Zimbabwe will proceed with presidential and legislative elections in July-August after the <a href="https://news.pindula.co.zw/2023/05/08/constitutional-court-dismisses-mwonzoras-application-to-nullify-zecs-delimitation-report/">Constitutional Court rejected an application</a> by the opposition party, MDC, to nullify ZEC’s Delimitation report.
MDC which is led by Senator Douglas Mwonzora approached the courts seeking the nullification of the delimitation report claiming that it favoured the ruling ZANU PF. 
What is delimitation?
Delimitation is a process of dividing a country into constituencies and wards for elections. An unbalanced delimitation that favours a party is called “gerrymandering” and can manipulate election results.
MDC claimed the February delimitation report favoured ZANU-PF. The Constitutional Court, however, rejected their application on the grounds that the MDC could not prove how fundamental rights were being violated and how the delimitation of constituencies affected those rights.
MDC Rejected the Court Outcome:
But the party’s president, Douglas Mwonzora, told reporters that the court dismissed the application because it does not hold jurisdiction and that the Constitutional Court had “made a political judgement.” Mwonzora said the judgement was unfair and they will continue to fight for free and fair elections. He stated that the delimitation report is flawed and could lead to a disaster, making Zimbabwe a laughingstock.
Lawyer Lovemore Madhuku who represented MDC said they want a court to declare the delimitation report invalid. They may go to the High Court to fight legally.
What if the delimitation report is invalidated:
If the delimitation report is declared invalid, it would mean that the electoral boundaries and precincts drawn by the report would be nullified and new boundaries would have to be created through a new delimitation process. This could potentially delay the upcoming elections in Zimbabwe, as a new delimitation process would need to be carried out. It is likely that a new delimitation process would take several months to complete.
The general elections must be held between 26 July and 26 August, to comply with Constitutional regulations that the election must come not more than 30 days after the expiry period of the current Parliament. Current laws also stipulate that a proclamation can only be made 44-88 days before the election date.

MDC Loses Delimitation Report Case: Here Are The Effects

Jeremiah Bamu, a legal practitioner associated with the opposition Citizens Coalition for Change (CCC), has filed an application with the Constitutional Court to oppose Douglas Mwonzora’s legal challenge against ZEC’s 2023 delimitation report.
Mwonzora seeks to nullify the report and postpone the general election, scheduled for August, by six months to give the Zimbabwe Electoral Commission (ZEC) time to redo the delimitation exercise and provide a new report.
Bamu’s application to become Amicus Curiae is significant because it opposes Mwonzora’s request that, if the delimitation report is nullified, President Emmerson Mnangagwa’s election proclamation should be postponed until ZEC has redone the delimitation exercise and submitted a new report. In other words, Bamu’s application is against delaying the general election.
The main case will be heard by the full bench of the ConCourt next week on 8 May. Douglas Mwonzora and his supporters are optimistic that the ZEC delimitation report will be nullified since the formula used by the Commission is unconstitutional.
However, Jonathan Moyo, a former Information minister and political professor, argues that there are indications that the case may not be decided on its merits, but rather on technicalities.
Moyo who is also a legal expert says Mwonzora may face preliminary obstacles, such as a lack of capacity (locus standi) to sue ZEC as a presidential candidate. Moyo explained that Mwonzora is a presidential candidate, therefore, is unaffected by the new electoral boundaries in the ZEC delimitation report since voters can vote for him no matter the ward or constituency they are voting from. He added:

The fact that ZanuPF has virtually completed its primary elections and that CCC is about to complete its stalled candidate selection process, both based on new electoral boundaries, makes it unlikely that the ZEC delimitation report will be set aside. More likely, praxis will prevail over theory to avoid chaos. But in the event that the delimitation report is set aside, it is difficult to see why and how the Court would grant Mwonzora’s prayer that the election proclamation should only be made after ZEC has redone the delimitation report. This expectation might explain why through its proxy, CCC has opportunistically made a eleventh hour application to basically argue against postponement of the election. It’s a winning argument, almost guaranteed!

The CCC party’s spokesperson, Fadzayi Mahere, has compared elections to Christmas and believes they should take place regularly, regardless of the situation. The party alleges that Mwonzora’s challenge of the delimitation report was instructed by the ruling ZANU PF party, which is afraid of holding elections this year. The upcoming elections are set to take place sometime between July 26 and August 26. Political analysts have urged the implementation of political reforms to ensure fair competition.

