A Ruwa Local Board Municipal Police Officer, Lucia Sithole (44), was arrested on Friday, September 27, by members of the Southern Africa Regional Anti-Corruption Organisation (SARACO) for allegedly demanding and accepting a bribe from a commuter omnibus driver.
According to a memo addressed to the SARACO Chief Corruption Prevention Intelligence Officer by an Assistant Deputy Director of Operations, Sithole now faces charges of criminal abuse of office as defined by Section 174 of the Criminal Law (Codification and Reform) Act [Chapter 9:23].
The allegations are that on September 27, 2024, at approximately 8:20 AM, Sithole and two other municipal police officers were on duty conducting traffic enforcement along the Harare-Mutare highway near the George shopping Centre in Ruwa. Reads the memo:

A Nissan Caravan commuter omnibus registration No AFE 7538 travelling from Harare to Goromonzi stopped at the market Bus stop along the highway and suddenly a municipal traffic officer emerged and placed a steel bar in the wheel of the commuter omnibus.
</blockquote>
All passengers were ordered to disembark and three municipal police officers jumped inside and ordered the driver to proceed to their council yard. As this was happening the other male officer was writing a fine ticket.
It is alleged that the driver of the kombi and the three municipal police officers left for the council yard, and along the way just near the shops, Sithole asked for twenty dollars from the driver.
The driver said that he had US$10 but she rejected it and insisted on $20.
After the driver gave her two US$10 notes, Sithole then instructed him to make a U-turn and drop them off immediately. Reads the memo:

The driver drove back to where he had dropped his passengers and advised the three Southern Africa Regional Anti Corruption Organisation members who had earlier on introduced themselves to him before boarding the commuter omnibus at Fourth Street.
</blockquote>
The three members of SARACO contacted their female counterpart nearby and approached the municipal police officers.
They requested that the officers empty their pockets of all cash, but Sithole refused to comply.
Subsequently, the SARACO members searched her and discovered US$45 in her shirt pockets. Two of the US$10 bills matched the photographs taken by the kombi conductor before the money was handed over to the driver.
Sithole was then arrested and taken to Ruwa Police Station, where Chief Inspector Tinarwo was informed.
A docket was opened for violating Section 174 of the Criminal Law (Codification and Reform) Act, registered under ZRP Ruwa RRB number 6160549.

A police officer in Ruwa was caught taking a bribe from a driver by SARACO. The officer, Lucia Sithole, along with two others, stopped a commuter omnibus and demanded money. The driver gave them US$20, but they asked for more. SARACO members intervened and found the money on Sithole. She was arrested and charges were filed against her. The incident happened on the Harare-Mutare highway. Being caught taking bribes is against the law.

Ruwa Municipal Police Officer Caught In Bribery Sting By SARACO

The Zimbabwe Anti-Corruption Commission (ZACC) has arrested the Tobacco Industry Marketing Board (TIMB) chairperson, Patrick Devenish, and the organisation’s chief executive officer Meanwell Gudu.
Devenish and Gudu appeared in court on Saturday, charged with criminal abuse of office. They were remanded in custody until Monday, August 26, for a bail application hearing before Harare regional magistrate Sandra Mupindu.
The duo are accused of extending a $397,000 loan to a local company owned by Itayi Masuka, without the knowledge or approval of other TIMB board members.
According to the State’s case, in May 2021, Devenish and Gudu, acting in common purpose and with the intention to defraud TIMB, granted the loan to Ultimate Accolade (Private) Limited, owned by the Masuka family.
They allegedly misrepresented that the loan was being provided under the Tobacco Inputs Credit Scheme funded by the Reserve Bank of Zimbabwe (RBZ), despite being aware that the RBZ’s funding for this scheme had been discontinued.
It is further alleged that Gudu, while out of the office, instructed the special projects manager to have the loan contracts signed by the acting chief operations officer, Blessing Dhokotera, who believed the loan was part of the legitimate Tobacco Inputs Credit Scheme.
As a result of this misrepresentation, the full $397,739.51 loan was disbursed to Ultimate Accolade (Private) Limited.
However, from 2021 to 2023, no significant effort was made to recover the debt, until the current acting CEO brought the issue to the board’s attention late last year.
The board then tasked the executive management to recover the debt, but so far, only $16,000 has been recovered out of the total $539,650.50, including interest.
Gudu’s arrest comes a day after he was acquitted by the Harare Magistrate Court of all charges related to the alleged misappropriation of over $2 million.

