Former Zimbabwe Broadcasting Corporation television (ZBC-TV) presenter <a href="https://www.pindula.co.zw/Oscar_Pambuka">Oscar Pambuka</a> was Tuesday sentenced to one year in jail for attempting to defraud <a href="https://www.pindula.co.zw/Croco_Holdings">Croco Motors</a> of R36 000.
Pambuka was being charged together with Elmore Mwenye and Ngonidzashe Mbauya who have since been absolved of the charges by Mbare magistrates Nyasha Vitorini.
The magistrate, however, suspended the whole sentence on the condition that Pambuka does not commit a similar offence in three years.
In suspending the sentence, the magistrate considered that Pambuka’s High Court appeal on his previous six-year conviction was dismissed.

What happened:
The court heard that Pambuka misrepresented to Gibson Mazhangara, who runs Gimatar Logistics, that he was Croco Motors’ marketing manager, and wanted some money to pay for the shipment of his motor vehicle parts in South Africa.
Prosecutor Vimbai Makamure told the court that on November 15, 2022, Pambuka, who was masquerading as Croco Motors’ marketing manager and representing Moses Chingwena, called Mazhangara using a South African number and claimed that Chingwena was in a meeting.
Pambuka demanded R36 000 as an advance payment for shipping vehicle parts from South Africa.
The court heard that Pambuka then asked Mazhangara to deposit the money into J Velem Enterprises trading as Ulphostery Trading’s FNB Bank account in South Africa.
He also told Mazhangira that he would receive the equivalent of R36 000 in United States dollars in the country.
Mazhangira became suspicious and went to confirm with Croco Motors, who indicated that they had no containers of spare parts in South Africa waiting for shipment.
He subsequently reported the incident to the police, which resulted in Pambuka and his aides being arrested.

Oscar Pambuka Gets A Suspended Year In Another Fraud Scandal

Croco Motors boss Moses Tonderai Chingwena was on Thursday convicted on his own plea for killing a pedestrian in Harare while driving along Poland Road in Gletwin at around 10 pm on 11 July last year.
Chingwena appeared before magistrate Barbara Mateko charged with culpable homicide and negligent driving after he ran over a pedestrian, Shepherd Mukatira, who died on the spot.
He pleaded guilty to the charges and was sentenced to four months imprisonment with an option of a $60 000 fine.
In sentencing him, the magistrate said Chingwena showed remorse to the family of the deceased after he paid the funeral expenses.
He also paid 10 cows to the family of the deceased as compensation and an additional US$4 000. Said Mateko:
<blockquote>The accident occurred at night and this meant there was poor visual sight.
The deceased was also supposed to check if the road was clear.
Despite all this, the accused person helped the deceased and this also mitigates the moral blameworthiness of the accused person.
The court noted that the accused person is 60 years old and was a first offender and that he did not waste the court’s time.</blockquote>

Croco Motors Boss Jailed 4 Months For Killing Pedestrian

Workers of a road construction company that is contracted to widen the Harare-Beitbridge highway had their festivities dampened when they were called back from leave to patch up a bad stretch of road in Masvingo.
The workers had been granted Christmas off days but were ordered back to work in order to repair a damaged road at Croco Motors in Masvingo where President Emmerson Mnangagwa’s motorcade was expected to pass through this Wednesday.
The development was confirmed by a worker who spoke to Masvingo Mirror on condition of anonymity as he is not authorised to speak to the press. He said:
<blockquote>We had just closed for Christmas when we were called back. It really disrupted our break.</blockquote>
President Mnangagwa was expected to launch the Chombwe Piped Water Project in Chivi today.

Workers Ordered Back From Christmas Off Days To Repair Road For ED's Journey

The <a href="https://www.pindula.co.zw/Reserve_Bank_of_Zimbabwe" rel="noopener noreferrer" target="_blank">Reserve Bank of Zimbabwe</a> has lifted a freeze on <a href="https://www.pindula.co.zw/Croco_Holdings" rel="noopener noreferrer" target="_blank">Croco Motors’</a> bank accounts, following investigations which absolved the company of any wrongdoing.
RBZ Financial Intelligence Unit (FIU) director-general <a href="https://www.pindula.co.zw/Mirirai_Chiremba" rel="noopener noreferrer" target="_blank">Mirirai Chiremba</a> on October 29, 2019, wrote a letter to Croco Motors in which he said that no irregular transactions were observed. He wrote:
<blockquote>With reference to the above, we wish to advise that the FIU has concluded its analysis of your company’s bank accounts. The analysis did not reveal any irregular transactions.
You are, therefore, advised to continue with your normal operations as the directive has now been lifted.</blockquote>
In September this year, the FIU sent a directive to all banks to freeze the accounts of several companies to facilitate investigations after there was a sudden spike in the exchange rate.
Croco Motors was one of the companies that were under the RBZ’s radar.

Croco Motors' Banks Accounts Unfrozen

50 companies reportedly control half the country’s deposits ZTN News reports. The matter came to light when the Minister of Finance was addressing the issue surrounding the RBZ investigating companies manipulating the exchange rate.
Mangudya said;
<blockquote>50 percent of the deposits are owned by 50 corporates. This is 50 percent of ZWL$ 19 billion. It is easy for us to monitor movements on those accounts…If left, they can cause suffering. We must not allow such a thing to happen. We are not targeting an individual, we are targeting those with energy to influence the market</blockquote>
Mangudya’s declarations comes a few weeks after the <a href="https://news.pindula.co.zw/2019/09/20/full-text-rbz-freezes-sakunda-access-finance-croco-motors-accounts/">RBZ’s Financial Intelligence Unit launched an investigation on Sakunda, Croco Motors</a> and many other companies on allegations of money laundering and manipulating the exchange rate.

50 Companies Control Zim's 9+ Billion Deposits - Mangudya

The Reserve Bank of Zimbabwe has exonerated financial trader Access Finance (Access) of money laundering allegations.
Access Bank accounts had been <a href="https://news.pindula.co.zw/2019/09/20/full-text-rbz-freezes-sakunda-access-finance-croco-motors-accounts/">frozen in September together with those of Sakunda and Croco Motors</a> amid allegations that they were fueling, sponsoring and or participating in money laundering activities.
Following the RBZ’s move to <a href="https://news.pindula.co.zw/2019/09/25/rbz-freezes-5-more-accounts-report/">freeze bank accounts</a>, exchange markets rates on the parallel market which were moving at an unparalleled rate, suddenly fell before stabilising.
The central bank revealed after investigations however that Access, which has emerged as one of the biggest dealers and embarked on a massive in-store rollout in partnership with Delta, Electrosales, Gain Cash &amp; Carry and Zimnat Lion Insurance had not violated the law.

RBZ Acquits Finance Access Of Money Laundering Allegations

President Emmerson Mnangagwa has said that the government was taking a raft of measures to address the cash shortage crisis.
Zimbabwe has been submerged under the cash crisis for years now with authorities failing to come up with an effective solution to address the issue.
Delivering his State of the Nation Address on Tuesday in Harare, Mnangagwa said:
<blockquote>Government is fully aware of the challenges faces by the public in accessing cash, which has resulted in some unscrupulous traders selling cash in exchange for electronic money. Appropriate measures are being taken to address the cash situation, which include the removal of arbitrage opportunities created through multi-tier pricing. </blockquote>
Mnangagwa’s remarks come a day after the central bank, the Reserve Bank of Zimbabwe has directed that all mobile money agents stop processing cash in, cash out and cashback facilities.
Earlier, the <a href="https://news.pindula.co.zw/2019/09/20/full-text-rbz-freezes-sakunda-access-finance-croco-motors-accounts/">RBZ had directed all banks to freeze bank accounts</a> belonging to a number of companies including Sakunda Holdings and Croco Motors.
Authorities believe that these accounts were being used to promote money laundering.
Analysts have however said that the measures implemented so far were not sustainable.

Zimbabwe Cricket Union has been taken to the High Court by Croco Motors after allegedly failing to settle a debt of $2 560 000 from 2015. In its court papers, Croco Motors says
<blockquote>On June 11, 2015, the defendant (Zimbabwe Cricket Union) acknowledged its liability to the plaintiff (Croco Holdings) in the sum of $2,8 million. In terms of the acknowledgement of debt, the defendant undertook to repay the sum of $240 000 through the provision of cricket boxes on lease for a period of 25 years, leaving a balance due and owing by the defendant to the plaintiff in the sum of $2 560 000,” Croco Motors said in its declaration.
In 2016 and early 2017, the defendant acknowledged its indebtedness to the plaintiff in the sum of $2 560 000. Despite demand, the defendant has failed to pay the sum of $2 560 000, which amount is now due and payable.</blockquote>
The cricket union is yet to respond.
