The Zimbabwe Lawyers for Human Rights (ZLHR) have formally requested an explanation from the Zimbabwe Prisons and Correctional Service (ZPCS) regarding the release of a convicted rapist from Harare Central Prison under a recent presidential amnesty order.
The individual in question, Bobby Makaza, who is 59 years old and resides in Murehwa in Mashonaland East province, was released from Harare Central Prison on 19 May 2023 as part of a presidential amnesty declared by President Emmerson Mnangagwa on 12 May 2023. The amnesty, which was aimed at reducing the prison population, benefited some inmates, including convicted sexual offenders, after President Mnangagwa gazetted Clemency Order No. 1 of 2023.
However, the ZLHR lawyers, Tinashe Chinopfukutwa and Paidamoyo Saurombe, acting on behalf of Makaza’s victim, have demanded a detailed explanation from ZPCS Commissioner-General Moses Chihobvu about the basis upon which Makaza qualified for amnesty and subsequent release from Harare Central Prison in terms of Clemency Order No. 1 of 2023. The lawyers have informed Chihobvu that Makaza had been convicted and sentenced to serve an effective 16-year prison term on 2 April 2019, after standing trial at Murehwa Magistrates Court in Mashonaland East province on a charge of rape as defined in section 65 of the Criminal Law (Codification and Reform) Act.
According to Chinopfukutwa and Saurombe, Makaza, being an inmate convicted of rape, which is a specified offence, was excluded from benefiting from the presidential amnesty in terms of section 12(d) as read with 13(c) of Clemency Order No.1 of 2023. The ZLHR lawyers have given Chihobvu until Friday 7 July 2023 to respond to their letter.
In the event that a court determines that the release of Bobby Makaza was illegal, the ZPCS may be compelled to re-incarcerate him, as well as any other individuals who were similarly released. The ZPCS had cited the reduction of prison overcrowding as the primary objective of the amnesty, which resulted in the release of 4,270 inmates. However, victims of violent crimes have expressed their dissatisfaction, stating that they were not consulted prior to the release of the perpetrators.

Human Rights Lawyers Question Release Of Rapist Under Presidential Amnesty Order

Two <a href="https://www.pindula.co.zw/Zimbabwe_Prisons_and_Correctional_Services">Zimbabwe Prisons and Correctional Services (ZPCS)</a> officials have lost personal property in a case they were being accused of assaulting trespassers.
Zimbabwe Lawyers for Human Rights (ZLHR) reported that the two ZPCS officers, Michael Nduna and Florence Chihambakwe, were sued for damages amounting to US$5 250 in their personal capacity by Harare resident, Alex Tendai Gombedza.
In a court update seen by Pindula News, the lawyers said the ZPCS officers accused Gombedza and his friend Evidence Kutsawa of trespassing before assaulting them.
Gombedza and Kutsawa were walking through the Chikurubi Prison garden in Harare in January 2022 when they were assaulted.
After the assault, an aggrieved Gombedza engaged ZLHR’s Tinashe Chinopfukutwa and Paida Saurombe who in August 2022 sued Nduna and Chihambakwe for damages amounting to US$5 250.
The money was for the physical attack and ill-treatment, for pain and suffering, humiliation, an affront to dignity and embarrassment. 
Gombedza also cited Justice and Legal Affairs minister, Ziyambi Ziyambi and ZPCS Commissioner-General Moses Chihobvu among the respondents. 
What happened:
During the trial at Harare Civil Magistrates Court, Chinopfukutwa and Saurombe said Nduna and Chihambakwe instructed Gombedza and Kutsawa to lie down on the ground before assaulting them on their feet using wooden pick handles. 
After the assault, the ZPCS officers instructed some prisoners whom they were supervising to also assault the duo. As a result, Gombedza and Kutsawa sustained severe injuries and had to seek medical attention. 
Gombedza sustained injuries on his legs and feet which warranted admission to Parirenyatwa Group of Hospital for treatment. 
He said he suffered excruciating pain in his feet, which he still feels to date. 
According to medical reports, Gombedza suffered a 3% residual disability as a result of the injuries he sustained from the assault. 
Chinopfukutwa and Saurombe argued that their client felt greatly humiliated, embarrassed, dehumanised and degraded by the assaults and ill-treatment that he received at the hands of the ZPCS officers. 
The human rights lawyers stated that Nduna and Chihambakwe treated Gombedza as if he was a dangerous criminal yet he was unarmed and posed no security threat whatsoever. 
Furthermore, Chinopfukutwa and Saurombe argued that there was no justification for the excessive use of force against Gombedza as he had not committed any crime but was just going about his business walking on his way to Harare’s central business centre. 
In the end, Nduna and Chihambakwe were ordered to pay compensation amounting to US$5 250 to Gombedza broken down as:

i). US$2 500 for damages for humiliation, embarrassment, an affront to dignity and contumelia, 
ii). US$2 500 for pain and suffering 
iii). US$250 for medical expenses which he incurred while being treated. 
</blockquote>
Now, the ZPCS officers have lost some personal property, which was attached and removed by the Messenger of Court on Friday 23 March 2023 and will be auctioned to recover the judgment debt owed to Gombedza. 
Among the household property which Nduna lost include a set of sofas, a deep freezer, a television set, a wardrobe &amp; a printer. Chihambakwe lost a set of sofas, a television set and a room divider.

ZPCS Officers Lose Personal Property For Assaulting "Trespassers"

A <a href="https://www.pindula.co.zw/Zimbabwe_National_Army">Zimbabwe National Army (ZNA)</a> and Zimbabwe Prisons and Correctional Services (ZPCS) officers who allegedly robbed a Chinese mine in Mazowe were arrested on Tuesday.
Tawanda Marumahoko (ZPCS) and Godfrey Chibanganye (ZNA) appeared before <a href="https://www.pindula.co.zw/Bindura">Bindura</a> regional magistrate Amos Mbobo facing a robbery charge.
The duo pleaded not guilty and was remanded in custody, according to <a href="https://bulawayo24.com/index-id-news-sc-national-byo-226327.html">Bulawayo24</a>.
<h2>What happened:</h2>
Prosecutor Edward Katsvairo alleged that on November 12, 2022, the armed duo together with their 12 accomplices pounced on the Iron Cap mine to rob pregnant carbons.
In the gold industry, activated carbon is used to recover gold from the gold-cyanide complex also known as the cyanide process. It is a technique for extracting gold from low-grade ore by converting the gold to a water-soluble coordination complex.
The duo tied security guards with brickforce before robbing them of their phones.
They proceeded to the storeroom where they robbed 300 kilograms of pregnant carbons valued at US$2 142.
A police report was filed leading to the arrest of the duo.
There have been several reported robbery cases involving serving or retired members of the uniformed forces prompting Parliament to summon military chefs to explain the trend.
Some observers attribute the trend to the economic challenges in the country.

Armed Soldier And Prisons Officer Rob A Chinese Gold Mine

Two women are among the applicants for the vacant post of public executioner with the Zimbabwe Prisons and Correctional Service (ZPCS).
The majority of applicants who expressed interest in taking up the job of an executioner in the past were mainly males, with two females throwing their names in the hat, <a href="https://www.sundaymail.co.zw/two-females-in-race-for-hangmans-post">The Sunday Mail</a> reported quoting Justice, Legal and Parliamentary Affairs Permanent Secretary, Mrs Virginia Mabiza. She said:
<blockquote>
In the past, we have been overwhelmed with applications for the post of hangman, but, because of the de facto moratorium that we have had for more than a decade, it has not been necessary to employ anyone. At the moment, it (the hangman’s post) is not an issue because the real discussion is centred around the abolition of the death penalty.
</blockquote>
Mrs Mabiza added that ideally, the post should not be a full-time job for “obvious reasons”.
While the death penalty is still legal, the country has not carried out executions since the hanging of Stephen Chidhumo and Edgar Masendeke in July 2005.
Sixty-six inmates are presently on death row.
Murewa-born Benard Chiwenga (71), who was convicted of murdering a woman in 2015, said the uncertainty of when he will appear before the hangman was affecting his sanity. He said:

I can’t eat, bathe or clean my cell. I even turned violent. Whenever I hear someone touching my cell door, I scream. Even when there is cleaning going on, I begin to think that this is my last day.
</blockquote>
Another death row inmate, 41-year-old Doesmatter Vhore, who was convicted of killing four white farmers, claims he was wrongfully convicted, although overwhelming evidence was presented against him during the trial. Vhore said:

At night, I don’t sleep; if I hear the sound of footsteps or keys, I begin to think death has finally come. Some inmates who have been here for long say when your time to die has come, they (prison officers) will come to pick you up around 3 am.

The Constitution of Zimbabwe confines death penalties to males aged between 21 and 70 years. Women are exempted.
President Mnangagwa, who survived the hangman’s noose on a technicality before independence for acts of sabotage, has reiterated that Zimbabwe should abolish the death penalty.

Two Women Apply For The Hangman Post

The Zimbabwe Prisons and Correctional Services (ZPCS) has decided to merge all its football teams into one starting in 2023 which means there will be no more Tenax C.S FC, <a href="https://www.manicapost.co.zw/end-of-the-road-for-tenax/">Manica Post</a> reports.
 The club formed 12 years ago, already faces relegation from the Castle Lager Premiership and the 2021/2022 last round of league fixtures will be Tenax’s last in the top-flight league.
ZPCS national sports officer, Richard Tarangeyi said a decision was made to have all their football teams merged into one unit, according to Post Sports.

Yes, the ZPCS football teams – Tenax C.S FC and Hwahwa are merging into one club. The Commissioner General announced that we will not have many clubs under the ZPCS banner since this presents administration and funding challenges.
Therefore, moving forward, we will bring all our talents into one basket. The decision has already been made and what now remains is the logistical arrangements on where the team will be based and which players will make up the new ZPCS squad.
</blockquote>
For Tenax C.S FC to survive relation, they need to win all their remaining three league fixtures while ZPC Kariba, the club just above the cut-off point, as well as Harare City, who are above them in the relegation zone, lose all the remaining three rounds of league matches.
Even coach, Shadreck ‘Father’ Mugurasave conceded that surviving relegation is now a tall order.
Tenax were promoted to Premier Soccer League in 2019. 
The club’s campaign since then was marred by the inadequacy of resources. Corporates in Mutare such as the Blessing Mangwiro-owned The Big Rock Logistics, mining entrepreneur, Scott Sakupwanya’s Better Brands and businessman, Kenneth Muchina occasionally chipped in with financial and material assistance.

No More Tenax As ZPCS Decides To Merge All Its Football Clubs

A 30-year-old Zimbabwe Prison and Correctional Services officer, Patience Muchineripi has said she is filled with boundless joy and happiness after giving birth to quadruplets in about 50 minutes last week. 
The babies, three boys and one girl, were delivered by a scheduled Caesarean section at Claybank Private Hospital in Gweru last Wednesday morning under the watch of her specialist gynaecologist, Dr Johannes Mukwembi. 
Muchineripi and her babies were finally discharged on Sunday. 
Speaking to <a href="https://www.herald.co.zw/prison-officer-gives-birth-to-quads/">The Herald</a>, Muchineripi said:
<blockquote>
I am filled with boundless joy and happiness but I am tired now. Talk to my husband.
</blockquote>
Her husband Anesu Mukototsi (36), also a member of the ZPCS said:
<blockquote>
We could not have asked for a better outcome. We are so thankful for all of the doctors and the nurses. We’ve had excellent care through every step of this process.
I was the only child from my family and as fate would have it, both my parents are late. If they were here today, they would have been celebrating having five grandchildren.
These babies need special attention and we don’t have accommodation that is enough for them. I think we will also need supplementary milk and diapers to make their life comfortable.
</blockquote>
Prison Officer Mukototsi took his wife and the babies to their lodgings in Kwekwe. 
The quadruplets join their big sister who is 10 years old making them five (three boys and two girls). 
Dr Mukwembi said the quadruplets were delivered at about eight months so as not to put their lives and that of their mother in danger.

