Prominent human rights defender Jestina Mukoko has taken the Minister of Finance, Economic Development and lnvestment Promotion, Mthuli Ncube, to court for allocating national funds to the National Peace and Reconciliation Commission (NPRC) whose term of office expired in August 2023.
According to the Zimbabwe Human Rights NGO Forum, Mukoko alleges that in terms of section 251 of the Constitution, the NPRC was supposed to exist for only 10 years from 22 August 2013, the date it was operationalized. This means the NPRC ceased to exist on 23 August 2023.
However, despite this position, Finance Minister Mthuli Ncube allocated funds to the NPRC in his 2024 annual budget. Mukoko stated:

There is no law that allows any public expenditure in favour of the NPRC and this event is contrary thus to section 17 of the Public Finance and Management Act. I submit that it is neither prudent nor economical for the Respondents to allow expenditure for an entity that is not recognized by law or authorized to receive such expenditure. Section 308 of the Constitution provides that “it is the duty of every person who has custody or control of public funds to safeguard the funds and ensure that they are spent only on legally authorised purposes and in legally authorized amounts.”

Mukoko has also cited the Parliament of Zimbabwe and the Attorney-General as respondents. They are yet to respond to Mukoko, who is represented by Noble Chinhanu of the Zimbabwe Human Rights NGO Forum.
The Ministry of Justice, Legal and Parliamentary Affairs announced that it was working on transferring the functions of the NPRC to the Zimbabwe Human Rights Commission (ZHRC).

Jestina Mukoko Takes Mthuli To Court Over NPRC Funds Allocation

The Parliament of Zimbabwe has shortlisted candidates to fill vacant posts at the National Peace and Reconciliation Commission (NPRC), Veritas reports. Below is Veritas’ Commissions Watch 4/2021 released on the 26th March 2021.

Candidates Shortlisted for the National Peace and Reconciliation Commission [NPRC]
There are eight vacancies to be filled on the NPRC.  One vacancy arose in February 2020 when a member resigned and the other seven in February 2021 when the 5-year term of office of the commissioners came to an end.
In terms of sections 237 and 251 of the Constitution, the Committee on Standing Rules and Orders (CSRO) of the Parliament of Zimbabwe is mandated to nominate candidates for the appointment by His Excellency, the President, to serve as Commissioners on the National Peace and Reconciliation Commission. This is provided for under Chapter 12 , Part 6 of the Constitution.
The Chairperson is directly appointed by the President but the NPRC current chairperson, Justice Sello Nare, is only coming into his fourth year of office and so this will not apply to him.
Previous Commissioners had only served one term and are, therefore, eligible for re-appointment.  In fact, five of them are on the list of candidates to be interviewed [we have marked their names with the # symbol in the list below].  Section 17 of the Constitution states that at least four of the members should be women.
Section 236 of the Constitution specifically states that members of Commissions are to be non-political. It is however possible for a political party member to be appointed to the Commission but he/she must relinquish his/her membership of the political party within 30 days of such appointment. For example, in the list provided by Parliament [see below], Obert Gutu is a shortlisted candidate who has recently publicly joined ZANU-PF, so if he were appointed by the President he would have to resign promptly.  And this would apply to any other appointee who is a member of a political party.
PARLIAMENT’S NOTICE
 
The Committee on Standing Rules and Orders (CSRO) of the Parliament of Zimbabwe is mandated, in terms of sections 237 and 251 of the Constitution, to nominate candidates for appointment by His Excellency, the President, to serve as Commissioners on the National Peace and Reconciliation Commission (NPRC) as provided for in Chapter 12, Part 6, of the Constitution.
The Functions of the National Peace and Reconciliation Commission
The functions of the Commission and the person specifications as specified under Section 252 of the Constitution are as given below.

