A recent visit by the Energy Parliamentary Portfolio Committee to the site of the proposed US$172.8 million solar plant in Gwanda revealed that little progress has been made towards the construction of the 100-megawatt plant.
According to <a href="https://cite.org.zw/stalled-gwanda-solar-project-raises-concerns-parliamentary-visit-exposes-lack-of-progress/">CITE</a>, the site is currently overgrown with bushes and shrubs and lacks signage and proper facilities.
The wooden buildings are infested by termites, the roof titles are missing, and there is a single solar panel for security lighting.
The state of the site prompted the parliamentarians to grill Zimbabwe Power Company (ZPC) managers about the contract awarded to Intratrek Zimbabwe Pvt Ltd, led by Executive Director Wicknell Chivhayo, and its technical partner ChiNT Electric, on October 23, 2015.
The meeting between the members of the Energy Parliamentary Portfolio Committee and the ZPC representatives was held under the blazing sun due to the absence of even basic facilities.
The committee’s chairperson, Leslie Mhangwa, accused ZPC of misrepresenting the project as “a running project” and demanded to know why the contractor was not present during the visit. Said Mhangwa:

We spoke to ZESA and they made it a point that all stakeholders are here. We expected that the contractor was supposed to be here. That’s why the Members are not very happy because that was the expectation.
</blockquote>
ZESA Holdings Legal Advisor and Corporate Secretary, Tungamirai Chinhengo, said the parliamentary committee should have directly summoned the contractor using their official powers. He said:

We thought it would be important to place on record that the nature of the contract we have is an Engineering, Procurement and Construction (EPC) contract, which has two stages.
The first stage is there are certain conditions precedent that must be satisfied before the contractor can mobilise on site.
We do acknowledge and confirm that this contract is valid and in effect following the (2023) Supreme Court judgement.

Chinhengo explained that Intratrek initially moved to the site around 2016 for preliminary works. However, the contract was terminated in April 2018, with an eviction order forcing them to demobilise.
He said the Supreme Court later ruled in ZPC’s favour in December 2023, reversing an earlier High Court decision that deemed the contract invalid. Said Chinhengo:

So that explains the reason why the contractor is not on site and there are no works which are actually ongoing. So it’s a more fair, legal and contractual issue.
To facilitate remobilisation to the site, we now still need to comply with the provisions of the contract and satisfaction of the conditions thereof, which would then allow for remobilisation.

ZPC Acting Project Technical Director, Forbes Chanakira said ZPC had advanced US$5.7 million to Intratrek.
He explained that this amount breaks down as US$2.1 million for the feasibility study, US$2.8 million for other pre-commencement costs, and the remaining amount for Value Added Tax (VAT).
Chanakira revealed that Intratrek first mobilised to the site in June 2016 but did not manage to complete all the works. He said:

The EPC contract was subsequently terminated as a result of the lapse of the precedent satisfaction period. So the termination of the contract was on account of the lapse of the CP satisfaction period.
After that, a protracted legal battle with the contractor ensued, which resulted in the cancellation in 2018.
</blockquote>
Chanakira said the pre-commencement works to be done by Intratrek included the feasibility studies, project site commencement and site establishment works. He said:

Site establishment means the basic ablutions, communication network, borehole drilling and storage access, roads and ground clearance where the solar farm was going to sit.
</blockquote>
Chanakira said ground clearance was done in 2016 and because of the passage of time, shrubs have emerged, warranting another site clearance.
The site was a “very huge bush” and there were a lot of big trees that were cut, according to Chanakira. He added:

Another key pre-commencement work, which was supposed to be done is the construction of a three-phase 33 KV power line to the site.
The contractor got a quotation from the ZETDC but this work is yet to be done. The communication is also yet to be done.

Chanakira further stated that the topographical, and geotechnical surveys, including the feasibility study, were done and completed, confirming that the 100 MW capacity solar power plant is realisable on the site.

