Vangelis Peter Haritatos has hit back at lawyer Doug Coltart for alleging that he had abused his authority by parking his vehicle in a bay reserved for Persons with Disabilities.
Posting on X on Friday, Coltart posted a picture showing that Hariratos, who is the Deputy Minister for Lands, Agriculture, Water, Climate and Rural Resettlement and Muzvezve MP, had parked in a bay reserved for Persons with Disabilities at Kensington Shops in Harare. Said Coltart:

Please, sir, kindly respect the rights and needs of our fellow citizens who really need those bays.
</blockquote>
Coltart said as a public figure, Haritatos had to respect the rights of people with disabilities.
<blockquote>
He is a public figure who was elected to represent the interests and rights of all Zimbabweans. We all have a responsibility to hold accountable those who disrespect the rights of persons with disabilities, especially those in authority…
If [Haritatos] does have a disability, he should get a disability sticker for his vehicle. This helps to ensure accountability that those bays are protected for their purpose – to serve those who need them most, being persons with disabilities.

In response, Haritatos accused Coltart of politicising “a serious family emergency” saying he had ferried his unwell 86-year-old aunt to buy medication from a pharmacy located at the shops.
Haritatos further stated that it was the parking attendant who had voluntarily decided to open the parking bay for him.
The ZANU PF MP told Coltart “I do not know anything about you” and asked the lawyer to remember his family in his prayers, adding “One day I will reciprocate should you need prayers for a family member who is critical.” Wrote Haritatos:

It is regrettable how polarized you are and how you want a serious family emergency to be used for political gain, however, you asked me to respond so I will avoid undue misunderstanding.
The parking attendant on seeing who my passenger was, decided to open the parking bay, not at all on my request.
My passenger was my 86-year-old aunt who we had rushed to an ER and had just been discharged.
Seeing that she remained unwell, on the opinion of our family doctor, I rushed her to Kensington Pharmacy to take some medication that we would later learn would save her life.
My aunt unfortunately could not make it in as she was unable to walk due to the excruciating pain so I decided to get her the medication instead.
Within an hour of taking the medication, I rushed her to another hospital where she was this time hospitalized because they suspected that she had a heart attack earlier on.
Her oxygen was 81% and her heart rate was as low as 38 and dropping. Next time ask your source to send you the picture of my 86-year-old passenger who could have died if we had not gotten her this life-saving medication.
Sadly, she is still very unwell and remains hospitalized. Being my only blood family member left outside of my children in Zimbabwe, she remains a priority in my life.
I do not know anything about you and have no idea if you believe in God or not, but if you do, I would appreciate your prayers for her recovery.
One day I will reciprocate should you need prayers for a family member who is critical.

Meanwhile, an X user, while wishing Haritatos’ aunt a speedy recovery, said “Old age is not a disability Hon. In other countries, you could have been fined all the same.”

Haritatos Slams Coltart In Row Over Reserved Parking Bay

Award-winning filmmaker Hopewell Chin’ono has shed more light on the “arrest” of top human right lawyer Douglas Coltart at the Harare Magistrates’ Court on Friday afternoon.
Coltart was picked up by detectives as he stepped out of the court building and taken to Harare Central Police Station for an “interview”.
He had gone to represent his client Chin’ono who is facing charges of defeating the course of justice. 
Posting on Twitter this Saturday, Chin’ono said Coltart was only released last night after 9 PM and was expected to be back at the police station by 8 AM today. Wrote Chin’ono:

Doug Coltart was asked to come to Harare Central Police by a team of detectives around midday yesterday. He had been in court representing me.
The detectives said that they only needed him for 15 minutes to clarify certain facts in a commercial deal involving his client.
He went to the police station with them because they had said if he resisted, they would arrest him.
He was only released last night after 9 PM because the police accusations from the complainant kept being disproved with documents brought by Doug’s boss, Beatrice Mtetwa.
Doug Coltart was asked to come back to the police station today at 8 AM so they can go to court.
Doug’s boss Beatrice Mtetwa said it is an abuse of the police service when connected people can get lawyers arrested because they can. Doug said the accusations are a pack of lies.
Doug’s role in all this was as a lawyer who was representing a client who supposedly did a business deal with the person who now got Doug Coltart arrested.
Doug is on his way back to the police station as agreed last night so that they can go to the magistrates’ court.

