A 40-year-old woman from Mutare has been sentenced to pay a fine of US$120 by the Mutare Magistrate’s Court on a charge of bigamy.
Bigamy is the act of entering into a marriage with one person while still being legally married to another person.
The accused, Tambudzai Muwadi, was found guilty of entering into a second marriage while her first marriage was still legally valid.
According to the National Prosecuting Authority (NPA), Muwadi initially got married to Jonathan Kisi in January 2004 under the Marriage Act Chapter 05:11 and was issued a marriage certificate by the Harare Magistrates’ Court.
Although Muwadi and Kisi later separated, they did not officially cancel their marriage. Then, on September 3, 2005, Muwadi went on to marry Julius Tawanda Mukajami, also under the provisions of the Marriage Act Chapter 05:11, and was issued another marriage certificate.
The court has ordered Muwadi to pay a fine of US$120 or face 30 days of imprisonment. Additionally, the marriage certificate issued for her second marriage has been referred to the Registrar General’s office for cancellation.

Mutare Woman Fined US$120 For Bigamy

The High Court has awarded US$5 000 in damages to a Harare man, Cloudio Jume, after his wife, Thelmah Guvakumwe, was convicted of marrying another man, while their marriage still subsisted.
<a href="https://www.hmetro.co.zw/man-wins-bigamy-damages/">H-Metro</a> reported that Jume had initially demanded US$50 000 for the loss of consortium and conjugal rights and a further US$50 000 for contumelia.
According to an <a href="https://zimlii.org/akn/zw/judgment/zwmsvhc/2023/19/eng@2023-01-25#:~:text=Contumelia%20encompasses%20the%20injury%2C%20insult,Khumalo%20v%20Mandishona%20(supra)%3B">online source</a>, contumelia encompasses the injury, insult and indignity suffered by the plaintiff as a result of the adultery and loss of consortium relates to the loss of comfort society and service of the wife of the husband and as the case may be as a result of the adultery committed by the defendant.
Jume approached the High Court saying his reputation was tarnished, privacy infringed and dignity lost.
However, Justice Emilia Muchawa dismissed the claim for loss of consortium after finding that Jume had no love left for Guvakumwe.
Guvakumwe was convicted of bigamy in December 2022 after marrying her neighbour, Elton Sanyamahwe, and sired a child with him while married to Jume.
Bigamy refers to the act of marrying someone while already being legally married to another person.
The court established that Sanyamahwe was aware of the existence of the marriage between Jume and Guvakumwe when he engaged in an adulterous relationship with her.
Guvakume was fined US$10 000 and made to perform 105 hours of community service at Warren Park 1 Primary School.
The court also found that Jume had divorced or separated from up to three other women. It established that Sanyamahwe was dishonest in his defence after denying fathering the child.
Jume and Guvakumwe married in March 2014 before solemnising their marriage in September 2017 in terms of the Marriages Act (Chapter 5:11).
Their marriage was dissolved on 16 March last year after Jume found out about the adulterous affair.
Justice Muchawa found it a common cause that Guvakumwe was still married to Jume in September 2021 when she started becoming intimate with Sanyamahwe.
Guvakumwe claimed she met Sanyamahwe at a bar after her break-up, drugged him and the two became intimate.
Sanyamahwe claimed he was raped after a night out as he had woken up naked in a bar.
Jume told the court that he was made to believe that his wife had secured a job in Chegutu while she was in the neighbourhood with Sanyamahwe.
In her ruling, Justice Muchawa said:

The totality of the evidence, however, shows that Jume was a philandering man who was married to a woman 24 years his junior, who was one in a row of up to three others whom he had divorced or separated from.
He even boasted that married men go out for a good time with many other women and it is okay. It only becomes a problem when the women do likewise.
Sanyamahwe is alleged to have been boasting that Jume’s wife had left him because of his small manhood and he was better able to satisfy her.
He was alleged not to be remorseful.

In Zimbabwe, the Marriages Act, which came into operation on 16 September 2022, introduced a civil partnership and a qualified civil marriage and recognises an unregistered customary law union as a marriage.
Under the Marriages Act, the types of marriages are Civil Marriage (one man, one wife), Registered Customary law union ((one man, potentially many wives), Unregistered Customary law union (one man, potentially many wives), Qualified Civil marriage (civil marriage which is polygamous or potentially polygamous), and Civil Partnership (which is not recognised as a marriage, but only recognised to determine rights upon dissolution of the relationship).

