President Emmerson Mnangagwa has appointed the Chairperson of the Zimbabwe Anti-Corruption Commission (ZACC) Justice Loice Matanda-Moyo as the Prosecutor-General.
According to a statement issued this Thursday by the Chief Secretary to the President and Cabinet, Martin Rushwaya, Matanda-Moyo’s appointment is with immediate effect. Said Rushwaya:

His Excellency the President, has in terms of Section 259(3) of the Constitution of Zimbabwe appointed Justice Loice Matanda-Moyo as the Prosecutor-General with immediate effect.
Justice Matanda-Moyo is the current Chairperson of the Zimbabwe Anti-Corruption Commission since May 2019. Justice.
Matanda-Moyo has vast experience in the justice delivery system having served as a Magistrate, State Advisor in the Zimbabwe Defence Forces, State Counsel (Criminal Division) of the Attorney-General prosecuting in the High and Supreme Courts.
She rose through the ranks to the post of Director Civil Division and Director Public Prosecution before being appointed Judge of the Labour Court (2009) and Judge of the High Court (2013).
She has also served as Chairperson of the Land Acquisition Task Force and represented Zimbabwe in international cases on human rights.

Nelson Mutsonziwa has been the acting prosecutor general since March 2022 following the resignation of Kumbirai Hodzi on medical grounds.
Hodzi’s predecessor was Ray Goba who replaced Johannes Tomana who in turn replaced Sobusa Gula-Ndebele who left office in May 2008.
The Prosecutor General of Zimbabwe is the head of the National Prosecuting Authority (NPA) and is responsible for overseeing the prosecution of criminal cases in the country.
The NPA is responsible for prosecuting criminal cases on behalf of the state, and its mandate is to ensure that justice is served in accordance with the law.

Justice Loice Matanda-Moyo Appointed Prosecutor-General

The Zimbabwe Anti-Corruption Commission (ZACC) is working with the Ministry of Primary and Secondary Education to provide content that will be taught to learners to ensure that they shun corruption from a young age.
In an interview with <a href="https://www.herald.co.zw/zacc-to-take-anti-corruption-lessons-into-classrooms/">The Herald</a>, Justice Matanda-Moyo said the provision of anti-corruption education in schools is a stepping stone towards the realisation of a corruption-free country at all levels. She said:

ZACC is currently working with the Curriculum Development Unit in the Ministry of Primary (and Secondary) Education to input teachable content in school syllabi.
The establishment of Anti-Corruption Clubs in schools and colleges, and the appointment of Anti-Corruption champions in both urban and rural communities are tools that will be used.
Mainstreaming anti-corruption content in the formal school curriculum is an important preventative tool.

She said ZACC will work with religious groups in raising anti-corruption awareness and also disseminate anti-corruption information on both electronic and print media.
Matanda-Moyo also said ZACC was working on correcting the public’s perception that it was a useless organisation with no capacity to fight corruption.

Anti-corruption Content To Be Added To School Syllabi

The Zimbabwe Anti-Corruption Commission (ZACC) is this year targetting to recover cash and assets valued at over US$1 billion that were acquired through proceeds of crime.
In an interview with <a href="https://www.sundaymail.co.zw/zacc-hunts-for-us1-billion-loot">The Sunday Mail</a>, ZACC chairperson Justice Loyce Matanda-Moyo expressed confidence that the target will be attained. Said Matanda-Moyo:

For asset recovery this quarter, investigations into unexplained wealth are at advanced stages and the commission is confident that by the end of the year, the commission will have seized assets valued at US$1 billion…
The commission is on course and has made 61 arrests and referred 68 completed dockets to the National Prosecuting Authority.

