Former Tobacco Industry and Marketing Board (TIMB) CEO, Meanwell Gudu, was acquitted of all charges related to criminal abuse of office on Friday, August 23.
Gudu had been arrested and accused of misappropriating over US$2 million. He appeared before Harare magistrate Marehwanazvo Gofa, along with co-accused Stuart Shanyika, TIMB’s former head of special services, and Andrew Matibiri, a retired former TIMB CEO.
The trio was arrested by the Zimbabwe Anti-Corruption Commission (ZACC) on September 6, 2022, and first appeared before the Harare Magistrate Court on September 8, 2022.
The state alleged that in the 2017-2018 farming seasons, the Reserve Bank of Zimbabwe had introduced a tobacco financing facility to support small-scale tobacco farmers with inputs and working capital.
A memorandum of agreement was signed on September 10, 2018, between the RBZ, AFC Commercial Bank, and TIMB.
The RBZ was the provider of the funds for the facility, AFC Commercial Bank was the agent and TIMB was the borrower.
However, the court heard that the three accused persons allegedly entered into private agreements with other tobacco contractors, handpicking them in a corruptly designed deal to support the firms with inputs from the TIMB loan.
As a result, the RBZ was allegedly prejudiced of US$2 million, and nothing was recovered.
The matter was heard at the Magistrate Court on Thursday, nearly two years after the arrests, and the charges were ultimately withdrawn before a plea was entered.
Gudu joined TIMB in 2008 as a technical services executive and was appointed CEO in April 2021, following the retirement of the then-CEO Matibiri.

Former TIMB CEO, Meanwell Gudu, was accused of taking money but has been found not guilty. The case was about $2 million for tobacco farmers that went missing. Gudu and others were accused of making deals with specific companies instead of helping all the farmers. The court said the charges were not true, and Gudu is now free. The case started in 2022, but after two years, it was dropped. Gudu has been working in TIMB for a long time and became CEO in 2021.

Former cabinet minister Ignatius Chombo has been cleared of all remaining criminal charges, as the prosecution withdrew two allegations against him. Chombo had been facing court proceedings without trial for the past five years, resulting in other charges being dismissed due to lack of evidence.
His initial arrest in 2017 was part of a crackdown on individuals associated with former President Robert Mugabe. The recent charges, which accused Chombo of showing favouritism to Alois Chiimba during his tenure as Local Government Minister, were found to lack supporting evidence by the Zimbabwe Anti-Corruption Commission (ZACC). The allegations included the manufacturing of fraudulent documents for the acquisition of a property and the subsequent fraudulent transfer to Chimimba.
Earlier this year, charges relating to the misappropriation of a US$14 billion Reserve Bank of Zimbabwe capital expenditure loan were also withdrawn due to insufficient evidence. Kennedy Madekutsikwa from the National Prosecution Authority (NPA) confirmed the lack of evidence against Chombo.
There are concerns regarding the practice of “catch and release” of individuals perceived to be involved in corruption. This approach has led some to question the government’s commitment to effectively combating corruption. Authorities defend their actions by stating that they cannot detain individuals without sufficient evidence. Supporters argue that it is more prudent to conduct thorough investigations before making arrests, as baseless arrests would violate the rights of individuals and waste taxpayers’ money.
Since President Emmerson Mnangagwa assumed power in 2017, numerous prominent politicians have been arrested on corruption charges, but convictions have been few and far between. Some analysts suggest that the arrests may be politically motivated, targeting Mnangagwa’s opponents, while others believe they are merely a façade to create the impression of action against corruption. Notable figures arrested include Prisca Mupfumira, Obadiah Moyo, and Justice Mayor Wadyajena.

