The Environmental Management Agency (EMA) has banned two Chinese mining companies suspected of causing environmental damage through their alluvial mining activities along the Sanyati River.
According to <a href="https://www.newsday.co.zw/local-news/article/200034525/govt-whips-errant-chinese-miners">NewsDay,</a> one of the companies was operating on the Hurungwe side, while the other had started clearing land on the Kariba rural side.
Both companies were reportedly using heavy equipment, including an excavator and water pump, among other machinery.
Mashonaland West EMA provincial spokesperson Munyaradzi Nhariswa said one of the companies, Riverlion (Pvt) Ltd, was sanctioned for excavating and modifying the river channel. He said:
Indeed, two companies were identified: Riverlion (Pvt) Ltd situated on the Hurungwe side and Baimei Investments located on the Nyaminyami side.

Riverlion (Pvt) Ltd was engaged in riverbed mining activities along the Sanyati River, with open workings and a wash plant within the river.
The company was sanctioned for excavating and modifying the river channel as defined in the Environmental Management Act [Cap 20:27] as read with Statutory Instrument 7 of 2007, as well as storage and usage of hazardous substances without the required licence from the agency as required in terms of Statutory Instrument 268 of 2018.

Baimei Investments was sanctioned for implementing a prescribed project without an Environmental Impact Assessment (EIA) certificate. Said Nhariswa:

The company was sanctioned for implementing a prescribed project without an Environmental Impact Assessment certificate as required in terms of the Environmental Management Act [Cap 20:27].
Both companies were served with environmental protection orders directing them to cease all mining activities immediately and relocate their equipment 500 metres away from the Sanyati River.
The order directed them to only recommence operations once they obtain the necessary licences.

The companies had tampered with riverbeds as defined in EMA regulations which attracts “a fine not exceeding level 14 or to imprisonment for a period not exceeding five years or to both such fine and such imprisonment.”

EMA Bans Two Chinese Companies Over Damage To Sanyati River

Two Presidential Guard and three Central Intelligence Organisation (CIO) officers are facing allegations of extorting US$2,000 from a Chinese miner, Enjie Zhang, at the Murodzi mining claim in Mazowe.
As reported by <a href="https://www.zimlive.com/cio-presidential-guard-officers-up-for-us2000-blackmail-against-chinese-miner/">ZimLive</a>, the suspects, identified as Chamunorwa Victor Chinorwiwa (32), Hilary Maravanyika (28), Tawanda Ngoshi (39), Samuel Zvishamiso Simbabure, and Respect Zuva, allegedly posed as members of the Criminal Investigations Department (CID) who were on duty.
The five, also facing robbery charges, were scheduled to be back in court on Tuesday for a ruling on their application challenging placement on remand.
According to the National Prosecuting Authority, on October 19, 2024, around midday, the group connived and proceeded to the Murodzi mining claim in Mazowe.
They allegedly ordered the miner Enjie Zhang and his 25 workers to gather and sit down in one place. Said the NPA in an outline of the charges:

Accused person one (Simbabure) and his accomplices ordered the complainant and the gathered mine workers to remain still as he would proceed to shoot them if they attempted to flee whilst showing a pistol which was placed on his waist.
The accused persons ordered the complainant and his fellow Chinese nationals who were present, Jinliang Xue, Hang Hainglin and Shan Dong Zhou to produce their identity documents, mining certificates and work permits.
Complainant and his Chinese counterparts produced their identity documents but failed to produce the mining certificates and work permits which they stated were in the custody of the company general manager, one identified as Hu, who was in Harare.
The accused persons accused the complainant and his fellow workers of conducting illegal mining operations in the area and demanded US$2,000 cash from the Chinese nationals so that they could release them.
They ordered the complainant to contact Hu so that she could bring the needed bribe money and the complainant complied.

