<p>The Crisis in Zimbabwe Coalition (CiZC) has demanded the implementation of the recommendations made by the Motlanthe Commission which was established to investigate the 1 August 2018 killings.</p>
<p>Six civilians were shot dead by soldiers in central Harare during protests over delays in announcing presidential election results.</p>
<p>Thirty-five others were wounded in the shootings, forcing President Emmerson Mnangagwa to appoint a commission headed by former South African President Kgalema Motlanthe, to probe the killings.</p>
<p>The Motlanthe Commission, recommended, among other things, compensation to families of the deceased as well as prosecution of the killers.</p>
<p>In a letter dated October 18, 2022, addressed to the Minister of Justice, Legal and Parliamentary Affairs Ziyambi Ziyambi, CiZC chairperson Peter Mutasa said:</p>
<blockquote>
<p>We address you in your capacity as the chairperson of the Inter-Ministerial Taskforce which was tasked with addressing issues arising from the findings of the Motlanthe Commission of Inquiry report.</p>
<p>We write to your esteemed office expressing our reservations over the failure of the Government of Zimbabwe to implement recommendations of the seven-member Motlanthe Commission of Inquiry following the events of August 1, 2018, that resulted in the death of six civilians at the hands of the army following protests over the late announcement of Presidential election results in Harare.</p>
</blockquote>
<p>Mutasa raised the issue of security sector reforms which he said should be addressed. He said:</p>
<blockquote>
<p>So far, the Government of Zimbabwe has not instituted security sector reforms to ensure that the military acts within the provisions of the Constitution of Zimbabwe and in conformity with human rights norms and standards.</p>
<p>The State is still to implement Section 210 of the Constitution of Zimbabwe that provides for an Independent Complaints Mechanism for receiving and investigating complaints from the members of the public about misconduct on the part of members of the security services, and for remedying any harm caused by such misconduct.</p>
<p>The Independent Complaints Mechanism is a crucial body in light of the increasing cases of human rights abuses linked to security.</p>

CiZC Demands Implementation Of Motlanthe Commission Recommendations

<blockquote><p>The Crisis in Zimbabwe Coalition (CiZC) is shocked by the government of Zimbabwe’s claims that it fully complied with recommendations of the Motlanthe Commission of inquiry into August 1, 2018 events during which the army killed six civilians with 35 others injured.</p>
<p>As a Coalition, we view such an announcement, without any evidence backing it, as a refusal by the government to be accountable for human rights violations and lack of respect to the unfortunate lives lost, a situation that has hindered previous efforts on National Healing and Reconciliation.</p>
<p>It is evident that none of those responsible for the killings has been brought to book and convicted.</p>
<p>Further to that, members of the Army and Police who were in breach of their professional duties and discipline are yet to be identified for their internal investigations and appropriate sanction as again recommended by the Commission.</p>
<p>If in any case, the Commission recommendations had been implemented, then some of the killings, beatings and human rights violations perpetrated during the lockdown might have been prevented.</p>
<p>It is important to underline that there has not been any meaningful or sincere effort towards reform and transformation from the government of Zimbabwe except mere politicking.</p>
<p>National Healing and Reconciliation also recommended by the Motlanthe Commission continues to be a pipe dream in Zimbabwe owing to lack of sincerity on the part of authorities and this explains why results of the Commission that investigated the Gukurahundi Massacres which claimed more than 20 000 lives remains a top-secret up to now. Victims of these massacres, their relatives, stakeholders and the nation at large have waited for justice in vain for more than three decades.</p>
<p>As a Coalition, we have always maintained that the Motlanthe Commission was set up with an interest to absolve President Emmerson Mnangagwa, ZANU PF and the Zimbabwe National Army from the killings of civilians who were demonstrating against electoral fraud.</p>
<p>We reiterate that, those involved in the killings should be brought to book and that the government should fully compensate all victims of August 1, 2018 army shootings.</p>
<p>We recommend that the government should set up an all-inclusive National Dialogue platform and an all stakeholders healing and reconciliation platform for the country to move forward.</p>

