Four Shurugwi residents are set to receive nearly US$40,000 in compensation after a judicial officer convicted Zimbabwe National Army (ZNA) Commander Lieutenant-General Anselem Sanyatwe and Defence Minister Oppah Muchinguri for violating their rights during a government-imposed lockdown three years ago.
The residents—Grant Zinyuke, Moreblessing Ncube, Batler Jabangwe, and Mavhuto Kachepa—were assaulted by soldiers enforcing the lockdown in August 2021. They argued that the soldiers acted unlawfully under the control of Sanyatwe and Muchinguri, who were held vicariously liable.
Represented by lawyers from Zimbabwe Lawyers for Human Rights, the residents described severe injuries resulting from the assaults.
Zinyuke suffered facial injuries and lost teeth; Ncube experienced swelling and bruising; Jabangwe endured multiple injuries that affected his ability to wear shoes; and Kachepa sustained serious leg fractures.
Magistrate Patricia Gwetsayi ordered Sanyatwe and Muchinguri to pay Zinyuke US$10,000, Ncube US$8,000, Jabangwe US$8,000, and Mavhuto US$12,000 for pain, suffering, trauma, and medical expenses related to their injuries.

FOUR AGGRIEVED Shurugwi residents are set to receive close to US$40 000 after a judicial officer convicted Zimbabwe National Army (ZNA) Commander Lieutenant-General Anselem Sanyatwe and Defence Minister Hon. Oppah Muchinguri for violating their rights, when some soldiers went on a rampage and brutalised them, during a government-imposed national lockdown, three years ago.
Sanyatwe and Hon. Muchinguri stood trial at Shurugwi Magistrates Court after the four residents namely Grant Zinyuke, who is employed at Shurugwi Hospital, Moreblessing Ncube, who is self-employed, Batler Jabangwe, an employee of Shurugwi City Council and Mavhuto Kachepa, who is self-employed, sued the duo, demanding payment of compensation for violation of their rights, when they were brutally assaulted in August 2021 by some soldiers, who were enforcing the national lockdown imposed by government in a bid to curb the spread of coronavirus.
In summons filed at Shurugwi Magistrates Court, Zinyuke, Ncube, Jabangwe and Kachepa, argued that the conduct of the soldiers, who at all material times were acting within their course and scope of their employment as duly attested members of ZNA and under the control or instructions of Sanyatwe and Hon. Muchinguri, who were held vicariously liable for their actions, was unlawful.
The residents, who were represented by Prisca Dube and Jabulani Mhlanga of Zimbabwe Lawyers for Human Rights, argued that the soldiers unlawfully, wrongfully and without just cause, assaulted them resulting in them sustaining several injuries on their bodies.
In the case of Zinyuke, he sustained some injuries which include swelling on the forehead, lacerations on the upper lip and nose, bruises on his back and losing some of his teeth and had to seek medical treatment.
Dube and Mhlanga told Shurugwi Magistrate Patricia Gwetsayi, who presided over the trial of Sanyatwe and Hon. Muchinguri, that Ncube sustained severe swelling on his face, forearms and bruises all over his back, when he was assaulted by some soldiers on 1 August 2021, for allegedly being outside his residence buying airtime so as to get an update on the health status of his ailing mother.
Jabangwe, an employee of Shurugwi City Council, was assaulted all over his body by soldiers, who saw him while coming from executing his duties of opening water taps at Makusha shopping centre and who accused him of wandering around.
As a result of the assault by the soldiers, Jabangwe sustained injuries on the right side of his back and on his left leg, which injury makes it difficult for him to wear closed shoes to date and remains severely traumatised by the incident.
In the case of Kachepa, the lawyers stated that he was assaulted by soldiers, whom he met when he was on his way home from a beer retail outlet, who confronted him and without any provocation or warning, used guns and broke his right leg in two spots.
While he was lying on the ground, some soldiers assaulted him all over his body and he sustained two severe fractures on the right leg, swelling all over the body, lacerations on the arms and some bruises on his body.
Dube and Mhlanga argued that such conduct by soldiers against the Shurugwi residents, was cruel, inhuman and degrading treatment punishment, which left them traumatised, anxious and in shock.
Recently, Magistrate Gwetsayi ordered Sanyatwe and Hon. Muchinguri to pay Zinyuke US$10 000, US$12 000 to Mavhuto, US$8 000 to Jabangwe and US$8 000 to Ncube, as compensation for damages for pain and suffering, trauma and nervous shock and for medical expenses, which they incurred while seeking treatment.