Harare Woman Marries Two Husbands, Ordered To Pay Damages To First Hubby

Simbarashe Mutsahuni Chikore, the son-in-law of the late former Zimbabwean president Robert Mugabe, is allegedly facing serious legal consequences following the reports that he committed bigamy by marrying his wife Bona Nyepudzai Ouma while his marriage to Margaret Jeanine Brooks in the United States was still in effect.
Chikore had married Brooks in St. Louis County, Missouri, US, on 9 October 2000, and subsequently married Bona on 31 March 2014. However, Chikore only obtained a formal dissolution of his marriage to Brooks on 23 April 2014 – one month and 23 days after marrying Bona. It appears that Chikore only sought to formally dissolve his previous marriage after marrying Bona in order to conceal his actions.
It is important to note that bigamy is a criminal offense in Zimbabwe, which renders Chikore’s civil marriage to Bona invalid. As a result, his claims to property in their estate may also be deemed invalid.
These reports have emerged in the context of an <a href="https://www.pindula.co.zw/2023/03/07/breaking-bona-mugabe-divorces-simba/">ongoing legal dispute</a>, following Bona Nyapudzai Ouma Mugabe’s <a href="https://www.pindula.co.zw/2023/03/07/bona-mugabe-files-for-divorce-from-simba-chikore/">filing for divorce</a> from her husband Simbarashe Mutsahuni Chikore, after nine years of marriage. The couple married in 2014 at Mugabe’s Blue Roof mansion in Borrowdale, Harare, in a ceremony attended by African heads of state and government and other high-level dignitaries. They lived in a house donated by Mugabe himself, along Quorn Avenue in Mount Pleasant, Harare.
Bona filed for divorce under HC 1521/2023, citing the loss of love and affection between the couple and the fact that they have been living apart for over nine months. She is seeking full custody of their three children, with Chikore being granted access to them every alternating weekend. Bona has also requested that Chikore pay maintenance for the children in the amount of USD2,700 per child per month until they attain majority status or become self-sustaining, whichever occurs first. The couple jointly and severally acquired various movable and immovable properties during the marriage. Bona is 32 years old while Chikore is 46.

Chikore Faces Legal Consequences For Allegedly Committing Bigamy With Bona Mugabe

A 29-year-old woman from Chitungwiza has been sentenced to six months in jail following her conviction for bigamy after getting married to two husbands.
The suspect, Thelma Guvakumwe, married her lover under customary marriage while she was still in a monogamous marriage with her first husband.
However, her jail term was commuted to community service after she was initially sentenced to six months in prison.
She will perform 105 hours of community service instead of serving the jail term.
Allegations were that Guvakumwe left her first husband, whom she was legally married to, saying she was pursuing further studies.
The matter came to light after her first husband discovered that Guvakumwe was not at school and had gone on to marry her lover.

Chitungwiza Woman Sentenced To Six Months In Jail For Marrying Two Husbands

A Zvishavane woman has been arrested for allegedly marrying another man while her marriage to her first husband was still in force.
Moreblessing Maridza (41) of Platinum Park in Zvishavane appeared before the local magistrate, Archie Wochionga facing bigamy charges last week and was convicted on her own plea of guilty.
She was sentenced to six months in prison, however, three months were suspended on condition that she pays a fine of $5 000.
The other three months were suspended on condition on she does not commit a similar offence in the next five years.
Maridza told the court that her first husband, James Chivandire is mentally challenged and has failed to be intimate with her for the past 12 years.
The court heard that Maridza and Chivandire wedded under Chapter 5.11 of the Marriage Act which prohibits a man or a woman from marrying more than one spouse.
In 2012 Maridza went on to marry a second husband, David Mhuru and wedded him under the same Marriage Act and the two started living together.
The matter only came to light in September when an officer at the Registrar-General’s office observed that Maridza had two valid marriage certificates.
The State proved that Maridza married and wedded Mhuru while fully aware that she was legally married to Chivandire under Marriage Act Chapter 5.11.