FULL TEXT: Motlanthe Commission Was Set Up To Absolve ED, ZANU PF And Army From August 1 Killings

<p>The Commission of Inquiry into the August 1 post-election violence which left six people dead and destroyed property estimated at millions of dollars has concluded that the violence was pre-planned and that deployment of the military was justified.</p>
<p>Part of the report reads:</p>
<blockquote><p>The Commission found that on the basis of all the prevailing circumstances, and in the light of all the evidence presented including the rapid escalation of the situation in a very short space of time, the decision to deploy the Military to assist the Police in the containment of the riots was justified. The deployment could only have been avoided if the Police were adequately experienced, better equipped, sufficient in numbers and more suitably organised. While recognising that in the circumstances, the deployment was unavoidable, the Commission considers that it would have been preferable if the Police had been able to deal with the situation on their own. Whilst the deployment was lawful, the operational framework in terms of Section 37 of POSA was not fully followed in that the deployed troops were not placed under the command of the Regulating Authority due to time constraints as acknowledged by the Commissioner General of Police.</p></blockquote>


Decision To Deploy Soldiers To Assist Police Was Justified- Motlanthe Commission

<p>President Emmerson Mnangagwa said that he will release the Motlanthe Commission Report next week. He said this while addressing ZANU PF delegates at the ongoing ZANU PF Annual  People’s Conference in Esigodini.</p>
<p>Mnangagwa said that he has already seen the report, and is studying it with his deputies. He said the report will be made public next week.</p>
<p>Meanwhile, Mnangagwa has vowed that he will not accommodate the MDC in a Government of National Unity. He reiterated the point that ZANU PF won the July 30 poll and the Constitutional Court case and therefore, there is no logic in accommodating the MDC.</p>

Mnangagwa Promises To Release Motlanthe Commission Report Next Week

<p>President Emmerson Mnangagwa said that he will make the Motlanthe Report public since the hearings were done in public. He said this at a re-alignment workshop with heads of foreign missions at Darewndale on Monday. Said Mnangagwa</p>
<blockquote><p>The hearings were done in public, so the report will be shared with the public.</p></blockquote>
<p>Meanwhile, University of Zimbabwe law lecturer and Motlanthe Commissioner, Lovemore Madhuku, said that there is no longer that compels Mnangagwa to make the report public immediately. Madhuku had this to say</p>
<blockquote><p>There is, in the law, room to be given to the President to read the report and thereafter to make it public. There is no law which says the President should make the report public immediately after being given.</p>
<p>The procedure at law is that he receives the report; he studies it and then makes it public. As far as we are concerned, the report will be made public.</p></blockquote>

Mnangagwa Says He Will Publicise The Motlanthe Commission Report

<p>Secretary to the Motlanthe Commission of Inquiry into the August 1 shootings, Virginia Mabiza denied allegations that the commission ignored some of the evidence presented by witnesses. There are concerns from some quarters that the Commission’s report was hurried thereby disregarding the testimonies of eyewitnesses of the killings. Mabiza has refuted those allegations, and she said</p>
<blockquote><p>People should wait for the full report, as opposed to speculating. It is unfortunate that now I have to disclose something which I should not have done. People will see it for themselves after we have put up a website.</p></blockquote>
<p>The Human Rights Forum had alleged that their 500-page dossier was not considered in the Commission’s report. On November 26, the Forum chairperson Jestina Mukoko wrote to the Commission. Part of the letter reads</p>
<blockquote><p>I, hereby, submit video evidence in connection with the violence of August 1, 2018. We note, with concern, that despite the submission of this evidence to the secretariat of the commission of inquiry on October 5 and 12, 2018, this evidence is not before the commission of inquiry and only two of the 18 witnesses covered by this evidence were invited to testify.</p></blockquote>
<p>Regarding the concerns raised by the Forum, Mabiza said</p>
<blockquote><p>… Let me say it today, we used quite a lot from their voluminous report which they presented to the commission. I can tell you that the commission relied upon the post-mortem evidence from the forum. So it would be unfair to allege that we ignored them, we did not.</p></blockquote>