Four Shurugwi Residents Tortured By Soldiers During Lockdown Awarded Nearly US$40,000

The Zimbabwe Lawyers for Human Rights (ZLHR) is urging victims of human rights violations to take legal action against the perpetrators, particularly those in the uniformed forces, reported <a href="https://cite.org.zw/zlhr-advocates-for-suing-perpetrators-of-human-rights-violations/">CITE</a>.
The organisation argues that holding violators financially accountable will force them to face the consequences of their actions.
In the past, ZLHR has successfully pursued legal action on behalf of victims of violence, filing suits against the Zimbabwe Republic Police (ZRP), the ZRP Commissioner General, the Zimbabwe National Army (ZNA), and the Ministers of Defence and Home Affairs.
As a result of these lawsuits, ZLHR has managed to secure monetary awards for the victims.
Roselyn Hanzi, the Executive Director of ZLHR, has called on victims of human rights abuses to directly sue the perpetrators, emphasizing that legal accountability can serve as an effective deterrent against future violations.Said Hanzi:

When such awards have been secured, applications for garnishee orders have been granted by the courts. The monetary award is deducted monthly from the salary of the police officer.
We must normalise hitting perpetrators of human rights violations straight in their pockets. Why should taxpayers foot the bill for gross human rights violations?
Ministers should also be hit in the pocket… Hundreds of judgments with monetary awards have been obtained against state actors in their official capacity.

Human rights lawyers are telling victims of police and army brutality to sue the people who hurt them. They say making the violators pay money will make them think twice before doing bad things. The lawyers have already won lawsuits against police, army, and government officials for victims. This has resulted in victims getting money as compensation. One lawyer, Roselyn Hanzi, says hitting the violators in the pocket is important, and victims should not be afraid to take legal action. Many victims have won money in court cases against the police and army, dating back to 2003.

Human Rights Lawyers Urge Victims Of Police, Army Brutality To Sue Perpetrators

The Harare Magistrates Court has ordered Zimbabwe National Army (ZNA) Commander Lieutenant-General Anselem Sanyatwe and Defence Minister Oppah Muchinguri to fork out about US$30,000 in damages to compensate Felix Mafondokoto, a victim of army brutality.
According to the Zimbabwe Lawyers for Human Rights (ZLHR), Mafondokoto was shot by a soldier during a clampdown on anti-government protests held five years ago. The ZLHR said:

Mafondokoto, a 43-year-old resident of Chitungwiza, was shot by ZNA members on 19 January 2019, when soldiers were dispersing people during a clampdown on anti-government protests, which gripped the country as people protested against an arbitrary hike in fuel prices and the agonising economic crisis blamed on President Emmerson Mnangagwa’s administration.
While Mafondokoto was not participating in the protests, he ended up being admitted in hospital after sustaining injuries from being shot at by a ZNA member.
The Chitungwiza resident, who suffered severe injuries from the shooting and still has some bullet fragments in his body, engaged Kossam Ncube of Zimbabwe Lawyers for Human Rights, who assisted him in suing Sanyatwe and Hon. Muchinguri and demanded to be paid US$49 000 in damages for the violation of his fundamental rights.
In the summons filed at Harare Civil Magistrates Court, Mafondokoto asked the court to order Sanyatwe and Hon. Muchinguri to compensate him for the pain and suffering he endured, nervous shock, loss of earnings and for the medical expenses, which he incurred as he got hospitalised for treatment.
On Monday 20 May 2024, after presiding over a full trial in which Lieutenant Colonel Whatmore Ziweni, the ZNA Operations Chief, testified on behalf of Sanyatwe and Muchinguri, Harare Magistrate Mandlenkosi Ndhlovu ordered the duo to pay US$29 182 to Mafondokoto as compensation for the damages, which he suffered from the brutality perpetrated by soldiers.