Site Of Chivayo's Gwanda Solar Project Now A "Very Huge Bush"

The Zimbabwe Power Company (ZPC) and Wicknell Chivayo’s Intratek Zimbabwe are poised to restart the 100MW Gwanda Solar Project.
The project faced setbacks due to alleged non-performance by Chivayo’s company, but recent developments have put it back on track.
ZPC’s acting managing director, Norbet Matarutse, informed the parliamentary portfolio committee on mines and energy that discussions are underway to revive the stalled Gwanda Solar Project. He said (<a href="https://www.zimlive.com/zpc-intratek-revive-abandoned-gwanda-solar-project/">via ZimLive</a>):

In 2015, Intratek Zimbabwe won a tender worth US$200 million. ZPC paid Intratek Zimbabwe US$5 million for initial tasks like site clearance and feasibility studies.
Due to delays, ZPC cancelled the contract and reported Intratek Zimbabwe and Chivayo to the police for fraud.
Later, the courts acquitted Chivayo and Intratek Zimbabwe of fraud, affirming the contract’s validity. Additionally, the court ordered ZPC to fulfil its contractual duties.
Tungamirai Chinhengo, a lawyer for ZPC told the same committee that the US$5 million paid to Intratek was for the commencement works. He added:

The parties are currently engaging each other intending to resume works at the Gwanda Solar Project.
However, I want to clarify a position which has been misinterpreted about the US$22 million damages.
The issue of damages has never been ordered by any court in respect of this. The High Court and Supreme Court never ordered anything in respect of damages to Intratek.

Chinhengo mentioned that ZPC and Intratek are currently discussing a review of the contract price. He said given the substantial reduction in global solar pricing due to technological advancements, the parties are exploring adjustments to the contract terms, considering the time that has passed since 2015.

The Supreme Court has reserved judgment in a case where the <a class="MarkdownLink_linkifiedLink__KxC9G">Zimbabwe Power Company</a> (ZPC) appealed against a <a class="MarkdownLink_linkifiedLink__KxC9G">High Court ruling</a> that found <a class="MarkdownLink_linkifiedLink__KxC9G">Wicknell Chivayo</a> not guilty of breaching <a class="MarkdownLink_linkifiedLink__KxC9G">contractual agreements</a> of the Gwanda Solar Project.
In 2013 Zimbabwe Power Company (ZPC) — a subsidiary of <a href="https://www.pindula.co.zw/Zimbabwe_Electricity_Supply_Authority_Holdings" title="Zimbabwe Electricity Supply Authority Holdings">ZESA Holdings</a>, floated a tender for the engineering, procurement, and construction (EPC) of a 1000MW Gwanda Solar Power Station Project. Chivayo’s Intratek Zimbabwe reportedly bid but lost. However, the terms of the tender were changed to allow Intratek (together with Chinese company ZTE) to be accepted and supply the solar stations.

It was alleged that the initial partners, Greenfield Solar of Germany, did not have the financing for such a project, after having been awarded the tender. They would later enter into a partnership with a Chinese company, China Electric Company, to build a now even bigger power station, said to be at the tune of US$750 million in <a href="https://www.pindula.co.zw/Gwanda" title="Gwanda">Gwanda</a>.
In 2014, Intratrek Zimbabwe partnered with Green Solar Europa to build a $350 million solar power station. However, China Jiangxi Corporation won the contract with a bid of $184 million.
ZPC demanded that Intratrek partner with Jiangxi, who had won the contract. Intratrek and ZTE then lowered their initial bid of $248 million to match Jiangxi’s price.
The State Procurement Board (SPB) later cancelled Jiangxi’s contract, alleging that they had raised their price. Intratrek was eventually awarded the contract for $202 million, although the initial reported price was $171 million, and there is no explanation for the $30 million difference or the multiple changes in the project’s cost.
Intratrek Zimbabwe won the bid for the 1000 MW Gwanda Solar Project in 2015 and received $5.6 million in advance payment for preparatory work. However, legal disputes have prevented the project from being implemented. ZPC cancelled the tender after Wicknell had allegedly failed to meet the set deadlines. He challenged and the High Court judge, Justice Priscilla Munangati-Monongwa, handed down a judgement in January 2023 declaring the <a class="MarkdownLink_linkifiedLink__KxC9G">EPC</a> contract valid and extant, which means that the contract is legally valid and binding between the parties.
The court also ordered ZPC to pay Intratrek for the work done, which amounted to US$1,191,374, and the outstanding balance of US$693,000. The High Court also gave Chivayo approval to proceed with the project.
ZPC then appealed against the High Court ruling. The case is now before the <a class="MarkdownLink_linkifiedLink__KxC9G">Supreme Court</a> for review.
This is happening when some Zimbabweans are angry with Wicknell Chivayo for importing six luxurious vehicles worth about 3.5 million dollars while the <a class="MarkdownLink_linkifiedLink__KxC9G">Gwanda Solar Project</a> has not yet started. Although Chivayo claims his success is due to his faith in God, some members of the public believe he is using stolen money. Zimbabwe is currently facing a severe power shortage due to old power generation equipment, corruption, and irregular rainfall.

