Last week, Representatives John James and Jared Moskowitz skillfully guided the bipartisan U.S.-South Africa Bilateral Relations Review Act through the House Foreign Affairs Committee.
The bill, which aims to evaluate and enhance the relationship between the United States and South Africa, received a favourable vote in committee with a tally of 36-13.
Representative James, who chairs the Subcommittee on Africa, emphasized the significance of South Africa’s role on the African continent.
He expressed pride in the longstanding cordial relations between the United States and South Africa, highlighting the latter’s status as the largest U.S. trading partner in Africa since 2014.
However, James also voiced concerns about the current alignment of the African National Congress (ANC) with China, and Russia, and their embrace of Hamas following the devastating October 7th attacks. He said:

As Chairman of the Subcommittee on Africa, I am acutely aware of South Africa’s important role on the African continent, and I am proud that the United States has held cordial relations with South Africa for nearly my entire life.
South Africa has been the United States’ largest trading partner in Africa since 2014 and is home to over 600 
American businesses.
However, it is clear to me that the ANC of today is no longer the party of Nelson Mandela and I am greatly concerned with South Africa’s alignment with China and Russia and embracement of Hamas in the wake of the devastating October 7th attacks.
It is important to show the South African people that the United States are paying attention, and I am proud that the committee passed this bipartisan legislation.

Representative Moskowitz echoed these sentiments, emphasizing the importance of reviewing relationships with nations that may not share American values.
He expressed hope that South Africa would reconsider its alignment with Russia and China. Said Moskowitz:

South African officials have made a miscalculation by aligning themselves with Russia and China. It is in our national security interests for the United States to review our relationships with nations that may not share our values and align themselves with such actors.
My hope is that they choose otherwise. I’m proud to have worked with Chairman McCaul and Congressman James on this bill and that there is strong bipartisan support among our colleagues.

The bill now heads to the floor of the U.S. House of Representatives to be considered by the whole House.
If the comprehensive review determines that South Africa’s actions undermine U.S. national security or foreign policy interests, South Africa could be removed from the African Growth and Opportunity Act (AGOA).
AGOA provides eligible African countries with preferential trade benefits, and exclusion would impact South Africa’s access to the U.S. market.
Findings against South Africa might hinder existing public health collaborations and regional development programs.

Bipartisan Bill Calling For Review Of US-South Africa Relations Passes Through Committee

South Africa’s Department of International Relations and Cooperation Deputy Director-General Public Policy, Clayson Monyela said that South Africa has noted a letter by four United States legislators to the country’s Secretary of State Anton Blinken.
In the letter, dated 09 June 2023, the four Congressmen asked that this year’s African Growth and Opportunity Act (AGOA) summit be moved away from South Africa, accusing Pretoria of supporting Russia militarily amid the ongoing war in Ukraine.
Posting on Twitter, this Tuesday, Monyela said that there is no decision by the United States Government to move the AGOA Forum from South Africa. <a href="https://twitter.com/ClaysonMonyela/status/1668553853480968192?s=20">He said</a>:

President Cyril Ramaphosa’s special envoys recently visited the US to meet and explain South Africa’s active non-aligned position on the Russia/Ukraine conflict to key stakeholders and decision-makers.
Our diplomats in Washington continue to engage on these matters. President Cyril Ramaphosa is leading an African Peace Mission (in the coming days) to Russia and Ukraine.
South Africa enjoys the support of the US government, the Africa Group and Business in hosting the AGOA Forum which is planned for November.
The relations between South Africa and the United States of America are mutually beneficial…even in the context of AGOA.

The United States has accused South Africa of shipping weapons to Russia in December last year. Wrote the U.S. legislators:

Late last year, a Russian cargo vessel subject to US sanctions docked in South Africa’s largest naval port, and intelligence suggests that the South African government used this opportunity to covertly supply Russia with arms and ammunition that could be used in its illegal war in Ukraine.
</blockquote>
The South African government has, however, denied the charge, with President Cyril Ramaphosa launching an independent investigation into the accusation.