"Doug Coltart's Arrest An Abuse Of The Police Service"

Human Rights lawyer, Douglas Coltart, was arrested by police in Harare on Friday.
According to one of his lawyers Chris Mhike, Coltart is facing fraud charges police have yet to clarify.
He was arrested at the Harare Magistrates’ Court on Friday afternoon as he walked out of the court building.
Coltart had gone to represent his client, Hopewell Chin’ono, a freelance journalist who is facing charges of defeating the course of justice. Mhike confirmed Coltart’s arrest. He said:

Yes, he has been arrested and is being charged with fraud.
It is not yet clear where and how the charges against him (Coltart) arose and we are expecting to have finer details tomorrow.

Coltart spent the rest of Friday afternoon at Harare Central Police station but was later released into the custody of his lawyers awaiting a court appearance this Saturday.

Human Rights Lawyer Douglas Coltart Arrested

Citizens Coalition for Change (CCC) activist, Godfrey Karembera, popularly known as Madzibaba Veshanduko, who last week arrested and tortured by the police has challenged his placement on remand arguing that he was held beyond the lawful 48-hour detention period.
His lawyer Doug Coltart said Karembera was arrested on Thursday 08:30 am and only attended to on Saturday at 1400 hours.
Karembera also told Harare magistrate Barbra Mateko that he was unlawfully arrested.
The State alleged he tried to deface the popular Mbuya Nehanda statue but through his lawyer, Karembera denied the allegations stating that police spokesman Paul Nyathi lied. He allegedly said:

Mapurisa makamama, makajaira kushandiswa nana Chiwenga, muri imbwa dzevanhu, munoita semunotambiriswa goridhe sei.
Loosely translated, it means: “You police officers are useless, and you are being used by (Vice President Constantino) Chiwenga. You are dogs. Why do you behave like you earn your salaries in sacks of gold?

Those allegations were not included in the court papers. Coltart said:

Nyathi is quoted saying the accused person was arrested for attempting to deface Mbuya Nehanda statue. There was no allegations relating to that on the court papers and it is common cause that the accused was more than 300 meters away from the Mbuya Nehanda statue. Nyathi lied and we don’t know where he got that from. He wanted to create his own narrative after the abuse of the CCC activist.

Karembera is being accused of undermining the authority of the police by insulting them.
Coltart presented evidence from doctor Jonathan Fernandes who examined Karembera at the Harare Central Police Station and he said he found Karembera with fresh bruises and scratches of beatings.
Fernandes said Karembera was struggling to walk due to the wounds on his feet, had a swollen eye and was unable to sit.
Coltart identified the lead attacker as one Constable Manyeruke.
He also said Karembera was never asked to sign the warned and cautioned statement which was only given to the lawyer in court.
Magistrate Barbara Mateko postponed the matter to Tuesday.

CCC Activist Madzibaba Veshanduko Challenges "Unlawful Arrest And Remand"

Human rights lawyer, Doug Coltart on Saturday reported that he had received an abduction alert from the family of former soldier Solomon Chanengeta.
He said the family reported that the former military man had been taken by six men at around 10 pm and they did not know where he was. 
Coltart was later told that the family had been informed that Solomon had been taken to the Karoi police station. Pindula News present Coltart’s series of Twitter messages he posted since Saturday.

I’m informed by the family of SOLOMON CHANENGETA that he was abducted by 6 men in plainclothes claiming to be soldiers from 451 Muzaradope Street, Karoi at about 10 pm this evening &amp; driven away in a Honda Fit. If anyone has information please contact +2778 1769063.
UPDATE from Solomon Chanengeta’s brother: “Your message worked. We found him at the police station. After your tweet, they took him to the station. I’m advised he was questioned about his leaving the military &amp; is still in custody at Karoi police station; no charges yet.
Another UPDATE from Solomon’s brother: “The police say it’s not in their hands now. Waiting for the people that dropped him off and they cannot provide their names to us. All they can say is that they are soldiers and they will come and fetch him.” Still no charges.