Two bosses from TIMB are in trouble for doing bad things. They gave a big loan without permission. They said the loan was from a special fund, but it wasn't true. They didn't try to get the loan money back for a long time. Only a little bit has been recovered. One boss got arrested, but was let go before. They will go to court to see if they can get out of jail. People are not happy with them for what they did.

Two TIMB Bosses Remanded In Custody On Corruption Charges

A Zimbabwe Revenue Authority (ZIMRA) officer is accused of extorting US$1 900 from a trucker whom he caught smuggling fuel.
As reported by <a href="https://www.zimlive.com/zimra-officer-in-court-for-extorting-us1900-from-trucker/">ZimLive</a>, Kespa Chabata (57), appeared before Harare magistrate, Stanford Mambanje facing criminal abuse of office charges.
He was granted US$200 bail.
The court heard that on 09 March 2024, Chabata allegedly demanded US$3 000 so he could not confiscate a truck that was carrying wrong cargo.
He allegedly extorted the money from a fuel tanker driver, Given Alcapony Nhamo who was parked and resting at Zindoga truck stop in Waterfalls, Harare.
Chabata, who was on night duty and drove by the truck stop while on his way home, spotted the truck, went over to Nhamo and asked to see the truck’s importation documentation. Prosecutors alleged:

Upon inspection of the documents, the accused noted that the declaration documents indicated that the tanker was carrying Butanone.
However, upon inquiry from the driver, what he was carrying was diesel and Chabata noted the anomaly.
The accused then asked who was in charge and the driver indicated that Lennon Chenga was the one in charge.
The accused asked the driver to contact Chenga to come to the scene.
The driver also informed one Kessie, the supervisor of Dinotic Energy in Sandton South Africa who had instructed him to transport the diesel to Zimbabwe.
Contrary to his duties, the accused did not contact his ZIMRA office or notify his supervisors of the development.
Rather, he went to extort US$3 000 from the driver and kept on holding on to the importation documents and indicated that Chenga should bring the money so that he does not confiscate the truck.
</blockquote>
Kessie is said to have managed to raise US$1 900 which he sent and delivered to Chabata.
After receiving the money, Chabata reportedly gave back the truck’s documents, telling them the importation documents were fraudulent.
However, despite knowing of the offence, Chabata still did not confiscate the truck and instead allowed Nhamo to go.
Prosecutors argued that Chabata’s actions showed undue favour to the trucker as he should have placed the truck under seizure.

ZIMRA Officer Extorts US$1 900 From Trucker

The defence case in the trial of ZANU PF Central Committee member and former Public Service Minister Prisca Mupfumira, who faces criminal abuse of office charges, is expected to finally start next month.
Mupfumira is accused of flouting National Social Security Authority (NSSA) tender processes and pressuring the Authority’s management to fast-track the construction of low-income houses in Gweru during her time as a cabinet minister.
<a href="https://www.herald.co.zw/mupfumiras-defence-case-moved-to-feb/">The Herald</a> reported that Mupfumira appeared in court this week before Harare regional magistrate Stanford Mambanje, who said the defence case will start on a continuous roll on 28 and 29 February.
Mambanje also indicated that the presiding regional magistrate Ngoni Nduna was not available, hence the postponement.
This comes as Barnabas Matongera, who was jointly charged with Mupfumira, was acquitted by Nduna at the close of the State case in March 2023.
Nduna said Matongera played no role in the decision towards the construction of the low-cost houses in Gweru.
Mupfumira and Matongera were charged with criminal abuse of office.
The magistrate ruled that Mupfumira should be put to her defence to explain how the construction firm, Drawcard Enterprises, that undertook the project, won the tender.
Mupfumira then approached the High Court, challenging Nduna’s ruling arguing that he erred in dismissing her application for discharge. The High Court, however, dismissed her application.

