The Crisis in Zimbabwe Coalition (CiZC) has urged the government to implement the recommendations of the Motlanthe Commission.
The Motlanthe Commission refers to the Commission of Inquiry into the Post-Election Violence that occurred in Zimbabwe on 01 August 2018. The commission was led by former South African President Kgalema Motlanthe.
The Commission was established by President Emmerson Mnangagwa in September 2018 to investigate the violence that erupted in Harare following the 2018 general elections.
The commission’s report, released in December 2018, found that the military was responsible for the deaths of at least 6 civilians and that the use of live ammunition by security forces was “disproportionate” and unjustified.
The Motlanthe Commission made several recommendations, including compensation for victims, reforms to security services, and the need for political leaders to commit to non-violence.
In a statement released this Thursday, 01 August 2024, which marks six years since soldiers shot and killed six civilians in central Harare, CiZC called on the government to implement the Commission’s recommendations. Reads the statement:

Today, we remember the tragedy of August 1 2018 when an estimated 6 civilians were shot in cold blood by the army following protests over the late release of Presidential election results.
The army killings attracted widespread condemnation and [President Emmerson Mnangagwa] instituted the [Motlanthe Commission] of Inquiry to investigate the incident and give recommendations. 6 years down the line the government is yet to implement the recommendations.
The recommendations from the [Motlanthe] Commission of Inquiry included compensation to relatives of the victims, accountability for the crimes committed by the military, electoral reforms, nation-building, reconciliation and political tolerance.
The government of Zimbabwe has apparently shown a lack of political will to implement the [Motlanthe] Commission of Inquiry recommendations in its letter and spirit.
We implore the government to compensate relatives of the victims and prosecute military personnel behind the shootings.
We call upon the government of Zimbabwe to respect the rule of law and constitutionalism, end rights violations and impunity, desist from the deployment of the military against civilians, respect political diversity and pluralism and set up a dialogue platform to agree on the reform agenda.

In 2018, violence in Zimbabwe led to deaths of civilians. The Motlanthe Commission investigated and found the military responsible for the deaths. They suggested compensating victims, reforming security, and promoting non-violence. Six years later, the Crisis in Zimbabwe Coalition urges the government to follow these recommendations. They want compensation for victims' families, prosecution of those responsible, and respect for the rule of law. The government has not acted on these recommendations yet. The coalition wants the government to respect human rights, stop using the military against civilians, and promote dialogue for reform.

1 August Killings: Crisis In Zimbabwe Coalition Calls For Implementation Of Motlanthe Commission Recommendations

President <a href="https://www.pindula.co.zw/Emmerson_Mnangagwa">Emmerson Mnangagwa</a> Friday assured businesses and investors that they are guaranteed the security of persons and property during the election season.
His remarks come amid fears that the 2023 harmonised elections could be violent.
Addressing a conference dubbed “ED Mnangagwa Business Summit” which was convened in Harare by the <a href="https://www.pindula.co.zw/Confederation_of_Zimbabwe_Retailers">Confederation of Zimbabwe Retailers (CZR)</a>, the president said:
<blockquote>
My government wishes to assure business and investors that measures are in place to guarantee the security of persons and property during the election season.
May you as the business community complement these efforts by fostering peace, love and tolerance.
</blockquote>
The conference was attended by some of the country’s top business executives, and ran under the theme, “Enhancing Development Through Public-Private Sector Engagement for Prosperity”.
History of Violence During Election Period:
Elections in Zimbabwe have often been violent, especially during presidential elections. 
There have been reports of intimidation and harassment of opposition members and supporters. 
In 2008, there was widespread violence and intimidation during the presidential election. 
Zimbabwe’s last election in <a href="https://zero.pindula.co.zw/august-1-2018-shootings-the-only-compensation-we-got-was-zw1-000-family-of-victim/">2018 saw property destroyed in wild protests</a> by some citizens who were agitated by the slow announcement of poll results by the Zimbabwe Electoral Commission.
There have been instances of companies leaving Zimbabwe during elections in the past due to concerns about political instability and the potential for violence.

