Zimbabwe’s health workers have condemned a new law that outlaws any industrial action, saying it will exacerbate the exodus of health professionals.
The Health Service Amendment Act which came into force on Tuesday prohibits health workers who are classified as an “essential” service from striking for more than three days.
The Act stipulates that those who do not comply face a fine or imprisonment of up to six months.
Enock Dongo, president of the Zimbabwe Nurses Association (ZINA) said the new piece of legislation takes away health workers’ right to protest. He said:
<blockquote>
After the rejection of the bill by various stakeholders, they still went ahead to pass it. It is very unfortunate. The right to protest has been taken away.
… They tried to be clever, saying we are allowed to strike for three days, but we all know that even when we down tools for more days they do not want to negotiate.

According to the Health Services Board (HSB), Zimbabwe has lost more than 4,000 doctors and nurses to the UK and other countries since 2021. Said Dongo:

When you threaten health workers with jail, how do you expect them to discharge their duties?
This will affect every citizen, nurses will just adopt a ‘go-slow’ [approach to work].

Norman Matara, the president of the Zimbabwe Association of Doctors for Human Rights (ZADHR) said:

This law has taken us two steps backward. We have been trying to fight brain drain. 
Further frustration of health workers would lead to more people leaving. This bill will bring more negatives than positives.
This bill was widely rejected by all health professionals and even after the parliamentary consultations, this bill was rejected by the people.
To see the bill being drafted into law without amendments is quite sad.

Health Workers In Zimbabwe Condemn Law Curbing Strikes

President Emmerson Mnangagwa last week signed into law the Health Services Amendment Bill which among other things, makes it illegal for government health workers to embark on industrial action lasting more than three days.
The Health Service Amendment Act stipulates that during job action, government health workers must continue to provide emergency services.
Under the Act, the old Health Services Board (HSB) was upgraded to a full commission, that is, the Health Services Commission (HSC) which set health workers’ conditions of service.
Health workers are now independent of the Public Services Commission (PSC), just like the judiciary, defence forces and police.
The restrictions on the health workers’ right to strike are contained in Section 16A of the new Act which says health services shall be deemed an essential service as defined in the Constitution. It reads:

Notwithstanding anything in the Labour Act, the Health Service shall be deemed as an essential service referred to in section 65(3) of the Constitution.
No collective job action, whether lawful or unlawful, shall continue for an uninterrupted period of 72 hours or for more than 72 hours in any given 14-day period and notice of any collective job action must be given in writing 48 hours prior to the commencement of such collective job action.

The Act says anyone inciting or organising collective job action in defiance of the new conditions can be tried for a criminal offence and if found guilty fined up to level four or jailed for six months.

Govt Outlaws Prolonged Strikes By Health Workers

Doctors, nurses and other health workers employed by the government have been threatened with dismissals if they go on strike for more than three days.
The Health Services Commission (HSC), which replaced the Health Services Board (HSB), issued the threat in a leaked memo.
According to the memo, strikes must not take more than 72 hours if they ever happen. Part of the memo reads:

Health Services Board has been replaced by the Health Services Commission. Health services are classified as critical services and no one should be denied access to emergency services or ICU services, even during a strike.
Striking by health workers is almost impossible. If a strike happens, it must not last more than 72 hours.
All those intending to strike must give the HSC a 48-hour written notice.
HSC has the power to deregister any member from professional body registers after disciplinary procedures.

Thousands of Zimbabwean health workers have left the country for greener pastures over the past few years.
In the past, the government has fired health workers for taking part in industrial action demanding living wages.
In August 2022, the Ministry of Health and Child Care fired Robert Emmanuel Chiduku, the leader of the Zimbabwe Professional Nurses Union (ZPNU).

Govt Health Workers Warned Over Strikes

The Zimbabwe Nurses Association (ZINA) has welcomed the decision by the government to extend its waiver on the re-appointment of health workers who had left the service to March 31, 2023, from September 30 this year.
ZINA president Enock Dongo told <a href="https://www.newzimbabwe.com/desperate-government-extends-reappointment-period-for-fired-retired-nurses-as-health-workers-flight-to-greener-pastures-persists/">NewZimbabwe.com</a> that the extension was the government’s admission that things were not well in the health sector. He said:
<blockquote>
This is a clear admission on the part of government that things are not well in the health sector.
A lot of health workers have left for greener pastures and the private sector, leaving gaps that have not been filled.
Government’s call is very serious and we support the return of those who are eligible so as to give service to the public, the most affected by current shortages.
These professionals have not just left services for no apparent reason; they left because of poor working conditions, poor remuneration, intimidation by the state and a general lack of dialogue between the employer and employee.
These have to be addressed, otherwise these re-appointments will be premature. If government fails to do so then they will either look at their colleagues who are still employed and opt not to join or join and leave again.