Prison Officer "Filled With Boundless Joy" As She Gives Birth To Quads

A suspected robber was shot and injured after trespassing into a Zimbabwe Prisons and Correctional Services (ZPCS) armoury in Harare on Friday 24 September 2022.
Zimbabwe Republic Police (ZRP) spokesperson, Assistant Commissioner Paul Nyathi told ZBC News that two men who were driving a Honda Fit vehicle trespassed into a sensitive area at Chikurubi Training School.
ZPCS National Public Relations Officer, Chief Superintendent Meya Khanyezi, confirmed that the matter was reported to Highlands Police Station.
She said alert prison officers responded swiftly after noticing that the intruders had parked their vehicle in a very sensitive and guarded area.
Chief Superintendent Khanyezi added that after noticing that they had been spotted, the intruders fled the scene and did not take orders from prison officers who had fired warning shots.

Suspected Robber Shot After Trespassing Into ZPCS Armoury

Two Harare men sustained broken legs after they were severely assaulted by Zimbabwe Prisons and Correctional Services (ZPCS) wardens who accused them of trespassing on Chikurubi Maximum security Prison premises.
The officers, Michael Moses Nduna (27) and Florence Chihambakwe (32) have since appeared before Harare Magistrate Munashe Chibanda facing assault charges.
They were not asked to plead and were released on ZW$15 000 bail each and will be back in court on February 22 for trial.
Complainants are Evidence Kutsawa, an employee for Premier Southerton and Alex Gombedza employed by Food World Supermarket.
Court papers show that the incident occurred on October 4 last year around 8 am when Kutsawa and Gombedza were walking from their places of residence heading to Gletwin using a road that passes through Chikurubi Maximum Security Prison premises.
It is alleged while at the prison’s recreational park, they bumped into the two prison guards who were on duty with some inmates.
They accused Kutsawa and Gombedza of trespassing on prison premises.
Nduna then allegedly instructed the complainants to lie down on their backs and when had complied, Chihambakwe instructed Nduna to assault them with a pick handle.
The complainants were allegedly brutally beaten several times until their legs got fractured.
After being released, the duo reported the assault at Highlands ZRP station.
They were treated at Parirenyatwa Group of Hospitals.

The High Court is set to hear a case in which prisoners are demanding to be allowed to vote. Zimbabwe Lawyers for Human Rights who are representing the prisoners said the application was filed in June 2017. Pindula News presents the ZLHR’s update on the case:

HIGH Court Judge Justice Munamato Mutevedzi will on Tuesday 25 January 2022 preside over the hearing and determination of an application filed by some prisoners seeking an order compelling Zimbabwean authorities to allow them to vote during elections.
In the application which was filed in June 2017, but is being heard now after the presiding Judge Justice Clement Phiri passed on in January 2021 after reserving judgment in July 2018, the prisoners want the High Court to issue an order compelling Justice, Legal and Parliamentary Affairs Minister Hon. Ziyambi Ziyambi, Zimbabwe Electoral Commission (ZEC) Chairperson Justice Priscilla Chigumba and ZEC as the elections management body, to register them on the national voters roll and facilitate their voting on election day.
The prisoners, Yvonne Musarurwa, Tungamirai Madzokere and Last Maengahama, who have since been released from Chikurubi Female Prison and Chikurubi Maximum Security Prison, and are represented by Advocate Tererai Mafukidze, instructed by Jeremiah Bamu of Zimbabwe Lawyers for Human Rights, argued that since the period that they had been in prison detention from 2011, ZEC had neither carried out any voter education, including voter registration nor enabled prisoners to vote during the several general and by-elections which were held in Zimbabwe.
Musarurwa, Madzokere and Maengahama argued that they were asserting their constitutional rights particularly the right to vote in elections and referendums as enshrined in Section 67 (3) (a) of the Constitution.
They argued that they are entitled to exercise their political rights regardless of their status as detainees.

