Two prestigious schools, <a href="https://www.pindula.co.zw/Gateway_High_School/">Gateway High School</a> and <a href="https://www.pindula.co.zw/Lomagundi_College/">Lomagundi College</a>, have been taken to court by parents of students who are aggrieved over the schools’ decision to withhold their “O” and “A” Level exam results due to outstanding tuition fees. The parents of the affected students sought the assistance of Tinashe Chinopfukutwa from ZLHR Lawyers to help them secure the release of their children’s examination results.
According to the Zimbabwe Lawyers for Human Rights (ZLHR), Chinopfukutwa filed an urgent application at the Chinhoyi Magistrates Court on behalf of the parents, seeking an order that would compel Lomagundi College to provide the child’s Cambridge “A” Level exam results within 24 hours of the court order being granted. In the court application, Chinopfukutwa argued that withholding the exam results to coerce payment was unlawful and extortionate. He further contended that the student’s educational planning was being hindered, as application deadlines for certain programs had already passed. The longer the school authorities withheld the results, the more uncertain the student’s future would become. The court is set to hear and determine the application on Thursday 15 February 2024.
Regarding Gateway High School, Chinopfukutwa wrote a letter demanding the release of “O” Level exam results for a 16-year-old student who sat for her Cambridge exams in November 2023. The results were being withheld due to alleged outstanding school fees. Chinopfukutwa stated that the parents had engaged with the school authorities multiple times, attempting to establish a payment plan to settle the arrears and requesting access to their daughter’s results. However, their efforts proved futile as the school authorities evaded their requests.
Chinopfukutwa argued that the student’s inability to access her “O” Level results prevented her from applying for “A” Level studies and planning her educational future. Additionally, “A” Level students had already enrolled in schools across the country, resulting in the students losing valuable learning time due to the withheld exam results. The human rights lawyer protested against the school authorities’ conduct, stating that it violated the student’s right to education as enshrined in the Education Act. He also argued that the authorities were infringing upon the child’s best interests, as outlined in the Constitution, by refusing to provide her with the exam results.
Chinopfukutwa warned Gateway High School authorities that if they failed to release the student’s exam results, legal action would be taken to compel them to do so.
The government has a policy that states schools should not prevent students from learning or withhold their results due to unpaid fees. However, the government has been reminding parents to pay fees to ensure smooth school operations. <a href="https://www.pindula.co.zw/2024/02/08/govt-directive-to-school-heads-over-payment-of-fees-backfires/">The government is aware that many parents especially in public schools are not paying fees</a> after the government’s directive against turning away students for non-payment. The Minister of Primary and Secondary Education, Torerai Moyo, acknowledged this and emphasized the importance of parents fulfilling their role in providing everything necessary for their child’s education.
For those who cannot afford fees, the government has introduced the Basic Education Assistance Module (BEAM) as a safety net. But there are payment issues as the money is sometimes not paid on time. Minister Moyo also expressed concern about corruption in the selection of BEAM beneficiaries by school administrators. He encouraged schools to organize fundraising projects to lessen the burden on parents.

Parents Sue Elite Schools Over Withheld Exam Results

Parents and guardians should ignore unauthorised school fees for the 2024 First Term, a senior government official has said.
Reports indicate that some schools have already communicated new tuition fees to parents and guardians that have not yet been approved by the Ministry of Primary and Secondary Education.
Speaking to <a href="https://www.sundaynews.co.zw/schools-inflate-prices-of-uniforms/">The Sunday News</a>, Ministry of Primary and Secondary Education Permanent Secretary, Moses Mhike, warned school heads who unilaterally increased school fees that they will face disciplinary action. Said Mhike:
<blockquote>
Our position is very clear, it’s a total no. There should be a parents’ assembly where they vote on the matter and that information is submitted to the Ministry through our structures, that fee must be approved by the Permanent Secretary of the Ministry and once that approval is done it will be communicated to the parents.
We have been getting so many complaints from the parents and we have investigated a majority of these issues.
Soon we will be issuing a Press statement where we will be saying, no to school authorities that continue to charge school fees without the approval of the Ministry.
The punitive measures are very clear as per our Acts, when it comes to public schools, it is misconduct. We will take action against all heads who allow this to happen.
It is also a chargeable offence that can result in imprisonment and as a Ministry, we don’t want to go there because the statutes are very clear and easy to follow.

