The <a href="https://wiki.pindula.co.zw/African_National_Congress">African National Congress</a>, the ruling party in South Africa, has said the country is not pulling out of the International Criminal Court (ICC) <a href="https://zero.pindula.co.zw/south-africa-to-pull-out-of-icc-ramaphosa/">as earlier announced</a> by President Cyril Ramaphosa. 
In a statement seen by Pindula News, the party said pulling out of the International Criminal Court was discussed by the ANC’s National Executive Committee (NEC) as a last resort action, not something that was to be done immediately. Reads the statement issued a few hours after President Ramaphosa’s announcement:

<h2>CLARIFICATION OF ANC POSITION ON THE ICC</h2>
The African National Congress’s Secretary-General presented the discussions and decisions of the National Executive Committee to the public at a press conference earlier today. 25 April 2025. This presentation covered discussions and decisions of the National Executive Committee (NEC) on international relations issues including ANC’s position on the International Criminal Court (ICC).
Members of the NEC discussed the unequal and inconsistent way international law is applied and this includes the often-selective application of international criminal law by the ICC.
The NEC discussions highlighted the need to revitalize the Malabo protocol which would establish a continental criminal court that would complement the ICC as a court of last resort.
The NEC also discussed options to amend national legislation that would domesticate the Rome statute in manner reflects all the articles of the Rome Statute. This includes provision of article 98 of the statute that requires a waiver of immunities for persons charged by the ICC from third-party countries where there is no referral by the United Nations Security Council.
There are several jurisdictions across the world which were used as a benchmark for this approach for instance the United Kingdom domesticated the Rome Statute to incorporate the provisions of article 98.
The ANC’s post-NEC statement reflects the discussions of the NEC in this regard.
At the press conference, the Secretary-General provided a reflection on the NEC discussion to the extent that a withdrawal from the ICC was also raised. Importantly, it was raised as a measure of last resort that would arise if- and only if- the other options outlined above do not yield the desired results of fairness and consistency in the administration of international law.
In outlining this broad context of discussion, an unintended impression may have been created that a categorical decision for an immediate withdrawal had been taken. This is not so. We reiterate the resolution of conference remains our policy position until such a point where its implementation does not yield the required result. 
On the International Criminal Court, the NEC noted its 55th National Conference Resolution that the ANC and the South African government must rescind the withdrawal from the ICC Court and intensify its lobby for the ratification of the Malabo Protocol”.
The NEC aligns itself with a report of Amnesty Internationals Annual Report of 2022 which exposes double standards throughout the world on human rights and the failure of the international community to unite around consistently applied human rights and universal values.

ANC Says South Africa Is Not Pulling Out Of International Criminal Court

The African National Congress (ANC), the ruling party in South Africa, plans to pull out the country from the International Criminal Court (ICC).
This is the second time the ANC has attempted to do so. The decision was made after the ICC issued an arrest warrant for Russian President Vladimir Putin on March 17, accusing him of illegally deporting hundreds of children from Ukraine.
President Cyril Ramaphosa told reporters during a state visit by Finnish president Sauli Niinisto:

The governing party, the African National Congress, has taken that decision that it is prudent that South Africa should pull out of the ICC, largely because of the manner in which the ICC has been seen to be dealing with (these) type of problems.