Responding to the allegations of abductions, the Secretary of Information, Publicity and Broadcasting Services, Nick Mangwana said the timing of the alleged kidnappings had a pattern. He tweeted:

The opposition and human rights defenders are convinced that the state is conducting the alleged abductions to intimidate government critics.
In 2020 scores of human rights activists and opposition members, including MDC Alliance trio – Joana Mamombe, Cecilia Chimbiri and Netsai Marova – reported that they had been abducted by suspected state security agents.
The government denies the allegations saying the alleged abductions were stage-managed to soil the image of the government.

Family Claims Former Soldier Solomon Chanengeta Was Abducted

Two Zimbabwe National Students Union (ZINASU) leaders who were arrested for disorderly conduct by police in Harare on Friday have been freed.
ZINASU Gender Secretary Nancy Njenge and Women’s University in Africa SRC president Paidamoyo Masaraure were arrested yesterday for allegedly shouting at some police officers who were arresting vendors and touts in Harare and taken to the Harare Central Police Station.
According to their lawyers, the Zimbabwe Lawyers for Human Rights (ZLHR), Njenge and Masaraure were initially accused of inciting public violence and undermining police authority but the police later changed the charge to disorderly conduct.
They were taken to the Harare Magistrates Court for an initial remand appearance on Saturday afternoon.
Meanwhile, the two students activists have been released into the custody of their lawyer Douglas Coltart of the Zimbabwe Lawyers for Human Rights.
Police advised that they will proceed by issuing summons against them if they intend to have them prosecuted.

Student Leaders Arrested For 'Shouting At Police Officers' Freed

A Zimbabwean lawyer, Doug Coltart, has claimed that it would take centuries for teachers to earn money equivalent to what was looted by president Mnangagwa’s spokesperson, George Charamba.
Coltart who is the son of the former Minister of Primary and Secondary Education during the Government of National Unity, David Coltart was basing his argument on a 2015 <a href="https://www.theindependent.co.zw/2015/10/16/george-charamba-pockets-us228-000/" rel="noopener noreferrer" target="_blank">article by Zimbabwe Independent which claimed that Charamba pocketed US$228 000 from PSMAS between 2009 and 2013 in board fees and allowances.</a>
The Premier Service Medical Aid Society group salary gate scandal also resulted in Cuthbert Dube then group’s chief executive officer who reportedly earned half a million dollars every month, forced to retire.
Posting on Twitter, Coltart said:
<blockquote>At their current salary of US$35 per month, it would take a Zimbabwean teacher 542 years to earn the same amount of money that George Charamba looted from PSMAS (US$228,000). Yes, you read that right: 542 YEARS!! He speaks then teachers have boycotted classes since the reopening of schools on 28 September demanding the restoration of their 2018 salaries.
Teachers and other workers across sectors claim incapacitation as a result of poor salaries amid soaring inflation which has continuously eroded their salaries since 24 months ago.
The government claims it is committed to addressing workers’ grievances but expect them to <a href="https://news.pindula.co.zw/2020/10/06/be-realistic-government-tells-striking-teachers/" rel="noopener noreferrer" target="_blank">be realistic.</a>
Meanwhile, workers refute the of the government’s commitment saying authorities are prioritising other issues like luxurious vehicles for political elites at their expense.

Coltart: Teachers Need Centuries To Earn Money Equal To Charamba's Loot

Freelance journalist Hopewell Chin’ono was made to appear before Magistrate Ngoni Nduna at the Harare Magistrates Court on Tuesday against the advice of his doctor.
Speaking to reporters, one of Chin’ono’s lawyers, Douglas Coltart, revealed that the journalist’s doctor on Monday told the Zimbabwe Prisons Security (ZPS) his client was seriously ill and showing symptoms of COVID-19.
Coltart further revealed that the state has been told to make sure that a trial date should be there by September 14 otherwise Chin’ono would apply against being put on remand for too long. Said Coltart:
<blockquote>Hopewell had been brought to Court against the advice of his doctor who spoke with the prison authorities yesterday given his condition and symptoms he was showing that it was ill advisable for him to attend court today.
That advice was not adhered to when Hopewell was brought to court against his will.</blockquote>
Chin’ono was arrested on July 20 and charged for allegedly inciting violence in connection with 31st July protests.
Magistrate Nduna postponed Chin’ono’s bail application hearing to 14 September.