Magistrate Ndhlovu ruled that Mafondokoto suffered severe injuries and endured excruciating pain and suffering and had to undergo various operation procedures.
Magistrate Ndhlovu stated that Mafondokoto now struggles to work for extended periods because of the injuries, he sustained which now impact his livelihood.

Chitungwiza Man Shot By Soldiers Gets US$30 000 In Compensation

Harare Civil Court Magistrate Tamara Chibindi has convicted Defence Minister Oppah Muchinguri and Zimbabwe National Army (ZNA) Commander Lieutenant-General Anselem Sanyatwe for the brutal assault of Muchademba Muponde by soldiers in 2019.
According to the Zimbabwe Lawyers for Human Rights (ZLHR), Chibindi on Wednesday, April 10, ordered Muchinguri and Sanyatwe to pay Muponde, a Harare resident, ZiG41 633 as compensation for the ill-treatment which he endured at the hands of soldiers on 16 January 2019.
The soldiers had been deployed to suppress countrywide anti-government protests which were held in response to a unilateral government increase in fuel prices and worsening standards of living. The ZLHR said:

Muponde was assaulted by soldiers as he accompanied his grandfather to buy a chicken at Glenview 1 Shopping Centre in Harare, where he saw a group of soldiers chasing people around and he also began to flee.
One of the soldiers, who was brandishing a gun, spotted him and gave chase and caught him before assaulting him on the back of his body and neck using the back of the firearm.
Muponde started bleeding when the soldier hit him on the back of his head and ran to hide at a nearby homestead.
But the soldier followed him and continued assaulting him using the back of the gun at the homestead. At one point, the soldier even lifted his gun threatening to shoot him.
Muponde sustained serious injuries on both legs including internal injuries on his left leg as a result of the assault and he could not walk.
The soldier continued beating him and only stopped after seeing the severity of the injuries sustained by Muponde and instructed him to wash the blood off his face.
Muponde then engaged Tinashe Chinopfukutwa of Zimbabwe Lawyers for Human Rights, who in 2019 sued Hon. Muchinguri and Sanyatwe claiming payment of damages for pain and suffering, nervous shock, contumelia, affront to dignity and humiliation.
During trial, which began in February 2024 at Harare Civil Magistrates Court, Hon. Muchinguri and Sanyatwe vainly argued that the soldiers, who assaulted Muponde were not under the control of the ZNA Commander but of the Zimbabwe Republic Police, as they had been deployed to assist the law enforcement agents in restoring law and order.
Out of the ZiG41 000, Magistrate Chibindi said ZiG20 816 will be damages for pain, suffering, trauma and nervous shock, which was suffered by Muponde while ZiG20 816 will be damages for affront to dignity, humiliation and embarrassment caused to the Harare resident.
Hon. Muchinguri and Sanyatwe were also ordered to pay interest on the total amount of damages from 2019 until the date when they will make the payment to Muponde.

Defence Minister, Army Boss Ordered To Pay ZiG40 000 To A Man Assaulted By Soldiers

Villagers who live near the Jason Ziyaphapha Moyo Airbase in Chegutu claim they were assaulted by soldiers on Tuesday.
The soldiers were reportedly searching for a MuShurugwi (machete gangster) who had assaulted their colleague.
The assaulted villagers reportedly sustained injuries on their faces, heads, legs and hands.
According to a medical report in possession of NewsDay, some of the assault victims received medical attention at Chegutu General Hospital.
Air Force of Zimbabwe (AFZ) spokesperson Squadron leader Donovan Muroyiwa told NewsDay that an investigation had already been launched to establish the truthfulness of the claims.
Villagers told the publication that the soldiers, who were armed with guns and knobkerries, stormed the village around 11 PM.
The soldiers were making inquiries on the whereabouts of a machete gangster who had allegedly fought their colleague.
They allegedly stormed a homestead where villagers were attending a funeral and harassed mourners. Said a villager:

They were beating everyone who professed ignorance of the whereabouts of the alleged gangster.
It was around 11 pm when a loud bang at the door woke me up. At first, I thought they were thieves until I saw soldiers clad in uniform. They accused us of hiding their suspect.

