A potential voter has issued a five-day ultimatum to the Civil Service Commission (CSC) to take immediate action to effect the automatic resignation of a school teacher who was recently nominated to contest as a ZANU PF political party candidate in local government elections scheduled for next month.
The concerned voter, Only Katanda, enlisted the services of Tinashe Chinopfukutwa of Zimbabwe Lawyers for Human Rights to assist in getting the CSC to take remedial action against Samuel Machumi, who is employed by CSC through the Ministry of Primary and Secondary Education as a teacher at Nyamhondoro Secondary School in Guruve, Mashonaland Central province.
Chinopfukutwa wrote a letter to the CSC requesting that it urgently terminates Machumi’s employment contract as a teacher, as he cannot serve as both a civil servant and a politician. Despite being nominated to contest in the upcoming local government elections, Machumi has continued attending to his teaching duties at Nyamhondoro Secondary School.
Chinopfukutwa has given the CSC five days to institute measures to effect Machumi’s automatic resignation from the teaching job, failure of which he will consider instituting appropriate legal action to have him barred from continuing to discharge his duties as a teacher.
According to section 200(3)(a) and (b) of the Constitution, civil servants are prohibited from acting in a partisan manner and from advancing the interests of any political party or cause. Nevertheless, several civil servants have in the past expressed interest in or contested for political office.
There have also been reports that some employees of the state-owned Zimbabwe Broadcasting Corporation (ZBC) were violating the Zimbabwe Broadcasting Corporation Act by actively participating in political activities and expressing support for the ruling party, ZANU PF. ZBC’s Chief Correspondent, <a href="https://www.pindula.co.zw/2020/12/11/zbc-reporter-reuben-barwe-wins-in-zanu-pf-election/">Reuben Barwe, won the position of secretary for Information and Publicity in the ZANU PF</a> District Coordinating Committee (DCC) elections held in December 2020.
Barwe’s victory when the Judicial Service Commission (JSC) was investigating magistrate Milton Serima, who contested in ZANU PF’s DCC elections, while Gweru prosecutor Namatirai Chipere resigned after reports indicated that he was campaigning for a spot in the ZANU PF DCCs.
The criticism of public office holders participating in politics and the alleged biased reporting by state institutions, including the ZBC, has led to calls for reforms to ensure a level playing field and enhance the credibility of elections.

CSC Given 5-Day Ultimatum To Fire Teacher For Contesting In Elections

Government workers have said that they are now incapacitated to carry out their duties and responsibilities as a result of the erosion of their salaries.
The Apex Council which represents government workers observed that on average, workers used to receive US$500 but now are getting an average of US$40 and the salary is continuously losing value.
They say that the government has been neglecting and or failing to address their grievances for too long and as a result of incapacitation, they are now suspending their services until their situation has been adequately dealt with.
Their declaration of incapacitation comes at a time when health workers in public medical institutions have since the 3rd of September been on industrial action as a result of incapacitation.
The Apex Council said that government workers are the ones carrying the burden of austerity measures which the government introduced alleging that they will quickstart the economy.

President Emmerson Mnangagwa has appointed three members of the Civil Service Commision with effect from the 1st of November 2018. We publish the statement from the Chief Secretary to the President and Cabinet, Misheck Sibanda,
<blockquote>APPOINTMENT OF MEMBERS OF THE CIVIL SERVICE COMMISSION
1. His Excellency the President has, in terms of Section 202 (1) (b) of the Constitution of Zimbabwe Amendment [No. 20] of 2013, appointed the following persons as members of the Civil Service Commission: – 
• Dr Tsitsi Rosemary Choruma 
• Dr Carroll Temba Khombe 
• Mr George Chigora
2. Dr Rosemary Tsitsi Choruma is a specialist in human resources management and development, and entrepreneurship and business development. She has more than 18 years of experience in public service in Zimbabwe and in organisational development work in education and gender equality at a global scale. Dr Choruma is currently the Chief Operating Officer of Fairtrade International based in Nairobi, Kenya.
3. Dr Carroll Temba Khombe is a specialist in strategic planning; entrepreneurial development; and business support. Dr Khombe possesses expertise in the formulation and use of formative and summative evaluations in programme and project development and management. He has extensive work experiences in agricultural research and development; and currently sits on Boards of state enterprises, parastatals, and universities in Zimbabwe and in southern Africa.
4. Mr George Chigora is a specialist in managing national finances with particular focus on budgeting, governance, projects planning and financial management. Mr Chigora has over 20 years’ experience, knowledge and expertise working in defence, transport, education and finance sectors in Zimbabwe. With additional experience of managing private sector companies, Mr Chigora possesses competence in the designing of financial models to turnaround both public and private sector organisations.
5. These appointments are with effect from 1st November 2018.

