<p>Four Shurugwi residents are set to receive nearly US$40,000 in compensation after a judicial officer convicted Zimbabwe National Army (ZNA) Commander Lieutenant-General Anselem Sanyatwe and Defence Minister Oppah Muchinguri for violating their rights during a government-imposed lockdown three years ago.</p>
<p>The residents—Grant Zinyuke, Moreblessing Ncube, Batler Jabangwe, and Mavhuto Kachepa—were assaulted by soldiers enforcing the lockdown in August 2021. They argued that the soldiers acted unlawfully under the control of Sanyatwe and Muchinguri, who were held vicariously liable.</p>
<p>Represented by lawyers from Zimbabwe Lawyers for Human Rights, the residents described severe injuries resulting from the assaults.</p>
<p>Zinyuke suffered facial injuries and lost teeth; Ncube experienced swelling and bruising; Jabangwe endured multiple injuries that affected his ability to wear shoes; and Kachepa sustained serious leg fractures.</p>
<p>Magistrate Patricia Gwetsayi ordered Sanyatwe and Muchinguri to pay Zinyuke US$10,000, Ncube US$8,000, Jabangwe US$8,000, and Mavhuto US$12,000 for pain, suffering, trauma, and medical expenses related to their injuries.</p>
<p>Below is the full statement by the Zimbabwe Lawyers for Human Rights on the matter:</p>

<p>FOUR AGGRIEVED Shurugwi residents are set to receive close to US$40 000 after a judicial officer convicted Zimbabwe National Army (ZNA) Commander Lieutenant-General Anselem Sanyatwe and Defence Minister Hon. Oppah Muchinguri for violating their rights, when some soldiers went on a rampage and brutalised them, during a government-imposed national lockdown, three years ago.</p>
<p>Sanyatwe and Hon. Muchinguri stood trial at Shurugwi Magistrates Court after the four residents namely Grant Zinyuke, who is employed at Shurugwi Hospital, Moreblessing Ncube, who is self-employed, Batler Jabangwe, an employee of Shurugwi City Council and Mavhuto Kachepa, who is self-employed, sued the duo, demanding payment of compensation for violation of their rights, when they were brutally assaulted in August 2021 by some soldiers, who were enforcing the national lockdown imposed by government in a bid to curb the spread of coronavirus.</p>
<p>In summons filed at Shurugwi Magistrates Court, Zinyuke, Ncube, Jabangwe and Kachepa, argued that the conduct of the soldiers, who at all material times were acting within their course and scope of their employment as duly attested members of ZNA and under the control or instructions of Sanyatwe and Hon. Muchinguri, who were held vicariously liable for their actions, was unlawful.</p>
<p>The residents, who were represented by Prisca Dube and Jabulani Mhlanga of Zimbabwe Lawyers for Human Rights, argued that the soldiers unlawfully, wrongfully and without just cause, assaulted them resulting in them sustaining several injuries on their bodies.</p>
<p>In the case of Zinyuke, he sustained some injuries which include swelling on the forehead, lacerations on the upper lip and nose, bruises on his back and losing some of his teeth and had to seek medical treatment.</p>
<p>Dube and Mhlanga told Shurugwi Magistrate Patricia Gwetsayi, who presided over the trial of Sanyatwe and Hon. Muchinguri, that Ncube sustained severe swelling on his face, forearms and bruises all over his back, when he was assaulted by some soldiers on 1 August 2021, for allegedly being outside his residence buying airtime so as to get an update on the health status of his ailing mother.</p>
<p>Jabangwe, an employee of Shurugwi City Council, was assaulted all over his body by soldiers, who saw him while coming from executing his duties of opening water taps at Makusha shopping centre and who accused him of wandering around.</p>
<p>As a result of the assault by the soldiers, Jabangwe sustained injuries on the right side of his back and on his left leg, which injury makes it difficult for him to wear closed shoes to date and remains severely traumatised by the incident.</p>
<p>In the case of Kachepa, the lawyers stated that he was assaulted by soldiers, whom he met when he was on his way home from a beer retail outlet, who confronted him and without any provocation or warning, used guns and broke his right leg in two spots.</p>
<p>While he was lying on the ground, some soldiers assaulted him all over his body and he sustained two severe fractures on the right leg, swelling all over the body, lacerations on the arms and some bruises on his body.</p>
<p>Dube and Mhlanga argued that such conduct by soldiers against the Shurugwi residents, was cruel, inhuman and degrading treatment punishment, which left them traumatised, anxious and in shock.</p>
<p>Recently, Magistrate Gwetsayi ordered Sanyatwe and Hon. Muchinguri to pay Zinyuke US$10 000, US$12 000 to Mavhuto, US$8 000 to Jabangwe and US$8 000 to Ncube, as compensation for damages for pain and suffering, trauma and nervous shock and for medical expenses, which they incurred while seeking treatment.</p>