The court heard that Simbabure communicated with Hu using the complainant’s phone to arrange for the bribe money to be delivered to Ngoshi.
Hu then contacted informant Godfrey Zambuko, who works for Holdenfield Investments in Harare, instructing him to go to Zimbabwe House and hand over the US$2,000 bribe to Ngoshi. Said the NPA:

Informant indeed proceeded to Zimbabwe House where he gave the US$2,000 bribe money to Ngoshi who is currently at large.
</blockquote>
According to court papers, one Chinese national, Hang Hainglin, escaped from the mining site and went to a nearby mine also owned by Holdenfields Investments.
There, he was given US$1,000 by another Chinese national to deliver to the accused persons in exchange for their freedom. Said the prosecution:

Kelvinator Don Paricha, employed as a Chinese company interpreter, went to the accused persons and gave them US$800 which resulted in the release of the complainant and the other mine workers. The accused persons then drove off in their getaway motor vehicle.

On October 21, 2024, Simbabure called Godfrey Zambuko from his mobile phone, inviting him to Zimbabwe House to discuss the need for an additional bribe payment. Said the NPA:

On October 22, 2024, the informant then advised the President’s Department about the issue and the two went to Zimbabwe House where they met accused one and two leading to their arrest.
Upon arrest the two accused persons implicated four accomplices who are still at large.

Five men, including two Presidential Guard members and three CIO officers, are accused of extorting money from a Chinese miner. They pretended to be police and threatened the miner and his workers with violence if they didn't pay $2,000. The miner's associate paid some money to free them. The suspects were caught after trying to get more money. They are in court, and four other people are still on the run. The suspects face serious charges of robbery and extortion. The Chinese miner was scared and had to give money to be safe.

Presidential Guard, CIO Officers Accused Of Extorting Chinese Miner

Hwange Central Member of Parliament, Daniel Molokele (CCC), has criticised Chinese coal miners in the district for not respecting Zimbabwe’s laws in their operations.
This follows complaints from residents of Ingagula township in Hwange about excessive dust pollution caused by Chinese miners’ haulage trucks and coal mining activities.
In a recent interview with <a href="https://vicfallslive.co.zw/mp-daniel-molokele-speaks-out-against-chinese-companies-arrogance-and-disregard-for-the-law-in-hwange/">VicFallsLive</a>, Molokele alleged that Chinese investors are shielded from scrutiny due to their connections with powerful politicians in Harare.
He argued that this protection has led to a sense of arrogance among the Chinese companies operating in the area Said Molokele:
<blockquote>
We have also made efforts to reach out to the Chinese companies, most community local members are complaining that it’s the Chinese companies that are leading in terms of violations of environmental laws and making sure that there’s too much pollution, not just of the air but of the land and the rivers… but what we have learnt is that Chinese companies are very arrogant and they never respect any type of law including labour relations act.
When you look at the terms and conditions of their employees, it’s clear that they are deliberately and arrogantly violating the laws in terms of working hours, in terms of compassionate leave, study leave, medical aid, pension aid and permanent employment and so on…
In terms of health and occupational hazards, awareness and protection, so there’s a lot of violations happening… but it’s the manner in which Chinese investors start investments here in Zimbabwe because they come through high-level politics and they have got connections in Harare and some of the companies that China had set up here in Hwange, they major shareholding include the political elite and that’s where the source of arrogance is coming from… I have been working with other parliamentarians to set up a national chapter for the Inter-Parliamentary Alliance on China.
We have an organization that works in over 50 countries that has been set up called IPAC headquartered in London that seeks to ensure that Chinese companies wherever they are investing, they have a sustainable development model and they respect local communities.
So we are in the process of setting the national chapter in Zimbabwe, hopefully, it’ll help to increase our capacity to force the Chinese companies to be more accountable.

Molokele pledged to raise the issue in the National Assembly to hold Chinese companies accountable for their environmental and social impact in Hwange.

Hwange MP Daniel Molokele is angry at Chinese miners for not following the rules in Zimbabwe. People in Hwange are upset about the pollution caused by the Chinese miners. Molokele says the Chinese companies act like they are above the law because they have connections with powerful politicians. He wants to make sure these companies are held responsible for their actions. Molokele plans to talk about this issue in Parliament and work with other MPs to try and make Chinese companies follow the law and treat local people better.

