A Ministry of Transport official, Enerst Shenje, who is the Deputy Director of Roads Division, has been taken to court for fraud involving USD1 million. In a statement seen by Pindula News, the National Prosecuting Authority (NPA) of Zimbabwe said the Ministry suffered an actual loss of USD200,000 and a potential loss of USD803,417 due to Shenje’s alleged actions.
In a statement seen by Pindula News, the NPA said SShenje is accused of collaborating with others to forge a sale agreement and manipulate paperwork to receive compensation meant for a property owner affected by a construction project. Shenje will appear in court on January 30, 2024, for a bail application. Read the statement:

<h3>MINISTRY OF TRANSPORT OFFICIAL IN COURT FOR FRAUD</h3>
Enerst Shenje (39) the Deputy Director Roads Division in the Ministry of Transport and Infrastructure Development was arraigned before the Harare Magistrates Court facing charges of fraud.
The Government through the Ministry of Transport and Infrastructure Development embarked on a project to construct a multi-level interchange at Mbudzi roundabout. The government put in place a fund to compensate the property owners affected by this project. One of the properties affected belonged to Geoffrey Bannister and he holds a title deed to that effect. When compensation was due to be paid for the property the accused person allegedly connived with Levy Idana who is still at large and other individuals who are yet to be accounted for, to forge an agreement of sale using an old Title Deed in John Maloney’s name, predecessor in title to Geoffrey Bannister. In so doing the accused persons intended to create the impression that the property had been sold to Levy Idana and Levy Idana was now the one due to be compensated.
The fraudulent agreement of sale and the old title deed were submitted to the accused person who in turn fast-tracked the paperwork for payment of the compensation. Levy Idana received USD100 000 on the r and another USD100 000 on the 28th of December 2023 from treasury. As a result of the accused person’s alleged actions the Ministry of Transport suffered an actual prejudice of USD200 000 and a potential prejudice of USD803 417.
The accused person will appear in court on the 30th of January 2024 for bail application.

Ministry Of Transport Official In Court For Fraud Involving USD1 Million

The courts in Zimbabwe convicted over 2,200 robbers in 2023, with an additional 700 cases still pending trial. The National Prosecuting Authority (NPA) has been prioritizing the timely and efficient prosecution of robbery cases. The statistics from the NPA show that out of the convictions, 721 were for armed robbery and 1,518 were for basic robbery. Armed robbery involves the use of weapons, while basic robbery can involve the threat of force without a weapon.
The majority of robbers are men, with only two females convicted of armed robbery and 17 of basic robbery. The provinces of Harare and Bulawayo had the highest number of convictions, with Harare convicting 412 male armed robbers and two females, while Bulawayo convicted 189 males. On the other hand, Matabeleland North had the fewest convictions, with only two individuals found guilty of armed robbery. Mashonaland Central came second with four convictions.
In an interview with <a href="https://www.herald.co.zw/zim-intensifies-fight-against-crime-over-2-000-robbers-convicted-in-2023/">The Herald</a>, NPA spokesperson Ms Angeline Munyeriwa said they were aiming to clear all pending robbery cases by the end of the first quarter of this year.

The NPA continues to ensure that all cases brought to the authority are timeously, effectively and efficiently prosecuted. The Prosecutor General (Justice Loice Matanda-Moyo) has continuously implored prosecutors to oppose bail in all robbery cases and ensure that the cases are finalised within the shortest possible time.
In light of the foregoing, the NPA has adopted new strategies and continues to strengthen existing mechanisms in reducing robbery incidents thus making our societies safe and secure environments for all. The NPA is working on improving synergies amongst the prosecutors and the investigating agencies to ensure thorough investigation of robbery cases through gathering of adequate evidence that is admissible in court.

Noteworthy cases included the sentencing of Tinashe Marandure Pfeveni, an infamous robber from Masvingo, who received a 45-year sentence, and Boniface Moyo, a repeat offender from Beitbridge, who was sentenced to 57 years. The NPA aims to clear all pending robbery cases by the end of the first quarter of this year.

Courts In Zimbabwe Convicted Over 2,200 Robbers In 2023 - NPA

The law-enforcement authorities in Botswana have sent a request to the National Prosecuting Authority (NPA) seeking the extradition of two Zimbabweans involved in a robbery case. Allan Taruvinga (37) and Jivas Chizunza (48) were recently apprehended in Karoi while possessing a high-end vehicle that had been stolen in Botswana the previous year.
Galetiwaelwe Makhondo, Botswana’s principal prosecution counsel, wrote a letter to the NPA, requesting mutual legal assistance from the Zimbabwean authorities to facilitate the extradition process for Taruvinga and Chizunza. Said Makhondo in a statement:

The assistance of the competent authority in the Republic of Zimbabwe is sought for the repatriation of the motor vehicle.
(We also request) . . . a copy of the statement that was taken from the victim, Mr Fadzani Fordson Phegelo, after he identified the motor vehicle as his.
We understand the said statement was recorded by Detective Sergeant Dowi of Karoi Police Station.
 Statements of the officers that arrested the accused persons in possession of the said motor vehicle.

Botswana and Zimbabwe are signatories to the Southern African Development Community Protocol on mutual legal assistance. Makhondo’s letter also requested a copy of Mr. Phegelo’s statement, recorded by Detective Sergeant Dowi of Karoi Police Station, as well as statements from the arresting officers.
The NPA’s international relations and anti-terrorism unit, Mr. Clement Chimbari, confirmed that they are working on the extradition request from Botswana. Chimbari said:

Botswana has written to us, seeking their extradition.