According to a letter signed by Health Services Board acting executive director, Angelbert Mbengwa, the government extended the waiver by six months. It reads:

It is noted that the Board extended the waiver of reappointment for former health workers who need to rejoin the service to Central Hospitals and Provincial Medical Directors for a period of six months from 01 April 2022 to 30 September 2022.
Please be advised that the waiver has been extended for a further period of six months from 1 October 2022 to 31 March 2023 to facilitate urgent appointments to fill vacant posts in institutions.
However, the reappointment of the following categories shall be centralized at the Board; all former nurses applying to rejoin the service, members who were discharged from the service on grounds of misconduct, convicted of a criminal offence, or terminated through medical grounds.
In view of the above, Central Hospitals and Provincial Medical Directors shall continue approving applications for reappointment of the other grades as communicated before. Institutions should thus submit the applications for the above two categories to the Board.
The General Manager of the Salary Service Bureau is therefore being instructed to accept reappointments authorised at stations in line with the above framework.

Union Welcomes Govt Re-hiring Of Fired And Retired Nurses

The Ministry of Health and Child Care (MoHCC) through the Health Services Board (HSB) has extended the waiver to reappoint former health workers who desire to rejoin the service.
The recruitment of the former health workers and the extension of the waiver are meant to fill the gaps that have arisen as a result of the exodus of skilled personnel.
Through a circular, HSB Executive Director, Angelbert Mbengwa said the waiver has been extended from the original September Deadline to March 31, 2023. Part of the letter reads:

Please be advised that the waiver has been extended for a further period of six months from October 1, 2022 to March 31, 2023 to facilitate urgent appointments to fill vacant posts in institutions.
</blockquote>

Govt Invites Retired And Former Nurses And Health Workers Back Into Service

The Health Services Board (HSB) has removed 1 032 nurses from the payroll after they refused to resume normal working hours and insisted on the continuation of the flexi-working arrangement.
The development was confirmed by HSB chairman Paulinus Sikosana on Tuesday night.
He said the nurses who are not working the normal hours will not be paid and the board has instituted disciplinary action against them. Said Sikosana:
<blockquote>We have removed 1 032 nurses from the paysheet. They defied a Government directive and we were left with no option.</blockquote>
The affected nurses, most of who were on the staff of central hospitals, face a variety of penalties depending on charges and circumstances.
These include dismissal or being placed on fixed-term contracts if they return as part of a proposed restructuring of the public health sector.
The HSB employees between 16 000 and 18 000 nurses and this imply that less than 8 per cent of the nursing staff will be affected by the twin developments.
Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa told a post-cabinet media briefing on Tuesday that the Zimbabwe Nurses Association (ZINA) has defied Government’s directive to terminate the flexi hours arrangement which has left authorities with no option.

HSB Strikes Over 1 000 Nurses Off Payroll

The Government has said it has reinstated striking health workers on the payroll after withholding their salaries in July in line with its ‘no-work-no-pay’ principle.
However, the striking nurses told the Government that despite receiving their salaries, they will not return to work until their demands are met.
Nurses are demanding the restoration of their pre-October 2018 salaries, where the lowest-paid health worker earned roughly US$500, and also adequate personal protective equipment (PPEs).
Health Services Board (HSB) deputy director public relations, Tryfine Rachael Dzvukutu on Thursday said all nurses, including those on strike were receiving their salaries and US$75 COVID-19 allowances.
Zimbabwe Nurses Association (ZINA) president Enock Dongo said while nurses are keen on returning to work, they are incapacitated to do so.
While some nurses are still reporting for duty, they are not attending to patients as they do not have PPEs. Said Dongo:
<blockquote>We hear the plea for the health workers to return to work and save lives, we want to and appreciate the call but we are still incapacitated, morale among health workers is low. Some might report for work but they will be doing nothing.
Patients will be turned away. Like today (yesterday) I was at Harare Hospital and nurses were just seated turning away patients because they don’t have PPEs, even gloves to attend to patients they don’t have.
The government must pay us a decent wage and avail PPE and we will return to work.</blockquote>

Striking Nurses Immovable Despite Govt Climbdown

Striking nurses have finally been paid their July [and August] salaries which had been withheld by the Health Services Board (HSB).
HSB has a no-work, no-pay principle and in July, it struck off its payroll all nurses who were no longer reporting for duty demanding USD salaries and adequate personal protective equipment (PPE).
Zimbabwe Nurses Association (ZINA) president Enock Dongo confirmed to the Daily News on Sunday that the nurses were paid double their normal salaries this month to compensate for July. He said:
<blockquote>The majority of nurses who did not receive salaries in July got them this month. It is a welcome development, but we still feel it was wrong in the first place to remove striking nurses from the payroll.
We want our concerns to be addressed and there is no need to be vindictive. We hope someone somewhere will see sense and do what is right because our concerns are legitimate.</blockquote>
Dongo reiterated the union’s stance that the nurses would not return to work until the government meets their demands.
Last week the civil servants’ Apex Council dismissed as false Finance and Economic Development Minister Mthuli Ncube’s assertion that negotiations under the National Joint Negotiation Council (NJNC) are going on.
A fortnight ago, Ncube said negotiations for an annual cost of living adjustment between the government and its employees under the NJNC had started.