Mnangagwa Assures Businesses, Investors Security During Elections

President <a href="https://www.pindula.co.zw/Emmerson_Mnangagwa">Emmerson Mnangagwa</a> has signed into law the Zimbabwe Independent Complaints Commission Act providing for the investigation and prosecution of members of security services for misconduct.
This follows complaints of human rights abuses and reports of alleged partisan conduct by members of the security forces in the discharge of their duties.
According to the latest Government Gazette, the Act provides for disciplinary proceedings and appropriate remedies in respect of any harm caused by any misconduct by members of the security services, according to The Standard.
The Act aims to enhance accountability and transparency by the security services and their members in accordance with the principles of the Constitution.
Reads the Act as outlined in the Government Gazette published on Friday:

Subject to this Act, the functions of the Commission are —
 (a) to investigate any complaint made by any person or on his or her behalf against any misconduct on the part of a member of a security service in the discharge or purported discharge of the member’s functions; 
(b) to investigate any contraventions of, or practices which do not comply with, sections 206(2) and (3) and 208 of the Constitution; Zimbabwe Independent Complaints Commission 114 No. 5/2022 Cap. 10:34. 
</blockquote>
The Act gives effect to Section 210 of the constitution which provides for an independent mechanism for receiving and investigating complaints from members of the public.
In terms of the procedure of reporting complaints, any person who is aggrieved by any act of misconduct by a member of the security service may make a written complaint to the Commission requesting it to investigate the act complained of.
The Commission, however, shall not investigate any complaint unless the complaint is submitted to it within three years from the date the act complained of occurred.

ED Signs Law Which Allows Investigation And Prosecution Of Security Forces

The Crisis in Zimbabwe Coalition (CiZC) has demanded the implementation of the recommendations made by the Motlanthe Commission which was established to investigate the 1 August 2018 killings.
Six civilians were shot dead by soldiers in central Harare during protests over delays in announcing presidential election results.
Thirty-five others were wounded in the shootings, forcing President Emmerson Mnangagwa to appoint a commission headed by former South African President Kgalema Motlanthe, to probe the killings.
The Motlanthe Commission, recommended, among other things, compensation to families of the deceased as well as prosecution of the killers.
In a letter dated October 18, 2022, addressed to the Minister of Justice, Legal and Parliamentary Affairs Ziyambi Ziyambi, CiZC chairperson Peter Mutasa said:

We address you in your capacity as the chairperson of the Inter-Ministerial Taskforce which was tasked with addressing issues arising from the findings of the Motlanthe Commission of Inquiry report.
We write to your esteemed office expressing our reservations over the failure of the Government of Zimbabwe to implement recommendations of the seven-member Motlanthe Commission of Inquiry following the events of August 1, 2018, that resulted in the death of six civilians at the hands of the army following protests over the late announcement of Presidential election results in Harare.
</blockquote>
Mutasa raised the issue of security sector reforms which he said should be addressed. He said:
<blockquote>
So far, the Government of Zimbabwe has not instituted security sector reforms to ensure that the military acts within the provisions of the Constitution of Zimbabwe and in conformity with human rights norms and standards.
The State is still to implement Section 210 of the Constitution of Zimbabwe that provides for an Independent Complaints Mechanism for receiving and investigating complaints from the members of the public about misconduct on the part of members of the security services, and for remedying any harm caused by such misconduct.
The Independent Complaints Mechanism is a crucial body in light of the increasing cases of human rights abuses linked to security.

CiZC Demands Implementation Of Motlanthe Commission Recommendations

A Harare man who was awarded $295 000 in damages by the courts in 2019 for the injuries he sustained during the 1 August 2018, electoral violence, is back in court to defend his claim.
Zakeo Mutimutema, a Zimbabwe Congres of Trade Unions (ZCTU) employee, is now partially blind after he sustained facial injuries when soldiers fired live ammunition to quell electoral related violence on 1 August 2018.
In 2019, Mutimutema successfully sued the government for $295 000, but the government, through Home Affairs minister Kazembe Kazembe, recently appealed against the award.
The complainant was shot while in his office at Gorlon House in Harare. As a result, he partially lost his sight.
He has undergone three unsuccessful eye surgeries to remove fine glass particles that pierced his eyes after a bullet shattered glass windows at his office.
Kazembe has, through government lawyer Abigail Mushayabasa, appealed against the award, saying Mutimutema must name the soldier who fired a bullet at his office before he gets financial redress.
Mutimutema’s lawyer Obey Shava told NewsDay that it was shocking that the government was refusing to compensate his client after it initially appeared ready to settle the claim. Said Shava:

According to police’s own investigations and conclusions which were conducted by the Criminal Investigations Department (CID) Forensic Ballistics, they confirm that the bullet which shattered and fragmented my client’s office window was fired by the Zimbabwe National Army from outside his office.
How does the Home Affairs minister expect someone who was in the office to name a person he never met?