However, in the past, schools have disregarded Government directives and unilaterally increased school fees.
Schools also force parents to buy school uniforms exclusively from the school. The schools inflate the prices of the uniforms.

Parents Complain Over Unilateral School Fees Hikes

The Government has warned schools, both public and private, against demanding fees exclusively in United States dollars saying the Zimbabwe dollar remains legal tender.
In a press statement released on 12 May 2023, the Ministry of Primary and Secondary Education said parents and guardians should be allowed to pay fees in local currency calculated against the prevailing bank rate. The Ministry said:
<blockquote>
The Ministry of Primary and Secondary Education has noted with concern the demand for school fees and levies in USD by school authorities.
For this reason, all public and private schools must accept all forms of currency payment obtaining in the country for school fees and levies.
Therefore, the demand to receive payment exclusively in USD is not permissible and is contrary to the laws of the land.
For the record, the Zimbabwe dollar is still the legal tender in the country.
Parents/guardians should therefore be allowed to pay fees and levies in Zimbabwean dollars.
Parents/guardians opting to pay school fees in USD or in Rand should be allowed to do so calculated against the prevailing bank rate on the authorized fee and levy structure.
As a matter of fact, no school; public or private should charge fees without the approval of the Ministry of Primary and Secondary Education.
The Ministry of Primary and Secondary Education remains committed to the education of all pupils at institutions that provide primary and secondary education as we strive to provide quality and relevant education to all Zimbabweans.

The Zimbabwe dollar is increasingly becoming unattractive for businesses and services providers as continues to fall rapidly against other countries in use in the country such as USD, Rand and Pula.
As a result, both formal and informal sectors are demanding payments in foreign currency and where the Zimbabwe dollar is accepted, in most cases the black market rate is used which is more than double the official rate.

Govt Says Forex Only School Fees Illegal

Some schools across the country are demanding fees exclusively in United States dollars ahead of the commencement of the third term, leaving parents and guardians in a quandary.
The government gave schools permission to peg fees in both US dollars and Zimbabwe dollars at the prevailing interbank rate.
However, due to runaway inflation, some schools are demanding fees exclusively in hard currency even though the majority of parents and guardians are earning exclusively in the local currency.
Some schools were reportedly using parallel market rates of up to $1 000 against US$1, while the official rate is at $547:US$1.
Further, some schools have reportedly suspended their local currency accounts, leaving parents with no other option but to pay in foreign currency.
Ministry of Primary and Secondary Education spokesperson Taungana Ndoro said the government will crack the whip on errant schools. He said:

Schools that continue to defy government policy risk deregistration, while the culprits risk being prosecuted by the Zimbabwe Anti-Corruption Commission.
</blockquote>
Progressive Teachers Union of Zimbabwe secretary-general Raymond Majongwe said:
<blockquote>
Schools have dollarised, just like what the economy has literally done.
This actually exposes the government (for) its policies on currency. The government is refusing to acknowledge that the economy has dollarised when all other public institutions are demanding foreign currency.
The whole education system is in jeopardy. Unless the government accepts that the Zimdollar is not working, we are doomed.
</blockquote>
Zimbabwe National Union of School Heads secretary-general Munyaradzi Majoni said:
<blockquote>
Government requires schools to apply first for them to be able to peg fees in US dollars.
So what it means is that only schools that have been approved by the government can charge in United States dollars, payable in local currency.
The problem is on the issues of government inconsistency on policies, where sometimes the directives are not clear and leave the school heads guessing on what they should do, especially given the hyperinflationary (environment) that we are experiencing.