Another villager claimed to have witnessed an altercation between the soldier and the man over a woman earlier in the day. Said the villager:

I saw two truckloads of soldiers, who were dropping off at various homesteads, interrogating and assaulting villagers over the whereabouts of a man who injured a soldier with a knife.
I witnessed the altercation between the soldier and the man. They had a misunderstanding over a woman while drinking beer at a local bar.

Zimbabwe Republic Police (ZRP) national police spokesperson Assistant Commissioner Paul Nyathi said he had not yet received the report.

Soldiers Assault Villagers In Chegutu

A Beitbridge villager Knowledge Sibanda narrowly escaped death last Thursday after soldiers shot at him as he was driving near the disused River Ranch Diamond Mine.
Sibanda said the soldiers fired at him without notice and later chased away police officers who had visited the scene to investigate. He said:

They fired at me and hit my car nine times. They had not even attempted to stop me, when I passed by they just started opening fire.
When police based at Makakavhule Clinic tried to attend to the scene, the soldiers chased them away.
I was grazed by a bullet in the head, but I do not have serious injuries. These people (soldiers) are causing a lot of problems in our village, and we have no protection because they are a law unto themselves.
You should have seen how they humiliated the police.

'A Bullet Grazed My Head', Beitbridge Villager Says He Was Shot By Soldiers

A ZANU PF senator and senior party official is in trouble after she unwittingly exposed human rights violations by the military in social media posts in February.
Maybe Mbohwa, who is Midlands Senator and ZANU PF women’s league commissar, will likely be dragged before the ruling party’s national disciplinary committee after she exposed cases of army brutality in Gokwe.
NewsDay reported sources in the ruling party saying the party’s national chairperson Oppah Muchinguri-Kashiri, who is also Defence Minister, was tasked with looking into the matter.
This followed recommendations made by the ZANU PF Gokwe North district coordinating committee (DCC) that Mbohwa should be demoted from party positions and be recalled from Parliament.
Midlands provincial chairperson Daniel Mackenzie Ncube yesterday confirmed to NewsDay that the province had received the recommendations from Gokwe North district.
Ncube said the matter had been forwarded to the national leadership since the province had no say over a women’s league senior member and senator. Said Ncube:
<blockquote>We got a report from Gokwe stating that the senator said something to that effect and the district was denying that the things happened. They want senator Mbohwa to be censured.
We referred the matter to the national body because Mbohwa is above the province and so we referred the matter to Cde Muchinguri and that is where it is.</blockquote>
Mbohwa alleged that soldiers were beating up people indiscriminately, including the elderly in the district.
She also said she would engage President Emmerson Mnangagwa, Muchinguri-Kashiri and senior party officials to stop the harassment in Gokwe Nembudziya.

ZANU PF Official In Trouble Over Army Brutality Remarks

A man from Gokwe Nembudziya’s Mutora stands is living in fear after he was harassed by alleged members of the Central Intelligence Organisation (CIO) and the Zimbabwe Republic Police (ZRP) for reporting a case of torture by members of the Zimbabwe National Army (ZNA).
Shadreck Muchena was allegedly assaulted by uniformed army officials at Nembudziya business centre on 1 February this year.
NewsDay established that Muchena sustained injuries to his right ear, nose and throat after an iron bar and the butt of a gun were used to assault him.
His attempts to have his docket finalised by the police hit a brick wall as they were seemingly not keen to conduct an identification parade.
Muchena was last week assisted by the Zimbabwe Human Rights Association (ZimRights) to pursue his case. He said:
<blockquote>I had gone to Nembudziya to buy maize-meal when two soldiers approached us. My cousin managed to escape, but they charged towards me and started beating me, kicking me on the ribs and backside before they took me to a police base where the torture continued.</blockquote>
Muchena said he was later released without charge, but from February 2-8 he tried to pursue the case to no avail.
Some police officers allegedly coerced him to withdraw the charges against the army officers citing challenges in investigating such cases.
Muchena then approached the human rights organisation which helped him to pursue the case — numbers RRB4641695 and CR 07/02/21.
However, Muchena alleges that CIO officials were threatening him for seeking help from ZimRights.