Hwange MP Daniel Molokele Slams Chinese Miners For "Arrogance And Disregard For The Law"

Farai Maguwu, the founding director of the Centre for Natural Resource Governance, has characterised the proliferation of Chinese mining operations across Zimbabwe as a form of “organised crime” due to their exploitative nature.
Maguwu made these remarks during a virtual discussion organised by the Bubi Community Parliament last week, where he was a guest.
The discussion focused on environmental management and degradation in the Bubi district.
Chinese miners have been accused of extensive environmental degradation and a reluctance to reinvest in the communities where they operate.
Maguwu claimed that mines that started operating in Zimbabwe after the year 2000 have failed to meaningfully improve the areas in which they are situated. He said (via <a href="https://www.newsday.co.zw/southerneye/local/article/200031454/zim-mining-activity-is-organised-crime">Southern Eye</a>):
<blockquote>
Mining that is conducted in Zimbabwe is organised crime, it is not really formal. In terms of mines that started operating after the year 2000, the one that I think is a demonstration of unit of environmental social or governance risk is Zimplats.
If you go to Zimplats you will realise that they have invested in the road infrastructure, and they have built a town such that even if Zimplats is said to have ceased operations in Zimbabwe, that settlement will continue to exist.
They have built houses for their staff, it is actually a town that they have built. But those coming from China, they have no intention to stay here, they have no intention to transform the place from the way they found it and turn it into a better place.
</blockquote>
Maguwu argued that some of the so-called investors are not genuine investors at all, but rather criminals masquerading as such.
He went on to assert that these individuals “cannot even build toilets for their employees,” underscoring their blatant disregard for the basic welfare and dignity of the local workforce. He said:
<blockquote>
The difference between a criminal and an investor is that an investor improves the place and leaves it a better place than they found it.
If you look at towns like Shurugwi and Zvishavane, they were built due to mining. Bindura, Hwange, they built that town from coal and today we have Hwange town because of mining.
But for criminals, what they leave are pits, some of these miners cannot even build toilets for their employees.
They do not invest in people, the environment and the future. Marange is a sad story, there is nothing in Marange, the roads are bad, and the clinic staff quarters are dilapidated.
</blockquote>
Maguwu also claimed that the working conditions in most mining companies were deplorable, adding that some workers are driven to supplement their meager incomes by stealing from their employers.

Farai Maguwu says Chinese mining in Zimbabwe is like organized crime - not good for the people or the land. Chinese miners don't help the communities where they work, just take and leave. Real investors should make things better, not worse. Some miners are not real investors, just criminals pretending to be. They don't care about the workers or the environment. Maguwu also said that working conditions in many mines are bad, forcing some workers to steal to make ends meet.

Maguwu Decries Chinese Mining Operations In Zimbabwe As "Organised Crime"

Approximately 200 workers employed at the Chinese-operated Jojo Mine near Kwekwe are reportedly living in deplorable conditions, with many residing in makeshift shacks and using the surrounding bushes as improvised toilet facilities, while their Chinese supervisors enjoy the comforts of a plush enclosure nearby.
The workers told <a href="https://masvingomirror.com/200-workers-at-chinese-mine-use-bush-toilets/">The Mirror</a> that they are not provided with any form of protective clothing by the mine management, and they also face a severe lack of clean water for domestic use.
Midlands Provincial Affairs and Devolution Minister Owen Ncube recently toured the mines, which are owned by Ming Chang Sino Africa Mining Investment.
Although he did not visit the living quarters of the workers, Ncube directed the mine management to address the issue of decent accommodation and living conditions for the employees. Said Ncube:

It is unacceptable for workers to stay under deplorable conditions like this. There is overcrowding, no decent accommodation, no ablution and no medical facilities. Failure to provide safety clothing and ill-treatment of workers is unacceptable.

An employee who declined to be named for fear of reprisal told The Mirror:

These Chinese treat us like slaves. We live under inhumane conditions with no toilets, water and houses. We stay in plastic shacks when they stay in plush houses.
Our health is at risk, they don’t give us protective clothing but instead, they sell the safety shoes and work suits that we should use at work.

In response, the administrative manager and assistant director for the company, Eric Yan Bo, said that the company was actively working to address the issues surrounding the deplorable living conditions of the workers. He said:
<blockquote>
We are very sorry about the accommodation. The issue is we are short of houses but the company is working towards evicting some illegal miners staying in the company houses.
</blockquote>
Yan Bo said Ming Chang Sino operates three mines in Kwekwe which are Bell, Jojo and Indarama with a total staff complement of 700 workers.