"Schools Have Dollarised"

The University of Zimbabwe (UZ) has gazetted the new fees ordinance for the current semester.
In a notice dated 31 March 2022, UZ Acting Registrar Munyaradzi Madambi advised students to check the updated fees accounts on their individual e-Mhare portals. It said:

In view of the adjustments necessitated by the new fees ordinance, the fees payment deadline is now the 30th of April 2022.
Those who are currently financially constrained and are yet to register can pay 60 per cent of the newly gazetted fees and register, and then clear their arrears before the 30th of April 2022.

Madambi also reminded students that they need to have registered to receive tuition and sit for their first examinations.

University of Zimbabwe Extends Fees Payment Deadline

Parents with children enrolled at Solusi Adventist High School have raised an outcry after the school reportedly demanded that they pay an extra US$100 towards fees.
The parents claimed Solusi had effected a 33 per cent school fees hike and now required an additional US$100 for every child.
They said the additional charge does not appear on the school’s fee quotation sheet while authorities also failed to give a convincing explanation.
Parents also accused the school of not clearing children whose parents were paying fees in Real Time Gross Settlement (RTGS).
Ministry of Primary and Secondary Education Director of Communications and Advocacy, Taungana Ndoro said they have not approved any fee hike and urged parents to report this matter at their district education office. Ndoro said:
<blockquote>
No school fees went up by 33 per cent. It’s the number of days that increased, not the approved fees per day.
Did they agree as parents and the school? They must report to the district office.
</blockquote>
Parents allege that when they inquired on the School’s WhatsApp communication group, the SDC chairperson, Dumisani Ncube, “blocked the parents from commenting on the group and changed the function to allow only administrators to comment.” The parents said:

Parents’ complaints and requests on the school WhatsApp group fell on deaf ears while the SDC Chairman insisted on the payment of the US$100.
When parents pay what’s on the quotation form in RTGS they are denied clearance and their children will be denied access to board the bus or deny entry to school.

As school fees payments are underway, school authorities sent parents another communique on their WhatsApp group informing them that only cleared learners will depart from the Bulawayo City Hall at 8 am on 5 September 2021.
Contacted for comment, the Solusi SDC chairperson declined to comment and referred questions to the school. He said: “I am not the rightful person, contact the school.”

Minister of Primary and Secondary Education Dr. Lazarus Dokora, has told school authorities that it is a curse to chase away pupils over the non payment of school fees. He said that the authorities should engage the parents instead so that they could provide labour at the schools. Speaking in Hwedza last week, Dokora said:
<blockquote>These children have not committed any crime and are not responsible for their own welfare.
These kids are born to us as a blessing not as curses so we should not quarrel about whether they should be chased away or not. They should be protected and if we dare exclude them from school, we are cursed.
We are going all out to empower schools and get more land for agricultural projects because we can do more on that land including looking after these kids.
 
If there is no money, parents should come and work. Chasing children from school is a thing of the past.</blockquote>

Star FM News reports that the <a href="http://www.pindula.co.zw/University_of_Zimbabwe">University of Zimbabwe</a> has reversed the decision to increase fees for the College of Health Sciences students which had been signed by Vice Chancellor proffessor Levi Nyagura on the 4th of January.
University of Zimbabwe Student Representative Council (SRC) vice president Zivai Mhetu said they are happy that the decision to hike fees  has been reversed.

University of Zimbabwe reverses fees increase for medical students

Government has ordered the <a href="http://www.pindula.co.zw/National_University_of_Science_and_Technology">National University of Science and Technology</a> (NUST) not to bar students from writing their examinations over unpaid fees. Nust is owed more than $500 000 by students on self-funding programmes.
Police were called to the institution last Thursday to restore order as students protested against Nust’s decision that those who have not paid fees would not sit for end of semester examinations. The students also approached Government which ordered the university to allow them to register so that they can write their examinations and make payments later.
In an interview with The Chronicle, Nust’s director of communication and marketing Mr Felix Moyo said all students would sit for their examinations. He however said that the student’s results and certificates will be withheld until they paid their outstanding fees. Moyo said the harsh economic environment should not be used as an excuse for not committing to the payment of fees.