Prisca Mupfumira’s Defence Case Moved To February

Former Zimbabwe National Roads Administration (ZINARA) chief executive officer Saston Muzenda (48) has been jailed for 36 months for corruption, reported <a href="https://www.newzimbabwe.com/former-zinara-boss-jailed-for-corruption/">NewZimbabwe.com</a>.
Muzenda was charged with criminal abuse of office as a public officer and was convicted after a full trial.
However, six months of his sentence was suspended on condition he doesn’t commit a similar offence in the next five years.
He will, therefore, serve an effective 30 months.
Muzenda was found guilty of unlawfully awarding a tender to an undeserving security company, at the expense of two other firms, which had been awarded the job.
He allowed Ex-Combatants Security company to provide services to ZINARA when the ZINARA board had resolved to give the job to Morden Security and Real Star Security.
Allegations were that in June 2019, Modern Security and Real Star Security were awarded tenders to provide services at ZINARA’s Northern and Southern regions from September 1 of the same year.
Ex-Combatants and National Eye Security’s contracts were expected to end on August 31, 2019, before Modern Security and Real Star Security took over.
Muzenda, who was acting ZINARA CEO, had already allowed Ex-Combatants Security to add security guards in areas that were manned by National Eye Security. Prosecutors said:

The accused person went on to write a letter to the Procurement Regulatory Authority of Zimbabwe (PRAZ) seeking the extension of the contract for a further 12 months.
</blockquote>
PRAZ asked Muzenda for the contracts and he responded by saying he had already extended Ex-Combatants Security’s contract by 12 months. Appearing for the State:

This was unlawful and unexpected of the accused person who held public office at the time.
ZINARA had to make payments amounting to ZWD300 948 to Ex- Combatants Security after receiving a letter from PRAZ instructing them to terminate their contract with the security company.

During the trial, Muzenda denied the charges. He argued that the security companies were already involved in contractual disputes when he assumed the position of CEO at ZINARA.

Former ZINARA CEO Jailed 36 Months For Corruption

The Clerk of Parliament, Kennedy Chokuda and the director of procurement, Stanley Bhebhe, appeared in court on Thursday charged with two counts of Criminal Abuse of Duty as a Public Officer as defined in section 174 of the Criminal Law [Codification and Reform] Act Chapter 9:23.
The two men appeared before Harare regional magistrate Vongai Guwuriro, who granted them $100 000 bail each, reported <a href="https://www.hmetro.co.zw/clerk-of-parliament-granted-bail-in-messy-computers-deal/">H-Metro</a>.
She ordered them not to interfere with State witnesses.
The court heard that on 17 June 2022, the Parliament of Zimbabwe flighted an advert inviting interested bidders for the supply and delivery of 173 laptops and 79 desktops.
Ninety-two (92) companies showed interest, and the number was reduced to 30 after some were disqualified for different reasons.
On 29 October 2022, Mid-End Computers was notified by Parliament that it had been awarded the contract to supply 79 desktops at US$3 076 each for a total of US$243 052 payable at the interbank rate.
Treasury, however, refused to release the payment citing the extortionate prices.
The court further heard that on 16 September, Bhebhe originated a letter, on the instructions of Chokuda, to the Procurement Regulatory Authority of Zimbabwe (PRAZ) asking for authority to negotiate a price reduction.
Bhebhe in turn instructed Rudo Doka, the director of external relations, to append her signature on Chokuda’s behalf, as he was away.
But PRAZ replied and advised Parliament that negotiating a price reduction was against Section 52 of the Procurement Act which prohibits negotiations between procuring entities and bidders.
Prosecutors said the two asked for authority from PRAZ although they had already negotiated for a price reduction with Noah Sakudye, the director of Mid-End Computers on 7 September.
An agreement was reached and the price was reduced from US$243 000 to US$180 000 for the supply and delivery of 79 desktops.
It was alleged that the meeting was chaired by Parliament’s chief director of finance, Bernard Zvamada.
They allegedly submitted an unsigned Standard Bidding Document which would ordinarily be signed by Chokuda as the accounting officer.
Prosecutors said Chokuda should have cancelled the tender and re-tendered.
On the second count, Chokuda and Bhebhe unlawfully negotiated a tender that was issued to Blinart Investments.
The duo allegedly negotiated with Elizabeth Muchenje, the director of Blinart Investments Pvt Ltd, on 9 September.
An agreement was reached on the same day to reduce the price of a single laptop from US$9 264 to US$7 985.