Unwell Chin'ono Dragged To Court Against Doctor's Advice

Doug Coltart who is with the Zimbabwe Lawyers for Human Rights has said police have invaded the house of award-winning journalist Hopewell Chi’ono where they were intending to take his documentary filming equipment.
The development follows Chin’ono’s arrest on Monday morning and charged with incitement to participate in public violence.
Coltart posted on social media:
<blockquote>At Hopewell’s house right now where the police are conducting an illegal raid with no search warrant. They are trying to take his documentary filmmaking equipment worth US$100,000 which has nothing to do with the charge against him. This is about crippling him as a journalist.</blockquote>
Chin’ono’s arrest came after his formidable fight against corruption in the country which exposed underhand dealings by some government officials including the ousted Minister of Health and Child Care, Dr Obadiah Moyo.
His arrest was preceded by threats by the members of the ruling ZANU PF including the minister of Home Affairs, Kazembe Kazembe.

Police Invade Chin'ono's House, Trying To Take His Filming Equipment - Lawyer

<blockquote>Trade unionist Moreblessing Nyambara has been beaten up by 6 men including a soldier in uniform for posting this powerful video [see the video at the end of the article] in which she speaks out against the torture &amp; sexual violence.
This is the THIRD incident I know of in the past month where State agents have specifically targeted WOMEN: following the assault of Nokuthula and Ntombizodwa Mpofu by police officers in Bulawayo and the abduction, torture and sexual assault of Joannah, Netsai and Cecilia last week.
Moreblessing is a Mathematics teacher and a firebrand trade unionist holding a senior office in ARTUZ. She was herself abducted and tortured on 8th September 2018. In her video posted last week, she calls on women to stand up and fight against gender-based violence.
On Saturday night, she went to the Mverechena Shopping Centre in Domboshava as she had heard there was the partisan distribution of food aid happening under cover of night. She joined the line to get mealie meal, got her number, and returned to her vehicle to wait her turn.
While seated in her car, Moreblessing was confronted by a soldier in uniform together with 5 other men. The soldier accused her of being there to expose the partisan distribution of food. He said he knew who she was and had seen her video about the violence against women.
The soldier got aggressive, angrily shouting at her:
“You are inciting women to turn against the government. You want the country to be controlled by zvimbwido”.
(Note: “Zvimbwido” refers to female combatants who assisted guerillas during the liberation struggle.)
When Moreblessing tried to respond, the uniformed soldier and the 5 men in suits dragged her out of her car and severely assaulted her. She suffered injuries to her wrist and legs. They destroyed her spectacles and damaged one of her teeth which is still loose.
The sexist and disparaging reference to “zvimbwido” downplaying the immense contribution of women to the liberation struggle and implying women have no right to lead the country, underlies the deeply patriarchal nature of Zimbabwe’s oppressive military regime.
The series of incidents shows a clear trend: WOMEN are being TARGETED by the regime. This abhorrent tactic of state-sanctioned gender-based violence in Zimbabwe has long been documented and exposed by groups such as @RAUZW.

Women, please heed Moreblessing’s call to stand with your fellow women.
Men, (as the primary perpetrators of GBV) we must all stand up and say: NO!