200 Workers At Chinese Mine Use Bush Toilets, Sleep In Shacks

Local communities living near Chinese-owned mining operations in Zimbabwe have accused the companies of lacking transparency and accountability in their operations, reported <a href="https://cite.org.zw/communities-lament-challenges-from-chinese-mining-companies/">CITE</a>.
These concerns were raised during a recent meeting organised by the Zimbabwe Environmental Law Association (ZELA) and the Centre for Natural Resource Governance (CNRG).
The event was part of a project titled “Strengthening Extractives and Natural Resources Transparency and Accountability through Community Action and Parliament Oversight (STACAP)”, which aims to empower local communities to monitor mining revenue and hold companies accountable.
A villager from Gwanda in Matabeleland South Province, situated near a lithium mine, claimed that the Chinese company had bypassed the community and instead only engaged with traditional leaders. He said:
<blockquote>
They didn’t talk to the community. It’s like they are working with traditional leaders without us knowing what’s going on.
Even when they offer community benefits, they go through traditional leaders, who seem to be friendly with them, instead of following proper procedures.
This has caused divisions within the community, with some residents refusing to attend meetings organised by local councillors to address mining-related challenges.
</blockquote>
Dickson Munyumbu, a resident of Shurugwi in Midlands Province, criticised the Chinese-owned mining companies for allegedly failing to conduct adequate environmental impact assessments (EIAs) before commencing their operations. He said:
<blockquote>
They hold selective consultations. The law requires consulting nearby communities, but they don’t consider our views.
</blockquote>
Munyumbu also lamented the poor working conditions experienced by employees of the Chinese mining companies. He noted issues such as inadequate housing provided to workers and unacceptably low wages.
Munyumbu further criticised the mining companies for failing to fulfil promised social responsibility initiatives, such as the construction of hospitals that had been pledged to local communities.
Unica Pabwaungana, another resident of Shurugwi, highlighted the significant destruction of natural resources and heritage sites caused by the mining activities in the region.
Khumbulani Maphosa, the coordinator of the Matabeleland Institute for Human Rights (MIHR), condemned the companies’ overall approach to corporate social responsibility (CSR), saying it fell short of community expectations and needs. Said Maphosa:

These donations of mealie meal and cooking oil feel like bribes to silence criticism. They distract communities from holding them accountable for environmental damage.

Chinese mining companies have established a substantial presence in Zimbabwe in the wake of the government’s “Look East” policy.
The Look East policy was largely necessitated by the imposition of Western sanctions on Zimbabwe following the land reform programme.
The relationship between China and Zimbabwe has been politically significant, with the Zimbabwean government regarding China as a dependable partner amid the country’s isolation from Western powers.
However, many ordinary Zimbabweans living in mining communities feel that the Chinese companies can disregard Zimbabwean laws and infringe on the human rights of the local population with little fear of accountability.
On 13 July 2024, a Chinese national was filmed torturing Zimbabwean workers at the Makanga Mine in Bindura, Mashonaland Central Province.
The Chinese mine manager then whipped the workers, accusing them of stealing an unspecified amount of diesel from the mine.
In May 2024, a 58-year-old Chinese miner named Cai Yulong allegedly shot and killed a man from Chief Njelele in Gokwe after the victim and his colleague encroached into Cai’s mining claim in Zhombe, Midlands Province. Cai also reportedly injured the victim’s colleague during the incident.
In June, a 51-year-old Chinese national was arraigned before the Gweru Magistrates’ Court on allegations of raping and impregnating a 17-year-old local girl.

Zimbabwean Mining Communities Lament Challenges From Chinese-Owned Companies

Residents of Hwange and surrounding communities have implored Parliament to enact laws that compel Chinese coal mining companies operating in the area to desist from environmental degradation and respect labour laws.
There are more than 10 mining companies mining and processing coal in Hwange.
Speaking at a consultative meeting conducted by the Portfolio Committee on Mines and Mining Development in Hwange, residents urged the government to protect local people and the environment, reported CITE.
Local communities raised a number of issues they want to be addressed, among them, environmental degradation, pollution, failure by mining companies to plough back to the community, destruction of infrastructure such as roads, exploitation and victimisation of labour.
Parliament is consulting citizens towards crafting a Mines and Minerals Amendment Bill that seeks to shape the future of mining activities in the country.