She said ZACC has already secured two high-profile convictions, that is, former Zimbabwe National Road Administration (ZINARA) chief executive officer Saston Muzenda and Karoi provincial magistrate Felix Chauromwe.
Muzenda (48) was recently sentenced to 36 months in jail after being convicted of criminal abuse of office.
Chauromwe was jailed for his unlawful release from remand of three Vehicle Inspectorate Department (VID) officers in 2021.
Justice Matanda-Moyo said that ZACC will take the war against corruption to the private sector, especially mining, civil society and non-governmental organisations.
She added that ZACC will follow leads from various Auditor-General’s reports and ensure the alleged culprits are prosecuted.

ZACC Targets US$1 Billion Unexplained Wealth

Legal think tank Veritas Zimbabwe claims that Zimbabwe has lost at least US$32 billion as a result of criminal financial flows.
Citing recent research on the shady movement of capital and wealth out of the Southern African country, Veritas said illicit financial flows are “stunting Zimbabwe’s economy, fostering corruption and enriching members of the élite at the expense of ordinary people”.
Although illegal domestic financial flows are occasionally included, illicit financial flows often refer to cross-border transfers or movements of money or capital connected with criminal activity. Veritas said:

The flows can be curbed, but it may be doubted if the Government has the courage and political will to do — its efforts to date have not had much success.
</blockquote>
Several studies on unlawful financial flows in Zimbabwe observed that between 2000 and 2020, Zimbabwe is estimated to have lost US$32 179 billion as a result of these transfers.
In the shorter period between 2009 and 2013, the country potentially lost an estimated US$2.83 billion.
Zimbabwe lost an estimated US$3 billion in 2019, according to <a href="https://www.pindula.co.zw/Loice_Matanda-Moyo">Loice Matanda-Moyo</a>, the chairperson of the <a href="https://www.pindula.co.zw/Zimbabwe_Anti-Corruption_Commission">Zimbabwe Anti-Corruption Commission.</a>
Unlawful financial flows from Zimbabwe accounted for 13.9% of the country’s total trade between 1980 and 2018, according to a policy brief published by the Brookings Institute.
According to evidence from research findings, there are political and economic reasons for money to flow illicitly from Zimbabwe, Veritas said.

"Zimbabwe Has Lost US$32 Billion Through Criminal Financial Flows" - Report

Zimbabwe Anti-Corruption Commission (ZACC) chairperson Justice Loice Matanda-Moyo has said the anti-graft agency will prioritise strengthening its investigations department in 2023 for prosecution and asset recovery.
Matanda-Moyo told State media in an interview that ZACC will also further decentralise its offices by establishing two new provincial centres. She said:

Zimbabweans are smuggling explosives to South Africa for use in blowing up automated teller machines (ATMs) in the neighbouring country.
This was said by Zimbabwe Anti-Corruption Commission (ZACC) chairperson Justice Loice Matanda-Moyo during a high-level National Anti-Corruption Strategy (NACS) steering committee meeting held in Harare on Thursday. She said:

Recently explosives were also smuggled from Zimbabwe to South Africa and during (a recent) meeting I was made to understand that the explosives were used to hit ATMs (automated teller machines) in South Africa. We cannot show such a lack of humanity as Zimbabweans.

Matanda-Moyo said she went to South Africa recently where she met officials from that country’s police service and the special investigations unit.
She said it was perplexing that Zimbabweans were being caught with contraband in South Africa. Said Matanda-Moyo:

How is that happening? Why are they not caught on the Zimbabwean side? We really need to introspect.

<a href="https://www.pindula.co.zw/Reward_Kangai">Reward Kangai</a>, a former chief executive officer of <a href="https://www.pindula.co.zw/NetOne_Zimbabwe">NetOne</a>, a government-owned telecommunications company, says it is public knowledge that bigwigs are involved in most of the corruption cases that have affected Zimbabwe’s economy.
He made the remarks in response to a Pindula News article in which the chairperson of the Zimbabwe Anti-corruption Commission, Justice <a href="https://www.pindula.co.zw/Loice_Matanda-Moyo">Loice Matanda-Moyo</a> bemoaned the <a href="https://zero.pindula.co.zw/zacc-losing-highly-skilled-workers-justice-matanda-moyo/">departure of skilled personnel from the commission. </a>