Clerk of Parliament, Kennedy Chokuda, Granted $100 000 Bail

National Social Security Authority (NSSA) acting general manager Charles Shava, who was arrested on Thursday on a criminal abuse of office charge, has been granted bail by the Harare Magistrates Court, reported <a href="https://www.newsday.co.zw/local-news/article/200008278/nssa-boss-gets-500-000-bail">NewsDay</a>.
Shava, who was being represented by Musindo Hungwe, was granted $500 000 bail when he appeared before Harare magistrate Stanford Mambanje on Friday.
Shava allegedly altered a board resolution that had rejected the proposed allowances for four NSSA doctors.
It is alleged that Shava caused the human resources manager to pay the allowances without approval, claiming the board had approved the allowances.

NSSA Boss Charles Shava Granted $500 000 Bail

The ZESA Holdings Southern Region manager King Dube was last week arrested by the Zimbabwe Anti-Corruption Commission (ZACC) on allegations of using one of the power utility’s employees as his domestic worker.
As a result, ZESA was prejudiced of US$17 568 which Andrew Homa, who was employed by the power utility, received from the company in salaries although he was working at Dube’s private home.
Dube was suspended on allegations of engaging in underhand dealings together with eight other senior ZESA officials from the region.
He appeared before Gweru magistrate Edwin Marecha on Wednesday facing criminal abuse of office charges.
Dube was remanded to March 29 on $20 000 bail and ordered to surrender his passport.
He was also ordered to reside at the given address, report three times a week at Gweru Central Police Station and to not interfere with investigations.
The State alleged that that from January 2013 to the end of February 2017, Dube ordered Homa, a ZESA employee, to work as a domestic worker at his residence in Gweru.
Homa was on the electricity utility’s payroll and Dube assigned him to do domestic duties at his home.

Manager Uses ZESA Employee As Domestic Worker For 4 Years

Former Harare mayor Hebert Gomba has been remanded in custody following his arrest Friday by officials from the Zimbabwe Anti-Corruption Commission (ZACC).
Gomba was arrested on fresh allegations of corruption after he allegedly expropriated vacant land in Milton Park.
He was not asked to plead when he appeared before Harare Magistrate Stanford Mambanje Saturday.
The magistrate remanded Gomba in custody to Monday next week for his bail hearing.
The MDC Alliance official was initially arrested in July last year on allegations of criminal abuse of office.
He was accused of illegally selling the City of Harare residential stands.
On the latest charge, Gomba is accused of illegally creating commercial stands inside Old Hararians Sports Club open space in Milton Park.
Gomba is alleged to have connived with Wellington Mutambirwa, a City of Harare evaluation executive to cause the creation of commercial stands at the open space at the Old Hararians Sports Club.
It is further alleged that the stands were for a proposed crèche, medical centre, recreational facilities, market place and fuel service station.
Gomba was reportedly among several senior council officials working in his office who were set to benefit from the stands scam.
The crimes were reportedly committed during the period extending from 2018 to 2020 when Gomba was the Harare mayor and Glen Norah councillor.

Gomba Remanded In Custody For Grabbing Sports Club Land

Harare mayor Jacob Mafume was arrested again on Monday after he allegedly tried to bribe Special Anti Corruption Unit (SACU) officers working on his abuse of office case.
Mafume’s party, the MDC Alliance confirmed the arrest but said the Harare mayor was arrested at Strathaven Shopping Centre after he responded to a greeting from someone he knows. The party said in a statement:
<blockquote>It is alleged he interfered with a witness. He denies this. After his remand hearing, he went to Strathaven Shopping Centre where he was greeted by a woman he knows.
He greeted her back then plainclothes police arrested him. Nobody was bribed as suggested by [the Permanent Secretary in the Ministry of Information, Publicity and Broadcasting Services, Nick Mangwana].</blockquote>
Mafume was released from remand prison last week on ZWL$30 000 bail following his arrest on 25 November 2020.
He had been arrested on allegations of illegally parcelling out residential stands to his sister Rotina Mafume and secretary at his law firm Rutendo Muvuti without following due process.
In granting Mafume bail, High Court Judge Justice Benjamin Chikowero ordered him not to interfere with witnesses, to surrender his passport and to continue residing at his given residential address as part of his bail conditions.

