A parent from Masvingo has sued the Zimbabwe School Examinations Council (ZIMSEC) and the Government for discriminating against her child enrolled at a private school in the payment of examination fees.
The parent, Susan Chikwanda of Jerera in Masvingo province, has two children, one aged 13 who is enrolled in Grade Seven, and the other who is aged 16 who is enrolled in Form Four.
In an application filed at Masvingo High Court on 28 April, Chikwanda said the Government was in breach of the right to education as enshrined in the Constitution.
In a circular dated 31 January 2023, ZIMSEC announced that the Government would be subsidising the 2023 Ordinary Level and Advanced Level examination fees for candidates only in public schools, local authority schools and mission schools.
Chikwanda is represented by Zimbabwe Lawyers for Human Rights (ZLHR) lawyer Paida Saurombe.
She argued that the Government was arbitrarily segregating underprivileged children from benefitting from government subsidies in the payment of examination fees for Grade Seven, Ordinary Level and Advanced Level studies.
She wants the court to declare the Government’s decision to subsidise examination fees for 2023 Grade Seven, Ordinary Level and Advanced Level examination candidates in public schools, local authority schools and mission schools at the exclusion of candidates in private schools and colleges, including private candidates in public schools, invalid and in breach of the constitutional protection to equality and the right to education enshrined in the Constitution. <a href="https://www.zlhr.org.zw/?p=3040">ZLHR said in a statement</a>:

She argued that her two children both come from the same home and are financed from the same less privileged and economically weak pocket.
Besides that one of them is learning at a government-run school and the other one at a private college, there is nothing else that differentiates their economic and social status and they both eat from the same plate and are clothed for school from the same source.
The Masvingo-based woman said she is concerned that government had made a decision to benefit one of her minor child by subsidising the exam fee but have the older minor child pay the full examination fee and yet the money that government is using to subsidise the examination fees for candidates in public schools including mission schools is coming from the same fiscus that all citizens pay taxes into.
She argued that when tax is collected, there is no question asked regarding which school one’s child attends but when benefits are being extended, the government has taken a decision to differentiate students based on the schools that they attend.
… She charged that this is not a fair discrimination and cannot be justifiable in a free and democratic society that has the rule of law and constitutionalism as its tenets of justice and that such unfair discrimination inadvertently results in candidates like her older minor child, who is enrolled in private college’s right to education being infringed.
Chikwanda’s older minor child, who has been studying eight subjects is required to pay total examination fees of US$192 and yet if she was going to benefit from the subsidy, she would have been paying US$88.

The matter is yet to be set down for hearing and determination.

ZIMSEC Sued For Discrimination Against Candidates Enrolled At Private Colleges

Some private schools have hiked tuition fees for the 2023 first term, citing rising inflation.
Arundel School in Harare has pegged its 2023 school fees at US$2 980 per term for day schoolers, while boarding schoolers will have to fork out US$5 150, <a href="https://www.newsday.co.zw/local-news/article/200004666/form-1-fees-shocker">reported NewsDay</a>.
According to a circular released by the school, learners will fork out over US$1 500 in enrolment fees for Form 1 places. The circular reads in part:
<blockquote>
Our country’s economic challenges and US$ inflation continue to present difficulties as costs increase in real terms.
Despite this, I assure you that the board remains committed to strategically pursue all avenues to keep costs at reasonable levels without compromising the quality of education offered at the school.
</blockquote>
Last month, Primary and Secondary Education ministry spokesperson Taungana Ndoro told State media that government will not block schools from charging exclusively in foreign currency if the majority of parents agree on the decision. He said:
<blockquote>
If parents have a consensus we cannot stop them, if they agree as a majority that they want to pay for their children in foreign currency we will not block them.
Yes, we have the policy that says schools cannot charge exclusively in forex, but remember we are dealing with a community of parents and if they collectively decide on something, we will not stand in their way.
</blockquote>
However, speaking to State media on Monday, Ndoro backtracked on his previous remarks, saying if parents have free funds in foreign currency, they can pay but no school must force any parent to pay in foreign currency.
Ndoro added that if schools have pegged fees in foreign currency, parents must be allowed to pay in local currency at the prevailing interbank rate of the day the fees are paid.

Private School Charges US$1 500 In Enrolment Fees

The government has warned private schools that have reopened for the second term without approval, that they will be dealt with.
Appearing before the Parliamentary Education Portfolio Committee on Wednesday, Ministry of Primary and Secondary Education permanent secretary Tumisang Thabela said all schools including private schools are run by the Ministry and should adhere to directives issued by the government. She said:
<blockquote>The Ministry has the mandate to run all schools including private schools and we have some of the trusts who appear to behave like they do not really report to the ministry.
We are trying to correct that you will be aware that the Ministerial statement that was given three weeks ago was reading the riot act to them and reminding them that they belong to Zimbabwe and have to be controlled by the ministry.</blockquote>
Thabela said the Ministry was hitherto unaware of allegations levelled against Knowsticks Group of Schools in Manicaland.
Reports suggest that Knowstics Group of Schools have invited Form 4 and 6 students on Monday for COVID-19 testing and screening at a fee of US$50 and threatening students who fail to comply by denying them a chance to sit for their final examinations.
Thabela also chided some private schools for failing to keep reserves for such times as these, and end collecting fees while schools are closed.

Govt Reminds Private Schools Of Who They Report To

Some private schools have reportedly hiked their fees for next term despite the uncertainty posed by the COVID-19 pandemic, Daily News reports. Schools that hiked fees reportedly communicated to parents that they were incurring fixed costs especially due to online classes which had already begun.
According to the publication, these are some of the fees parents will have to pay at these schools:
<blockquote>Peterhouse is charging $79 500 or US$1 590 for Peterhouse Girls (PHG) day scholars a term, while Peterhouse Boys’ School boarders should pay $133 000 or US$2 660.
St John’s wants $99 000 or US$1 650 from its Form Six students, $90 000 or US$1 500 for forms One to Four, $66 000 or US$1 100 for its preparatory level pupils, and $54 000 or US$900 for Early Childhood Development (ECD) learners.
<div>Heritage School justified its fees hike by saying its senior department had been working with children through the e-learning platform. The school is demanding US$900 from its preparatory pupils, US$1 150 for those in year one and two, US$1 350 in year three to seven, US$1 650 for those in year eight to 13, and US$1 750 for those in boarding.</div>

<div>Schools closed prematurely on 24 March due to COVID-19 and up to date, nothing has been said about reopening as the COVID-19 risk remains relatively high.</div>