No Decision By United States To Move AGOA Forum From SA - Monyela

A group of both US Democratic and Republican lawmakers has asked the White House to move this year’s African Growth and Opportunity Act (AGOA) summit away from South Africa.
They are accusing the South African Government of deepening its military relationship with Russia amid the ongoing war in Ukraine.
AGOA gives duty-free access to 25% of South African exports to the United States of America.
A letter dated 09 June addressed to US Secretary of State Antony Blinken, Trade Representative Katherine Tai and National Security Advisor Jacob Sullivan, by the group reads:
<blockquote>
Dear Secretary Blinken, Ambassador Tai, and Mr. Sullivan:
The African Growth and Opportunity Act (AGOA) is the cornerstone of the United States’ economic relationship with Sub-Saharan Africa, enabling deeper commercial ties and strengthening U.S. relationships with the region.
We strongly support this program, and support its reauthorization well ahead of its expiration in 2025.
The annual AGOA Forum offers an important opportunity for U.S. and African leaders to bolster economic and diplomatic relations, and we support your continued work to convene a forum in Africa this year.
However, we wish to express serious concerns with the current plans to host this year’s AGOA Forum in South Africa.
South Africa’s government has formally taken a neutral stance on Russia’s unlawful invasion of Ukraine but has deepened its military relationship with Russia over the past year.
Late last year, a Russian cargo vessel subject to U.S. sanctions docked in South Africa’s largest naval port, and intelligence suggests that the South African government used this opportunity to covertly supply Russia with arms and ammunition that could be used in its illegal war in Ukraine.
In February, South Africa held joint military exercises with Russia and China, and in April, authorized a Russian military cargo plane also subject to U.S. sanctions to land at a South African air force base.
On top of this, in August, South Africa will host the BRICS Summit where the government aims to strengthen its ties with China and Russia and is working to facilitate the participation of Russian President Vladimir Putin, despite the outstanding arrest warrant issued by the International Criminal Court (ICC).
We are seriously concerned that hosting the 2023 AGOA Forum in South Africa would serve as an implicit endorsement of South Africa’s damaging support for Russia’s invasion of Ukraine and possible violation of U.S. sanctions law.
Further, these actions by South Africa call into question its eligibility for trade benefits under AGOA due to the statutory requirement that beneficiary countries “not engage in activities that undermine United States national security or foreign policy interests.”
While we understand that the AGOA eligibility review process for 2024 is underway and that decisions have not yet been made, we question whether a country in danger of losing AGOA benefits should have the privilege of hosting the 2023 AGOA Forum.
Our concerns are shared by many South African citizens and businesses, who are increasingly vocal about deteriorating conditions in the country.
We encourage you to explore other possible locations to host this year’s forum: we believe it is important that the forum takes place this year and that it be held in Africa, continuing the tradition of alternating the forum’s location between the United States and an AGOA-eligible country.
If South Africa continues to demonstrate support for Russia in its unlawful invasion of Ukraine, then hosting the forum in another country in Sub-Saharan Africa would send a clear and important message that the United States continues to stand with Ukraine and will not accept our trading partners provision of aid to Russia’s ongoing and brutal invasion.

Top United States Lawmakers Demand South Africa Be Punished For Alleged Russian Support

<blockquote>The African Growth and Opportunity Act (AGOA) is a trade act created by the United States as a way to help the countries of sub-Saharan Africa increase their access to U.S. markets to improve trade.
The African Growth and Opportunity Act can help producers in Africa ship their products to the U.S. duty-free. There is no required size for a company to be eligible, and there is no minimum product requirement to receive The African Growth and Opportunity Act treatment on products.
Here are the ways you can figure out whether or not your product is eligible for The African Growth and Opportunity Act treatment:
Your country must be eligible 
Only countries within sub-Saharan Africa are eligible for The African Growth and Opportunity Act. To be eligible, a country must be striving to improve human rights, labour standards and rule of law, among other things.
The beneficiary countries and specific criteria used to determine the eligibility of countries for AGOA treatment can be found on AGOA’s website.
Your product must be eligible and meet the requirements of origin rules 
Once you know whether your country is eligible, you must determine whether your product is eligible. For a product to be eligible it must be 100 per cent locally produced by the AGOA country.
If a product has inputs from other countries, 35 per cent of the value and materials must be by the beneficiary countries.
Agricultural products 
Agricultural products can be shipped duty-free without having to go through AGOA. However, they must comply with regulations set out by the FDA, USDA and the EPA.
Textiles or apparel 
Apparel and apparel made of sub-Saharan African fabric that is assembled in a beneficiary country are both eligible for the African Growth and Opportunity Act treatment.
Apparel assembled of fabric from anywhere in the world is eligible for The African Growth and Opportunity Act treatment as well, even for imported fabrics, as long as 35 per cent of the fabric is from the beneficiary country.
Documentation must be filled out carefully 
This is the final but most important detail for receiving AGOA treatment for products. The invoice used to apply for AGOA treatment must be stamped with a visa stamp.
Various countries provide the stamp at customs services. This is important because without this stamp your product will not be eligible for duty-free treatment. For textiles, a specific AGOA textile certificate of origin for textiles and apparel must be filled out.
