High Court Upheld Ban On Opposition Party's Campaign Launch

The High Court on Sunday upheld a ban on the planned launch of a campaign by the main opposition party, Citizens Coalition for Change (CCC). This is the third rally to be banned, as the leader of the party, Nelson Chamisa, faces obstacles on his campaign trail. The CCC was set to hold its campaign launch in Bindura, which is approximately 100 km (62 miles) north of the capital, Harare. However, the police banned the gathering, citing issues with the venue.

On Friday, CCC lawyers filed an urgent application at the High Court challenging the police’s decision. However, on Sunday, a judge referred the matter back to the lower court. Bindura Magistrate Mary Musika then upheld the ban, stating that the CCC had failed to notify the police on time.

According to CCC lawyer Agency Gumbo said the outcome showed that the playing field was not even. He told Reuters:

The ruling showed there is an uneven playing ground in this election. It shows that the democratic space has been eroded. We are getting into a match with both legs tied so you cannot score.

A few opposition supporters protested outside the court, chanting party slogans and expressing their disappointment that they were not free to support their party. Some had travelled all night to attend the rally. 36-year-old Patience Chigwande said:

It is disheartening because ZANU PF is allowed to campaign freely, but they are using the law to block our rallies. People now fear for their lives, and this will impact our vote.

Political analysts believe that the elections, in which President Emmerson Mnangagwa is seeking a second term, may lose credibility if the clampdown on the opposition continues.

The ruling ZANU-PF party has not commented on the matter yet.

The Charmerboy is working them busy, they are running like headless chicken. Even without campaigning Chamisa would easily win the elections. People are tired of this tired geriatric octogenarian president, it's now time for change. @Anonymous, Nero is The People's President. He won all systems down in 2018, but the Kleptocratic ZANU stole the vote with the connivance of a captured Thief Justice Ruka Marabishi. The Gold Mafia Godfather maybe the de jure and de facto president, but he lacks moral credibility.

The High Court actually ordered the Magistrate to hear the appeal on an urgent basis. It was the CCC Mayor who opposed the initially chosen venue - Chipadze Stadium - which is undergoing renovations. CCC bungled by not giving adequate notice to the Police & by not promptly finding a suitable venue for the rally. CCC must stop doing everything at the last minute. They should plan ahead & leave time to react & restrategise if things don't go as planned. But alas, "Stratejic Ambuguity" reqires them to do everything at the last minute. The Police also have an obligation to uphold public health in terms of the Public Health Act apart from enforcing law & order. The Victim mentality does not auger well for a party which wants to form the next government. Hichilema never went around crying like a baby. He strategised, gave Zambians courage to vote and he won. He never portrayed himself as helpless and hapless victim. Now, many Zimbabweans feel discouraged because of the CCC leader's victim rhetoric. Show the people you are strong and tough will prevail against all odds...

Fighting for your rights is not being a cry baby. The law is clear- the field must be level and every candidate should get equal opportunity to state their case to the populace. So how can we judge opposition leaders capability when the Powers-that-be are denying them a platform to sell themselves? All we are getting on public broadcasters is ZANU propaganda 24/7 and frankly it is not convincing.

Norton Independent Member of Parliament Temba Mliswa says opposition parties in Zimbabwe have always been treated badly by the status quo, but should instead devise other ways to campaign than being cry babies. He says it is not new that the opposition especially the main (Nelson Chamisa led Citizens Coalition for Change) or its predecessors have always been denied equal room to campaign. “The opposition has been facing the same issues and problems for decades now. “The issues of banned rallies and generally an uneven political field are old stories for which they should by now have created alternatives. Complaining and crying are not strategies!,” He says. According to him, by saying opposition should be pro active, he is not saying what ZANU PF is doing is right. “Encouraging the opposition to be pro-active in dealing with an uneven playing field doesn’t translate into condoning actions such as banning rallies and other illegal manouvres. “We still desire & call upon the ruling party to observe the strict dictates of a democratic country,” he adds. He goes on: “Chamisa himself has not helped matters nekubva ayisa party muhapwa. Anyone serious about the opposition growing as an institution should be worried about the current structural set-up. How can a national entity be centred around one person no matter how charismatic or popular? “The party should be an animal by itself not hitched to the emotional and personal seasons of a single person. The fallout from the Biti saga and divisive primaries has already had a negative impact on the party’s support base.”