Just two days before this announcement, South Africa’s parliament said it would stop its seven-year-long effort to withdraw from the ICC’s Rome Statute. This was because the ruling party had decided in December to stay in the ICC and work for changes from the inside, but now they have changed their mind and want to leave the ICC after all.
The international arrest warrant for Putin was issued after he had been invited to attend the BRICS summit in South Africa in August. If he comes to South Africa, he could be handed over to the ICC in The Hague.
South Africa’s official in charge of relations with BRICS countries confirmed that Putin had been invited by President Ramaphosa and Russia had indicated attendance. The Kremlin has not yet decided whether Putin will attend. If he does, it could restart the process to withdraw South Africa from the ICC, but that process takes a long time and is unlikely to be completed before the summit.
In 2016, three African countries – Burundi, the Gambia, and South Africa – announced their intention to leave the International Criminal Court (ICC), leading to concerns that more countries would follow. However, only Burundi and South Africa formally communicated their decision to withdraw. The Gambia initially said it would withdraw but changed its mind after a new government was elected. Despite the African Union’s agreement for a collective withdrawal from the ICC, no other countries have left the court. South Africa revoked its notice of withdrawal in March after being forced to do so by its own courts for not following proper legal procedures. <a href="https://www.aljazeera.com/news/2017/10/27/burundi-first-to-leave-international-criminal-court">Burundi eventually withdrew in 2017.</a>
Some African leaders, including Uganda’s Yoweri Museveni, Rwanda’s Paul Kagame, and Kenya’s Uhuru Kenyatta, have criticized the International Criminal Court (ICC), calling it a “bunch of useless people,” a tool of global power politics, and not about justice.
Many Africans feel that the ICC disproportionately targets African countries and does not respect their sovereignty. However, ICC’s former prosecutor Fatou Bensouda dismissed these criticisms, noting that most cases were initiated by the countries themselves. 
Even as the AU was reported to have adopted a mass withdrawal strategy, some countries, such as Nigeria, opposed it, particularly the idea of leaving en masse.
Critics say that Sudan and Libya were referred to the ICC by the UN Security Council, even though three of the five veto-wielding countries on the council (China, Russia, and the United States) are not ICC members. These critics argue that the Security Council was quick to indict leaders of these two countries, but efforts to refer countries like Syria have been blocked by some of these same countries.
What some countries are demanding:
As far back as 2013, Kenya wanted sitting presidents to be exempt from trial while South Africa called for presidents’ immunity from prosecution to be respected.

South Africa To Pull Out Of ICC - Ramaphosa

The government of Zimbabwe has reportedly hired a London-based lobby and public relations firm to cleanse its tarnished image.
The firm, BTP Advisers, is the fourth PR firm to be engaged by President Emmerson Mnangagwa’s administration after the government also hired United States-based Mercury International Limited, Ballard Partners and Avenue Strategies.
BTP has worked with African governments and political leaders before. It advised Rwandan President, Paul Kagame and successfully led a campaign to exonerate him from the 1994 genocide.
It also advised Kenya President, Uhuru Kenyatta and ran his PR campaign when he was facing charges from the International Criminal Court for crimes against humanity.
The development comes when Zimbabwe is working towards re-engaging the international community after two decades of isolation over alleged human rights abuses.
Some countries, particularly from the West, have urged Zimbabwe to first implement the intended socio-economic and political reforms before they re-engage.
Meanwhile, government officials have said that <a href="https://news.pindula.co.zw/2019/09/27/president-mnangagwa-is-a-genuine-committed-reformer/">Mnangagwa is committed to implementing the reforms.</a> On the other hand, political analysts and some opposition political parties have said that Mnangagwa is not doing what he is saying.

Govt Hires UK-Based Lobby & Public Relations Firm

The International Criminal Court (ICC) has confirmed the receipt of a report by “Team Pachedu” which to have president Emmerson Mnangagwa arrested over the August 1, 2018 shootings. This was revealed in an email the ICC sent to VOA Studio7.
Human rights lawyer and director of the Africa Regional Programme of the International Commission of Jurists (ICJ), Arnold Tsunga has however said that the case is likely to be thrown out since Zimbabwe is not a member of the ICC. He said that The matter can only be referred to the UN Security Council where chances of it being considered are also very slim. He said that the matter is likely not to be accepted considering that the current Zimbabwean situation is, unlike that of Sudan, in a stable state.
Studio also spoke to the Minister of Justice, Ziyambi Ziyambi who argued that the report that was sent to the ICC was a waste of time. He said that the ICC does not have jurisdiction to deal with issues to do with non-state actors unless it gets a report from the United Nations Security Council.
He described the act of sending the report to the ICC as foolish. Ziyambi also said that the move reflects that the people who sent the report do not understand how the law operates.
Meanwhile, Motlanthe led Commission has since made a report and recommendations on the matter which the government is saying it is already implementing. The findings were however made known to the public. Listen to the audio below:
