Justice, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi on Wednesday met representatives of Civil Society Organisations in Harare to discuss the Private Voluntary Organisations Amendment Bill that is currently before Parliament.
The Bill, which has faced criticism for its potential impact on civil society, aims to amend the existing Private Voluntary Organisations Act.
CSOs have raised concerns that the Bill if enacted into law, would violate their right to freedom of association as enshrined in the Constitution.
Addressing the meeting, Ziyambi said the Bill was crafted to, among other things, deal with organisations that register as trusts to circumvent scrutiny that comes through registering as a PVO. He said (via <a href="https://www.herald.co.zw/pvos-bill-aimed-at-tackling-illegal-activities-govt/">The Herald</a>):
<blockquote>
We are Government and we need to secure public funds, if you go out there and raise funds, you must not abuse that and we put it (the requirement to register as a PVO) in there to regulate that.
We have somebody who is running away from being accountable under the PVO Act and goes to register a trust and we are saying if you want to do this activity (charitable work), you satisfy the requirement of being under the PVO Act. Why do you then want to register as a trust?
We have noticed a proliferation of people who register trusts as a form of business to say, I register a trust and call it Ziyambi Trust, and go begging for money and there is no accountability for that money, and we said those people must register as PVOs

Ziyambi, however, agreed with the recommendation from the CSOs that there was a need to provide a transitional period, possibly up to 12 months, for organisations doing charitable work to register as PVOs if they had been previously registered as trusts.
He also accepted the recommendation that the registrar of CSOs be given a timeline to respond to applications for registration and that a clear mechanism for appeals is laid out, if the Registrar does not respond to the application within set timelines.
Speaking to <a href="https://www.herald.co.zw/pvos-bill-aimed-at-tackling-illegal-activities-govt/">The Herald</a> after the meeting, Ziyambi stated that the regulation of CSOs was not unique to Zimbabwe. He said:

The majority of countries have an Act that deals with the regulation of the NGO sector, we are not the only ones.
We do it also to protect those individuals who donate to those charitable organisations. It is something that is done globally, in most jurisdictions.
I am absolutely happy with the deliberations we had today (yesterday), it was robust and we managed to learn a few things and we are going to amend the Bill in its current structure because we have noticed that there are issues that were not consistent, but I believe that the interaction allowed the NGO sector to appreciate where the Government is coming from.
I believe that now when they go back, they will understand that the Bill is not about punishing the NGO sector, but just a regulatory framework to do their work freely and without any hindrances.

A representative of CSOs, Blessing Nyamaropa, said as CSOs, their wish is to have a conducive environment to work and complement the Government’s efforts in all facets of life, be it development, governance issues, humanitarian, human rights and all other sectors.

Ziyambi, CSOs Meet Over PVO Amendment Bill

Suspected ZANU PF youths on Friday disrupted public hearings on the Private Voluntary Organisations Amendment Bill in Gweru and Harare.
The PVO Amendment Bill, gazetted on 5th November 2021, seeks to regulate the operations of civic groups and non-governmental organisations (NGOs).
As reported by <a href="https://www.newsday.co.zw/local-news/article/200027071/zanu-pf-youths-disrupt-pvo-bill-hearings">NewsDay</a>, in Gweru, the meeting was abandoned after the ruling party youths heckled the officials led by Senator Sisasenkosi Ndebele, forcing her to leave the venue of the meeting.
In her welcome remarks, Ndebele had said the meeting was non-political and participants were “free to air their views”.
After disrupting the meeting, the youths reportedly started singing in support of President Emmerson Mnangagwa asking why “people hated him”.
During the meeting, the ZANU PF youths would clap their hands when fellow party members were making their submissions but boo other participants’ contributions.
In their support of the Bill, the youths unanimously said it would “curb terrorism” by monitoring the activities of non-profit organisations.
They maintain that NGOs harbour a “regime change agenda” through support from “hostile Western countries”.
In Harare, police had to be called in after suspected ZANU PF youths disrupted the public hearing held at the Ambassador Hotel.
The hearing was abandoned after participants largely from ZANU PF and some religious sects started singing party songs in response to a young woman who had criticised the Bill.
The young woman had said the Bill gave the responsible minister overarching powers to interfere in the work of civic groups.
She left the room fearing for her life following the heckling by ZANU PF supporters.
Critics of the Bill argue that it undermines freedoms of expression and association and gives the government unjustifiable control over the operations of civic groups.
Among other provisions, the PVO Bill stipulates that NGOs and civic society organisations (CSOs) should disclose their sources of funding.
The organisations are required to sign a memorandum of understanding (MoU) with the government defining their activities and zones of geographic coverage.
The Bill gives the government the authority to “deregister any private voluntary organisation that fails to comply with its conditions of registration.”
In February 2023, President Emmerson Mnangagwa said that he would “speedily” sign into law the Private Voluntary Organisation Bill (PVO) once it reaches his desk.
He said no amount of pressure from foreign governments will stop the signing of the Bill into law.
However, when the Bill eventually reached his desk, Mnangagwa did not sign it but referred it back to Parliament for reconsideration after he raised reservations about certain aspects of the Bill.

Rowdy ZANU PF Youths Disrupt PVO Bill Hearings

ZANU PF has allegedly deployed the Forever Associates Zimbabwe (FAZ), to spy on and intimidate non-governmental organisations (NGOs).
FAZ is a registered private voluntary organisation reportedly linked to the Central Intelligence Organisation (CIO).
According to a report titled “FAZ, Lawfare and the Menu of Electoral Manipulation”, by Zimbabwe Democracy Institute (ZDI), FAZ is being used to cripple civil society organisations (CSOs). Part of the report read:

FAZ has been used to restrict the activities of civil society organisations, which play a vital role in promoting democracy and human rights in Zimbabwe.
FAZ group, which is made up of former military personnel and CIO operatives and led by CIO deputy director Walter Tapfumaneyi, is being used by ZANU PF to spy on and harass CSOs.
</blockquote>
Speaking to <a href="https://www.newsday.co.zw/local-news/article/200016327/ed-unleashes-faz-on-csos">NewsDay</a>, ZDI principal researcher Bekezela Gumbo FAZ has been monitoring CSO activities and disrupting their work resulting in self-censorship by some NGOs. Said Gumbo:

This has also led to self-censorship among civil society people.
Calling people to meetings which are hosted by non-governmental organisations has been difficult due to the heavy presence of FAZ in their community.
Some of these people, who would have been invited to the meetings by the CSOs, are afraid that their personal information will not be safe, hence the risk of being harassed.
Many CSOs are now afraid to be vocal, they now self-censor.

However, FAZ president Kudakwashe Munsaka told NewsDay that the report by ZDI is mischievous and meant to soil their image.
Munsaka, who was the ZANU PF candidate for the Binga North parliamentary seat in the 23 August 2023 elections, lost to Citizens Coalition for Change’s Prince Dubeko Sibanda.
ZANU PF’s acting director for information, Farai Marapira, also dismissed the allegations raised by ZDI saying they are false.

FAZ Spying On Activities Of NGOs - ZDI Report

Leaders of various Civil Society Organisations (CSOs) met President Emmerson Mnangagwa at State House in Harare on Friday.
<a href="https://www.newsday.co.zw/local-news/article/200009072/csos-meet-ed-over-pvos-bill">NewsDay</a> reported that the meeting was a last-minute bid by CSOs to persuade Mnangagwa to stop signing the Private Voluntary Organisations (PVO) Amendment Bill into law.
The Bill is currently being scrutinised by the Attorney-General’s (AG) office after it sailed through Parliament.
In a tweet, the permanent secretary of the Ministry of Information, Publicity and Broadcasting Services, Ndavaningi Nick Mangwana confirmed the meeting. He wrote:

Late this afternoon HE President Emmerson Mnangagwa met and engaged with representatives of CSOs in Zimbabwe at State House.
The subject of the engagement was the PVOs Bill which is currently being tidied up by the AG. The meeting was cordial and good-natured.
</blockquote>
Some of the CSOs leaders who attended the meeting include Jenni Williams (Women Arise Zimbabwe), Isaac Maphosa, and Musa Kika (Zimbabwe Human Rights NGO Forum).
The trio reportedly refused to disclose the outcome of their meeting with Mnangagwa.
But representatives from Crisis in Zimbabwe Coalition were excluded from the meeting.
Critics of the amended PVOs Bill say it will enable the government to severely restrict the operations of civil society organisations.
The government will be able to deregister CSOs perceived as rogue or susceptible to money laundering and funding terrorism.

Civil Society Organisations Leaders Meet Mnangagwa Over PVOs Bill

ZANU PF has accused civil society organisations (CSOs) of planning to conduct a parallel tabulation of results in general elections scheduled for 2023.
According to the party’s central committee report presented at the congress, parallel tabulation of results will be a recipe for chaos especially if the results gathered by CSOs are different from those released by the Zimbabwe Electoral Commission (ZEC). The report reads in part:

The Zimbabwe Election Support Network and the Election Resource Centre are planning to conduct parallel voter tabulation during the 2023 harmonised elections.
In pursuit of that, they will deploy election observers at all polling stations who will also double as CCC agents.
These will send results to their established Command centres and have consolidated results before Zimbabwe Electoral Commission (ZEC) announces.
If ZEC announces what is different from what they have, they are planning to have violent protests.
This plan is a recipe for chaos and mayhem as well as a serious security threat.
</blockquote>
The central committee report also claimed that CCC was working with civil society organisations in penetrating ZANU PF’s perceived rural strongholds. It said:

In their quest to upset the ruling Zanu PF party support base, the opposition working with their Western handlers, have employed hybrid warfare, ranging from political, economic, social and cyber threats.
</blockquote>
This has seen the opposition political party penetrating Zanu PF strongholds, particularly rural constituencies.

The main opposition outfit is using NGOs and CSOs as their agents for regime change, with Goal Zimbabwe, Danish Church Aid and Plan International being on record for handing cash handouts ranging between US$10 and US$20 per individual in high-density suburbs such as Mabvuku, Highfield and Mbare.
In essence, they are acting as the opposition commissars whose activities complement those of the opposition outfit.

CSOs Planning Parallel Tabulation Of Election Results, Says ZANU PF

Harare Provincial Development Coordinator (PDC), Tafadzwa Muguti has directed all Non-governmental organisations (NGOs), Private Voluntary organisations (PVOs), Trusts and Civil Society Organisations (CSOs) operating in the province to submit their work plans for the year 2021 to his office as they are now reporting to him.
In a memo dated 30 June 2021, Muguti also accused the organisations of straying from their mandate, saying he will not tolerate such behaviour. Wrote Muguti:
<blockquote>It has been noted with a high degree of concern that many organisations operating in Harare Metropolitan Province in particular NGOs, have been straying from mandates stated in their respective Memoranda of Understanding (MOUS).
Suffice to say that such behaviour represents a breach of Memorandum of Agreement and should not be allowed to manifest further.
In view of the foregoing, all Non-Governmental Organisations (NGOs) are hereby directed that operations and clearance of NGOs is now domiciled with the Provincial Development Co-ordinator.
Further to that, all NGOs are directed to submit work plans for the year 2021 to the office of the Provincial Development Co-ordinator as well as information relating to workshops, commissioning of projects, work being undertaken in Harare Metropolitan Province, monthly reports and any other pertinent information as regards their operations by 9th July 2021.
All NGOs country directors are also invited to a courtesy call with the Provincial Development Co-ordinator and the Minister of State for Provincial Affairs and Devolution for formalities.</blockquote>

Muguti’s directive comes barely 10 days after Masvingo Provincial Development Coordinator Jefter Sakupwanya directed all NGOs in the province are required to sign a Memorandum of Understanding (MOU) with the Ministry of Youth, Sport, Arts and Recreation.