Ex-NetOne CEO Kangai Says "It’s An Open Secret Bigwigs Are Involved In Most Corruption Cases"

The <a href="https://www.pindula.co.zw/Zimbabwe_Anti-Corruption_Commission">Zimbabwe Anti-Corruption Commission (ZACC)</a> has been losing highly skilled workers trained in investigating cases of corruption, especially cyber crimes.
The departure of skilled officers has made it harder to track down and deal with sophisticated criminals, <a href="https://www.herald.co.zw/zacc-hit-by-resignations/">The Herald</a> reported quoting chair Justice <a href="https://www.pindula.co.zw/Loice_Matanda-Moyo">Loice Matanda-Moyo</a>.
She spoke to the publication in a wide-ranging interview on the sidelines of a ZACC strategic review workshop in Harare:

Initially, it was a skills challenge, but we then managed to recruit skilled personnel. But now it is about retaining skilled personnel, especially after training. We have been training our officers in crimes involving cyberspace.
With the advancement of technology, most of the crimes are now being committed with the use of technology so the Commission has been training officers along those lines.
After being trained they become marketable and are wanted in other sectors or countries. So this has been our major challenge of late.
We are also doing everything possible to encourage our officers to stay and we are teaching them that this is a national job. While we are advocating better salaries, we are also trying to inculcate the idea that they should also be inspired by the desire to see a better Zimbabwe.
The absence of legislation that protects whistleblowers and witnesses scares away potential witnesses or whistleblowers especially in high-profile cases where they can endanger their lives.
There are also cases of accused persons being acquitted because of witness fatigue and lack of witness protection. As you know currently we do not have a witness and whistleblower protection law in Zimbabwe. That in itself scares away possible witnesses or whistleblowers, especially in high-profile cases.

Justice Matanda-Moyo said they were in the process of enacting the Public Interest Disclosure (Protection of Whistle-blowers) Act to protect whistleblowers and witnesses.
Justice Matanda-Moyo said the catch-and-release conception of ZACC operations is also partly a product of a general or public misunderstanding of court processes.
She said when culprits are granted bail the public takes it as if they have been acquitted.

"ZACC Losing Highly Skilled Workers" - Justice Matanda-Moyo

Zimbabwe Anti-Corruption Commission (ZACC) chairperson Justice Loice Matanda-Moyo has denied that the anti-graft body has a “catch and release” culture whereby suspected criminals are arrested for show and then released to enjoy their ill-gotten riches.
Matanda-Moyo stated that ZACC’s mandate is to investigate and arrest culprits and then prepare and send dockets to the National Prosecuting Authority.
She said it is imperative for ZACC and the NPA to work together to ensure that corrupt individuals are prosecuted and punished. She said:

ZACC is mandated to investigate and arrest. We prepare dockets and hand over these to the National Prosecuting Authority.
ZACC cannot even follow the courts, whatever happens there we have no obligation to consult and it is the prerogative of the National Prosecuting Authority (NPA) to prosecute.
And we need to be acting in unison to successfully fight corruption.
</blockquote>
On Monday, economist Professor Gift Mugano said authorities should take corruption as seriously the way they are taking the anti-sanctions drive.
Speaking on one of Star FM’s current affairs programmes, Mugano said the billions of dollars lost through corruption could have been used to bust the sanctions. He said:

We don’t want to package corruption as if it is an excuse because we have sanctions, that will be wrong; that will be tragic and that is my point of departure that when we have agreed that sanctions are a real issue, but I am very concerned as an academic that Government has not taken serious steps to deal with corruption.
Do you think even if sanctions are removed today, we can be given US$3,3 billion by the IMF (International Monetary Fund) and World Bank? No.
But we could have used the resources to bust sanctions if we were very careful and very proactive in terms of corruption.