Former Minister Chombo Cleared As State Withdraws All Corruption Charges

Thirty-one land and space barons have been arrested since the Government launched an operation to clamp down on land barons.
This was revealed by Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa while addressing a post-Cabinet media briefing on Tuesday. She said:

Pertaining to the prosecution of land and space barons, Cabinet wishes to inform the nation that there has been progress on new cases of land barons arrested under criminal abuse of duty and fraud, with a cumulative 31 arrests.
These are high-profile cases being handled by the Criminal Investigations Department in Harare, while low-profile cases are being dealt with at police stations countrywide.
The Zimbabwe Republic Police has received a total of 426 cases, and so far 10 convictions have been secured since the operation commenced.

The Government has been accused of promoting a “catch and release” culture whereby suspected criminals are arrested for show and then released to enjoy their ill-gotten riches.

31 High Profile Land Barons Arrested - Govt

The Deputy Chief Justice, Elizabeth Gwaunza, has scoffed at allegations that the country’s justice delivery system is plagued by a “catch and release” syndrome whereby well-connected individuals are arrested for graft and then released.
Over the years, a number of senior government officials and their alleged associates have been hauled before the courts on corruption allegations only to be later released and acquitted.
This has left ordinary people questioning the impartiality of the country’s justice system.
However, speaking during the official opening of the 2023 legal year in Bulawayo on Monday, Gwaunza said the allegations lack both legal and factual basis. She said:

The so-called “catch and release” narrative ascribed to the courts has no legal and factual basis.
The cynical suggestion has been that courts are involved in a conspiracy arrangement with the other state agents in the criminal justice system to release persons accused of corruption in what is called a “catch and release” phenomenon.”
When a person has been arrested, he or she is entitled to bail as of right unless there are compelling reasons not to grant bail.
When a person accused of a crime is released on bail, this is a legal and constitutionally provided for process, not to be derogatively dismissed as a “catch and release” procedure.
When a trial takes place, it is also a constitutional imperative that the suspect goes through a fair trial.
A person who has gone through the criminal proceedings and is released on acquittal cannot be dismissed as a “catch and release” case.
The Constitution guarantees a fair criminal justice system. It does not guarantee a criminal justice system in which everyone arrested must be convicted even where there is no evidence.

She said there are currently 147 corruption-related cases pending in the courts.
Gwaunza added that of these cases, 89 are either in progress or have been finalised, with 16 cases having trial dates, whilst for 52 cases trials have commenced.

Deputy Chief Justice Dismisses The "Catch And Release" Accusation

Zimbabwe Anti-Corruption Commission (ZACC) chairperson Justice Loice Matanda-Moyo has denied that the anti-graft body has a “catch and release” culture whereby suspected criminals are arrested for show and then released to enjoy their ill-gotten riches.
Matanda-Moyo stated that ZACC’s mandate is to investigate and arrest culprits and then prepare and send dockets to the National Prosecuting Authority.
She said it is imperative for ZACC and the NPA to work together to ensure that corrupt individuals are prosecuted and punished. She said:

ZACC is mandated to investigate and arrest. We prepare dockets and hand over these to the National Prosecuting Authority.
ZACC cannot even follow the courts, whatever happens there we have no obligation to consult and it is the prerogative of the National Prosecuting Authority (NPA) to prosecute.
And we need to be acting in unison to successfully fight corruption.

On Monday, economist Professor Gift Mugano said authorities should take corruption as seriously the way they are taking the anti-sanctions drive.
Speaking on one of Star FM’s current affairs programmes, Mugano said the billions of dollars lost through corruption could have been used to bust the sanctions. He said:
<blockquote>
We don’t want to package corruption as if it is an excuse because we have sanctions, that will be wrong; that will be tragic and that is my point of departure that when we have agreed that sanctions are a real issue, but I am very concerned as an academic that Government has not taken serious steps to deal with corruption.
Do you think even if sanctions are removed today, we can be given US$3,3 billion by the IMF (International Monetary Fund) and World Bank? No.
But we could have used the resources to bust sanctions if we were very careful and very proactive in terms of corruption.
