More than four thousand (4,000) prison inmates benefited from the latest Presidential amnesty that is meant to decongest the country’s jails.
The amnesty was granted under Clemency Order Number 1 of 2024, published in an Extraordinary Gazette on Tuesday.
The announcement was made by the Permanent Secretary in the Ministry of Justice, Legal and Parliamentary Affairs, Vimbai Nyemba, under General Notice 467 of 2024.
In 2023, the President granted amnesty to 4 270 inmates. The latest amnesty, however, excludes those serving time for specified offences.
Specified offences are murder, treason, rape or any sexual offence, carjacking, robbery, public violence, human trafficking, unlawful possession of a firearm, contravention of the Electricity Act, contravention of the Postal and Telecommunications Act, contravention of the Public Order and Security Act/Maintenance of Peace and Order Act and any conspiracy, incitement or attempt to commit any of the offences listed above.
Speaking to <a href="https://www.herald.co.zw/president-grants-amnesty-to-4-000-prisoners/">The Herald</a>, Zimbabwe Prisons and Correctional Services (ZPCS) spokesperson, Assistant Commissioner Meya Khanyezi, urged the beneficiaries of the amnesty to use their freedom to transform their lives as law-abiding citizens. She said:

As we celebrate the 44th anniversary of our great country’s independence tomorrow (today), let us rejoice in this great act of clemency.
In due course, our correctional facilities shall witness the joyous sight of inmates embarking on their journey back home, as soon as due processes to select deserving inmates are completed.
This Presidential Amnesty serves as a tangible demonstration of the Government’s commitment to the rehabilitation of our fellow citizens.
It is a significant step towards building a harmonious and inclusive society, where every individual has the opportunity to contribute positively.
To beneficiaries of this amnesty, we extend our warmest congratulations and encourage them to seize this fresh start as an opportunity for personal growth and transformation.
This release is not only a second chance: it is an opportunity to rewrite the narrative of their lives and become productive members of society, coming from behind bars to business.
We encourage them to embrace this freedom with a deep sense of responsibility and a commitment to making amends for past mistakes.

According to the Zimbabwe National Statistics Agency (ZIMSTAT), the total prison population in the 3rd Quarter of 2023 was 21,619, (20,997 males and 622 females). Males constituted 97.1 percent of the prison population whilst women were 2.9 percent.
The national imprisonment rate was 142 prisoners per 100,000 people. The imprisonment rate for males and females was 288 per 100,000 and 8 per 100,000, respectively.

4 000 Prisoners Benefit From Presidential Amnesty

President Emmerson Mnangagwa has announced a general amnesty to several categories of inmates in a bid to release pressure on overcrowded jails.
According to Clemency Order No. 1 of 2024 published in the Extraordinary Government Gazette on 16 April, the amnesty covers all convicted female inmates except for those convicted of “specified offences”, among other categories.  Moreover, the female inmate should have served one-third of the sentence by 18 April 2024. The Clemency Order reads in part:

