An octogenarian farmer (81) from Headlands, who accidentally shot and killed his 46-year-old biological son while chasing a troop of baboons that had invaded his maize field, has been charged with culpable homicide.
Culpable homicide refers to the unlawful act of causing the death of another person due to negligence or recklessness.
Any person who negligently causes the death of another person, either failing to realize that death may result from their conduct or realizing the risk but failing to guard against it, can be charged with culpable homicide.
Furthermore, if an accused person was defending themselves or someone else against an unlawful attack and did something essential to the crime (such as causing harm), they may still be guilty of culpable homicide if the requirements for self-defence are met, except that the means used to avert the attack were unreasonable in the circumstances.
As reported by <a href="https://www.manicapost.co.zw/dad-mistakes-son-for-baboon-fatally-shoots-him/">The Manica Post</a>, the now late Innocent Nyakurerwa was chasing a troop of baboons that had invaded their maize field when he was shot dead by his father, Isaac Nyakurerwa of Plot 20A, Fairfield Farm in Headlands.
The acting spokesperson for the Zimbabwe Republic Police (ZRP) in Manicaland province, Assistant Inspector Wiseman Chinyoka, said as Innocent was chasing the baboons, his father was not aware of his presence and using a registered Winchester rifle, he fired a single shot that hit his son on the chin and killed him on the spot.
Nyakurerwa allegedly spotted his now-deceased son’s shadow and mistook it for a baboon and only realised the fatal mistake when he screamed for help.
Assistant Inspector Chinyoka said they had initially charged Nyakurerwa with murder as defined in Section 47 of the Criminal Law (Codification and Reform) Act, Chapter 9.23.
However, after vetting the docket presented to them last week, the National Prosecuting Authority (NPA) at Rusape Magistrates’ Courts directed the police to charge Nyakurerwa with culpable homicide.
The request for remand form submitted to the prosecution by police reads in part:

On March 26, 2024, at Plot 20A, Fairfield 20 Farm in Headlands, the accused person was chasing some baboons which were approaching his maize field. He fired a shot with his rifle, a Winchester 22 to the mountain where the baboons were and he accidentally shot his biological son, Innocent Nyakurerwa, aged 46 on the chin. Innocent died on the spot. The rifle and spent cartridge were recovered from the scene.

Nyakurerwa has since been released from custody waiting to be charged with culpable homicide and is expected to appear in court soon.

New Details Emerge On Octogenarian Farmer Who Mistook His Son For A Baboon And Fatally Shot Him

An elderly woman from Headlands (name withheld) was determined to go down to the grave with US$2 000 strapped to her body after she was admitted at Rusape General Hospital’s COVID-19 isolation centre last week.
The woman, believed to have been in her 60s, later succumbed to COVID-19, prompting her relatives to beg authorities to search her body and retrieve the money before placing her corpse in a body bag.
A body bag, also known as a human remains pouch or cadaver bag, is designed to stop the spread of COVID-19.
The family members reportedly started arguing over the money once doctors had recommended the admission of the elderly woman who had tested positive to COVID-19 on Friday last week.
The woman, who was experiencing shortness of breath, is said to have refused to hand over her money to any relative due to mistrust. Manica Post was told:
<blockquote>Some relatives, including her children, requested to keep the money for her but she flatly refused. She insisted that she would keep it, even if it meant dying with it on her.
Repeated pleas from both relatives and hospital staff fell on deaf ears. She said she trusted no one among her relatives. They eventually admitted her with all her money.</blockquote>
After the admission, the woman’s relatives left the isolation centre hoping to visit her the following day, but she died that night.
The relatives reportedly pleaded with the authorities who were on night duty to suspend placing her corpse in a body bag until they could recover the money.
The US$2 000 was found and was handed over to the relatives the following day.
Efforts to get a comment from the deceased’s relatives by Manica Post were fruitless as they refused to entertain the media.
Meanwhile, Makoni District Medical Officer, Dr Tendai Nyafesa, could neither confirm nor deny the incident. He said:
<blockquote>It is something that was not brought to my attention. However, most grannies always have money on them.
Money can be retrieved, sanitised and used again; and that has to be done before the corpse is put in the body bag. Once the body is in the body bag, that is it.
If they were able to recover the money there is nothing wrong because US$2 000 is a lot of money. It can go a long way in assisting with funeral arrangements and other things.</blockquote>

ZANU PF youths in Manicaland province are planning to invade farms belonging to the ruling party’s secretary for finance Patrick Chinamasa, former secretary for administration Didymus Mutasa and former Agriculture minister Joseph Made.
The youths from Headlands, where Chinamasa and Made’s farms are located and Makoni Central, where Mutasa’s farm is situated, claim the farms are oversized and underutilised.
Chinamasa owns Tsukami Farm where only 40 hectares under tobacco is the only section that is being utilised, while Made owns Tara Farm.
Headlands MP Christopher Chingosho told The Standard that ZANU PF youths wanted to hold demonstrations against the trio but he told them to allow authorities to address their grievances. Said Chingosho:
<blockquote>I can confirm the youths here in Headlands almost two weeks ago wanted to demonstrate over the issue of allocation of land to the youths, but I told them that we need to approach the Manicaland Provincial Affairs minister Nokuthula Matsikenyeri over the matter and we have since done that.
The reason I stopped them is that I don’t want to put Headlands in the headlines, but this time I won’t stop them if their concerns are not addressed.
I am behind the youths, they need to benefit from the land.</blockquote>
Mutasa was Manicaland provincial godfather in ZANU PF politics before he was expelled from the party by the late former president Robert Mugabe for supporting then vice-president Joice Mujuru in 2015.
Made was also sidelined from the ruling party in 2017 following a military coup that ousted Mugabe and he has been in the shadows since.
Meanwhile, Made dismissed the youths’ claims that his farm is over 1 000 hectares saying there could someone using the youths to fight him.
ZANU PF has been accused of using farms repossessed from white Zimbabweans to perpetuate its patronage system.

ZANU PF Youths Plan To Seize Farms From Party Bigwigs

Mwarazi bridge links Headlands with Chendambuya, Nyanga, Mayo, Chinyudze, Rusape, and Maparudzi areas was Friday swept away leaving residents desperate.
The community has been relying on the Mwarazi bridge to access health facilities, schools, and agricultural markets mainly the Grain Marketing Board Depots.
Residents called for a speedy rehabilitation of the Mwarazi bridge as the disaster has forced them to use a detour which many said posed danger to life in the event of another heavy rain.
Transport and Infrastructural Development Minister Felix Mhona, his deputy Mike Madiro, Minister of State for Manicaland Matsikinyeri, and other senior Government officials toured the site and expressed the need for quick action.
Minister Mhona said there was a need for quick action to ensure the Mwarazi bridge is repaired early and people continue with their economic activities.
A number of bridges, roads, and other infrastructure were destroyed during the current rain season.
