<p>Prominent human rights defender Jestina Mukoko has taken the Minister of Finance, Economic Development and lnvestment Promotion, Mthuli Ncube, to court for allocating national funds to the National Peace and Reconciliation Commission (NPRC) whose term of office expired in August 2023.</p>
<p>According to the Zimbabwe Human Rights NGO Forum, Mukoko alleges that in terms of section 251 of the Constitution, the NPRC was supposed to exist for only 10 years from 22 August 2013, the date it was operationalized. This means the NPRC ceased to exist on 23 August 2023.</p>
<p>However, despite this position, Finance Minister Mthuli Ncube allocated funds to the NPRC in his 2024 annual budget. Mukoko stated:</p>
<blockquote>
<p>There is no law that allows any public expenditure in favour of the NPRC and this event is contrary thus to section 17 of the Public Finance and Management Act. I submit that it is neither prudent nor economical for the Respondents to allow expenditure for an entity that is not recognized by law or authorized to receive such expenditure. Section 308 of the Constitution provides that “it is the duty of every person who has custody or control of public funds to safeguard the funds and ensure that they are spent only on legally authorised purposes and in legally authorized amounts.”</p>
</blockquote>
<p>Mukoko has also cited the Parliament of Zimbabwe and the Attorney-General as respondents. They are yet to respond to Mukoko, who is represented by Noble Chinhanu of the Zimbabwe Human Rights NGO Forum.</p>
<p>The Ministry of Justice, Legal and Parliamentary Affairs announced that it was working on transferring the functions of the NPRC to the Zimbabwe Human Rights Commission (ZHRC).</p>

Jestina Mukoko Takes Mthuli To Court Over NPRC Funds Allocation

<p>There is growing concern in Zimbabwe regarding the safety of opposition political activists after several of them were abducted, tortured, and injected with unknown substances by suspected state security agents. These injections have raised fears that they may contain a slow-acting poison, leading to the gradual deterioration of the victims’ health.</p>
<p>The opposition party, Citizens Coalition for Change, led by Nelson Chamisa, has publicly accused state security agents and the ruling party, ZANU PF, of being responsible for these acts. They believe that these actions are part of a broader campaign of violence and attacks targeting opposition activists.</p>
<p>Victims have come forward to share their experiences, describing the physical and emotional pain they endured during their abductions and torture. Medical professionals suspect that the unknown substances injected into them may pose a long-term health risk. CCC spokesperson, Promise Mkwananzi, told <a href="https://www.thedailybeast.com/zimbabwe-dissidents-may-be-victims-of-serial-poison-plot-by-emmerson-mnangagwas-regime?ref=scroll">The Daily Beast</a>:</p>

<p>We are not aware what the substance is but experts in one of the cases indicated that it could lead to a deadly cancer within five years if not drained out [of the body] in time.</p>

<p>Womberaishe Nhende, a Harare city councillor and member of the CCC, says he was abducted, beaten, and injected with an unknown substance. He believes his involvement with the CCC and organising protests against the alleged theft of the August 2023 election made him a target. He said:</p>

<p>But l have never shifted on my resolve to fight for a better Zimbabwe for all, though disturbed by the methods of engagement being used by ZANU PF. I know for a fact it’s ZANU PF-sponsored state agents, for they were blunt in their conduct. </p>
<p>The doctors have recommended further treatment outside Zimbabwe. Nothing conclusive has been reached hence the need to have further tests in highly specialized laboratories.</p>
</blockquote>
<p>The Zimbabwe Association of Doctors for Human Rights has sent some victims for testing in South Africa, but the results are pending. International organizations like Amnesty International have condemned the worsening human rights situation in Zimbabwe and called for thorough investigations into these crimes.</p>
<p>The abductions and assaults on opposition activists have also raised concerns among the US and European embassies. The government has in the past dismissed claims of abductions as fabricated. </p>

<p>Some of the alleged abductions have not been reported to the police due to fears that the state might use the case against those who would have reported. This concern is based on incidents involving Joana Mamombe, Cecilia Chimbiri, and Netsai Marova, who reported their abductions but were later charged with faking their abduction to defame the government.</p>

Abducted People Were Possibly Injected With Slow-killing Poison

<p>The Zimbabwe Lawyers for Human Rights (ZLHR) has urged the government to criminalise abductions and enforced disappearances in accordance with the country’s constitution. On the occasion of the International Day of the Victims of Enforced Disappearances, the human rights organization emphasized the need for the government to ratify the United Nations International Convention for the Protection of All Persons from Enforced Disappearance. ZHLR said:</p>
<blockquote>
<p><em>While in Section 53, the Constitution expressly outlaws torture or cruel, inhuman or degrading treatment or punishment, the lack of legislation that criminalises abduction and enforced disappearances has created a gap in domestic law and fuelled impunity.</em></p>
</blockquote>
<p>ZHLR said the recent surge in reported cases of enforced disappearances, particularly targeting government critics, highlights the urgency for Zimbabwean authorities to establish a legal framework that prevents such grave human rights violations and ensures justice and redress for victims and their families. ZLHR also called upon both state and non-state actors to take effective measures in preventing enforced disappearances and holding the responsible parties accountable.</p>
<p>Several government critics, including opposition members and human rights defenders, have made claims of being abducted by suspected state security agents. Some notable cases include Itai Dzamara, a well-known activist advocating for political change, he was abducted in 2015 and has not been seen since.</p>
<p>Another one is Jestina Mukoko, a human rights activist and journalist. She was abducted in 2008 and held incommunicado for several weeks before being charged with plotting to overthrow the government. Tawanda Muchehiwa, a journalism student, was abducted in 2020 and allegedly tortured by suspected state security agents. Joana Mamombe, Cecilia Chimbiri, and Netsai Marova claimed that they were abducted by suspected state security agents in 2020 after participating in a protest and reportedly subjected to torture and sexual assault.</p>
<p>The government denies these allegations, claiming they are staged to tarnish its image. Authorities often attribute the abductions to a “third force” aiming to discredit the government. Some analysts argue that these abductions are intended to instil fear among government critics who expose human rights violations and mismanagement by the government.</p>

