Four thousand (4 000) Whitecliff residents, mostly civil servants illegally settled at the private farm in Harare in 2006 are set to be evicted after the Government failed to honour its promise to pay US$44 million to the property owner.
The evictions are to take place by April 2024.
Speaking in an exclusive interview with <a href="https://masvingomirror.com/4000-civil-servants-to-be-evicted-from-whitecliff/">The Mirror</a>, the owner of the 1 065.7 hectare farm, Edward Nyanyiwa Pfugari (Junior) said there is no going back on the evictions.
The farm was compulsorily acquired by the Government in 2006 and subdivided and distributed for free among 4 000 civil servants and other people by the then Minister of Local Government, Public Works and National Housing Ignatius Chombo.
Eddies Pfugari Properties contested the compulsory acquisition in the High Court and Supreme Court and won back the farm.
The company then obtained an eviction order for the 4 000 illegal settlers from the Supreme Court but the Government offered to pay Pfugari US$44 million for the property so that the residents would not be evicted.
Beneficiaries have hitherto been told that the land belongs to the Government and their tenure is secure.
However, some residents who tried to get title deeds for the stands from the Ministry of Local Government were told that the titles could only be obtained from Pfugari who is the legitimate owner of the land.
The eviction order given by Justice David Mangota is against the Minister of Lands and Rural Resettlement and all parties claiming occupation through him. Part of the eviction order reads:

Now therefore, you are required and directed to eject the said Minister of Lands and Rural Resettlement and or all persons claiming occupation through him, their goods and possession, from and out of occupation and possession whatsoever of the said premises, and to leave the same to the end that the said Pfugari Properties may peacefully enter into and possess the same.

Pfugari told The Mirror that the decision to carry out the evictions followed numerous false promises by the Government to compensate him for his land. He said:

We agreed with the Government in 2019 for a settlement of US$44 million so that it could take the farm and secure the tenure of the civil servants. However, we have been waiting for years for the payment but nothing is coming.
When we put pressure to get the money last year, the Government offered a downpayment of US$21 million but turned around and said they could only pay US$2 million which is a slap in the face.
Our board of directors for Eddies Pfugari Properties therefore resolved that we immediately evict the illegal settlers and retain our land and this we will do in the next few weeks.
The court order from Justice Mangota is clear about this and the Sheriff will use the Police to effect the eviction.

Some residents have formed the Whitecliff South Residents Association (WSRA) and approached Pfugari Properties with an offer to pay for their stands.
WSRA chairman Maxwel Gwatire confirmed to The Mirror the formation of the association and said engaging Pfugari is the right and legal thing to do. Said Gwatirere:

We went to the Ministry of Local Government and were told by various senior officials including Engineer Nhoro in no uncertain terms that the land belongs to Pfugari and not the Government. They told us that we could only get the title deeds to the stands from Pfugari.
We have since sent emissaries to Pfugari in a bid to avert evictions and we understand he is willing to sell the land to us at US$5 per square metre and those with 300 m stands will pay US$1 500.
We have been lied to for 19 years that this is Government land. The problem is that the issue is being politicised for votes.
Politicians lie to residents that the Government will ultimately give them the stands for free; it’s a lie.
Minister Ziyambi Ziyambi was telling residents recently that the Government will give Pfugari another piece of land somewhere and settle the matter. This again is a lie.

Gwatirere said WSRA already has 800 members and on Monday they are meeting Pfugari over the pending evictions in a bid to make a private settlement.