IT is hereby notified that His Excellency the President has, in terms of section 112(1)(a) and (d) of the Constitution of Zimbabwe, made the order set out in the Schedule…
This order may be cited as Clemency Order No. 1 of 2024.
Remission of Sentence for Convicted Female Inmates
1. A full remission of the remaining period of imprisonment is hereby granted to all convicted female inmates, save for those convicted of specified offences. The inmate should have served one third (1/3) of the sentence by 18th April, 2024.
Remission of Sentence for All Juveniles
2. Full remission of the remaining period of imprisonment for all juveniles that is, those inmates under the age of eighteen (18) years. The inmate should have served one third (1/3) of the sentence by 18th April, 2024. Age determination will be based on the birth certificate or dental age estimation of the concerned prisoner. Inmates charged under the Criminal Law (Codification and Reform) Act [Chapter 9:23] are excluded from this Amnesty.
Remission for Prisoners Sentenced to 48 Months and Below
3. Full remission of the remaining period of imprisonment is hereby granted to all those prisoners serving an effective period of forty-eight (48) months and below and who would have served one third (1/3) of their sentence by 18th April, 2024, provided they are not convicted for specified offences.
Remission of Sentence on Medical Grounds
4. Full remission of the remaining period of imprisonment is hereby granted to all inmates certified terminally ill by a Correctional Medical Officer or a Government Medical Officer (GMO). Inmates charged under the Criminal Law (Codification and Reform) Act [Chapter 9:23] are excluded from this Amnesty. The Department of Correctional Services should liaise with Social Welfare so that there is continuity of treatment after release.
Remission of Sentence for Prisoners at Open Prison
5. Full remission of sentence is hereby granted to all inmates serving terms of imprisonment at the Open Prison. Inmates charged under the Criminal Law (Codification and Reform) Act [Chapter 9:23] are excluded from this Amnesty.
Remission of Sentence for Prisoners Aged 60 Years and Above
6. Full remission of the remaining period of imprisonment for all prisoners aged sixty (60) years and above, and who would have served one tenth (1/10) of their sentence by 18th April, 2024. Inmates charged under the Criminal Law (Codification and Reform) Act [Chapter 9:23] are excluded.
Remission of Sentence to Prisoners Sentenced to Life Imprisonment
7. Full remission of the remaining period is hereby granted to all those inmates who would have served life imprisonment for at least twenty (20) years. This includes-
(a) inmates sentenced to life imprisonment; 
(b) inmates whose sentences were commuted from death to life imprisonment. In this case the period of 20 years will include the period when the inmate was serving as a Prisoner under sentence of death; 
(c) inmates whose sentences were altered to life imprisonment on appeal or review.
Commutation of Death Sentence to life imprisonment
8. Commutation of the death sentence to life imprisonment is hereby granted to all inmates who have been on death roll for ten years and above.
Remission of Sentence for Prisoners with disabilities
9. Full remission of the remaining period of imprisonment is hereby granted to all inmates who are certified by a Correctional Medical Officer or a Government Medical Officer to be visually impaired, and those who are physically challenged to the extent that they cannot be catered for in a Prison or Correctional environment and have served one third (1/3) of their sentence by 18th April, 2024.
Quarter Remission for Inmates Serving Effective Sentence Above 48 Months
10. An additional one quarter remission of the effective term of imprisonment to those prisoners who were sentenced to more than 48 months and who would have served at least one third (1/3) of the sentence by 18th April, 2024, including those with specified offences provided they are not excluded in terms of paragraph 12.
Prisoners Excluded from the Proposed Amnesty
11. Inmates to be excluded from the proposed general amnesty are the following: 
(a) any inmate who was previously released on amnesty; 
(b) any inmate serving a sentence imposed by Court Martial; (c) any inmate who has a record of escaping from lawful custody. Specified Offences
12. For the purpose of this amnesty “specified offence” includes: (a) Murder; 
(b) Treason; 
(c) Rape or any sexual offence; 
(d) Carjacking; 
(e) Robbery; 
(f) Public violence; 
(g) Human trafficking; 
(h) Unlawful possession of firearm; 
(j) Contravention of the Electricity Act; 
(k) Contravention of the Postal and Telecommunications Act; 
(1) Contravention of the Public Order and Security Act/ Maintenance of Peace and Order Act; 
(m) Any conspiracy, incitement or attempt to commit any of the offences listed above.

President Mnangagwa Pardons Prisoners In Clemency Order No. 1 Of 2024

President Emmerson Mnangagwa has ordered the release of 4 279 prisoners under the latest Presidential Amnesty.
According to the Zimbabwe Prisons and Correctional Services (ZPCS), a total of 4 166 men and 104 women will be released from the country’s 47 main prisons and eight satellite prisons.
In a statement released on Thursday, ZPCS spokesperson Meya Khanyezi said:

These inmates were being rehabilitated and have been serving for the offences they committed against the state therefore, those aggrieved are encouraged to forgive them for their successful reintegration into society.

According to a Statutory Instrument of an Extraordinary Government Gazette published last Friday by the Ministry of Justice, Legal, and Parliamentary Affairs, those who have been pardoned include terminally ill female prisoners and juveniles who are not serving specified offences.
Those to be released would have served one-third of their sentences by 18 April 2023 while those who remain in prison are convicts serving time for violence-related offences.
Khanyezi urged communities to forgive and embrace the inmates that have been given amnesty.<a href="https://www.chronicle.co.zw/over-4-000-prisoners-set-for-release/"> She said</a>:

We would like to appeal to the close family members, stakeholders, and the society at large to embrace and accept inmates who have been released on amnesty.
Successful reintegration of inmates back into society is not the sole mandate of ZPCS alone but it requires combined efforts from all citizens of Zimbabwe.
These inmates were being rehabilitated and have been serving for the offenses they committed against the state, therefore, those aggrieved are encouraged to forgive them for their successful reintegration into society.

Bulawayo Metropolitan – 688 (680 males and 8 females)
Matabeleland North – 231 (230 males and 1 female)
Matabeleland South – 129 (127 males and 2 females)
Harare – 790 (770 males and 20 females)
Midlands – 537 (527 males and 10 females)
Mashonaland East – 397 (358 males and 39 females)
Mashonaland West – 340 (333 males and 7 females)
Mashonaland Central – 206 (204 males and 2 females)
Masvingo – 398 (392 males and 6 females)
Midlands – 537 (527 males and 10 females)
Zimbabwe’s prisons have a carrying capacity of 17 000 inmates but were holding more than 22 000.