<p>In an interview with an American broadcaster, National Public Radio (NPR), Minister for Finance and Economic Development Mthuli Ncube claimed that former President Robert Mugabe was responsible for the brutal crackdown on protestors by security forces in January 2019.</p>
<p>Ncube made the claims notwithstanding the fact that Mugabe was pushed out office in November 2017. Below is an excerpt from the interview:</p>
<blockquote><p><strong>SHAPIRO:</strong> As we heard, the president, Emmerson Mnangagwa, campaigned on this message of Zimbabwe is open for business. Earlier this year, widespread protests were violently shut down by the military. International investors want to see stability and rule of law before they put their money into a country. Are you concerned that the sort of violent crackdown on protesters we saw will actually scare away international investors?</p>
<p><strong>NCUBE:</strong> You know, we had a previous leader of Zimbabwe who was in power for 37 years.</p>
<p><strong>SHAPIRO</strong>: Robert Mugabe.</p>
<p><strong>NCUBE</strong>: Yes. Let’s be honest. When you stay that long, you become the institution. You erode all other institutions. So when we have a new regime taking over, it just takes time for the institution to settle down and take over. So what happened during that period, the intensity of the protests basically overwhelmed the enforcement – law enforcement agents. It’s very clear. But the president came out very strong, very strong and said, look, I like the president, leader of Zimbabwe, I condemn this violence from both sides. And I think that is a very, very strong statement.</p>
<p><strong>SHAPIRO</strong>: It was not just the violent crackdown in the heat of the moment. There was also the arrest of more than a thousand critics and civil society leaders detained without warrants on dubious grounds according to Amnesty International. Does that kind of a crackdown, even outside of a protest, tell the international community that Zimbabwe is not yet ready for being open for business?</p>
<p><strong>NCUBE</strong>: As I say, it is really about the ability to cope with such intense protests in a situation where some of the state institutions are not as strong because their power is eroded by a – this leader who was there for too long.</p></blockquote>

Mthuli Blames Mugabe For January's Brutal Crackdown On Intense Protest

<p>A ZANU PF activist who told prosecutors last week that he had been given an army uniform at the ZANU PF headquarters before going in a robbery spree has changed his statement. He now claims that police officers forced him to wear a friend’s army uniform.</p>
<p>Shepherd Magorimbo told Harare magistrate Rumbidzai Mugwagwa on Monday that police officers who arrested him in the city centre took him to his residence had forced him to wear Fungai Makoni’s army fatigue that was in his room.</p>
<p>Magorimbo pleaded not guilty to two counts of robbery. His lawyer Blessing Mupwanyiwa told the court that the State must have brought the arresting officer to testify if it was opposing bail.</p>
<p>The prosecutor Sebastian Mutizirwa opposed bail for Magorimbo. He told the court that the accused was arrested by members of the public. He further argued that the accused is a flight risk and if released, he would link up with his accomplices, who are still at large. Mgorimbo was remanded to February 25.</p>