<h3>Some Context:</h3>
According to allegations, Taruvinga and Chizunza, who were residing in Francistown, Botswana, ambushed Mr. Fadzani Fordson Phegelo of Selolwane Ward, Tutume, last year and robbed him of property worth P573,300. This included a Toyota Land Cruiser. After the incident, they returned to Zimbabwe and took the stolen vehicle to Karoi, where CID detectives later arrested them at a local food court.
The two suspects have already appeared in the Karoi Magistrates Court and have been charged with robbery. They are currently in custody awaiting trial. The Botswana authorities have also requested the recovery of Mr. Phegelo’s vehicle, which is being held as evidence at the Karoi Police Station.

Botswana Seeks Extradition Of Two Zimbabweans Implicated In A Robbery

A gold buyer held hostage a Chinhoyi couple for selling him fake gold worth US$24 000.
Donald Chiwenga (45) has since appeared before Dennis Manogid accused of holding hostage Eric Marangarire and Mercy Maphosa after establishing they had sold him 480 grams of fake gold, <a href="https://www.newzimbabwe.com/chiwenga-duped-into-buying-fake-gold-for-us24000-takes-couple-hostage-in-revenge-and-force-them-to-handover-4-vehicles/">NewZimbabwe</a> reported.
The court heard that Chiwenga also forcibly took the couple’s four vehicles to make up for what they had done to him.
Chiwenga appeared before Harare Magistrate Dennis Mangosi and was remanded in custody until January 21 of 2023.
The  National Prosecuting Authority (NPA) alleges Chiwenga purchased 480 grams of fake gold worth US$24 000 from Marangarire and Maphosa.
The court heard that Chiwenga only realised it was fake when he was smelting it in Kwekwe.
Infuriated by this, Chiwenga planned a payback by holding the couple hostage and forcing the two to sign agreements of sale of their four vehicles to his name in the presence of a lawyer.
The cars include a Mercedes Benz, Honda Fit, Toyota Hilux and Toyota Corolla.

Gold Buyer Buys Fake Gold Worth US$24 000

The National Prosecuting Authority (NPA)’s Asset Management Unit has said it has confiscated corruptly acquired assets worth close to US$6 million, <a href="https://www.zbcnews.co.zw/npa-forfeits-us-5-6-million-in-ill-gotten-properties/">ZBC News</a> reported.
Acting Prosecutor General Mr Nelson Mutsonziwa made the remarks while addressing delegates during a National Prosecuting Authority Strategic Review Workshop this Monday in Gweru. He said:

A number of corruptly acquired assets have thus been recovered from criminals using both methods of asset forfeiture, some of which are now under the management of the Asset Management Unit and so far, corruptly acquired assets worth US$5.6 million have been forfeited by our courts and the pending cases that are before the courts involve corruptly acquired assets worth US$D 20 million. In regard to other criminal matters, this year, we have received a total of 79 064 cases, of which 44 918 have been completed and the remaining cases are at various stages of prosecution.

Mutsonziwa said the department is initiating several strategies to improve the country’s justice delivery system to ensure that those accused of corruption are brought to trial and effectively and efficiently prosecuted with a minimum of delay. 
He added that the National Anti-corruption Strategy Steering Committee agreed that non-complex corruption cases be completed within six months and complex matters within a period of 12 months respectively.

NPA Confiscates Corruptly Acquired Assets Worth Nearly US$6 million

The Zimbabwe Anti-Corruption Commission (ZACC) has seized property worth over $700 million.
The anti-corruption body has also filed 18 unexplained wealth order case files with the National Prosecuting Authority (NPA).
Speaking at the commemoration of the International Anti-Corruption Day in Harare on Thursday, the Commission’s chairperson, Justice Loice Matanda-Moyo, said ZACC was on course in its mission to eradicate corruption in the country. She said:

It is with great pride that I pronounce that Zimbabwe has made great strides in ensuring maximum cooperation is given to state parties during Mutual Legal Assistance Requests.
The fight against corruption is real and it takes tireless efforts and undivided dedication for us to totally weed out corruption.

Justice Matanda-Moyo said ZACC would be launching Corruption Reporting Awards next year to honour journalists who bring issues of corruption to light through brave reporting. 
She added that journalists have a crucial role in fighting corruption.

The National Prosecuting Authority (NPA) has embarked on an exercise of conducting a lifestyle audit on all public prosecutors countrywide in a bid to rid the system of corrupt officials, The Herald reports.
This was revealed by Prosecutor-General Kumbirai Hodzi who said the move is meant to fight against organized crime and corruption:
<blockquote>A cornerstone policy of State has been the fight against corruption and organized crime. A cocktail of measures has been devised to enhance the monitoring of the integrity of each Prosecutor.
Among such measures, is the requirement to subject any officer to a Life Style Audit, should the circumstances of the situation require. These legitimate tools are in tandem with global trends and international best practices.
It is often said that an ounce of prevention is worth a pound of cure and for organizations such as the NPA and the PG’s Office this is best achieved through an effective internal program for preventing and detecting violations of the law or for ethical standards.</blockquote>
Hodzi said the audit will tally an individual’s expenditure over their income and if they do not match the prosecutors will be made to explain the difference:
<blockquote>Those who cannot prove legitimate sources of their wealth and assets will be subjected to legitimate due process of the law  a criminal investigation, asset seizure and forfeiture, a civil or criminal process and internal disciplinary proceedings for summary dismissal from the PG’s Office and NPA.</blockquote>
He appealed to whistleblowers to come forward and reports NPA staff members who are living large:
<blockquote>The public has always been very helpful in the fight against corruption. We appeal for whistle-blowers to supply any information helpful in the lifestyle audits at the NPA. So far, most of the information we are getting, is coming from members of the public.</blockquote>
ZIMRA and ZRP are reportedly carrying out similar exercises on their staffers too.