Supreme Court Reserves Ruling In Chivayo, ZPC Gwanda Solar Project Case

<a href="https://www.pindula.co.zw/Wicknell_Chivayo/">Wicknell Chivayo</a> has claimed that he had been praying for over three years for six luxurious vehicles worth about 3.5 million dollars he imported recently and that his success is a result of his faith in God. In a social media post seen by Pindula News, Chivayo expressed his love for cars and apologized for any offence caused by buying so many vehicles at once. He said:

Wicknell Chivayo: I Prayed For 3 Years Before Importing $3.5m Worth Vehicles

Zimbabwean businessman <a href="https://www.pindula.co.zw/Wicknell_Chivayo">Wicknell Chivayo</a> recently purchased three luxury vehicles: a 2023 <a class="MarkdownLink_linkifiedLink__KxC9G">Maybach Benz</a> GLS600 for US$400,000, a 2023 Rolls Royce Cullinan for US$850,000, and a <a class="MarkdownLink_linkifiedLink__KxC9G">Rolls Royce Ghost</a> for US$700,000, bringing his total expenditure to US$1,950,000.
This comes amid anger from members of the public over the multi-million dollar 100MW Gwanda Solar Project which has failed to take off since 2015.
Chivayo, an ex-convict, blames his company’s failure to complete the project on a nine-year-long court battle between him and the government after power utility ZESA tried to terminate its contract with his Intratek.

2023: Chivayo won the prolonged fraud legal battle. 
The Magistrate ruled that Chivayo had not defrauded ZPC since in another case, the power company had denied complaining against Chivayo. The Magistrate added that Cabinet, the State’s highest decision-making body, ordered on  June 30, 2022, that the contract between Chivayo and ZPC is valid and must be carried out. The magistrate added that the Cabinet’s decision is public knowledge and endorses the continuation of the project.
The magistrate noted that a jointly carried out and ratified report on the pre-commencement works, evaluated on July 13, 2020, confirms that Chivayo and Intratek fulfilled their <a class="MarkdownLink_linkifiedLink__KxC9G">contractual obligations</a> and even used their own resources to complete some of the required works. The report clears them of unfounded allegations of short-changing or defrauding ZPC. The report confirmed that as of July 13, 2020, ZPC owed Intratrek US$609 693.87 for work that had been overdelivered.
The magistrate added that while the significance of the 100MW Gwanda Solar Project for Zimbabwe is crucial, given the frequent 16-hour load-shedding power shortages, the contract between Chivayo and ZPC should be the starting and ending point. The magistrate noted that Chivayo did not violate the contract as he was supposed to deliver after all payments had been done. He only got an advance, used his own money for some work and is actually owed by ZPC.

Chivayo Spent $1.95M On Three Luxury Cars

<a href="https://www.pindula.co.zw/Wicknell_Chivayo">Wicknell Chivayo</a>, a Zimbabwean businessman, is importing a Rolls Royce from London, United Kingdom amid anger from members of the public over the multi-million dollar Gwanda Solar Project which has failed to take off since 2015.
In a video circulating on social media, an Apostolic Sect preacher is heard saying he had sanctified (blessed/consecrated) Wicknell’s Rolls Royce which was due to be sent to Zimbabwe. The unidentified man also said another car was on its way. Watch the video below for more:

Chivayo Imports Rolls Royce From UK Amid Anger Over Gwanda Solar Project

Intratrek Zimbabwe Pvt Ltd managing director Wicknell Chivayo has vowed to fast-track and complete the Gwanda solar project to help alleviate the electricity crisis bedevilling the country.
The controversial Gwanda solar project had stalled for years after the Zimbabwe Power Company (ZPC), a ZESA Holdings subsidiary and Intratrek were locked in a legal wrangle over its implementation.
On 11 January 2023, the High Court ruled that the US$173 million project should go on as it is still valid.
Chivayo and his company had sued ZPC for causing malicious prosecution against them.
Intratrek had demanded US$25 million from ZPC for defamation and expenses he incurred.
But speaking after the court ruling, Chivayo said his focus was to now resume the project and complete it. He said:

We receive the High Court judgment as highly commendable as it is a vindication of the position that we have always advanced, particularly that the EPC Contract was unlawfully terminated by ZPC.
It allays the regrettable misinformation about the project and aspersions that Intratrek did not perform its contractual obligations.
We applaud our judiciary for seeing this matter for what it is, applying the law impartially to the dispute and not being swayed by the court of public opinion.
… We remain resolute to ensure that with the legal impediment removed by the courts, the solar project will be implemented expeditiously and in the national interest.