Jestina Mukoko-led Zimbabwe Peace Project Responds To Attack Against Catholic Priests

<p>Zimbabwe Peace Project leader, Jestina Mukoko has recalled how she was abducted by 5 unidentified armed men and a woman who were driving an unmarked vehicle with no registration numbers, from her home in Norton on the <span class="ILfuVd NA6bn"><span class="e24Kjd">3rd December 2008 around 5 am. Posting on Twitter, she said:<br/>

<blockquote><p><strong>On this day they came for me at dawn. Incommunicado for 21 was tortured then 68 at Chikurubi. Why subject to abduction it’s cruel inhuman and cruel. My crime: to overthrow govt really ini? zvimwe vanhu itai muchinyara (me overthrowing the government? You must be ashamed of yourselves.)<br/>
</strong></p></blockquote>
<p>In her affidavit back then, she said:</p>
<blockquote><p><strong>I was not wearing anything other than a nightdress. I had no undergarments and other personal and medical requirements.</strong></p></blockquote>
<p>She asked to wear some better clothes but she was forced out of the window by her abductors who then drove her for about an hour before putting her in “an interrogation room”. She said that she was asked numerous questions which later turned into accusations.</p>
<p>She said that the six men who were interrogating her accused her of recruiting youths to join the MDC through her organisation, ZPP. She added:</p>
<blockquote><p><strong>First, I was assaulted underneath my feet with a rubber-like object which was at least one metre long … Later, I was informed to raise my feet on to a table, and the other people in the room started to assault me underneath my feet. This assault lasted for at least five to six minutes. They took a break and then continued again with the beatings.</strong></p></blockquote>
<p>Mukoko was finally able to, briefly, in the presence of police, see her family. On Christmas Eve, and without legal consultation she was made to appear in court.</p>
<p><span class="ILfuVd"><span class="e24Kjd">In March 2009, three months after her abduction, Mukoko was released on bail only to have the bail revoked in May. She was then again freed after an international outcry and protests from then MDC leader, Morgan Tsvangirai. </span></span></p>
<p><span class="ILfuVd"><span class="e24Kjd">In June, at a hearing before the Supreme Court, a prosecutor admitted that Ms Mukoko had been abducted illegally. </span></span></p>

Jestina Mukoko Recalls How She Was Abducted On 3 December 2008, Then Tortured

<p>The Zimbabwe Human Rights NGO (Forum) has castigated the government for peddling falsehoods through State media and harassing civil society leaders.</p>
<p>Speaking to journalists in Harare on Wednesday, the group’s chairperson and Zimbabwe Peace Project (ZPP) director Jestina Mukoko said:</p>
<blockquote><p>The Zimbabwe Human Rights NGO (Forum) has noted with regret the state’s coordinated and systematic attacks on Civil Society Organisations (CSOs) in Zimbabwe through falsehoods in the media and arbitrary arrests of the civil society leaders.</p>
<p>… There has been an increase in surveillance, office visits and interruption of our meetings by the State and this has affected our ability to implement initiatives aimed at addressing challenges which are affecting communities.</p></blockquote>
<p>The statement follows the arrest of civic organisations leaders last week and early this week on allegations of attempting to subvert a constitutionally elected government.</p>
<p>The activists were nabbed at the RGMI Aiport on their return from attending a workshop in the Maldives.</p>
<p>Mukoko said in her statement that the government should not consider human rights defenders as enemies of the state but to treat them as partners for development. She continued:</p>
<blockquote><p>They are not enemies, but partners for development. Their work is legitimate and must not be criminalised.</p>
<p>The actions (by the government) not only violate the Zimbabwean Constitution and international treaties such as the African Charter on Human and People’s Rights but are also contrary to the spirit of the Cotonou Declaration on strengthening and the protection of all human rights defenders in Africa.</p></blockquote>

Civil Society Rubbishes Accusations Of Planning To Overthrow Govt

<p>Police have been urged to contain the growing menace of touts.  The touts are reportedly terrorizing people, especially women who will be boarding buses at Mbudzi terminus.  The touts are accused of abusing ladies verbally and physically.</p>
<p>Zimbabwe Peace Project (ZPP) director <a href="http://www.pindula.co.zw/Jestina_Mukoko" target="_blank">Jestina Mukoko</a> spoke  to Newsday saying:</p>
<blockquote><p>If women are abused in public places then if the culprits are caught they need to be punished.</p>
<p>The same applies to these touts at Mbudzi that they need to account for their actions. Unless people account for their actions they will continue doing these things. I urge people to identify who is doing these things and identify the buses associated with such and then be able to talk to the owners and tell them that behaviour is unacceptable.</p></blockquote>
<p>Zimbabwe Women in Politics Alliance (Zwipa) boss <a href="http://www.pindula.co.zw/Linda_Masarira" target="_blank">Linda Masarira</a> also said:</p>
<blockquote><p>As Zwipa we are calling the ZRP to launch an investigation into this matter. Touts are illegal in Zimbabwe why are they still operating? We will petition the Ministry of Home affairs about these issues.</p>
<p>ZRP has to scale up its response and protection mechanisms for women who are most vulnerable in our society. Instead what we see is the reverse and at a time police are also perpetrating some forms of violence against women instead of protecting them and the general citizens.</p></blockquote>