A member of the <a href="https://www.pindula.co.zw/Zimbabwe_Lawyers_for_Human_Rights" rel="noopener noreferrer" target="_blank">Zimbabwe Lawyers for Human Rights (ZLHR)</a> <a href="https://www.pindula.co.zw/Doug_Coltart" rel="noopener noreferrer" target="_blank">Douglas Coltart</a> said President Emmerson Mnangagwa’s administration’s heavy-handedness when dealing with its critics indicates that it is clues and bereft of ideas on how to solve the crises bedevilling the country.
Coltart also called for genuine and inclusive dialogue that goes beyond political parties and embraces all stakeholders. He said:
<blockquote>The regime feels threatened and is in a corner. They have no clue how to get the country out of the crisis, so you end up lashing out at anyone and everyone. They should take responsibility and sort the crisis.
… we do need dialogue, we need genuine and inclusive dialogue beyond just political parties but that includes citizens, trade unions and other stakeholders.
The reality is that the regime is not genuine about dialogue, so as a first step, we need to acknowledge that all of us have a role to play and we need to figure out what that role is.</blockquote>
Coltart has recently been on the receiving end of police brutality. He was assaulted while representing a client, Amalgamated Rural Teachers’ Union of Zimbabwe (ARTUZ) president <a href="https://www.pindula.co.zw/Obert_Masaraure" rel="noopener noreferrer" target="_blank">Obert Masaraure</a>.
The young lawyer, who is Caucasian, was labelled a racist by MDC-T vice president Obert Gutu and accused by government officials of bribing doctors to remain on strike.

'The Regime Is Clueless, It Ends Up Lashing Out At Anyone & Everyone', - Coltart

Human rights lawyer <a href="https://www.pindula.co.zw/Doug_Coltart" rel="noopener noreferrer" target="_blank">Douglas Coltart</a> has remained indefatigable under constant vitriol directed towards him by government apologists and trolls on social media (varakashi).
In an interview with The Standard, Coltart vowed to remain steadfast in fighting for justice on behalf of the downtrodden. He said:

The young lawyer has not only been attacked by “ghost” trolls on social media but prominent government officials and opposition politicians have joined the bandwagon in maligning his person.
President Emmerson Mnangagwa’s spokesperson <a href="https://www.pindula.co.zw/George_Charamba" rel="noopener noreferrer" target="_blank">George Charamba</a>, who uses the @jamwanda handle on Twitter has attacked Coltart, so has MDC-T vice president Obert Gutu who went as far as playing the race card.
Deputy Defence Minister <a href="https://www.pindula.co.zw/Victor_Matemadanda" rel="noopener noreferrer" target="_blank">Victor Matemadanda</a> recently accused Coltart of influencing the country’s incapacitated doctors to stay away from work.

<blockquote>The <a href="https://www.pindula.co.zw/Law_Society_of_Zimbabwe" rel="noopener noreferrer" target="_blank">Law Society of Zimbabwe</a> is greatly concerned by the allegations of police brutality committed on one of its members, Mr Douglas Coltart whilst he was in the course of executing his duties as a legal practitioner.
The Law Society is equally concerned that Lawyers seeking to represent their client were obstructed by the Zimbabwe Republic Police Officers.
The Council contacted the members and they indeed confirmed that they were denied access to their client whilst <a href="https://www.pindula.co.zw/Doug_Coltart" rel="noopener noreferrer" target="_blank">Doug Coltart</a> was assaulted by officers of the Zimbabwe Republic Police whilst visiting his client. Written accounts in this regard have been received by the LSZ.
The Law Society takes a dim view of the issues raised in the written accounts. The Law society condemns police brutality in whatever form. We reiterate once again that the Constitution provides for the right to personal security.
Every person has a right to freedom from all forms of violence from public or private sources. The state is obligated to provide the security and not to breach the right.
The Law Society of Zimbabwe further reiterates the constitutionally enshrined right to legal representation. In addition to the constitutional provisions, the High Court has declared the right of lawyers to carry out their work without hindrance.
The declaratur reiterates the internationally held principle that a lawyer has the right to exercise his profession unhindered and without being associated with the cause of his client. The acts by the police are in contempt of that standing declaratory order.
The LSZ accordingly calls upon the members of the <a href="https://www.pindula.co.zw/Zimbabwe_Republic_Police" rel="noopener noreferrer" target="_blank">Zimbabwe Republic Police</a> to;</blockquote>

<blockquote>Conduct themselves with the utmost respect for all the fundamental rights and freedoms guaranteed in the Constitution and all the international instruments to which Zimbabwe is a state party.</blockquote>

ZLHR CONDEMNS ASSAULT OF HUMAN RIGHTS LAWYER 
<a href="https://www.pindula.co.zw/Zimbabwe_Lawyers_for_Human_Rights" rel="noopener noreferrer" target="_blank">ZIMBABWE Lawyers for Human Rights (ZLHR)</a> strongly condemns the despicable conduct of some Zimbabwe Republic Police (ZRP) officers, who physically assaulted human rights lawyer <a href="https://www.pindula.co.zw/Doug_Coltart" rel="noopener noreferrer" target="_blank">Douglas Coltart</a> on Saturday 23 November 2019 while discharging his professional duties.
Coltart, a member of ZLHR, was assaulted at Harare Central Police Station by some unidentified police officers after he had attended to offer emergency legal and other attendant support services to <a href="https://www.pindula.co.zw/Obert_Masaraure" rel="noopener noreferrer" target="_blank">Obert Masaraure</a>, the President of Amalgamated Rural Teachers Union of Zimbabwe (ARTUZ), who had been arrested on Saturday 23 November 2019 by some ZRP officers and charged with disorderly conduct.
The attack on Coltart is in itself alarming in that it comes three months after some ZRP officers assaulted the same human rights lawyer while executing his professional duties of representing some ARTUZ members, who had been arrested while intending to hand over a petition to Finance and Economic Development Minister Mthuli Ncube’s Office in Harare demanding improved remuneration and favourable working conditions for teachers.
ZLHR strongly condemns the brutal actions of the police. Such conduct puts the integrity and independence of the legal profession at critical risk.
The physical assault of a lawyer while carrying out his professional duties is a clear sign of the police’s outright disregard for constitutional protections and regional and international human rights standards which oblige all state actors to ensure that lawyers are able to carry out their duties without fear or favour and enjoy the same fundamental rights and freedoms as other people of Zimbabwe.
The assault on Coltart is in violation of section 219 of the Constitution which mandates the Police Service to protect and secure the lives of people and also violates section 208 of the Constitution which prohibit police officers from violating the fundamental rights or freedoms of people.
The ZRP officers’ callous actions also contravene Zimbabwe’s obligations under regional and international law. The United Nations (UN) Basic Principles on the Role of Lawyers and the UN Declaration on Human Rights Defenders, provide that lawyers and human rights defenders must be able to carry out their professional functions and work without hindrance, harassment, intimidation or improper interference.
The UN Basic Principles on the Role of Lawyers require adequate protection of lawyers if their security is threatened when carrying out their legitimate professional duties and not to be identified with their clients or their clients’ cause 
ZLHR calls upon the government to:
<ul>
<li>Guarantee Coltart’s safety and physical integrity and to ensure that legal practitioners are able to carry out their work free of fear, harassment or intimidation and to adequately protect the safety and independence of all lawyers and end the culture of impunity.</li>
<li>Promptly and thoroughly investigate the assault of Coltart with the aim of identifying those responsible and holding perpetrators accountable in order to serve justice and to prevent reoccurrence of violations.</li>
<li>Fully comply with and create awareness about the core values underlying the legal profession, amongst others by bringing the UN Basic Principles on the Role of Lawyers to the attention of ZRP and other relevant stakeholders.</li>
<li>Expedite the establishment of Independent Complaints Mechanism as provided in section 210 of the Constitution which will be mandated with receiving and investigating complaints from members of the public about misconduct on the part of members of the security services who include the Police Service and for remedying any harm caused by such misconduct.</li>