Prisoners Demand To Vote, Case To Be Heard In High Court

Six prison officers and four inmates succumbed to COVID-19 during the festive season which was preceded by the outbreak of the second wave.
Zimbabwe Prisons and Correctional Service (ZPCS) Commissioner-General Moses Chihobvu said despite the surge in cases during the festive period, they didn’t record alarming cases. In an interview with the Herald, Chihobvu said:
<blockquote>We have four inmates and six prison officers who succumbed to Covid-19 during the festive period across the country. The numbers are not alarming given our population and we are happy that the situation is under control.
Comm-Gen Chihobvu said ZPCS was strictly adhering to the Ministry of Health and Child Care as well as the World Health Organisation’s health regulations.</blockquote>
COVID-19 first breached prison <a href="https://news.pindula.co.zw/2020/07/11/coronavirus-breach-prison-walls-as-inmates-officer-test-positive/">walls in July 2020</a> when four inmates and one prison officer at Bulawayo Prison tested positive for the deadly pandemic prompting ZPCS to scale up measures to contain the coronavirus.
Since then, thousands of prisoners were released from jail through the presidential amnesty programme which was also a way of decongesting the correctional services.
The report comes when health authorities have said Zimbabwe is already experiencing a third wave of the novel virus.
The Ministry of Health and Child Care is urging members of the public to get vaccinated en masse so as to achieve community immunity.

Prison Officers, Inmates, Succumb To COVID-19

Southern Eye has reported that seventy-six prisoners and 25 correctional officers at Grey Prisons in Bulawayo have reportedly tested positive for coronavirus.
<figure aria-describedby="caption-attachment-85376" class="wp-caption aligncenter" id="attachment_85376"><figcaption class="wp-caption-text" id="caption-attachment-85376">The tragedy was confirmed by Bulawayo Provincial Affairs minister Judith Ncube who told Southern Eye that she had verified with Zimbabwe Prisons and Correctional Services (ZPCS) officials. She said:</figcaption></figure>
<blockquote>I have just verified with them, they are also at loss.
I will be having a meeting with relevant offices tomorrow (today).</blockquote>
Ncube however, could not be drawn into revealing the number of cases recorded while ZPCS spokesperson Superintendent Meya Khanyezi who said she was still gathering the statistics and would call back before the end of the day had not done so when the publication published the story.
This happens when ZPCS has revealed that the number of prisoners in the country has since surpassed the number that was there before president Mnangagwa pardoned thousands in March.

COVID-19: 76 Inmates, 25 Prison Officers Test Positive

The Zimbabwe Prisons and Correctional Services has proposed the release on bail those facing minor offences and increasing testing on new admissions as a measure to minimise the spread of the disease at its facilities.
This comes amid reports that the number of people who have tested positive for the coronavirus is increasing rapidly.
Speaking during the handover of personal protective equipment to the ZPCS by the Zimbabwe Human Rights Association in Gwanda this Friday, Assistant Commissioner Ngwenya said:
<blockquote>The number of inmates has gone back to where it was before the amnesty. As such we are having a challenge in placing new admissions in our facilities separate from those who are already there. We, therefore, wish we could enhance testing and also appeal to our courts to deal with cases with speed.</blockquote>
President Mnangagwa issued a <a href="https://news.pindula.co.zw/2020/03/03/prisoners-general-amnesty-proposal-approved-by-the-cabinet/" rel="noopener noreferrer" target="_blank">presidential pardon</a> to convicts back in March to decongest prisons as a way to stop the spread of the coronavirus.
The virus has however since breached prison walls and the trend is likely to get worse as new people are being imprisoned for various crimes.