CCC-linked Lawyer Applies To Oppose Mwonzora's Application On ZEC Delimitation Report

Opposition MDC-T led by Senator <a href="https://www.pindula.co.zw/Douglas_Mwonzora">Douglas Mwonzora</a> has recalled Chitungwiza Mayor, Councillor <a href="https://www.pindula.co.zw/Lovemore_Maiko">Lovemore Maiko</a>. In a letter, seen by Pindula News, the local authority’s Acting Clerk said they had received a letter from the Minister of Local Government and Public Works, July Moyo, notifying them that Maiko had been expelled from the party. Maiko is one of the dozens of councillors and legislators who have been recalled by the MDC-T since the <a href="https://news.pindula.co.zw/2020/04/02/full-supreme-court-ruling-on-mdc-leadership-crisis-case/">2020 Supreme Court ruling</a> on the MDC leadership crisis. Mwonzora-led MDC-T Recalls Chitungwiza Mayor Lovemore Maiko

Exiled former Information Minister, Jonathan Moyo, has said MDC-T leader, Douglas Mwonzora, orchestrated the demise of the opposition Movement for Democratic Change (MDC) brand.
He made the remarks this Thursday after the MDC Alliance led by Nelson Chamisa morphed into the Citizens’ Coalition for Change (CCC) after Mwonzora claimed that he was the leader of MDC Alliance and all MDC derivatives. 
Some analysts say the split of MDC-T into two factions, one led by Mwonzora and the other led by Thokozani Khupe as well as the formation of the CCC marks the demise of the MDC brand. Pindula News previously quoted Mwonzora as denying that the MDC-T had split.
Moyo, a Political Science professor accuses Mwonzora of causing the “demise” of the party formed at the turn of the millennium. Pindula News presents a statement by the former legislator for Tsholotsho:

Mwonzora Will Be Remembered As The Undertaker Of The MDC - Jonathan Moyo

MDC-T leader Douglas Mwonzora on Sunday apologised for “harsh” remarks that appeared to attack the quality of education at the Harare Polytechnic he uttered in response to Pedzisai Ruhanya’s criticism.
Mwonzora was responding to a tweet by MDC Alliance activist Ruhanya who had suggested that the MDC-T leader was a sellout. Ruhanya’s tweet read:

In Zimbabwe’s modern, contemporary history, there is no person and political party that beats Douglas Mwonzora and MDC-T in selling out and betraying the cause of the masses..
</blockquote>
Ruhanya also claimed that Mwonzora was closely associated with the ruling Zanu PF while also accusing him of “democratic subversion.”
In his response, Mwonzora equated the Harare Polytechnic where Ruhanya studied journalism before going on to university in Zimbabwe and the United Kingdom to Morogoro, a Tanzanian primary training camp for freedom for fighters during the war of independence. He said:

My brother that is why they say you have to directly go to university not via Morogoro. Poly ruined you my brother.
</blockquote>
Mwonzora’s remarks attracted criticism from some quarters, including exiled former minister of higher education, Professor Jonathan Moyo who described Mwonzora’s views as corrupt. Moyo said:

Your views on education are so demented and corrupt that no parent or guardian would want to be your neighbour, let alone to have you as a leader in their political party.
</blockquote>
The National Electoral Reform Agenda (NERA), a group of political parties, said in a brief statement:

Such insensitive mockery of lived experiences of many people is uncalled for.
</blockquote>
Mwonzora later took apologised saying adding that he was not attacking the quality of education at the institution. He said:

I apologise unreservedly to the good Zimbabweans who may have found this tweet offensive. I was attacking the type of student politics at the Polytechnical college during Mr Ruhanya’s time and not the quality of education there. Once again sorry.

Dispute With Ruhanya: Mwonzora Apologises For Harsh Remarks

The MDC-T led by Thokozani Khupe on Saturday while celebrating the party’s 21st anniversary said it was officially a an opposition party now and it was now participating in regional and international engagements on behalf of Zimbabwe, New Zimbabwe reports.
Douglas Mwonzora, the party’s Secretary General said the party has had successful engagements with regional and international diplomats and said;
<blockquote>We are happy to inform the nation and the party we are going to be lawfully participating in the programmes of the African Union as the official opposition party in Zimbabwe. Our first engagement is a workshop that is going to be held by the continental body on 29 September 2020.
We are happy to advise that we have been meeting both African and non-African diplomats in the country.
So far, we have engaged diplomats from United States, Britain, Germany, Switzerland, Australia, Botswana, Malawi and South Africa briefing them on what is happening in this country. We are glad that these engagements were very fruitful and a huge success. Our party is slowly on the rise.</blockquote>
Mwoznora said the party was getting ready to conduct the court sanctioned congress and details for the congress will be announced in due course:
<blockquote>The organising department has completed the finalisation of the data base for the congress delegates.On Wednesday next week, the national standing committee will receive a report and recommendations from our secretary for elections Mr Gadhi Mudzingwa. This will relate to the appointment of the independent electoral commission to run the congress elections, the dates and procedures of the nomination of candidates of this congress and the timeline to the actual congress. We appeal for discipline of party members as we go towards our congress.</blockquote>
The Supreme court in March ruled that nelson Chamisa was not the legitimate leader of the MDC T and made Khupe the interim MDC T leader and ordered the party to hold a congress in 90 days.