<blockquote>Today riot police assaulted and arrested people on the steps of Rotten Row Magistrate’s Court for signing a funeral song protesting the death of <a href="https://www.pindula.co.zw/Hilton_Tafadzwa_Tamangani" rel="noopener noreferrer" target="_blank">Hilton Tafadzwa Tamangani</a>, the vendor who died in custody after being tortured by police and denied medical treatment.
They were part of a group of citizens who attended court today to show solidarity with the remaining 10 vendors who were arrested with Tafadzwa last week (many of whom were also brutally assaulted by the police). Many people were blocked from getting into court by police.
Last week, Magistrate Learnmore Mapiye remanded Tafadzwa and the other vendors in custody, despite them being in a serious medical condition. She heard their bail application but FAILED to give a ruling for a week! Today they were granted bail but for Tafadzwa it’s too late.
For Hilton Tafadzwa Tamangani, it was the epitome of the saying: JUSTICE DELAYED IS JUSTICE DENIED. The postponement of his bail ruling, while he languished in prison being denied medical treatment for injuries sustained during torture, meant he wasn’t alive to get bail today.
Perhaps if Magistrate Learnmore Mapiye hadn’t twice postponed the bail ruling, Tafadzwa would still be with us today. Or if we had a professional police service that didn’t torture people… We have to imagine a Zimbabwe where this type of evil does not happen and fight for it.
As the vendors walked into court today, many in the audience silently raised their palms on which the words “Ndini Tafadzwa” were written. There was a pain in the vendors’ eyes as they looked out across the room remembering their colleague. One gave a gentle nod of appreciation.
The vendors’ lawyers Kadzere &amp; Mandevere of @ZLHRLawyers made an application for the court to order an independent pathology report on Tafadzwa’s death in custody. The State opposed the disingenuous ground that there is no death certificate before the court! Ruling tomorrow.
Meanwhile, Makomborero Haruzivishe, Denford Ngadziore (councilor ward 16 Mabelreign), and a vendor Jonah Matoratora, who were arrested this morning at court, have now been charged with disorderly conduct and will be detained overnight. They’ll be in court tomorrow morning.</blockquote>

The Labour Court on Thursday reserved judgment on a case to establish the legality of doctors’ industrial action which they embarked on since the 3rd of September this year.
Doctors have <a href="https://news.pindula.co.zw/2019/10/01/striking-doctors-we-want-to-come-to-work-but-we-are-incapacitated/">declared incapacitation as the soaring inflation</a> has continuously eroded their salaries.
Doug Coltart, a lawyer representing Zimbabwe Hospital Doctors Association, said that their main argument was that the doctors were not voluntarily on strike. He said:
<blockquote>Doctors were not able to get to work and cannot afford basic needs, this does not amount to a job action.
We also argued that the Labour Act does not apply to doctors because they are governed by the Health Services Act. Doctors face imminent threat to their health and safety because they don’t have enough money to pay for their health insurance.</blockquote>
Meanwhile, <a href="https://news.pindula.co.zw/2019/10/11/health-crisis-worsens-in-zimbabwe-as-nurses-join-strike/">nurses have also joined the strike</a> saying they are incapacitated and overwhelmed since the doctors embarked on industrial action.
Workers are demanding that their salaries be indexed in United States dollars and be paid in the local currency using the interbank rate of the day since <a href="https://news.pindula.co.zw/2019/06/24/breaking-rbz-si-142-bans-use-of-all-foreign-currencies-with-effect-from-24-june-2019/">the government outlawed the use of all foreign currencies for domestic</a> transactions.

Court Reserves Judgment On Striking Doctors Case

Amalgamated Rural Teachers’ Union of Zimbabwe (ARTUZ), president, Obert Masaraure has vowed that teachers will continue fighting for better wages as inflation and de-dollarisation has made salaries worth very little.
Speaking a United Kingdom publication, the Guardian, Masaraure bemoaned the state of hospitals and advised authorities to at least have a shred of shame. Said Masaraure:
<blockquote>We remain in the trenches and will continue to fight … We will be on the streets very soon to push the government to address this issue.
They are celebrating budget surpluses but they are not paying workers, there are no hospital medicines … They should be ashamed of themselves.</blockquote>
Meanwhile, reports of abductions and torture of human rights activists surfaced on Wednesday morning, evoking memories of the Mugabe-era forced disappearances.
Masaraure himself is a victim of abduction and torture by suspected state security agents.
The assailants reportedly have a similar modus operandi, they move in groups of five, they carry assault rifles, use unmarked cars and strike in the dead of the night. Added Masaraure:
<blockquote>There were 54 people on the floor of one room, with one blanket. The prison [clothes] were full of lice. I got sick with a chest problem.
… I am afraid one day I will lose my life. I am afraid for my mother, for my family. The trauma is terrible … and the government is reckless, reckless against its own people.</blockquote>
A Harare-based human rights lawyer, Doug Coltart said:
<blockquote>We can see a buildup now with government ministers normalising the idea that it is OK to deploy the army against protests and use live ammunition.
By failing to deal with past atrocities, the likelihood of future atrocities is very apparent.</blockquote>