Full Text: Civil Service Restructuring Continues: Mnangagwa Appoints Members Of Civil Service Commission

Addressing permanent secretaries and principal directors for ministries during an induction workshop in Harare, Civil Service Commission chairperson Dr Vincent Hungwe announced term limits for permanent secretaries.
Hungwe said Government has put permanent secretaries on performance-based five-year contracts which can only be renewed once subject to delivery. He also said no permanent secretary would serve beyond the mandatory 65 years of retirement, unless there were compelling reasons. Said Hungwe:
<blockquote>The new ethos no longer provides for permanent secretaries appointed for an indefinite period, but instead, envisages ‘Performing Secretaries’ who are appointed on fixed five year term contracts, renewable only once, subject to performance and delivery. They cannot be taken beyond the mandatory retirement age of 65. Only in exceptional circumstances, only in circumstances merited by the exclusive possession of outstanding skills and competencies would one be considered for engagement on an annual contract beyond their retirement age of 65.</blockquote>

Permanent Secretaries Put On 5 Year Contracts, None To Serve Beyond 65 Years

Finance and Economic Development Minister Patrick Chinamasa has ordered the Civil Service Commission (CSC) to follow proper procedures in terminating contracts for over 3 000 youth officers informally known as Green Bombers after the court ruled that it had failed to comply with the law in firing them.
The Green Bombers engaged lawyers after their dismissal arguing that procedure had not been followed. As a result Government was forced to reinstate them. Said Chinamasa:
<blockquote>With respect to youth officers, as you aware, they took the matter to court and the court ruled that the procedures were not followed. So, we directed the Civil Service Commission to follow the procedures and to see that the decision we took (as Cabinet) is implemented. I think the commission will follow the right procedures which they may not have taken.</blockquote>
Presenting the 2018 National budget in December last year, <a href="https://news.pindula.co.zw/2017/12/07/breaking-govt-lay-off-civil-servants/" rel="noopener" target="_blank">Minister of Finance and Economic Planning Patrick Chinamasa announced that 3 188 youth officers</a> were going to be retrenched in order to save the treasury US$19.3 million dollars per year.

Green Bombers To Be Fired Again As Chinamasa Orders Civil Service Commission To Follow Procedure

The Civil Service Commission (CSC) has suspended a rationalisation exercise which would have seen thousands of youths getting retrenched. This comes after youths, together with the Minister of Youth, Indigenisation and Economic Empowerment Patrick Zhuwawo, complained to President Robert Mugabe about the issue. CSC chairperson Dr Mariyawanda Nzuwah said the CSC would wait to hear from the Cabinet before acting on the freeze.

<blockquote>I was given instructions by the Minister of Public Service, Labour and Social Welfare Minister (Prisca Mupfumira) last week to freeze any action on the rationalisation exercise until further instruction. I immediately instructed all organs in Government involved to stop it. We have frozen everything pending further instruction from the Minister who consults the appointing authority (President Mugabe). Nothing is being done until we get instructions to proceed or not. It is sad that some sections of the media say the Minister is disobeying the President. She has already implemented the decision made by the President in Chinhoyi. She came back (from the rally) and we were communicating and she told us to stop and we complied.</blockquote>

Civil Service Commission freezes retrenchments after youths complain to President Mugabe

In a letter signed by Stephen Dihwa on behalf of the Secretary for Energy and Power Development and dated January 31 2017 and addressed to Renewal Democrats of Zimbabwe party leader Elton Mangoma, the Civil Service Commission (CSC) alleged that he continued to receive allowances payable to Cabinet ministers between August 23 and 31 2013 due to late notification of termination of his services.
However, Mangoma who is expected to reimburse $1 064,61 to the government, yesterday questioned why it had taken the SSB so long to realise that they had overpaid him. He said that he was shocked that they wanted money from him when they should be paying him money owed to him by government for his services as Energy minister. NewsDay could not reach Dihwa for comment, as he was said to be in a meeting.