President Mnangagwa Grants Amnesty To Over 4 000 Prisoners

President Emmerson Mnangagwa has approved amnesty on prisoners serving lighter sentences or who have served over one-third of their sentences.
The move follows a request by the Zimbabwe Prisons and Correctional Services (ZPCS) who are keen on decongesting the correctional facilities for controlling the spread of the coronavirus.
Speaking during an interview yesterday on the sidelines of his tour of Beitbridge Prison, ZPCS Commissioner-General Moses Chihobvu said:
His Excellency, the President has today signed our request to offer amnesty to some prisoners.
<blockquote>What is only left is to gazette the new order so that we may be able to release those who qualify.
… I don’t have the statistics offhand, but we are hopeful that the amnesty will help a great deal in decongesting crowded correctional facilities.
At the same time, I want to urge those that will benefit from the clemency to take this as a second chance for them to lead a better life.</blockquote>
Inmates in the country are graded into four classes, A-D and those in Class D are the ones serving long-term sentences ranging from seven years and above, including those who would have committed serious crimes some of which include murder, armed robbery, fraud, or rape, among others.

Mnangagwa Approves Prisoner Amnesty Request

Commissioner General of the Zimbabwe Revenue Authority (Zimra), Faith Mazani has revealed that most businesses have ignored Zimra’s tax amnesty. The amnesty is ending on the 30th of June. Mazani said that it was unfortunate that most of the businesses had not taken advantage of the amnesty to put their books in order. Said Mazani
<blockquote>This is worrisome because it’s very slow. Very few companies have responded to the tax amnesty. It’s ending in June, so we don’t expect many (corporate) to come over now.</blockquote>
When the amnesty was announced Zimra said,
<blockquote>In an effort to encourage our valued clients to regularize their tax affairs, Government has, through the Finance Act No. 1 of 2018 published on 15 March 2018, made provisions for the granting of a tax amnesty to persons on application. Persons include companies, corporate or unincorporated body of persons and trusts. Any person who has unpaid tax or duty by 1 December 2017 is eligible to apply for tax amnesty. This applies to tax or duty already known by ZIMRA and recorded on its systems or that which a person had not declared to ZIMRA but should have been paid by 1 December 2017. The tax or duty should have been due and payable before 1 December 2017.</blockquote>

Businesses Ignore Zimra's Tax Amnesty

The Zimbabwe Revenue Authority (Zimra) has extended its amnesty for persons that has unpaid tax or duty prior to 1 December 2017. The amnesty ends on June 30 this year.
A statement on Zimra’s website reads:
<blockquote>In an effort to encourage our valued clients to regularize their tax affairs, Government has, through the Finance Act No. 1 of 2018 published on 15 March 2018, made provisions for the granting of a tax amnesty to persons on application. Zimra Gives Businesses Three Months To Get Their Books In Order

Speaking at the handover ceremony of a 30-tonne sugar donation by Tongaat Hullet, Zimbabwe Prisons and Correctional Services (ZPCS) Commissioner-General Paradzai Zimondi, confirmed President Emmerson Mnangagwa approved the release of inmates serving light sentences or experiencing health challenges.
Zimondi said that the Minister of Justice had confirmed the development to him. Said Zimondi:

Mnangagwa Approves Release Of Prisoners

In an interview with The Sunday Mail last week, Reserve Bank of Zimbabwe (RBZ) governor John Mangudya said that the Central Bank is working on an amnesty deal similar to the one issued by President Emmerson Mnangagwa last week. RBZ will allow individuals and companies hoarding cash inside Zimbabwe to bank the funds without prosecution.
This is meant to improve availability of cash at banks. RBZ will also introduce other measures such as increasing the importation of cash using part of the Nostro Stabilisation Facility proceeds. Said Mangudya:
<blockquote>Confidence-building is critical as it gives impetus to the efficient circulation of money within the economy, and is, therefore, a prerequisite to improve the availability of cash at banks. Secondly, the amnesty granted by the President in respect of illegally-expatriated cash and assets is expected to increase cash availability once the funds start to flow into the economy.
Thirdly, Government, through the Reserve Bank, is working on a similar amnesty to deal with cases of in-country hoarding of cash at homes. Hoarding of cash is counter-productive as it reduces the circulation of money. Hoarding has a cash-hemorrhaging effect on the economy. Fourthly, the Reserve Bank shall be increasing the importation of cash using part of the Nostro Stabilisation Facility proceeds. Cash imports currently stand at around US$50 million per month to cater for diaspora remittances, small-scale gold producers and the banking public, and $15 million bond notes to fund the Export Incentive Scheme.</blockquote>