Crackdown On Human Rights Defenders Intensify - Report

Doug Coltart, a human rights lawyer and son to the former Education Minister and current MDC Treasurer, David Coltart, says that he does not regret representing ZANU PF bigwigs who were under the cosh during the Robert Mugabe-era.
Coltart represented the controversial ZANU PF MP for Goromonzi West, Energy Mutodi and War ZANU PF MP for Gokwe Central, Victor Matemadanda in 2017.
Writing on microblogging site Twitter on Wednesday, Coltart said:
<blockquote>I was part of the legal team who represented Energy Mutodi and Victor Matemadanda when they were being persecuted by G40 in 2017. We did so because their rights were being violated. Now they’re in power they turn around and threaten to kill citizens for exercising their rights.
When Mutodi was detained at Harare Central, I asked him: “If things go your way and you come to power, will this experience change the way you do things?” He responded “Yes, we have to do things differently. People shouldn’t be persecuted for exercising their rights.”
While I was sitting with Matemadanda when he was detained at Harare Central, he told me and the police officers: “This is what we went to war to fight against, the violation of human rights. What is being done by this Government is the same as what was done by the Rhodesians.”
I don’t regret representing either of them. Human rights violations are human rights violations, and we have to fight against them no matter who the victims and perpetrators are. I’m just sad they’ve forgotten so quickly what it’s like to be on the receiving end.</blockquote>

Coltart Does Not Regret Representing ZANU PF Bigwigs In Court

According to a lawyer and human rights activist, Doug Coltart, Dr Lindiwe Ncube has been flown to Manicaland to offer her services. Other doctors from the Zimbabwe Hospital Doctors Association (ZHDA) were being driven to the province in the aftermath of Tropical Cyclone Idai. Cyclone Idai: Doctors Deployed To Manicaland - Doug Coltart

The government has reportedly denied legal representation to detained General Secretary of the African Regional Organisation of the International Trade Union Confederation (ITUC), Kwasi Adu-Amankwa.
Adu Amankwa was on Tuesday morning dragged from his hotel room in Harare by authorities soon after his arrival.
The labour leader has not been told the reason for his arrest yet his immigration documents were all in order.

Kwasi Adu Amankwa Denied Access To His Lawyer

Renowned human rights lawyer Doug Coltart says that he is not afraid of President Emmerson Mnangagwa’s threats.
While addressing ZANU PF supporters in Mwenezi on Saturday, Mnangagwa said that he is coming after lawyers and doctors who helped the victims of military and police brutality during ShutDownZim.
Writing on Twitter on Monday afternoon, Coltart said:

Human Right Lawyer, Doug Coltart Not Afraid Of Mnangagwa

Medical students at the University of Zimbabwe’s College of Health Sciences finally returned to their halls of residence earlier on today.<a href="http://www.pindula.co.zw/news/2017/06/26/uz-orders-students-vacate-premises-feesmustfall-protest-30-increment-fees/" rel="noopener" target="_blank"> The students had been evicted by the institute’s authorities for protesting against an increase in fees on Monday</a>. This prompted the Zimbabwe Human Rights Lawyers to file an urgent application at the High Court to overturn the eviction. High Court Judge Justice Nyaradzo Munangati-Manongwa said that the institution’s eviction of medical students was irrational and<a href="http://www.pindula.co.zw/news/2017/06/28/high-court-rules-favour-evicted-uz-medical-students-says-eviction-irrational/" rel="noopener" target="_blank"> ruled that the students should be allowed back on campus</a>. However, despite this ruling Vice Chancellor Levi Nyagura and other authorities<a href="http://www.pindula.co.zw/news/2017/06/29/uz-medical-students-remain-homeless-university-refuses-comply-high-court-order/" rel="noopener" target="_blank"> refused to allow the students back on campus yesterday.</a>
They only relented today after they were threatened with contempt of court by lawyers. Human rights activist and lawyer Doug Coltart together with UZ Students Representative Council Legal Representative Max Mhandu went from office to office with contempt of court letters until the Institute buckled under the pressure. The students have started moving into their halls of residence.