Harare magistrate Bianca Makwande has postponed to Saturday (tomorrow) the bail ruling for Harare mayor Jacob Mafume who was arrested on Wednesday on criminal abuse of office charges.
Mafume allegedly forced Harare City Council officials to parcel out some stands in Harare’s Westlea suburb to his sister and colleague.
The State opposed bail on the grounds that Mafume will likely interfere with witnesses and could also abscond.
Through his lawyer Tonderai Bhatasara, Mafume said there was no way he could interfere with investigations because he is not a Council employee. Said Bhatasara:
<blockquote>As an officer of this court, the accused is aware of the dire consequences of breaching bail.
He is a legal practitioner for 20 years; he is married with two kids. He has a car and immovable property being a residential stand in Mt Pleasant.
He is a mayor of Harare and earns about $6 000 from this job. He generates $100 000 a month from his practice as a lawyer.</blockquote>
Mafume is denying the charges. He said if he had indeed committed the offences, then the witnesses would be accomplices because they are the ones who have powers to parcel out stands.

Mafume To Spend Third Night In Prison

A Gweru magistrate on Thursday sentenced a top police detective to an effective two years in jail on criminal abuse of office charges.
Gweru regional magistrate Phathekile Msipa initially sentenced former officer-in-charge of Gweru CID, Detective inspector, Leonard Gwandu, to three years before suspending one year on condition of good behaviour.
According to prosecutor Namatirai Chipere, on December 14 last year, Gwandu released a Toyota Hilux truck, which had been confiscated from local businessman Shepherd Tundiya without following procedures.
The car was being kept as an exhibit and should eventually be handed over to the South African police.
Tundiya was arrested in connection with the stolen vehicle that he had bought and had been acquitted.
However, there was no order to release the car in question.

Top Police Detective Gets 2-year Jail Term

Former State House principal director, Douglas Tapfuma, has fingered senior government and Zanu PF officials in underhand dealings involving the abuse of the free-duty vehicle scheme to import personal vehicles.
Tapfuma, an ally of President <a href="https://www.pindula.co.zw/Emmerson_Mnangagwa" rel="noopener noreferrer" target="_blank">Emmerson Mnangagwa</a>, is facing criminal abuse of office charge after he allegedly bought five personal vehicles using the official facility.
He revealed that Youth deputy minister Tinoda Machakaire, who runs TinMac, a logistics company, is one of the party functionaries who also abused the facility, and that several senior officials that he could not name also used the duty-free facility.
In his testimony before the court on Monday, Tapfuma declared that he was not the first official to use the facility. He said:
<blockquote>Everyone in government and Zanu PF has been doing it.
… It is a system that has been in existence for long to import personal vehicles through the Office of the President and Cabinet under the vehicles duty-free facility.
TinMac Company has done exactly what I am accused of and using the same documents that I used. Mupereri also used the same documents. These kinds of transactions have been in existence for a long time.</blockquote>
Tapfuma asserted that the allegations against him were malicious, and he accused Deputy Chief Secretary to the President and Cabinet Ray Ndhlukula of wanting to second his own people to the position that he held.

Former State House Official Exposes High-level Corruption

A former <a href="https://www.pindula.co.zw/ZINARA">ZINARA</a> boss who was being investigated for corruption was arrested and hailed <a href="https://zero.pindula.co.zw/zacc-arrests-ex-zinara-ceo-over-us20m-corruption-scandal/">before the court facing 6 counts of criminal abuse of office </a>charges.  Mr Frank Chitukutuku allegedly awarded road rehabilitation contracts worth a whopping US$20 million to an alleged colleague without following legal processes.
The matter came to light through court papers that allege that Chitukutuku was corruptly working with a former ZINARA technical director:
<blockquote>The accused, in connivance with former Zinara technical director Moses Julius Juma, corruptly imposed the awarding of contracts for rehabilitation of road works for Rural Districts Councils without following procurement procedures.
The accused acted contrary to his duties as a public officer for the purpose of showing favour to Fremus Enterprises (Pvt) Ltd, a company owned by his ZAOGA church associate, Freddy Chimbari.</blockquote>
Chitukukutu last week changed his last name to Mandlamakhulu together with his family and 2 other people. The state used the name change as their reason to remand Chitukutuku in custody till Tuesday to verify why he had suddenly changed his name.