Chivayo said he was not concerned with receiving damages from ZPC but with ensuring that Zimbabwe has 100MW of clean energy. He said:

I wish to reiterate and set the record straight that we are not overly concerned with receiving damages from ZESA yet the country is reeling under prolonged hours of load shedding.
It will be a dereliction of duty as citizens of Zimbabwe to pursue a remedy that will impoverish a State utility and prejudice the generality of Zimbabweans, ourselves included.
We shall therefore prioritise and emphasize to our partners at ZESA that the demand for power be immediately resolved by allowing the project to be implemented, as opposed to payment of the damages awarded by the Courts.

Chivayo Pledges To Expedite Implementation Of Gwanda Solar Project

Intratrek Zimbabwe (Pvt) Ltd and its managing director Wicknell Chivayo have succeeded in the US$22 million damages claim for breach and repudiation of contract against Zimbabwe Power Company (ZPC), a subsidiary of ZESA Holdings, after a fully contested trial.
Intratrek had also demanded US$3 million in compensation for expenses it had incurred between 2013 and 2018 funding the project.
High Court judge Justice Siyabona Paul Musithu upheld Chivayo’s application.
The ruling was handed down Wednesday, 11 January, by Justice Priscilla Munangati-Munongwa. Reads part of the judgment:
<blockquote>
Resultantly it is ordered that: The procurement contract for the Engineering, Procurement and Construction (EPC Contract) of the 100MW Gwanda Solar Project (ZPC 304/2015) between the plaintiff and the defendant as amended is valid and binding between them.
Consequent to the declaration of the validity of the EPC Contract, an order for specific performance of the said contract is hereby granted.
The defendant’s (ZPC) claim in re-convention is hereby dismissed with costs. 
The defendant shall pay the plaintiff’s costs of suit in the claim in convention.
</blockquote>
The ruling brings to an end the legal dispute that has been between the parties since 2015.
In his ruling, Justice Musithu said the contractor won the project in an open tender having gone through a fair and thorough process sanctioned by the then State Procurement Board.
The agreement between ZPC and Intratrek was signed subsequent to a successful tender bid, for the engineering, procurement, and construction of a 1 000MW Gwanda Solar Power Station Project.
Intratrek was awarded as the lowest compliant bidder to specification out of 6 bidders at a cost of US$173 million.
In his judgement, the judge criticised ZPC for trying to torment its legal contractor who won the project in an open tender. He said:

The plaintiff maintained that it was required under the contract to secure funding for the entire project through a debt financing arrangement.
The plaintiff was expected to engage in a robust and expensive process of engaging international banks and project financial institutions. It incurred expenses in the sum of US$3 000 000 from 2013 to 2018.
Further, the contract itself was of significant value and if it was to be implemented, the plaintiff expected to realise a return on investment of US$22 000 000.
As a result of the breach, the plaintiff had therefore suffered a loss of profit.

Chivayo Wins US$22 Million Damages Against ZPC, Gwanda Solar Project Reinstated

Businessman and socialite, <a href="https://www.pindula.co.zw/Wicknell_Chivayo">Wicknell Chivayo</a>, has told the High Court that his arrest on allegations of defrauding the Zimbabwe Power Company (ZPC) had tarnished his integrity to an extent that it was now difficult to get any lucrative contracts.
He was testifying in a case where he is suing ZPC for US$22 million for defamation, and for breaching the solar project deal, which he argues was still valid.
Chivayo said his company, Intratrek Zimbabwe, has lost considerable business, locally and abroad, owing to the ZPC scandal.
He said he has lost credibility with potential clients. <a href="https://www.newzimbabwe.com/chivayo-laments-impact-of-zesa-fraud-charge-i-can-no-longer-win-new-contracts-he-tells-court-as-he-sues-utility-for-us22m/">NewZimbabwe.com</a> cites Chivayo, an ex-convict, as saying:

I can no longer do any projects due to the bad publicity l have received due to the ZPC deal.
I have lost potential business in Kenya and Tanzania. l had gone there to do business and l was told l was the person who took money from ZPC and ran away. 
We visited the site together, they came back and did a report so it does not make any sense that l failed to deliver on the promises agreed on.
They have been malicious and circulating falsehoods