Striking Nurses Receive 'Double Salary'

The government, through the Health Services Board (HSB), has removed from its payroll all nurses who are on strike.
Some nurses working in the public health sector have been on strike for almost 50 days citing poor remuneration and lack of personal protective equipment (PPEs).
In July, the government withheld the striking nurses’ salaries as well as the US$75 COVID-19 allowances.
HSB deputy director public relations, Tryfine Rachael Dzvukutu confirmed the development. She said:
<blockquote>The striking nurses didn’t receive their July salaries and it’s because they were removed from the payroll by the Health Services Board on a no-work-no-pay basis.</blockquote>
Dzvukutu added that there are consultations taking place with Government so that the affected nurses receive their August salaries and allowances.
Zimbabwe Nurses Association (ZINA) president Enock Dongo said in May, nurses received $3 400 as basic salary, an amount he said wasn’t enough to cover their monthly demands such as rentals, food and transport costs.
He said nurses are willing to return to work but are still incapacitated.

Striking Nurses Struck Off Payroll

The Health Services Board (HSB) has declared the ongoing nurses’ strike illegal, saying the nurses did not give 14 days’ notice as required by the law and just withdrew labour without notice.
HSB, through the Attorney-General’s Civil Division, has approached the Ministry of Public Service, Labour and Social Welfare seeking an order declaring the strike illegal. HSB said in its submission:
<blockquote>The strike is illegal on account of the fact that the workers have embarked on the strike without an attempt to present their grievances or conciliate the dispute. A certificate of no-settlement was not issued as required under Section 93 of the Labour Act.
… It is common cause that the health workers are essential service providers and their withdrawal of labour causes unnecessary loss of life.</blockquote>
Meanwhile, Zimbabwe Nurses Association (ZINA) secretary-general Enock Dongo asserted that the strike was legal and it was staged due to incapacitation and fear of exposing nurses to the risk of infection by COVID-19 as they are being forced to work without protective clothing.
Nurses went on strike on June 18 and have not returned to work as the government has been reluctant to improving their remuneration and availing PPEs.

HSB Says The Prolonged Nurses' Strike Is Illegal

Senior doctors have penned the following letter notifying the Acting Minister their intention to embark on an industrial action citing incapacitation among other reasons.

To: The Honourable Acting Minister of Health and Child Care
Ref: Notice of intent to withdraw from offering services
As specialist doctors offering services in government hospitals we are finding it difficult to continue offering services in our work stations because of a number of challenges as outlined below, which we have been in discussion with your office and the Health Services Board (HSB) and for which no solution has been proffered.
1. The hospitals are having serious challenges in procuring and providing appropriate personal protective equipment (PPE) and as such we are unfairly exposed to Covid19. Efforts to get this rectified has been associated with erratic supplies coming in at times.
2. Covid19 testing of hospital inpatients remains erratic and the results often take days to come out. Consequently, we are inundated with patients whom we admit, and who endure an inordinately long wait for Covid results, and at times cannot access some services until the result is out. This can lead to poorer outcomes for patients, and even unnecessary deaths. At the same time HCWs are put at risk of infection due to issues of inadequate PPE as outlined above. We want to be able to run our theatres and other specialist services seamlessly and availing testing and tirneous results is paramount.
3. Since the promise for more equipment made in March last year, no progress has been made except for the equipment received towards the end of the year. Little attention has been paid to the issue of making sure drugs, sundries and equipment are made available in adequate stocks. We note with concern allegations of massive fraud in the procurement of PPE, drugs, and sundries, amounts which would have made a life-changing difference to institutions. It still remains the responsibility of government to avail to us the necessary tools of the trade for us to function properly and offer quality healthcare service to the population of Zimbabwe in an ethical and professional manner.
4. Our salaries as paid in the Zimbabwe dollar cannot sustain an anymore. The Zimbabwe dollar is so volatile and subject to inflationary pressures that make it unpredictable. It is therefore continually losing value at a much higher rate than adjustments to our salaries are made. Prices for groceries and other goods are now charged in US dollars or pegged to the realistic parallel market rates. Faced with this scenario as doctors we feel the only reasonable solution is to be paid in United States Dollars (USD). The government has the template of our previous salaries as of 1 October 2018 when we were paid in US dollars. As such, we urge the ministry to reconvene the Bipartite negotiating forum so that these issues can be discussed.
5. Our members who are officially employed by the University of Zimbabwe continue to offer services in hospitals, but they are not being paid their clinical allowances. We have presented this issue to your office, but it remains an unresolved issue with no payment being done.
Please accept this letter today being Wednesday the 14th of July 2020 as we give a 2 week notice in terms of section 104 of the Labour Act Chapter 28:01 as amended, to the relevant arms of the government of Zimbabwe of our intention to withdraw services because of our grievances as outlined above with the following demands:
1. Make Covidl9 testing readily available in all hospitals so we can be able to offer seamless services
2. Provide adequate PPE in hospitals.
3. Pay us in the USD which is a stable currency which carries predictable buying power. We do not want to be paid in the Zimbabwe dollar again.
4. Our payment in USD should be benchmarked to our October 2018 salaries that were in USD.
5. Pay the clinical allowance that is due to University of Zimbabwe clinicians who are offering services in tertiary hospitals
6. Provide drugs, sundries, and equipment in our hospitals.
7. As doctors we need our other health delivery colleagues present to be able to function well. They have not been able to report for duties in line with grievances that they have presented to yourselves.
The employer should solve their incapacitation so that we can be able to resume normal services ethically and professionally. We need nurses, radiographers, pharmacists, and all others to deliver a reasonable service.
For the avoidance of any doubt, if these issues are not resolved, on the 29th of July 2020 the specialist doctors will no longer be able to continue to stretch themselves beyond measure to offer the little service currently being offered at government hospitals, and shall therefore cease to do any work.

