put an end to the pattern of criminalisation of education and labour rights defenders. <a href="https://srdefenders.org/un-expert-urges-zimbabwe-to-end-judicial-harassment-of-education-and-labour-rights-defenders-press-release/">Said Lawlor</a>:

Mr Obert Masaraure has long been targeted in reprisal for his peaceful work in defence of the labour rights of teachers, educators, and all those who seek to uphold the fundamental right to education in Zimbabwe.
</blockquote>
Masaraure was first charged in 2019 with “subverting a constitutionally elected government and inciting public violence”.
Since January 2022, Masaraure has faced multiple arrests and charges, including participation in a protest, alleged murder, and public incitement to violence, while being released on strict bail conditions, said the UN expert.
After several postponements, Masaraure is due to stand trial on 29 May 2023 on charges related to national security, including public incitement to violence and obstruction of justice.
A hearing on the murder charge is scheduled for 31 May 2023. Said Lawlor:

Since I took office in 2020, I have heard numerous allegations of arbitrary arrests, excessive use of force and ill-treatment by police officers against human rights defenders working to protect labour rights.
</blockquote>
The Special Rapporteur expressed concern that such targeting may be an attempt by Zimbabwean authorities to deter others from standing up and peacefully assembling for the right to education in the country.
The UN expert has raised her concerns with the Government of Zimbabwe and will continue to monitor the situation.

UN Expert Urges Zimbabwean Authorities To End "Lawfare" Against Masaraure

The Citizens’ Coalition for Change (CCC) has accused ZANU PF of abusing state institutions and resorting to lawfare after the Zimbabwe Republic Police (ZRP) blocked several opposition rallies across the country that were slated for this month.
CCC had sought to have rallies in Marondera, Chikomba, Chendambuya, rural Mutare, Beitbridge, Gutu and Uzumba but all were blocked by the police.
In prohibiting the rallies, police said CCC’s notifications were NOT fully compliant with the Maintenance of Peace and Order Act (MOPA), among other reasons.
CCC spokesperson Fadzayi Mahere told <a href="https://www.newzimbabwe.com/https-www-newzimbabwe-com-ccc-cry-foul-as-police-ban-four-of-their-rallies-in-a-month-venue-reserved-for-boozers-football-says-mutare-police-in-one-bizarre-response/">NewZimbabwe.com</a> that the banning of its rallies shows that ZANU PF is panicking. She said:

We condemn ZANU PF’s continued abuse of state institutions in banning our rallies. It confirms beyond any doubt that their backs are against the wall as all available data points to a CCC victory in the upcoming elections.
ZANU PF can never win a free and fair election in Zimbabwe hence they resort to their usual dirty tricks of political violence, weaponising the law against opponents, banning our gatherings, criminalising dissent and enacting draconian laws to try and destroy the opposition. It will not work.
</blockquote>
Mahere said the banning of CCC rallies by the police will not stop them from campaigning as they have already devised “sophisticated ways of gathering, mobilising and organising”. Said Mahere:

President Nelson Chamisa has already put the nation on notice that we have more sophisticated ways of gathering, mobilising and organising over which they have no control.
We are penetrating villages, towns and cities in all provinces; and we will leave no stone unturned to ensure a citizens’ victory for change this year.
Zimbabweans want and deserve a new government led by Chamisa and ethical leaders who can drive a transformation and modernisation agenda.
We are ready to build a New Great Zimbabwe. No amount of tantrums, toxic politics or intimidation by ZANU PF will stop us.
</blockquote>

CCC Accuses ZANU PF Of Resorting To Lawfare After Several Rallies Are Blocked

Self-exiled former ZANU PF Politburo member and Local Government Minister Saviour Kasukuwere on Monday accused President Emmerson Mnangagwa’s government of using the law as a weapon against critics saying the practice should stop.
Lawfare is the use of the law or courts to damage or delegitimise an opponent, or to deter individuals’ usage of their legal rights.
In a statement marking the country’s 42nd Heroes Day Commemorations on 8 August 2022, Kasukuwere said it was wrong for the government to hound citizens out of the country because of political differences. Said Kasukuwere:

No Zimbabwean should be imprisoned without charge for lawfully and rightfully taking part in our politics, no Zimbabwean should be persecuted because of political differences and no Zimbabwean should be exiled because of personal or political differences.
Ours is no longer a war of canons and guns, it is a war to deliver economic independence. We are no longer pressed with racial inequality, but we see economic inequality all around us.
Let us seize the opportunity to be the heroes of future generations and present. Let us rise to our generational calling. Out of us, heroes must emerge.
</blockquote>
Kasukuwere also bemoaned the country’s seemingly unending economic challenges that have pushed millions of Zimbabweans out of the country in search of greener pastures. He said:

As we celebrate and remember, let’s not forget the Zimbabwean child toiling because of a lack of employment, lack of empowerment and lack of services.
Let us not forget the millions of Zimbabweans who have been forced to live as second-class citizens in other countries, sometimes subjected to degrading and inhumane conditions and discrimination in these foreign domiciles.
</blockquote>