He further insisted that ZPC was owing Intratrek huge amounts of money from a deal they penned seven years ago.
Chivayo denies the allegations by ZPC that he took money meant for the Gwanda solar project which he reportedly failed to implement.
He says he should be given a chance to complete the project for the benefit of the country.
The trial continues Tuesday. 
<h2>Context:</h2>
ZPC paid $5.6 million to Intratrek Zimbabwe, in which Chivayo is a director, for pre-commencement works in the construction of a $200 million solar power plant in Gwanda. Chivayo failed to deliver.
The case spilt into court and in 2019 the High Court <a href="https://news.pindula.co.zw/2018/12/14/uproar-as-wicknell-chivayos-company-wins-25-million-zesa-lawsuit/">prohibited ZPC from cancelling the contract</a> and suing to recover the money paid to Chivayo’s company. The ruling left ZPC with the onus of paying him $25 million for breach of contract or allowing his company to proceed with the project.
The Supreme Court overturned the ruling.

Wicknell Chivayo Says The Gwanda Solar Project Tender Tainted His Image

A Parliament’s Public Accounts Committee meeting this morning was disrupted and prematurely ended after opposition MDC-T MP <a href="https://www.pindula.co.zw/Memory_Mbondiah">Memory Mbondiah</a> punched Norton legislator, <a href="https://www.pindula.co.zw/Temba_Mliswa">Temba Mliswa</a>, in the face.
The violent clash was over local business tycoon and ex-convict Wicknell Chivayo’s Intratrek Holdings-Zesa deal in which Chivayo was supposed to install a solar power project in Gwanda.
The Gwanda solar project has failed to take off despite ZESA’s subsidiary, ZPC, paying over US$5 million to Chivayo back in 2015.
It is alleged that Mliswa was of the view that Chivayo was not supposed to be before the Parliamentary Committee. MDC legislators intended to find out whether Chivayo had been paid in full or not and whether he was committed to fulfilling the agreement he made with the State or not.

One of the newest ministers in President Mnangagwa’s cabinet  Zhemu Soda has revealed that the government is reportedly planning to resuscitate the controversial Gwanda solar project aimed at contributing 100 MW of electricity to the national grid, The Herald reports.
Soda revealed this during an interview after he commissioned the Rural Electrification Project in Silobela when he told reporters that:
<blockquote>Government has plans to resuscitate the project following a Cabinet position on engagements between Intratek and Zesa Holdings in order to bring the gwanda Solar Project back on track.
What I can just confirm for now is that the two parties have constituted themselves into some working committees. They have set up legal, finance and technical committees that are meant to oversee the resuscitation of the programme.
The technical committee is the one that will try and find a way forward on how to pick up the project from where it had ended and give it new life</blockquote>

Government Has Plans To Resuscitate The Gwanda Solar Project - Zhemu Soda

The Procurement Regulatory Authority of Zimbabwe (PRAZ) has instructed the Zimbabwe Power Company (ZPC) the permission to address issues hindering the implementation of the Gwanda solar project.
This comes after the Zesa Holdings power generating arm lost a court case in which it sought the termination of the contract with Intratek (the company that won the tender in 2015) over delays in the imlementation.
After losing the court case, ZPC wrote to PRAZ indicating that the new contract was a bit different from the initial one signed in 2015. PRAZ responded:
<blockquote>In light of the issues raised in the aforementioned letter, please note that your entity must be guided by the provisions of the contract between the parties to the agreement in addressing issues at hand.
However, it is important to note that the applicable procurement law would be the repealed Procurement Act because that was the law that was in place at the time of contract signature.</blockquote>
PRAZ also said ZPC has tofind ways on how to proceed with the contract guided by the provisions of the Procurement Act and repealed regulations, together with terms of the contract that is still extant.
Wicknell Chivayo’s Intratek says it wants to implement the project in two phases of 10 megawatts then 90 megawatts.

PRAZ Allows Implementation Of Gwanda Solar Project

Controversial businessman and ex-convict, Wicknell Chivhayo has reportedly resumed construction at the Gwanda solar project site after a prolonged pause.
Chivhayo won the tender for the multimillion-dollar solar project in 2016 but the sight of the project site has been sickening.
The Intratek boss argues that progress was also being derailed by his arrest at the instigation of the Zimbabwe Power Company (ZPC) which had contracted him to implement the project.
The development comes after High Court judge, Tawanda Chitapi, ruled that ZPC and Chivhayo should find common ground and make sure the project is completed as it is significant to the nation.
Zim Morning Post reports that pursuant to the ruling, Chivayo dispatched construction workers on the site this week.
Observers have been grumbling over the project’s failure to take off particularly when the country has a huge power deficit.
Some suggested that Chivhayo be forced to resume operations and if he is unable to deliver his end of the bargain, he has to return the money he received for the project.