Former ZINARA CEO Being Investigated For Corruption Arrested After He Changed His Name

Former Zimbabwe National Road Administration (ZINARA) board Chairman, Albert Mugabe appeared before a Harare magistrate on Monday facing criminal abuse of office charges.
Mugabe was released on $500 bail by Harare magistrate Vongai Guuriro Muchuchuti. He is being represented by Admire Rubaya and the matter was remanded to April 11. Mugabe allegedly faked a letter of undertaking to CBZ bank advising that the ZINARA board had agreed to set off a $300 000 mortgage loan for the Chief Executive officer.
On March 30, 2017, ZINARA Human Resources Committee deliberated through a round robin resolution the acquisition of a mortgage loan from CBZ bank for ZINARA Chief Executive Officer Nancy Chamisa Masiyiwa. The six member Human Resources Committee unanimously resolved to recommend to ZINARA Board for approval to secure a mortgage loan scheme not exceeding $300 000 with CBZ Bank. On April 5, 2017, Mugabe wrote a letter of undertaking for mortgage loan in respect of Masiyiwa to CBZ bank advising that ZINARA board had authorised Masiyiwa to enter into a housing loan scheme with the bank. He said ZINARA undertook to pay off the mortgage facility if Masiyiwa’s contract was to expire with the mortgage loan still existing. The ZINARA Board had not approved the loan facility.

Postal and Telecommunications Regulatory Authority (POTRAZ) Director-General Gift Machengete’s trial was yesterday postponed to the 18th and 19th of March at the magistrate’s court.

UPDATED: Potraz Boss's Criminal Abuse Of Office Court Case Postponed

Former NetOne CEO Reward Kangai appeared before Harare magistrate Ms Rumbidzai Mugwagwa facing 21 counts of criminal abuse of office charges. Kangai is being accused of hand-picking his relatives and close associates for contracts to erect the company’s base stations before paying them rentals in advance.
He was remanded to January 31 on $800 bail and was ordered to surrender his passport, report to the police once a week and not to interfere with witnesses. His lawyer Mr Nyasha Munetsi said there were no reasonable grounds for Kangai’s arrest arguing that the Zimbabwe Anti-Corruption Commission (ZACC) had not carried out proper investigations.
It is the State’s case that Kangai showed favour to Bopela Family Trust by authorising the advance rental payment of $10 500, which covered a period of 21 months. Richwood Sports Club was paid $33 000, which covered a period of five years, while Avondale Christian Church was paid $27 000, which covered three years. It is alleged that house No. 514 Chipembere Road, Windsor Park in Ruwa, Harare was paid $5 400 when NetOne has no provision for advance rental payments.

Supa Mandiwanzira's Accuser Reward Kangai Freed On $800 Bail

Suspended Prosecutor-General (PG) <a href="http://www.pindula.co.zw/Johannes_Tomana">Johannes Tomana</a>, who is facing six charges of criminal abuse of office, is now set to be tried at the High Court. Tomana’s trial was supposed to kick off on August 29 this year, but was postponed to October 4 after the State notified the court that it had not furnished the defence with relevant court papers in time for Tomana to prepare his defence.
Following the new developments, Tomana abandoned his application for refusal of further remand and consented to the postponement. Tomana’s reporting conditions were scrapped after his lawyer, Tazorora Musarurwa, made an application before magistrate Vakai Chikwekwe.
Allegations against Tomana stem from 2004, when the then chief executive of the <a href="http://www.pindula.co.zw/Zimbabwe_United_Passenger_Company">Zimbabwe United Passenger Company</a> (Zupco), Bright Matonga, was charged with culpable homicide arising from an accident which claimed the life of a pedestrian, Chipo Chikowore. It is alleged Tomana ordered the State to withdraw the charges against Matonga.