Victim Of Army Torture Alleges Harassment By CIO Operatives

Midlands Minister for Provincial Affairs and Devolution, Larry Mavhima has refuted claims that members of the Zimbabwe National Army (ZNA) are brutalising Gokwe-Nembudziya communities for violating lockdown regulations.
This comes after Zanu-PF women’s league commissar Maybe Mbowa alleged that soldiers were beating up villagers in the area. Said Mavhima:
<blockquote>Nothing of that sort ever happened, that is fake news. The army did not brutalise anyone in Gokwe-Nembudziya; any reports to that effect are nothing but fake news.</blockquote>
Meanwhile, Gokwe-Nembudziya Member of Parliament, Justice Mayor Wadyajena (Zanu-PF), recently described the reports of army brutality in the district as “mischievous and poisonous”. He said:
<blockquote>It’s not surprising that her audio was first published by UK based online sites and well known Government critics before even being shared locally, a move calculated to bolster the UK’s defence on its imposition of sanctions on the aforementioned members of the Security Services on the basis of ‘human rights violations’.
These very damaging lies cannot and should not be ignored because of their broader implications locally and globally.</blockquote>

Gokwe-Nembudziya Member of Parliament, Justice Mayor Wadyajena (ZANU PF), has dismissed reports claiming that soldiers are brutalising citizens in his constituency in the name of enforcing the national lockdown.
Wadyajena said comments made by Indigenisation and Empowerment Parliamentary Portfolio Committee chairperson Senator Mbowa alleging military brutality on Gokwe communities are “mischievous and poisonous”. He said:
<blockquote>It’s not surprising that her audio was first published by UK based online sites and well known Government critics before even being shared locally, a move calculated to bolster the UK’s defence on its imposition of sanctions on the aforementioned members of the Security Services on the basis of ‘human rights violations’.
These very damaging lies cannot and should not be ignored because of their broader implications locally and globally.</blockquote>
Wadyajena’s remarks follow <a href="https://news.pindula.co.zw/2021/02/02/audio-sen-mbowa-confronts-opc-over-army-brutality/" rel="noopener" target="_blank">the emergence of Senator Mbowa’s recorded phone call to Mr Govha, an official in the Office of the President and Cabinet, alleging that soldiers are terrorising the Gokwe Nembudziya community.</a>
During the conversation, the senator threatened to call President Emmerson Mnangagwa himself if army brutality continues unabated.

The Zimbabwe National Army (ZNA) is investigating reports that soldiers indiscriminately assaulted residents of Harare’s Warren Park suburb and looted their goods on Wednesday night.
This was said by ZNA deputy public relations director, Alex Zuva, during an interview with the Daily News on Friday. He said:

Reports claim that the soldiers assaulted residents and looted goods from vendors, including potatoes and vegetables.
Two journalists, Tinashe Chokodza (263Chat) and Leopold Munhende (NewZimbabwe.com) were also assaulted and injured while on their way home from work.
Speaking in Parliament in response to opposition legislators a day before the Warren Park incidents, Defence and War Veterans Affairs Minister Oppah Muchinguri-Kashiri called on members of the public to report abuses by armed forces during the course of their work. She said:
<blockquote>If there are such cases (of abuse), we will be more than happy to investigate them. I am hoping and also appealing to you to bring forward or to report such individuals if you know them or if some of your informers have information.
Everyone is free to come forward to our offices. We will definitely investigate the cases.</blockquote>

Army Investigates Warren Park Incidents

President <a href="https://www.pindula.co.zw/Emmerson_Mnangagwa" rel="noopener noreferrer" target="_blank">Emmerson Mnangagwa</a> on Friday said he would send the army and assault <a href="https://www.pindula.co.zw/Kuwadzana" rel="noopener noreferrer" target="_blank">Kuwadzana</a> residents if they were responsible for the current dry spell.
Addressing Kuwadzana residents during the National Clean-Up Campaign in the high-density west of Harare city centre, Mnangagwa said:
<blockquote>Asi deno taiziva kuti vanhu vekuKuwadzana vasingade kuti mvura inaye taingoti army kombai tirove. (If we knew it were the Kuwadzana residents who were wishing for a drought on the country, we will deploy the army to beat them up).</blockquote>