The Health Services Board (HSB) has reportedly fired all Chief Executive Officers (CEOs) in government hospitals in a ‘restructuring exercise’.
HSB Board Chair Paulinos Sikhosana told Health Times that the restructuring was meant to bring sanity in all public health institutions. Said Sikhosana:
<blockquote>There is a restructuring going to improve efficiency effectiveness and integrity, so that’s the only statement that I can tell you.</blockquote>
Zimbabwe’s public health system is in a bind, the health minister Obadiah Moyo was fired recently for allegedly awarding tenders for medicines and consumables worth US$60 million to a company which had failed due diligence.
Nurses have been on an indefinite strike demanding better remuneration while the number of people testing positive for SARS-CoV-2 is increasing daily with cases nearing 1 000.

Govt 'Fires' Hospital Bosses In Restructuring Exercise

Health Services Board (HSB) heavyweights reportedly controversially awarded themselves additional allowances while health care front liners are reportedly getting paltry salaries and incentives. Daily News reports.
According to the publication, HBS documents show that:

<div>Kaseke was allocated an additional 360 litres of fuel, over and above her usual monthly allocation. 
She was also allocated $650 for airtime and $2 250 for data bundles while general manager Englebert Mbengwa and four others, who have  monthly fuel allowances of 200 litres, were each given 200 more litres, $380 for airtime and $1 500 for data bundles.</div>

<div>Their deputies got allowances ranging between 40 and 80 litres of fuel, between $150 and $300 for airtime, and between $400 and $900 for data bundles depending on the number of days they were on duty during the two weeks.</div>

<div>When contacted for comment HBS Chair Paulinus Sikhosana said the allowances were not enough because they travel a lot:</div>

<div>It is actually not enough because we do a lot of travelling. I am sometimes with the minister (Obadiah Moyo) when he visits institutions.</div>

<div>At times we will be working online. So, we need data … there is nothing unusual about the allowances. The officers have less because they do not come to work every day because of the lockdown shifts.</div>

Health Services Board Bigwigs Controversially Award Themselves Hefty Additional Allowances - Report

The Zimbabwe Hospital Doctors Association (ZHDA) has notified the Health Services Board (HSB), permanent secretary for the Ministry of Health and Child Care, Dr Agnes Mahomva and the Minister of Health Obadiah Moyo of their imminent incapacitation.
In a letter signed by ZHDA Acting President Dr Peter Magombeyi dated Friday, 30 August 2019, the association said:
<blockquote>REF: IMMINENT INCAPACITATION
We refer to the above subject matter.
This letter serves as notice that from the 3rd of September this year, doctors at Mpilo, Bulawayo United, Parirenyatwa Group, Harare and Chitungwiza central hospital are not going to report for work. We simply do not have the means to continue coming to work because the salary is not sufficient.
Attempts to engage the employer have proved futile. Letters have been submitted and meetings have been attended through the Bipartite Negotiation Panel to register this concern.
No satisfactory agreement has been reached so far to insulate the doctors from the current high cost of living.
Delays by the Health Service Board in reviewing our salaries have exposed us to incapacitation.
To this end, it is within this reason that on the date stated above we will not report for duty until the salaries are adjusted to an interbank rate that is based on the market forces of the day.</blockquote>