A commission of inquiry chaired by former South African President Kgalema Motlanthe was appointed by President Emmerson Mnangagwa to probe the shootings.
It recommended that government should compensate all the victims of the 1 August 2018 shootings, and bring to book members of the army and police who were behind the shootings.
Three years down the line, the government has made no attempt to bring the soldiers to book or compensate the victims.

In a report that the Newsday says Zanu PF has “blamed everyone, but itself for the crisis in the country, including the West, the MDC, saboteurs, <a href="https://www.pindula.co.zw/G40_(Zanu-PF_Faction)">G40</a> remnants and natural disasters” Zanu is claiming the Western powers wants Zanu PF gone through a regime change mantra.
The report from <a href="https://www.pindula.co.zw/Zimbabwe_African_National_Union_-_Patriotic_Front">Zanu PF</a>’s Chitepo School of Ideology read in part:
<blockquote>…The reaction of countries of the West to the events of 1 August 2018, 14 January 2019 and many other anti-government activities have demonstrated, in no uncertain terms, that these countries have not changed in their decision to remove Zanu PF from power through the mantra of regime change.</blockquote>
The report further claims in reference to the 1 August 2018 killings, that:
<blockquote>That sad chapter in our recent history marked the beginning of a well-organised, meticulously co-ordinated and generously funded campaign of economic sabotage and misinformation designed to mislead both the Zimbabwean population as well as the international community with the ultimate aim of overthrowing the elected government.</blockquote>
The economy has curved over the last few months with inflation skyrocketing to 450% in November.

The West And Many Other Govts Still Want To Remove Zanu PF From Power - Zanu PF

President Mnangagwa has said that no rule of law has been breached in Zimbabwe during his presidency. He was speaking to a Nikkei journalist during an interview <a href="https://news.pindula.co.zw/2019/09/01/9-doors-ticad-japan-opened-for-us-ed/" rel="noopener noreferrer" target="_blank">during the just ended TICAD</a>.
Asked about reports of a crackdown against the opposition and how that could be the reason for sanctions by the US against Zimbabwe, Mnangagwa responded:
<blockquote>A: There has been no incident where the rule of law has been breached. Not even one incident. We apply the rule of law; those who commit crime, the law must apply. You cannot have double standards where the rule of law (applies); if people funded by the Americans commit crimes, we should not touch them? No! Zimbabwe is a unitary State and our laws apply to every citizen, whether you are in the opposition or you are in Government or don’t belong to any political party at all. If you commit murder, you get arrested; if you commit corruption, you get arrested; any violent act, you get arrested. That is the rule of law which we observe.
I would like you to quote an action where Zimbabwe has acted outside the rule of law, then I would like to hear that.</blockquote>
The government has been criticised for the 1 August 2018 killings immediately after elections and <a href="https://news.pindula.co.zw/2019/08/01/govt-yet-to-implement-motlanthe-commission-recommendations-on-1st-august-violence-a-year-later-dutch-embassy-harare/" rel="noopener noreferrer" target="_blank">a commission set to investigate the matter found that the army, under the president’s instruction, shot and killed civilians</a>. No individual has been arrested or tried for the killings.
There was also a crackdown on civilians by the military and police after that the January 2019 protests. The <a href="https://news.pindula.co.zw/2019/02/11/sadc-silent-on-army-killings-and-violent-crackdown-on-protesters-blames-ngos-for-trying-to-destabilise-zimbabwe/" rel="noopener noreferrer" target="_blank">crackdown resulted in the death of more than 10 civilians</a> but no individual has been tried for the deaths.
In recent weeks there has been a number of <a href="https://news.pindula.co.zw/2019/08/30/ziyambi-ziyambi-dismisses-as-bar-talk-allegations-that-govt-was-behind-abductions/" rel="noopener noreferrer" target="_blank">abductions and beatings of activists and opposition politicians</a>. The government has accused the opposition of stage-managing the abductions but no arrests have been made thus far.

