Some Zimbabweans who returned home after working and studying for years in South Africa are battling to rebuild their lives, <a href="https://www.dailymaverick.co.za/article/2022-09-27-returning-zimbabweans-face-increased-hardship-uncertainty-in-harare/">Daily Maverick</a> reported.
Most were forced to return after the South African government’s decision to scrap the Zimbabwe Exemption Permit (ZEP) facility.

Returnees who spoke to the Daily Maverick said their lives were in South Africa. Tapiwa Munda is cited as saying:

It is painful to leave a place you have heavily invested in, and to be forced back into a country you fled because of corruption, dictatorship and an economy that is regressing.
</blockquote>
Munda worked in Yeoville selling fresh flowers. He now sells second-hand bags, joining the informal traders who line the dusty road that leads to the Bindura terminus in Harare.
He said business picks up during the tobacco and cotton trading season when the farmers come to town to do some shopping.
Munodei Machingura worked for a decade as a domestic worker in East London. She is now an informal foreign currency dealer at the Roadport bus terminus in Harare. 
She said police often arrest money dealers and confiscate their holdings. She wishes the government would regularise the trade for informal dealers like herself.
She said she misses South Africa’s free primary health care most.s
Some Zimbabweans still in South Africa, who will find themselves with no legal papers to stay in South Africa <a href="https://zero.pindula.co.zw/south-africa-home-affairs-minister-extends-zimbabwean-exemption-permit-full-text/">after 30 June 2023</a>, say returning home is not a realistic option. They are playing wait-and-see, hoping they will win in the courts.

Some Zimbabweans Returning From South Africa Find It Hard To Adjust

The South African government is set to introduce new employment quotas on foreign workers, as well as ban foreigners from starting small businesses in some sectors.
On Monday, Employment and Labour Minister Thulas Nxesi introduced the National Labour Migration Policy (NLMP) and Employment Services Amendment Bill for public comment.
The NLMP will introduce quotas on the total number of documented foreign nationals with work visas that can be employed in agriculture, hospitality and tourism, as well as construction, along with other sectors.
The limit on foreign nationals will be set by the minister of labour, and the quotas will differ per occupation, sector or region. Quotas would apply not only to formal employees but, also to anyone paid for any work as well as “platform workers”, such as Uber drivers.
The proposed new legislation will be accompanied by amendments to the Small Business Act, which will limit foreign nationals from establishing small and medium-sized enterprises and trading in some sectors of the economy. This will include a list of sectors where foreign nationals cannot be allocated business visas.
Foreign nationals will include all people who aren’t citizens, permanent residents or refugees
The government said there are four million foreign-born persons in SA, representing 4% of the population and 7% of the labour force. 
The department of labour said, “migrants are in particular concentrated in the informal sector – a worrying trend.” 
Nxesi said it was critical for government to act and curb the hiring of foreign nationals in the country, as employers were exploiting desperate foreign nationals and “distorting the labour market”.
Nxesi said the Constitution of South Africa does not allow them to ban the employment of foreign nationals but they can limit and control it. 
Nxesi said along with the migration labour policy, the strengthening of border management policy will be prioritised.

South Africa Set To Ban Foreigners From Starting Small Businesses In Some Sectors

South Africa’s Minister of Home Affairs, Aaron Motsoaledi has dismissed reports that they have reversed a decision to suspend Zimbabwean Exemption Permits (ZEPs).
He said they have only reversed a circular issued last week because it created confusion. He said:

The Cabinet decision on Zimbabwean permits still stands.
</blockquote>
He reiterated that when the ZEPs expire in December, the current holders still have a 12-month grace period.
Motsoaledi dismissed reports saying holders will be immediately arrested when their permits expire. Watch the video below for more.

Some South African banks are threatening to freeze accounts of Special Zimbabweans Exemption Permit holders if they don’t provide new documents in January 2022.
One of the permit holders, who requested anonymity, said he received a notice from Capitec Bank informing him that his work permit is expected to expire and therefore he has to renew it in order to have an active bank account. The letter reads in part:

… Your work permit expires in January. Visit your nearest branch with your new permit to keep your account active …
</blockquote>
In a message posted on YouTube, Ngqabutho Mabhena, chairperson of the Zimbabwe Community in South Africa, said his organisation is engaging banks to ensure that ZEP holders’ accounts are not closed since all the permits expire at the end of this month. Mabhena said:

What we have already said is that we need to get clarity on whether the banks will not close down people’s accounts as a result of this 12-month grace period. Any government department will not refuse people entry or refuse to provide services to ZEP holders …

The South African government decided last Friday to discontinue the ZEP programme and give permit holders until December 31, 2022, to regularise their immigration status.

South Africa: Banks Threaten To Freeze Accounts Of Zimbabwean Exemption Permit Holders

Helen Suzman Foundation Friday moved in to assist over 200 000 Zimbabweans holding South African special permits called Zimbabwean Exemption Permits (ZEP) to continue living and working in South Africa.
This comes after South Africa announced that it was not going to extend the ZEPs saying current holders were being given 12 months to regularise their stay in the region’s most industrialised economy.
Zimbabweans this week escalated their push to force Pretoria to stop deportations.
The Helen Suzman Foundation which promotes liberal constitutional democracy and the rule of law told the Zimbabwe Independent yesterday that the foundation would be working with Zimbabwe Exemption Permit Holders Association (ZEPHA) in challenging Pretoria’s decision. Simba Chitando, the lawyer representing the permit holders, confirmed:

After Nicole Fritz, the head of Helen Suzman Foundation, got hold of us, we have agreed to work together in whatever way we can to challenge the decision by cabinet not to renew ZEP. The lawyers working on the matter, and the ZEPHA, are humbled by the support of the Helen Suzman Foundation.

Chitando said the foundation was one of the most important non-governmental institutions safeguarding human rights and the rule of law in South Africa.
Chitando has also defended the fight against the South African cabinet decision saying South Africa was exposing Zimbabwean immigrants to exploitation as long as their stay was not guaranteed.
He said Zimbabweans in the United States and Canada, for instance, had received the full benefit of migration laws in those jurisdictions and had thrived.
He accused South Africa of exploiting Zimbabweans through the special permits, which, he argued, were designed to “extract labour without rights”.
The first Zimbabwean special dispensation started in 2009 and was called the Dispensation for Zimbabwe Permit and it provided for the documentation of qualifying Zimbabweans for a five-year period.
In 2014, the dispensation was extended by three years and called the Zimbabwean Special Permit and the current ZEP was initiated in 2017 and comes to an end on December 31, 2021.