Chivhayo Resumes Construction At Gwanda Solar Project Site

Harare magistrate Mr Lazini Ncube yesterday abided by a High Court ruling when he abandoned the matter in which businessman Wicknell Chivayo was facing $5,6 million fraud charges.
The fraud charges relate to a botched Zimbabwe Power Company (ZPC) solar project. Chivayo had approached the High Court challenging the magistrates’ court decision to dismiss his application excepting him of the charges on the grounds that they did not constitute an offence. The High Court then acquitted him. Ncube said the High Court decision was self-explanatory. Said Ncube:
<blockquote>Accordingly, the exception dismissed by this court was set aside and both accused persons were found not guilty and acquitted of all the counts. This, therefore, means allegations are quashed and accused persons are free.</blockquote>

The Anti-Corruption Special Unit (ACSU) said it will launch an appeal against Wicknell Chivayo’s acquittal in the $5,6 million fraud case involving Zimbabwe Power Company (ZPC)’s Gwanda solar project.
Chivayo and his company, Intratrek, were acquitted of any criminal liability. He won his case after the High Court upheld his application for exception to the fraud charges following his application for review of the trial court’s decision in November last year.
ACSU head Mr Thabani Mpofu told The Herald yesterday that they will be challenging the High Court decision to acquit Chivayo under the circumstances of the case taking into account the relief sought by the accused and the stage it has reached, is unprecedented.

President Emmerson Mnangagwa is reported to have authorised the release of US$52 million from power utility, Zesa to controversial businessman Wicknell Chivayo. The money is part of the $140 million which will be released to Chivayo for the construction of the Gwanda Solar Power Project. The Zimbabwe Independent reports that the authorisation came after Chivayo wrote to Mnangagwa pleading for his intervention after  Zesa subsidiary, the Zimbabwe Power Company (ZPC) had refused to release the funds.
Part of the letter from Chivayo reads,
<blockquote>Your Excellency, the correct position, to allay fears and rising speculation on Intratrek/CHiNT’s capacity to implement the project, CHiNT advised ZPC on 20 April 2018 that China Exim Bank is ready and willing to issue an internationally backed advance payment bank guarantee to cover an aggregate of US$51 854 579,28 (30% of the contract value) and requested for relevant banking details in order to process the bank guarantee. This overture has been met with a deafening silence from ZPC as have many progressive advances that we have made towards resolving this.
It may be of particular importance to note that the contract value largely consists of the imports from the Chinese technical partner. Intratrek is only entitled to a small commission out of the contract value in keeping with the fair profit envisaged in ZPC’s request for proposals during the bidding of the solar tender.
…Further, the minister specifically directed ZPC to implement this funding proposal immediately. Notwithstanding Intratrek’s proposal and the minister’s strong recommendation, ZPC contemptuously refused to implement the proposed option…Had the funding been readily available through ZPC, Intratrek/CHiNT would only require 6-8 months to implement the contract and feed clean energy into the national grid.</blockquote>

The Parliamentary Portfolio Committee on Mines and Energy has recommended that the contract for the Gwanda Solar Power Project should be rescinded and that Wicknell Chivayo should pay back the money advanced to him. The committee also recommended the arrest and prosecution of all ministers involved. Said Committee chairperson, Temba Mliswa,
<blockquote>Ministers and deputy ministers named in the corrupt activities at the Gwanda Solar Project should be investigated and prosecuted, and the Zimbabwe Anti-Corruption Commission and the Zimbabwe Republic Police should conduct an investigation on the ministers implicated in the scandal… The money paid to Intratrek ($5,6 million) should be recovered after investigations are completed. The award to Intratrek needs to be rescinded in light of violations of the Companies Act and the repealed Procurement Act.</blockquote>

Wicknell Chivayo's Contract Should Be Rescinded, All Ministers Involved Should Be Prosecuted Say Parly Committee