<blockquote>The Defence forces day, is a day set aside to honour the men and women who have dedicated themselves to defend our nation.
The defence forces form the backbone of any nation and ours is no exception.
Indeed, our national constitution (through Sections 211 and 212) recognises the role and significance of the defence forces in our body politic, in safeguarding our territorial integrity.
Indeed, we salute and duly recognize the unstinting and committed service that our patriotic soldiers continue to render to their beloved country, even under these extremely difficult circumstances.
As a nation, we fought a just war of liberation, and the dedication, sacrifice and patriotism of the sons and daughters of this land deserves our veneration and utmost respect.
We are thankful to the men and women in uniform for the sacrifices and service to the nation in fulfilling their constitutional mandate and national duty.
Over the years, our defence forces have earned accolades for the work they have performed on international duty, in peace-keeping missions across the world.
We honour them for raising the national flag.
They have also done fantastic community work in our rural areas, and their recent efforts in the wake of Cyclone Idai deserve special mention.
This indeed is the kind of work that endears the defence forces to the public.
Whilst our constitution recognises the key role of the defence forces, it also lays down the foundation for a smooth relationship with other branches of our body politic, setting the boundaries of what they can or cannot do.
This is why we continue to encourage our defence forces to uphold the values of professionalism, respect, forbearance and non-partisanship.
We know that the majority of our defence forces are bound and are faithful to their oaths as defenders of the nation.
The few who stray beyond the lines of professionalism should never be allowed to taint the entire institution.
This taint can be cleansed by holding to account those who have strayed away from their constitutional prescriptions.
Regrettably, we have lost innocent lives in the past year at the hands of such elements.
We echo public and international sentiment of accountability for these losses to prevent a culture of impunity and immunity.
Considering the recent killings of civilians on the 1st of August 2018 and around the 15th of January, which has eroded the confidence of our people, I would like to encourage our Defence Forces to swiftly address concerns about impartiality on partisan politics, respect for human rights and subordination to civilian authority as enshrined under our constitution.
To this end, I am quite encouraged by the comments made by the National Army Commander, Lieutenant General Edzai Absolom Chanyuka Chimonyo, and Zimbabwe Defence Forces Commander, General Philip Valerio Sibanda.
Both Generals have recently and passionately spoken about the need for a professional, disciplined and non-partisan Defence Force which protects Zimbabwe, its citizens, its national security, its interests, its territorial integrity and more importantly, to uphold the Constitution of the land.
We remember with a profound sense of humility the songs of liberation such as Nzira dzemasoja and Tinoda Zimbabwe neupfumi hwayo hwese, great motivational anthems that also constitute a code of conduct for our defence forces.
The core message is: treat the people with respect.
When our constitution behoves the defences forces to respect human rights and freedoms, it is merely restating these organic commandments with deep-seated roots.
Therefore, as we celebrate and honour the defence forces, we call upon our men and women to uphold, defend and respect the core values that helped our forebears to prosecute the liberation struggle together with and not against the people.
They said they were fish and the people were the water. It was true then and it is true today and always.
We know our men and women are not spared by the economic and social challenges that we are facing as a nation.
They are our brothers, our sisters, fathers and mothers to some and uncles and aunties to others.
They are our brothers and sisters in law to all of us.
In short, they are people like us, facing the same darkness when electricity is down, the same anxiety when the new school term begins and there is no money for school fees.
They are, like many of us, breadwinners without the bread; wage earners with eroding wages.
When we express ourselves, we are also doing it on their behalf; on behalf of and with their families, friends and neighbours, singing songs of freedom and prosperity that they cannot sing on account of their job.
Poverty, like rain falls upon every roof. However poverty is not a natural phenomenon.
Since it is made by humankind, it can be overcome by humankind too, through working together in unison.
Going forward, in a truly New Zimbabwe, under our new leadership, we envisage a defence forces that is built on a foundation of meritocracy, patriotism and professionalism, where service, merit and excellence take precedence.
We aspire for a new Zimbabwe is which there is mutual respect between our defence forces and members of the public.
In our New Zimbabwe, the military forces will be well-equipped, well-fed and well-remunerated.
The relationship between the military and politicians will be characterised by professionalism, progressiveness and non-partisanship, allowing military men and women to flourish and defend the nation with pride.
Politics will guide the gun. The ballot will manage the bullet.
In a New Zimbabwe, our military will not be owned or appropriated by any political party.
The army is above partisan politics. Our military will be nonpartisan.  Our national army is people’s force.
We salute men and women in uniform. ou are the pride of the nation. God bless our men and women in uniform.
Let me assure you all about my unwavering support for the Zimbabwe Defence Forces and my vision for a great, peaceful and prosperous country for all who live in it.