'Fake' Soldier Tells Court Police Officers Forced Him To Wear Friend's Army Uniform

<p>A man who terrorised Harare residents clad in army uniform told prosecutors during his court appearance before magistrate Rumbidzai Mugagwa, that he got the uniform from the ZANU PF headquarters in Harare.</p>
<p>Shepherd Magorimbo was arrested last week and appeared before the court where he revealed that he was a ZANU PF member. When questioned by the prosecutor, Magorimbo’s response was:</p>
<blockquote><p>We were given the uniform at the party office.</p></blockquote>
<p>He is currently in remand prison and will appear in court on Monday. Magorimbo is being charged with two counts of robbery.</p>
<p>In one of the alleged robbery incidents, on January 15, Magorimbo together with his two accomplices who were also clad in army uniform, got into Nicholus Mupazi’s vehicle, opened the glove compartment and took R60 and a Samsung mobile phone and went away.</p>
<p>The incident occurred along Baines Avenue in Harare. He was positively identified by Mupazi, leading to his arrest.</p>

<p>The United States of America on Friday expressed deep concern over reports of human rights abuses by Zimbabwe’s security forces.</p>
<p>Assistant Secretary for U.S. Department of State’s Bureau of African Affairs Tibor Nagy demanded that those responsible for the wanton human rights violations should be held accountable. Writing on microblogging site Twitter, Nagy said:</p>
<blockquote><p>The U.S. is deeply concerned about continued reports of human rights violations in Zimbabwe. We call on the government to respect human rights, hold accountable those responsible for human rights violations and immediately end all violence by government forces.</p></blockquote>
<p>Soldiers have been accused of beating up members of the public, breaking the bones of some in the process. There are reports of women being raped by men in military fatigues in high-density suburbs.</p>
<p>However, the Zimbabwean government has scoffed at criticism for its heavy-handedness. The government insists that its use of force was justified.</p>

United States Demands Immediate End Of All Violence By Zim Government Forces

<p>The United Nations (UN) has condemned the government crackdown on protestors and urged President Emmerson Mnangagwa to bring to justice those involved in torture and rape.</p>
<p>The world body denounced the destruction, lootings, mass arrests and detentions as well as reported physical violence, rape cases and sexual violence perpetrated by security agencies. It said investigations should be carried out to bring justice to the victims.</p>
<p>This comes after widespread reports of wanton abuse of human rights by security forces. Hundreds of people have been tortured while scores of women have been raped during the crackdown. In a statement released on Friday, the UN said:</p>
<blockquote><p>The investigations should result in holding the perpetrators to account and bringing justice to those affected, assisting families who lost loved ones, ensuring due process of law to those in custody and providing survivors with necessary health, psycho-social and legal services.</p>
<p>Acts of violence, rape, and other forms of violence are heinous crimes and a serious threat to every individuals’ rights to life and dignity. The safety, security and dignity of every person are universal human rights enshrined in the country’s Constitution and the Universal Declaration of Human Rights.</p></blockquote>

United Nations Condemns Violation Of Human Rights During Military, Police Crackdown On Protestors

<p>The government rejected claims that it always resorts to violence when dealing with protests. This comes after Midlands Senator Morgen Komichi (MDC Alliance) asked Justice minister Ziyambi Ziyambi if it was the only solution for the government to use brute force against protestors. In response Ziyambi said:</p>
<blockquote><p>The historical narration by Komichi is untrue. Doctors went on strike and their grievances were resolved and then hooligans started barricading roads and destroying property and now Komichi is saying the country is on fire.</p>
<p>If they did not barricade roads and loot, the country would be functioning in peace. We sent police to work 24 hours arresting those people and now there is peace.</p>
<p>We do not know what other actions the government should have taken other than the actions we took.</p></blockquote>
<p>The government still insists that it was justified in the manner in which it handled recent protests. Heavily armed soldiers were deployed across the country have they allegedly killed at least 12 protestors, broke the bones of hundreds and raped countless women.</p>
