The Supreme Court of Zimbabwe has dismissed an application for leave to appeal filed by <a href="https://www.pindula.co.zw/Tendai_Biti/">Tendai Biti,</a> who faces a US$1 million defamation lawsuit brought by Augur Investments’ top executives <a href="https://www.pindula.co.zw/Kenneth_Sharpe/">Kenneth Raydon Sharpe</a> and Tatiana Aleshina.
Biti’s application was dismissed with costs by Justice Alfas Chitakunye, who said it was improperly placed before the court, <a href="https://www.newsday.co.zw/local-news/article/200012656/biti-loses-us1m-defamation-appeal">NewsDay</a> reported. The High Court had already ordered that the trial proceed after Biti objected to the lawsuit but lost by default judgment. Biti then approached the Supreme Court seeking leave to appeal the High Court’s verdict. However, Justice Chitakunye said Biti should have first purged the default judgment he lost at the High Court before approaching the Supreme Court for leave to appeal.
Biti’s appeal comes after his application for exception was dismissed by High Court judge, Justice Jacob Manzunzu in 2021. The trial was due to commence before High Court judge, Justice Tawanda Chitapi, but failed to kick off after the opposition legislator filed an appeal against the High Court’s ruling at the Supreme Court.
Augur Investments is seeking US$500 000 damages from Biti while its chief operations officer, Aleshina is claiming US$100 000. Sharpe wants US$400 000.
Biti is accused of having scandalized the company’s good standing over the Harare Airport Road tender. Augur accuses Biti of making false claims that they were involved in fraudulent transactions and land theft from the City of Harare, portraying them in a bad light.

Biti Suffers Setback In US$1 Million Defamation Lawsuit

Augur investments, owned by prominent property developer, <a href="https://www.pindula.co.zw/Kenneth_Sharpe">Kenneth Raydon Sharpe</a>, Friday launched the refurbishment of a one-stop village at the Warren Hills Golf Course in partnership with the <a href="https://www.pindula.co.zw/Harare">City of Harare</a>.
The golf course is one of Harare’s oldest up-market recreational facilities and is owned by Sunshine Developments, a joint venture company between the City of Harare and Augur Investments.
Sharpe told journalists at a press briefing that they are now in the final weeks of planning before they start the development. NewZimbabwe.com reports Sharpe as saying:

We are not building on the golf course or on sensitive areas, we are building that area and we will prevent any environmental damage.
There have been rumours that we were removing the golf course, and these are not true, because we are actually upgrading the golf course.
We are spending a budget of about four to five million United States dollars to bring it to an international championship course status.
The golfers that are currently playing there, we would love them to continue playing there and be members of this estate. The membership will also include outside golfers.
We are very proud to bring this in Zimbabwe, especially in Warren Hills, a place that we believe needs upliftment and significant investment.
The estate will encompass a five-star hotel and conference centre, retail shops, office park, club house facilities for the enhanced golf course and an exclusive residential estate of modern contemporary style villas, flats (luxury apartments), townhouses and an attached retirement section with health and medical facilities.

There was a public outroar when it was announced earlier this month that the <a href="https://news.pindula.co.zw/2022/05/07/harare-seeks-to-convert-golf-courses-to-residential-stands/">City of Harare is seeking to convert two community golf courses into residential and commercial stands</a>.
The two recreational facilities are Sherwood Golf Course in Mabelreign, which was established in 1961, and Warren Hills Golf Course.
Sharpe assured residents that the project will not destroy the golf course and current members will not be shut out.
He also asked the public and politicians to support the project and give him a chance to help develop a world-class city.

Developer Sharpe Speaks On Refurbishment Of A One-stop Village At Warren Hills Golf Course

Lawyers representing Pokugara Properties managing director, Michael John Van Blerk, have said perjury charges levelled against their client are fake and are meant to embarrass him.
The state alleges that Van Blerk lied under oath that a house constructed by land developer George Katsimberis was built without approved building plans from the City of Harare.
Katsimberis vehemently denies the same saying that he is in possession of all documents to prove his assertions.
The show house in question was constructed by Katsimberis under a deal with Pokugara proprietor, <a href="https://www.pindula.co.zw/Kenneth_Sharpe">Kenneth Raydon Sharpe,</a> who is said to have controversially pulled out from the deal.
But in a defence outline seen by NewZimbabwe.com, the defence led by Tawanda Zhuwarara says Blerk pleads not guilty. Zhuwarara said:

The allegations of perjury are calculated to embarass the accused person in that they are based on facts that the complainant admitted under cause HC8943/18. Each allegation the prosecution now claims to have been falsely averred was admitted by the complainant by non-contravention.
Perjury cannot actuate from an affidavit whose averments were admitted by complainant as having been true in the proceedings wherein such affidavit lodged. The charge is, therefore, incompetent, and embarrassing. It must be quashed.
</blockquote>
The defence further argued accused Blerk did not lie that the show house was built without approved building plans from the City of Harare (CoH) through a letter dated July 26, 2018. 
The show house was then demolished at the direction of the CoH who were acting in terms of Section 32, 34 and 35 of the Regional Town and Country Planning Act (Chapter 29:12).
Van Blerk also denies that it was alleged that Katsimberis had built on Stand 10 instead of Stand 9.
The matter is yet to go for trial following numerous false starts.