"The Number Of Inmates Has Grown Back To Where It Was Before The Amnesty," - ZPCS

Two Guruve inmates were on Wednesday sentenced to 36 months in prison with six months conditionally suspended after they attempted to break out of prison.
The duo, Anymore Zitsva (27) and Simbarashe Nyambare (22) reportedly tried to escape from prison on the 2nd of April this year.
The court heard that the two hatched a plan to escape when correctional officers were playing checkers with other inmates.
Prosecutor Carson Kundiona told the court that on April 2, the inmates who were initially serving 44 months and eight months, respectively, noticed that prison officers were not paying attention to them as they concentrated on the game and the inmates cut a hole through the security fence and tried to escape.
The court further heard that Mockias Chirume, another inmate, realised that the two were trying to escape and rushed to the fence and grabbed Zitsva’s foot while shouting for help.
Zitsva was dragged back into the yard and implicated his accomplice.
Last year, some inmates also helped authorities to bring back the other inmates who trying to escape.

Zimbabwe Prisons and Correctional Services (ZPCS) public relations officer Chief Correctional Officer Meya Khanyezi said they are moving remand prisoners to bigger prisons in an effort to minimise overcrowding at smaller prisons.
Khanyezi said it is important to manage overcrowding at prisons as it has a negative impact on the rehabilitation of prisoners. Said Khanyezi:
<blockquote>The issue of overcrowding in prisons is problematic as it stretches limited resources. ZPCS always endeavours to minimise overcrowding by ensuring that some offenders awaiting trial are accommodated at other less overcrowded prisons within a particular area. With reference to Bulawayo, some remand prisoners are being accommodated at Prisons at Khami Complex.</blockquote>

Remand Prisoners Moved To Bigger Prisons To Minimise Overcrowding

The Zimbabwe Prisons and Correctional Services (ZPCS) has failed to transport inmates to the courts for the past week after its truck broke down. ZPCS Assistant Commissioner Elizabeth Banda said,
<blockquote>
It is a nationwide problem that has affected the prison trucks, but in some areas, the trucks have been fixed and inmates are being taken to court. We bought new tyres for the truck, though it is still having minor mechanical problems. We need to get the necessary resources and funding for the trucks. I think the situation will be back to normal by next week.</blockquote>