Matanda-Moyo Speaks On ZACC's Alleged "Catch And Release" Culture

Zimbabwe Anti-Corruption Commission (ZACC) chairperson Justice Loice Matanda-Moyo has accused the private sector of abetting corruption in the country.
In an interview with <a href="https://www.businessweekly.co.zw/private-sector-abetting-corruption-zacc/">Business Weekly</a> on Thursday, Matanda-Moyo insisted that the private sector is “very guilty” of corruption in Zimbabwe. She said:

What is apparent is that corruption is not only rife in the public sector, it’s also rife in the private sector because when you look at bribes, the ones who are offering bribes are from the private sector.
They also bribe the public sector, taking advantage that public service salaries are low.
You look for something which is bought in South Africa for R5, that thing is sold here in Zimbabwe for US$100 and you wonder what pricing system is being used.
When you look at that person who is selling for US$100, the person has not even declared that product to the customs, the person has not paid duty …and you go to ZIMRA (Zimbabwe Revenue Authority) again, those companies are not paying taxes.
So, the private sector is the one that is very guilty of corruption in this country.

Matanda-Moyo said there is a need for Government departments and parastatals to tighten procurement systems.
She said the Public Procurement and Disposal of Public Assets Act should be tightened.
Last month, it emerged that Parliament had approved the purchase of laptops for US$9 000 for each gadget.
The laptop tender had been awarded to Blinart Investments, a private company believed to be owned by a Harare businesswoman, Elizabeth Muchenje.
The tender was, however, revoked by Treasury.

Private Sector Very Corrupt, Says Justice Matanda-Moyo

Clement Masango, the suspended Registrar General has written a letter to The Police Anti Corruption Unit (PACU) and to the Special Anti Corruption Unit (SACU) demanding that they investigate ZACC Chairlady Justice Loice Matanda for criminal abuse of office, Newsday reports.
According to the publication, the suspended RG Masango is claiming Justice Matanda Moyo showed favouritism to a witness who is part of his case which is before the courts right now.
Masango is reportedly alleging that the investigation officer in his case Eric Chacha, Justice Matanda Moyo were unprofessional in handling his case. In a letter to PACU dated 4 March 2021 Masango said:
<blockquote>For the foregoing reasons, I submit that both the chairperson of Zacc and Eric Chacha criminally abused their duty as public officers in showing undue favour to Peter Bwanya to my detriment within the contemplation of section 174 of the Criminal Law (Codification and Reform) Act and with that, I would like to lodge an official complaint against them with your office
Having looked at the documentary evidence placed before the magistrates court against me and listened to the testimony of the attesting witnesses, I am convinced that both the investigation and the subsequent criminal charges against me are clearly a culmination of gross abuse of duty by the chairperson of Zacc as well as by Eric Chacha, the investigating officer in the matter.</blockquote>
According to the publication, Masango is stating the following:

<li>He requested Chacha to be investigated for perjury because he allegedly lied under oath</li>
<li>He requested a forensic audit from Home Affairs and Cultural Heritage ministry secretary Aaron Nhepera but it was not done</li>
<li>He complained about Chacha’s conduct to Matanda Moyo but he did not receive any response</li>
<li>Chacha reportedly arrested arrest two other workers at the Civil Registry Department Benjamin Makiwa and Arthur Mathews, forcing them to corroborate Bwanya’s allegations against him and when they refused he arrested them for theft.</li>

The suspended RG Masango was arrested <a href="https://news.pindula.co.zw/2020/05/16/registrar-general-masango-suspended/">for criminal abuse of office and prosecutors</a> are alleging that at some point he diverted government vehicles to be used at his farm allegations he is denying saying he got approval to use the vehicles.