<li style="font-weight: 400;">a)to ensure post-conflict justice, healing and reconciliation;</li>
<li style="font-weight: 400;">b)to develop and implement programmes to promote national healing, unity and cohesion in Zimbabwe and the peaceful resolution of disputes;</li>
<li style="font-weight: 400;">c)to bring about national reconciliation by encouraging people to tell the truth about the past and facilitating the making of amends and the provision of justice;</li>
<li style="font-weight: 400;">d)to develop procedures and institutions at a national level to facilitate dialogue among political parties, communities, organisations and other groups, in order to prevent conflicts and disputes arising in the future;</li>
<li style="font-weight: 400;">e)to develop programmes to ensure that persons subjected to persecution, torture and other forms of abuse receive rehabilitative treatment and support;</li>
<li style="font-weight: 400;">f)to receive and consider complaints from the public and to take such action in regard to the complaints as the Commission considers appropriate;</li>
<li style="font-weight: 400;">g)to develop mechanisms for early detection of areas of potential conflicts and disputes, and to take appropriate preventive measures;</li>
<li style="font-weight: 400;">h)to do anything incidental to the prevention of conflict and the promotion of peace;</li>
<li style="font-weight: 400;">i)to conciliate and mediate disputes among communities, organisations, groups and individuals; and</li>
<li style="font-weight: 400;">j)to recommend legislation to ensure that assistance, including documentation, is rendered to persons affected by conflicts, pandemics or other circumstances.</li>
</ol>
Person Specifications
Members of the National Peace and Reconciliation Commission must be chosen for their integrity and their knowledge and understanding of, and experience in, mediation, conciliation, conflict prevention and management, post-conflict reconciliation or peace building.
The following twenty–nine (29) candidates who meet the above criteria, have hence been shortlisted for interviews which will be held in public on the 14th April, 2021. These interviews will be held in the SENATE Chamber, Ground Floor, Parliament Building, corner Nelson Mandela Avenue and Third Street, HARARE. The under listed candidates must, therefore, report for the interviews by not later than 07:30hrs on the day of the interviews. Today, the Zimbabwe Human Rights Association (ZimRights) has lodged a complaint with the Zimbabwe Human Rights Commission (ZHRC) as well as the National Peace and Reconciliation Commission (NPRC) against the hate speech by Acting ZANU PF Spokesperson Mr. Patrick Chinamasa.
In a communication to the two independent commissions, ZimRights has noted that hate speech and incitement to commit violence is prohibited by the laws of Zimbabwe and in violation of fundamental rights guaranteed in the Constitution.
By inciting his supporters to commit violence against anti-corruption protestors, Mr. Chinamasa is putting the lives of many Zimbabweans in danger. ZimRights has noted that in the history of Zimbabwe, when leaders propagate hate speech, violence follows. ZimRights is urging the ZHRC and the NPRC to investigate the statements by Mr. Chinamasa and have the law take its course.

FULL TEXT: ZimRights Files A Complaint Against Patrick Chinamasa's Hate Speech And Enticing Public Violence

<blockquote>The MDC leadership today met with Commissioners of the <a href="https://www.pindula.co.zw/National_Peace_and_Reconciliation_Commission" rel="noopener noreferrer" target="_blank">National Peace and Reconciliation Commission (NPRC)</a>, an independent Constitutional Commission, at the party headquarters at Morgan Richard Tsvangirai headquarters in a frank and honest debate regarding the work and mandate of the Commission.
President Nelson Chamisa welcomed the Commissioners to the party headquarters and said the party appreciated the heavy workload of the Commission.
In his welcome remarks, he said that he hoped for an open, frank and honest discussion between the party leadership and the NPRC in a manner that would further the interests of the people of Zimbabwe and entrench a culture of peace and tolerance in the country.</blockquote>

<blockquote>President Chamisa sought leave of the Commissioners to attend the funeral of one his drivers in Mbare. He left Vice President Hon. Tendai Biti to chair the MDC leadership’s two-and-half-hour fruitful and candid engagement with the leadership of the NPRC.
The MDC leaders raised issues to do with the independence and autonomy of the Commission, the continued culture of impunity in the country in spite of the existence of the Commission as well as the disturbing fact that the NPRC had not referred anyone for prosecution, even in cases where the culprits of violence and conflict had been identified.
The party leaders cited Gukurahundi, the electoral violence that has been committed by Zanu PF over the years and the non-prosecution of perpetrators of violence in cases such as the State-sponsored violence of August 01, 2018, in which six people were killed as well as the State-driven violence of January 2019 in which more innocent people were callously murdered.
The NPRC insisted that it was an independent Commission and that it would roll out a national visibility programme in 2020, even though they said they required more resources to execute their Constitutional mandate.
The party leadership and the NPRC agreed to continuously engage to solve conflicts and promote peace and reconciliation in the country.
As a party, the MDC has been a victim of Zanu PF and State-sponsored violence in which thousands of people have been brutally killed, with no action taken against the culprits.
The party leadership insisted in the meeting that peace and reconciliation alone were not enough as justice had to be seen to be done particularly against the perpetrators of violence and genocide against the people.