PRESS STATEMENT 
GENERAL AMNESTY 2018: CLEMENCY ORDER NO 1. OF 2018
1. His Excellency the President has in terms of section 112 (1)(a), (c) and (d) of the constitution of Zimbabwe granted amnesty to prisoners as outlined in the following categories; 
CATEGORY ‘A’ 
Remission of sentence for all convicted female prisoners.
2. A full remission of the remaining period of imprisonment is hereby granted to all female prisoners, regardless of the offence committed, save for those sentenced to life imprisonment and to death. 
CATEGORY ‘B’ 
Remission of sentence of all juveniles
3. Full remission of the remaining period of imprisonment is hereby granted to all juvenile prisoners under the age of eighteen years serving terms of imprisonment, irrespective of the offences they committed.
CATEGORY ‘C’ 
Remission of sentence for prisoners sentenced to 36 months and below
4. Full remission of the remaining period of imprisonment is hereby granted to all those prisoners sentenced to imprisonment for a period of 36 months and below and who would have served a quarter of their sentence by the date of gazetting of this Clemency Order provided they are not excluded from benefitting in terms of paragraph 13 and 14.
CATEGORY ‘D’ 
Remission of sentence on medical grounds
5. Full remission of the remaining period of imprisonment is hereby granted to all terminally ill prisoners who are unlikely to survive their prison terms irrespective of the offences they committed upon certification by a Prison Medical Officer or a Government Medical Officer, of the fact that the concerned prisoner is unlikely to survive his or her prison term. 
CATEGORY ‘E’ 
Remission of sentence for prisoners at the open prison
6. Remission of sentence is hereby granted to all prisoners serving a term of imprisonment at the open prison. This category consists of prisoners who as a result of good behaviour and a genuine desire to reform whilst in closed prison have been selected for the open prison rehabilitation programmes.
CATEGORY ‘F’ 
Remission of sentence for prisoners aged 60 years and above
7. Full remission of sentence is hereby granted to all prisoners aged 60 years and above, and who would have served one third of their sentence by the date of gazetting of this Clemency Order regardless of the offence committed save for those sentenced to life imprisonment or death.
CATEGORY ‘G’ 
Remission of sentence for prisoners convicted of stock theft
8. Full remission is hereby granted to all prisoners serving a sentence of imprisonment for stock theft who would have served one third of their sentence after a one third remission by the date of gazetting of this Clemency Order.
CATEGORY ‘H’ 
Remission of sentence for prisoners sentenced to life imprisonment
9. Full remission is hereby granted to all male prisoners sentenced to life imprisonment on or before 28 February 1998. Further a full remission is hereby granted to all female prisoners sentenced to life imprisonment on or before 31 December 2010.
CATEGORY ‘I’ 
Commutation of death sentence to life imprisonment
10. Commutation of the death sentence to life imprisonment is hereby granted to all prisoners who have been on death row for ten years and above.
CATEGORY ‘J’ 
Remission of sentence for disabled persons
11. Full remission of the remaining period of imprisonment is hereby granted to all prisoners who are certified by a Prison Medical Officer or a Government Medical Officer to be blind and those who are physically disabled to the extent that they resort to the use of their hands to move around the prison and those who rely on other persons to be moved around the prison.
CATEGORY ‘K’ 
Quarter Remission of sentence for prisoners sentenced to above 36 months
12. An additional one quarter remission of the remaining effective period of imprisonment is hereby granted to all those prisoners sentenced to imprisonment for a period of more than 36 months and have served at least one third of the effective term of imprisonment.
Prisoners excluded from the proposed Amnesty
13. The following prisoners are excluded from this amnesty:— 
(i) Any habitual criminals serving a term of extended imprisonment; 
(ii) Any person who was previously released on amnesty; 
(iii) Any person serving a sentence imposed by a Court Martial; 
(iv) Any person who escaped from lawful custody and is still at large by the date of gazetting of this Clemency Order; 
(v) Any person convicted of a specified offence other than those benefitting in terms of paragraphs 2, 9 and 10.
Definitions
14. For the purposes of this amnesty, “specified offence” means— 
(a) murder, treason; 
(b) rape or any sexual offence; 
(c) carjacking, armed robbery; 
(d) any conspiracy, incitement or attempt to commit any of the offences referred to in paragraphs (a), (b) or (c); 
(e) being an accessory after the fact to any of the offences referred to in paragraphs (a), (b) or (c).
15. As ZPCS, we applaud the move taken by His Excellency in exercising his prerogative of mercy to some prisoners behind bars. The exercise has not only gone a long way in decongesting our prisons but has served as a reminder to inmates and society that the purpose of imprisonment is founded on the pretext of reformation than retribution. It is now left to society to ensure that those released reintegrate safely and well in their respective communities. 
16. Whilst we as ZPCS would have made endeavours to rehabilitate the inmates, our efforts and His Excellency’s pardon would be in vain if society fails to assist the returnees. We call upon all stakeholders including families, churches, after care groups, business community and society at large to facilitate the ex-offenders’ reintegration. 
17. Beneficiaries of this presidential pardon are advised to respect this amnesty by refraining from further committing crimes resulting them in finding their way back to prison. We expect them to live as law-abiding citizens if society is to trust and embrace them.

Full Text: Zimbabwe Prisons And Correctional Service's Statement On Mnangagwa's Release Of 3000 Prisoners

The Zimbabwe Prisons and Correctional Services (ZPCS) is facing an acute shortage of plates and has resorted to begging from churches. The ZPCS is asking for donations of cash or kind.
Officer-in-charge Bindura Prison, also known as Chawagona-hapana, Superintendent Kardie Chanetsa recently sent solicitation letters to churches in Bindura. Part of the letter reads
<blockquote>We are appealing for aluminium plates which we want to use for the feeding of prisoners. The shortage of these plates has been caused by huge numbers of inmates the prison is receiving every day and your contribution towards this cause in either cash or kind (plates) is greatly appreciated</blockquote>
In the 2017 national budget, the treasury allocated the department only $3 042 000 for inmates rations against a target of $28 631 658.