Wicknell Chivayo’s foreign partners in the Gwanda solar project, CHiNT Electric, have been barred from accessing funds for three years by the African Development Bank Group (AfDB) due to fraudulent activities.
Representatives from CHiNT electric were expected in Zimbabwe this week to renegotiate some of the terms of the $200 million Gwanda solar project contract. In a statement, AfDB said CHiNT had engaged in numerous fraudulent activities in bidding for a number of power projects AfDB had financed. AfDB has imposed a 3 year debarment on CHiNT Electric although the period may be reduced to 24 months if the firm complies with all conditions of the agreement early.
During the debarment period, CHiNT Electric is ineligible to be awarded contracts under any AfDB financed project or to be a sub-contractor. AfDB says CHiNT Electric has worked on other projects in Zimbabwe where they misrepresented the technical specifications, value, execution period and/or the degree of completion of contracts used as credentials in order to qualify for the tenders.

Controversial businessman Wicknell Chivayo’s Chinese partners on the $200 million Gwanda Solar Power Project have been banned by the African Development Bank (AfDB). The AfDB blacklisted CHINT Electric for 3 years saying the firm lied about its experience in order to qualify for contracts.  Chivayo recently <a href="https://news.pindula.co.zw/2018/02/28/wicknells-gwanda-solar-power-project-site-despite-5-million-advance-zesa/" rel="noopener" target="_blank">came under fire because of the lack of progress on the project site</a> despite being given a<a href="https://news.pindula.co.zw/2017/11/11/minister-grilled-5-million-controversially-advanced-sir-wicknell-gwanda-solar-project/" rel="noopener" target="_blank"> US$5 million advance in irregular circumstances</a>.
In a notice, the AfDB said,
<blockquote>An investigation conducted by the bank’s office of integrity and anti-corruption established that CHINT Electric engaged in a multitude of fraudulent practices: In bidding for contracts in the context of numerous bank-financed power projects, the company misrepresented its experience with similar assignments in order to meet qualification requirements.</blockquote>
However, Chivayo dismissed the blacklisting saying,
<blockquote>CHINT is a listed company. They have $12 billion annual revenue they can’t be blacklisted nezvima bank zvakaita se (low rated banks) like AfDB. That’s a false story.</blockquote>

AfDB Blacklists Chivayo's Partners On Gwanda Project, Says They Lied About Experience To Qualify For Contracts

The Parliamentary Portfolio committee on Mines and Energy will tour the site of the proposed Gwanda Solar Plant today as legislators continue their probe into the contentious deal signed by the Zimbabwe Power Company (ZPC) and Intratrek, a company owned by Wicknell Chivayo.
The visit comes barely two weeks after Chivayo appeared before the committee where he was questioned over the $5 million he received from the ZPC for the Gwanda solar project without the requisite bank guarantee. Chairperson of the committee, Temba Mliswa said the visit was meant to enable Parliament to assess progress made on the ground in relation to the amount that Chivayo received.
During his appearance before the committee, Chivayo was also questioned over the manner in which he won the tender for the project in 2013. He admitted that he had been paid by the company without a bank guarantee and had sought assistance from former Minister of Energy and Power Development Dr Samuel Undenge after suspended ZPC managing director Noah Gwariro had refused to pay him the money without the guarantee.

Probe Into Wicknell Chivayo Deal Continues As MPs Tour Gwanda Solar Plant Site

Stanley Kazhanje the chairperson of the Zimbabwe Power Company (ZPC) is alleged to have prepared the tender documents for Wicknell Chivayo’s company without declaring a conflict of interest to the board. Chivayo’s company Intratek was later awarded the US$200 million tender by the ZPC for the Gwanda Solar Power Project. Chivayo is yet to start work on the project almost two years later despite receiving an advance of US$5 million in irregular circumstances.
The allegations against Kazhanje were levelled by ZPC managing director Noah Gwariro. Kazhanje suspended Gwariro in December 2017, over the irregular payment of the US$5 million advance to Intratek without a guarantee. However, in a letter to Kazhanje, Gwariro has challenged the suspension on the basis of the apparent conflict of interest. Part of the letter written by Gwariro’s lawyers and which was quoted by the weekly publication, the Zimbabwe Independent, reads
<blockquote>We address you at the instance of our above-mentioned client and refer to your letter dated 12 December 2017. From the instructions we have, it is apparent that you have a massive conflict of interest on account of the following factors.
Prior to your appointment a(s) ZPC Board chairman, you were contracted to Intratek through your company called Terminal Engineers (Pvt) Ltd. You even prepared the tender documents for the Gwanda Project on behalf of Intratek.
Notwithstanding the foregoing, you never declared your conflict of interest to the Board at several meetings that deliberated on the Gwanda project.
In the premises, it would be wholly inappropriate for you to be involved with ‘investigations’ into allegations of irregularities in the management of the 100MW Gwanda Solar Power Station Project. For that reason, we have advised our client that your purported suspension of him is a nullity and he will accordingly be reporting for duty.
Kazahanje did not respond to questions directed at him.</blockquote>