MDC Leadership Engages National Peace And Reconciliation Commission {Full Text}

The National Peace and Reconciliation Commsion is looking for an Editor to edit academic papers on Gukurahundi. The advert reads:
<blockquote>The consultant is required to edit one paper produced by NPRC on the Gukurahundi conflict in order to contextualize and provide understanding to the NPRC in their planning. This will enable the Commission a deeper appreciation of the conflict in order to pave way for healing and reconcilliation.
The Consultant should review the paper, add, subtract and correct facts in the paper in order to produce as near a reflection of the Gukurahundi as possible. The various narratives espoused by authors should be reflected and this wil be complimented by communities when the Commission interacts with them. The theoretical and practical blending of information will enable the NPRC to obtain a comprehensive understanding of the conflict.
Deliverables
A Consultant is expected to edit one paper on Gukurahundi  conflict, its causes and consequences and implications on NPRC programming today.
Requirements and experience Education

The National Peace and Reconciliation Commission (NPRC) has asked for Zimbabweans to give it a chance to enable it to carry its mandate.
In an interview with Southern Eye, NPRC spokesperson, Charles Masunungure, said:
<blockquote>This is the only opportunity that we have to settle past conflicts when victims are still alive as secondary victims will be less-forgiving and more militant.
Peace is just not the absence of war and violence but denotes well-being of the people, happy, healthy lives, access to basic services, inclusive of economic growth, a celebration of diversity and differences.
An independent commission like NPRC is best placed to resolve conflicts as it is non-partisan and constitutional.</blockquote>
The NPRC came into being on January 5, 2018, when President Emmerson Mnangagwa signed the NPRC Bill into law.

NPRC Spokesperson Calls For Tolerance

Treasury has authorised the National Peace and Reconciliation Commission (NPRC) to recruit 32 people before the end of the year.
In an interview yesterday, the Commission’s media liaison officer, Commissioner Reverend Charles Masunungure said they require 103 staff members. He said they have already advertised the post of Executive Secretary. Said Masunungure:
<blockquote>We have advertised the post of Executive Secretary and we are hoping that before mid-month we would have completed the selection of the Executive Secretary, and then the rest of the posts will be advertised so that the Executive Secretary is part of the selection process because they will be working under him or her. We will do the adverts very soon so that everyone who believes that they are competent and they are Zimbabwean can participate. Some of the posts that are in the 32 are financing, administration, legal, audit and a few are in programmes.</blockquote>

Peace And Reconciliation Commission Authorised To Recruit

The National Peace and Reconciliation Commission (NPRC) the body which is to look into the Gukurahundi Massacres among other issues, has postponed its public consultations due to a court challenge. The challenge is from the Zimbabwe Human Rights NGO Forum which wants Commission which to have a substantive chairperson first before it starts meeting with communities.
President Emmerson Mnangagwa signed the National Peace and Reconciliation Commission Bill (NPRC) into law early this year, making operational the Commission that was appointed in 2016.  Vice President Kembo Mohadi is the Minister of National Peace and Reconciliation.

National Peace And Reconciliation Commission Postpones Consultations After Court Challenge

Chief Secretary to the President and Cabinet Dr Misheck Sibanda announced that President Emmerson Mnangagwa signed the National Peace and Reconciliation Commission Bill (NPRC) into law on Friday last week, making operational the Commission that was appointed in 2016.
The announcement was made under General Notice 2 of 2018 in the Government Gazette.
<blockquote>The following law, which has been assented to by His Excellency the President, is published in terms of Section 131 (6) of the Constitution of Zimbabwe — National Peace and Reconciliation Commission Act (Chapter 10:32 (No.11 of 2017).</blockquote>
The Act provides for the functions, powers, operations and removal from office of the members of the Commission, manner of conducting investigations and staffing of the Commission, among others. It also provides for the independence of the Commission and empowers individuals that may have been affected by any dispute or conflict out of any act of omission or commission on the part of an authority or person to make oral or written submissions to the Commission in any one of the 16 official languages. Although a new chairperson is yet to be appointed, the Commission has people like Lilian Chigwedere, Patience Chiradza, Choice Ndoro, Charles Masunungure, Geoffrey Chada, Leslie Ncube and Godfrey Chekenyere.