ZACC Chair Justice Matanda Moyo Must Be Investigated - Suspended RG Masango

Zimbabwe’s Foreign Affairs and International Trade Minister, Retired Lieutenant General Sibusiso Busi Moyo has died.
Moyo succumbed to COVID-19 in Harare on Wednesday morning.
He was 61.
In a statement announcing Moyo’s death, the Acting Chief Secretary to the President and Cabinet, George Charamba described the late as a decorated soldier and freedom fighter. Said Charamba:
<blockquote>His Excellency the President, Cde E.D. Mnangagwa, regrets to announce the passing on early this morning of Dr S.B. Moyo, our Minister of Foreign Affairs and International Trade. The late Minister succumbed to Covid-I9 at a local hospital.
The Nation will be kept apprised of further developments regarding this untimely demise of the late Minister, himself a decorated soldier and freedom fighter.</blockquote>
President Emmerson Mnangagwa has expressed his grief over Moyo’s death in a statement posted on his social media channels. He wrote:
<blockquote>It is with a heavy heart that I announce Foreign Minister Dr SB Moyo has died.
Zimbabwe has lost a devoted public servant and a true hero, and I have lost a friend. He fought his entire life so that Zimbabwe could be free.
May he rest in peace.</blockquote>
Moyo who was the husband of ZACC Chairlady Justice Loice Matanda Moyo had reportedly been fighting a kidney ailment for some time.
Moyo became famous mostly for announcing the coup that toppled Robert Mugabe from power in 2017.
Moyo is the third minister to die from the respiratory illness since July last year, the other being Lands and agriculture minister Perrance Shiri, a former Air Force of Zimbabwe commander, and Ellen Gwaradzimba, who was the minister of provincial affairs for Manicaland.
Shiri died in July 2020 while Gwaradzimba died last week and is being buried at the National Heroes Acre in Harare on Thursday.

ZACC is set to arrest a former cabinet minister, a property mogul and a Minister of State for Provincial Affairs for criminal abuse of office, fraud and abuse of funds, The Sunday Mail reports

In Gweru, investigators are nearly through with a big case involving former Minister of State and a well-known property mogul. We planned to decentralise to all provinces so that we can fast-track investigations into all cases raised by the commission but we were forced to delay because of the Covid-19 pandemic.</blockquote>

Zimbabwe’s anti-graft commission said it is working on over 600 dockets of people accused of being involved in corruption Sunday News reports.
According to ZACC’s <a href="https://www.pindula.co.zw/Loice_Matanda-Moyo">Justice Loice Matanda Moyo</a> ministers, judges, MPs, company executives are part of the 600 dockets they are working on:
<blockquote>There are high profile cases which include ministers, MPs, judges, CEOs and MDs we are targeting everyone involved in corruption and we will investigate everyone. We urge all those with evidence which may lead to convictions to come forward. There should be convictions in court, but we need prosecution (NPA) to up their game.</blockquote>

ZACC Working On Over 600 Dockets For Prosecution, High Profile Cases Included

Former Vice President, Phelekezela Mphoko is a target of the Zimbabwe Anti-Corruption Commission (ZACC) after the former diplomat gave short shrift to detectives at his Douglasdale house in Bulawayo on Friday.
The detectives had been sent to question him with a view to recording a warned and cautioned statement, according to ZACC chairperson, Justice Loice Matanda Moyo.
In an interview with State media, Justice Matanda-Moyo warned Mphoko that he is not above the law. She said:
<blockquote>Yesterday (Friday), our officers visited the former VP Phelekezela Mphoko at his residence. The officers intended to question him with a view to recording a warned and cautioned statement. The matter relates to abuse of office whilst he was VP.
It is said that the former VP refused to collaborate with the enforcement officers. Unfortunately, he and those around him believe that they are above the law….no one is above the law.
We will ensure that the long arm of the law visits him in a manner that he understands and that he answers for his actions ASAP (as soon as possible).</blockquote>
Mphoko is under investigation over criminal abuse of public office. While he was still Vice President, Mphoko allegedly stormed Avondale Police Station to release former Zimbabwe National Road Administration (ZINARA) acting chief executive officer Moses Juma.
He reportedly threatened to beat junior police officers at the station if they failed to comply with his demands.