Our Party Is Slowly On The Rise - Mwonzora On Successful Engagements With International Diplomats

Reports suggest that opposition MDC leader, advocate Nelson Chamisa is faced with a hard task of accommodating party heavyweights who fell by the wayside at the recently held MDC congress. The Chronicle reports that party insiders believe that Chamisa has to simultaneously balance competing interests and accommodate those who lost elections.
Losing party bigwigs include former vice presidents, Mr. Morgan Komichi and Mr. Ellias Mudzuri, former secretary general, advocate Douglas Mwonzora, former youth leader Mr. Happymore Chidziva and executive members Ms. Lilian Timveous, Mrs. Teresa Makone and Mr. Murisi Zwizwai, among others.
The main issue, as reported by the Chronicle, is to decide which member among the losing bigwigs is to be included in the Standing Committee and the national executive.
Among other posts, the losing members will have to contest for the Organising secretary and secretary of information and publicity positions currently held in that order by Mr. Amos Chibaya and advocate Jacob Mafume.

Analysts Say Accommodating Losing MDC Bigwigs Puts Chamisa In A Difficult Situation

A Sunday News article has claimed that the MDC’s 5th elective congress that was recently held in Gweru has helped in disclosing serious democratic deficiencies in the party.
The author of the article, Khumbulani Vodloza Sibanda argues that during the party deliberately scandalised the court for political opportunism. Sibanda said:
<blockquote>This has the effect of undermining the Judiciary. The conduct of the congress itself left adherents of democracy in doubt as to the party’s commitment to fair play and transparency. Right from the start of the provincial congresses, Chamisa made sure that intimidation and violence were visited upon anyone who dared aspire to challenge him for that party’s presidency.</blockquote>
The author also notes that the violence targeted at ousted secretary-general, Douglas Mwonzora and his supporters for daring to challenge Nelson Chamisa for the party presidency was undemocratic. Sibanda also condemns Chamisa’s presence at provincial congresses where provincial members were choosing their candidates ahead of the main congress. Sibanda said:
<blockquote>This was gross intimidation and abuse of incumbency. Who would dare nominate other interested members to lead MDC when Chamisa and his violent Vanguard misfits were in the caucuses. No wonder why he emerged uncontested. Mwonzora eventually withdrew from the presidential race.</blockquote>
Sibanda also claims that Chamisa himself would complain about vote buying. The article suggests that contributions by VP aspirants, Tendai Biti, and Welshman Ncube were meant to influence the delegates. The author also decried the barring of many delegates from voting.

"MDC Congress Outcome Points To Serious Democratic Deficiencies In The Party," Opinion

MDC stalwarts who were not elected at the just ended party 5th elective congress are now banking on party leader Nelson Chamisa to save their political careers.
The party’s National Council and Congress, as well as the constitution, recently gave Chamisa the powers to appoint some individuals into the national executive.
Party bigwigs such as former vice presidents Elias Mudzuri and Morgen Komichi,  secretary-general Douglas Mwonzora, Tracy Mutinhiri,  former Economic planning minister Tapiwa Mashakada, youth assembly chairperson Happymore Chidziva and youth secretary-general Lovemore Chinoputsa among others fell by the wayside at the Congress.
Speaking to the Daily News yesterday, MDC spokesperson Jacob Mafume said:
<blockquote>The appointments will be done before the national standing committee which will be diarised soon but there are no constitutional provisions to say the president must make the appointments on or before this date.</blockquote>
Weeks before the Congress, Chamisa promised sweeping reforms which seek to boot out every suspicious element. Bigwigs including Douglas Mwonzora and Elias Mudzuri were labeled ZANU PF agents by some members of the party. Mwonzora has on several occasions refuted the claims.
These are not the first to be labeled enemies of the party working from within. Tendai Biti and Jacob Mafume (2014 onwards), Nelson Chamisa (after 2014 congress), Welshman Ncube (2005 onwards), and Job Sikhala (2010 onwards) are some of the party members who have been accused of working with the ZANU PF.
The Congress has however pardoned the formerly accused party cadres and readmitted them into the party.