Chairperson Of Zimbabwe Power Company Prepared Tender Documents For Wicknell's Company To Win US$200m Project

Speaking at a Parliamentary Portfolio Committee of Mines and Energy hearing yesterday, Energy and Power Development Minister Simon Khaya Moyo said that employees from ZESA Holdings’ subsidiary Zimbabwe Power Company (ZPC) will be fired over irregular payments made to Harare businessman Wicknell Chivayo for the 100 megawatt Gwanda solar project.
Khaya Moyo said whoever is responsible will be fired after the forensic audit is completed. Said Khaya Moyo:
<blockquote>In any case, I do not think that the ZPC board can investigate itself. But Government, in any case, will act after the audit is completed. We were told of $5 million and I do not know about the $7 million. What we heard was that it was a directive from the Minister (Dr Samuel Undenge), but now ZPC is not clear on what happened and I am quite surprised. I am totally in agreement with what you are doing as a committee, grill them, but after the forensic audit, whoever is responsible heads will roll. We can even dissolve the board; I do not think it is quite fair to take action when there are these investigations. The Auditor-General will look into all these issues, including the faulty pre-paid meters that we were reading about in the newspapers.</blockquote>
ZPC has since suspended managing director Eng Noah Gwariro over the Gwanda solar deal to pave way for an audit.

ZESA Employees To Be Fired Over Wicknell Chivayo Deals

Controversial businessman, Wicknell Chivayo, may soon be facing tough times after reports that Parliament is planning to pass a motion to direct the Zimbabwe Power Company (ZPC) to cancel all energy deals awarded to the businessman’s Intratek company. The parliamentarians also want ZPC, a subsidiary of Zesa Holdings, to make the businessman pay back the US$5 million which was awarded to Chivayo in controversial circumstances after sacked former Energy Minister Samuel Undenge directed ZPC to make the payment.
If the parliamentarians are successful, Chivayo may lose out as much as US$684 million in potential revenue on the following energy tenders he had been awarded:

<li>US$200 million Gwanda Solar Project</li>
<li>US$ 73 million Harare Power Station Refurbishment</li>
<li>US$163 million Munyati Power Station Restoration</li>
<li>US$248 million Gairezi Power Project</li>
</ul>
After winning the tender to build the Gwanda solar project, Chivayo was unable to start the project despite receiving an upfront payment of US$5 million before commencing any work after instructions from Undenge. Despite receiving the money, no progress was made on the project resulting in the Zimbabwe Power Company taking over the management of the project. The ZPC later announced that the project has been contracted to another entity.
A parliamentarian who spoke to The Independent said:
<blockquote>We will summon ZPC to parliament so that the explain how they issued Chivayo the energy contracts and also urge the power company to make sure that Chivayo pays back the US$5 million.</blockquote>

Parliament To Direct Zesa To Cancel Chivayo Energy Deals, To Reclaim US$5m Advance

Deputy Minister of Energy and Power Development Tsitsi Muzenda has revealed that the country’s three major solar projects are hanging in the balance due to lack of funding. Muzenda added that people who had won the bids did not have sufficient resources to undertake the projects. The three major solar projects are Gwanda Solar Project, Munyati and Bulawayo-located Insunkamini project.
Muzenda said:
<blockquote>Most of our solar projects have been having challenges in that people bid, they are given permission to do whatever they are supposed to do, but at times those people would not be having (financial) resources.
There is Gwanda, Munyati and the other one, all those projects were supposed to be on course by now but funding has been our greatest problem.
You are aware that most of what is supposed to be used, the solar panels and so forth are imported so the capital outlay is quite massive</blockquote>
Controversial businessman Wicknell Chivayo who won the tender to build the Gwanda solar project has been unable to start the project despite receiving an upfront payment of US$5 million before commencing work at the behest of Energy minister Samuel Undenge. Speaking of Wicknell’s Gwanda Project, Muzenda said that Wicknell’s partners are yet to release the funds as they were unhappy with the businessman’s company Intratek. Said Chivhayo