4 000 Civil Servants Set To be Evicted From Whitecliff

Leading property developer Eddie Pfugari Properties has been dragged to court by Knowe Residents Trust and Rate Payers Association for breach of contract. 
The bone of concentration between the two parties is that Pfugari Properties, as the developer,  did not fulfill their contractual obligation of Knowe, tarred roads, tap water, street lighting and storm way drainage for the suburb.
Pfugari Properties is yet to be given a certificate of compliance by the Norton Town Council due to its failure to provide the aforementioned.  
The matter is currently at the High Court of Zimbabwe.  
An official from Knowe Residents Trust and Rate Payers Association who spoke on condition of anonymity confirmed that they engaged Pfugari Properties before taking the  matter to court. He said:

Knowe residents engaged Eddies Pfugari before we took the company to court. Pfugari was not cooperative to the issues raised by the Knowe residents until we had no option but to engage the courts for assistance.
</blockquote>
When contacted for a comment, Pfugari Properties Operations Manager Julius Muzuva said he could comment on a matter which is handled by the courts.

Pfugari Properties Dragged To Court For Breach Of Contract

People who settled in Whitecliff, Harare illegally on land that belongs to a property developer have pleaded with the Government to honour its pledge to compensate the developer and save their homes from demolition.
The residents were settled on land owned by Eddies Pfugari Properties (Pfugari) over a decade ago with the government’s blessing.
In 2017, Pfugari obtained a High Court order to evict the settlers but the Government quickly moved in and promised to compensate the company.
Four years down the line, the Government is yet to honour its pledge, prompting the company to write to the police through its lawyers seeking an escort for the deputy sheriff to evict the residents.
A local councillor, Luckson Maronga, told NewZimbabwe.com that the residents expect the Government to honour its commitment as they are on the verge of being evicted. Said Maronga:

There might be a misunderstanding between the government and Pfugari Properties. Government is the one that is negotiating on behalf of the people.
As local leadership, we can not blame Pfugari because it’s their land. There is no land for free in Zimbabwe.
Government is the one that settled people here, so Pfugari is right to say the authorities should bill their people.
Some of the people have already built properties; they want to safeguard their assets.
People are ready to pay but Pfugari is saying the government is the one that settled people here and should collect money from the people.

A resident, Maxwell Goche (71), said he has no other place to go to and the constant fear of being evicted is depressing.
Goche is one of the people who were settled by the Government in 2005 through the much-hyped Garikai/Hlalani Kuhle program.
Another resident, Charity Mudzi (45), said the Government should pay the company and then residents will negotiate terms of payment with the former as they won’t be able to meet the demands of the company.

Whitecliff Residents Plead With Govt To Pay Pfugari Properties As Demolitions Loom

Hundreds of families illegally settled in Whitecliff, Harare, risk eviction after the Government reneged on compensating the property developer as it had earlier undertaken to do.
The developer, Eddies Pfugari Properties (Pfugari), obtained an eviction order at the High Court a few years ago.
However, the Government, through the Local Government Ministry, prevented the execution of the eviction order after committing to paying for the land, which the residents illegally occupied 10 years ago.
Negotiations between the company and government, which have been going on for about five months now, have stalled after the latter became unyielding.
This has forced Pfugari’s lawyers to write to the Zimbabwe Republic Police (ZRP) asking for an escort as it moves to implement the eviction order as required at law.
A letter written by Pfugari’s lawyers, Scanlen and Holderness addressed to the officer commanding police in Harare province, dated November 18 and obtained by NewZimbabwe.com from police sources reads in part:

Our client obtained an order for the eviction of the respondent and all persons claiming through him from its property at Whitecliff, Harare. This order has to be enforced by the Sheriff.
As you are aware, there is a court judgment in case no. HC4012/17 compelling the police to provide the sheriff with escort services for purposes of maintaining law and order while the eviction is being conducted.
It would unnecessarily tarnish the image of the police if our client is left with no option but to apply a contempt of court order against your good offices.
We, therefore, request that you kindly provide a date when you will be able to provide the sheriff with police escort.
We would be grateful if you could confirm a date within seven days of the date of this letter.
</blockquote>
NewZimbabwe.com reported sources as saying the ZRP has dispatched senior police officers, who were accompanied by intelligence people to Pfugari’s offices to ascertain the size of the land where evictions will take place.
The ZRP is expected to deploy officers to Whitecliff to effect the evictions “soon.”
